still the highest in our county. santa clara health officials tell abc7 news that while the east san jose area was whit the highest covid late in the area, there's no data to show that it's that high there. >> the california constitution and our education code gives children a right to in-person instruction-free from discrimination and harrisment. >> i said to the court just to be clear so we understand each other, you're refusing to educate my healthy son because he won't wear a facemask? and she repeatedly answered yes. >> boys were not sent home they were given options. those skinned of wearing a mask for an hour with a two-minute break or do an independent study or wear a clear face shield.

>> sad part they went from loving school to really hating school in a matter of two weeks. they're so pied to return. and now, they don't want to go back. >> the district says they are keeping the policy in place. the father says he is looking at possible legal action. j.r. stone abc7 news. >> some development news tonight, oakland police say they have located 9 year-old wanay newton after he was reported missing. he was found at about 7:00 p.m. police did not say wear but they said the young wanay is safe. that's six bay area law enforcement agencies have reported finding credit card skimmers. this map shows you the one that is have been found from the south bay to the north bay. really a troubling trend which has long targeted card holders

july 15th, one device was reported at a chevron 7-eleven. then they reported skimmers were found between a bank of america a.t.m. and three 7-eleven stores. o.p.d. showed a plan plant ago device. a skimmer found at a 7-eleven was reported by broad more on the 7th and on the 19 morgan hill p.d. was alerted to a skimming device and small camera above the key pad. >> having the information hand it would people are not authorized to do it is risky all the time. >> crooks use information to order new cards all on your dime. >> he says to avoid skimming, consider paying in cash or use ago third party option like apple or google pay which won't transmit your credit card info. >> it will look at the device itself to see if it's really

friends f he helped her move items into a storage unit. she was later able to get the car back but it took a frightening confrontation >> he found out and that's when he fired a gun at her slashed her tires etcetera and still was demanding money for the dog. ama: wednesday the suspect 40 year-old johnny togola was arrested. most of them involving french bulldogs. in some cases they're held for ransom or the thieves attempts to sell them. it's critical for information to know to reporter. they're urging owners to get their dogs microchipped and. >> a san francisco city official was sentenced to seven years in prison. he also was fined and has to forfeit a home after pleading guilty to accepting more than $1

million in bryce. dan has been tracking this case since it started and was in the courtroom as the sentence was handed down. there are afternoon, former department of public works director, walked into federal court all alone after pleading guilty to accepting more than $1 million of bryce in exchange of city contracts. his large custom home on 20 acres in calusa county was built with those bryce. some companies doing work for free or supplying furniture or appliances. they sentenced narute to three years probation and a $35,000 fine. he had a heart attack and he's trying to see doctors. he's set to report to prison january 6. i questioned him after the hearing >> do you have anything to say to the people of san francisco who feel betrayed by what you did? anything to say at all, sir? you owe an explanation to the

people of san francisco. his team then release add statement saying again, i want to apologize to the people of san francisco for my misconduct. now, that sentencing is behind me, i plan to concentration trait on my family and my health in the near term. i look forward to the time that i can return to serving my community and work to repair the damage that my action caused both the city and my family. and we also got a statement from u.s. attorney stephanie hines about the case it says in part for that's three years, naruk traded his authority and influence for millions of dollars in cash, construction work, travel, meals and gifts. this case demonstrates that the justice system will punish corrupt public officials. ama: a rather unusual billboard has popped up with a clear message. don't move to texas. there are some interesting taken on it. dan: will the lieu mar new year

dan: a controversial billboard has popped up in san francisco and los angeles discouraging people from moving to texas. abc7 news reporter leian melendez has a look at how people are reacting. >> the message is intended to be dark. the texas miracle die in uvalde. the billboard showing a man in a hoodie says don't move to texas. >> i don't think it's a particularly good taste. >> billboard is meant to highlight the lax gun laws in texas following one of the deadliest school shootings in uvalde with 19 students and two teachers were killed. it's not known who's behind the billboard, but it's capturing the attention of many who go through the intersection of 7th and folsom street. >> i totally agree wit 100%.

so many people leaving here and going texas. it's like don't go there. that is why -- >> but are people from california really leaving the state to move to texas? >> this is what the u.s. census told us. on average 68, 700 californians moved to texas each year. other data sources show that trend accelerated slightly during the pandemic. but with a total state population of over 39 million, the number of californians moving to texas is only a tiny percentage less than 1%. >> when home prices go up in california as they've been doing a lot in the last couple of years, more californiaians move to texas. when home prices level off or go down, fewer californians move to texas. for individual californians, it's really about home price. >> then there's the matter of the texas miracle. >> i think i've heard it kind of as a buzz word about texas, but i'm not exactly sure i can

celebrations where pride week were in full effect. pride flags were raised outside city hall. it's fold by weekend pride celebrations with a festival and a parade. the silicon fall valley pride level take place in downtown san jose saturday and sunday. dan: the california air resources board approved the state's plan to ban the sale of new gas powered cars by the year 2035. governor newsom says the transportation sector is responsible for more than half of california's carbon pollution. he issued an executive order mandating that 100% of sales of new passenger cars and trucks be zero emission by 2035. it also sets zero emissions sales goals. 35% of vehicles sold by 2026 and 68% by 2030. >> absolute historic and the reason for that is i think it's pretty clear that climate change
