♪ thanks for joining us. we begin with late developments involving former president trump investigation into the top - secret documents he took with him when he left the white house. abc news chief justice correspondent pierre thomas reporting tonight from florida. pierre? >> reporter: juju, i'm here in west palm beach on the night before trump's attorneys and doj prosecutors will face off in court in this case for the first time. they'll be battling over trump's request for a special master to review all those documents and weed out privileged information. but doj has been pushing back hard, challenging the request, revealing explosive new details in the process, and levying allegations of obstruction of justice. tonight, the justice department methodically laying out how they struggled to retrieve classified documents from mar-a-lago in the face of alleged lies and

resistance from donald trump's team. their blunt conclusion, efforts were likely taken to obstruct the government's investigation. the sheer number of classified documents is staggering. 322. 184 were handed over to the national archives in january. then in june, trump turned over another 38. at that time, his attorney in a sworn statement said the additional documents were discovered after a diligent search, insisting there were no more classified material on site. trump has repeatedly insisted he cooperated fully. but the fbi claims it soon uncovered evidence from multiple sources indicating that classified documents remained at the premises. that's why the fbi said there was an urgent need for a warrant t search the president's home earlier this month. what they discovered, over 100 classified records, including information classified at the highest level. doj even releasing this picture of some of them. as you can see, they're clearly

marked "secret," "top secret," and "sci," "sensitive compartmented information." only for the eyes of those with the highest security clearance. doj noted in hours they recovered twice the amount they received in june when trump's attorney told them everything had been turned over after their, quote, diligent search. according to doj, trump's attorney insisted all the documents were stored in one location, a storage room. but investigators determined government records were likely concealed and removed from that storage room, revealing they discovered three classified documents in desks of trump's own office. when he ran against hillary clinton, trump insisted he would handle the nation's secrets with the utmost care. >> in my administration, i'm going to enforce all laws concerning the protection of classified information. [ cheers ] no one will be above the law.

>> our thanks to pierre. just this evening, trump's attorneys filing a response to the justice department, doubling down on the need for a special master. because they say the former president can claim privilege over some of those documents. we turn now to a shocking rape allegation against a rookie nfl punter, matt araiza already released by the buffalo bills. he denies any wrongdoing. tonight his accuser is speaking out. a warning, the allegations are graphic. here's abc's eva pilgrim. >> everything about this has been hard. there's no easy part of it. and there's no days where it gets better. >> reporter: this young woman is reliving the horror that she says changed her life forever. >> i can't stop thinking about it. >> reporter: only 17 years old at the time, she claims in a lawsuit she was sexually assaulted at an off-campus halloween party by san diego state university football

standout matt araiza and two of his teammates. se says she was heavily intoxicated. >> i know i made mistakes that night. however, i don't think that any sort of mistakes deserve what was done to me that night. and they still need to be held accountable for what they did. >> reporter: the alleged victim, who wishes to remain anonymous, filed a civil lawsuit where she claims she was gang raped by araiza, then 21, and two others, both 18 at the time. >> how well do you remember that night? >> i remember certain blocks of the night very vividly. some parts of the night i don't remember. >> reporter: this woman now at the center of a controversy involving one of the top nfl rookies, the punter drafted by the buffalo bills in april, known as "the punt god" for his extraordinary kicks, like this. an 82-yard punt at an nfl preseason game. his firing shaking the nfl.

>> when i first found out about the draft, i actually threw up for hours about it. just to see him continuing on and thriving while i felt like my life was completely torn apart. >> reporter: the alleged victim's attorney says he was in contact with the bills in late july about the allegations. the team released the punter last weekend after the civil lawsuit was filed. >> at this time, we just think it's the best move for everyone, to move on from matt. culture here is more important to us than winning football games. >> it seems for whatever reason, this civil lawsuit hit a lot of people like a ton of bricks. the allegations here are very serious. yet according to the plaintiff's lawyer, they've informed the

bills weeks ago about what the allegations were. and didn't hear back. >> reporter: in a statement via his attorney, araiza said the facts of the incident are not as portrayed in it the lawsuit or in the press. i look forward to quickly setting the record straight. >> he is 100% adamant he never forcibly raped this young lady or forcibly had sex with her in any type of way. >> reporter: his attorney also alleging in an interview that his client did not know the alleged victim was drunk or that she was a minor, claiming she said she was in college. >> she was telling everybody at the party that she was 18 years old. he never gave her a drink, he never gave her any intoxicating substance. she was not visibly intoxicated when he was speaking to her. >> reporter: according to the complaint, the victim says she told araiza she went to high school. >> i never told him that i was of age, and he never asked. >> reporter: the alleged victim's father supports his daughter. >> i absolutely believe that he did what my daughter is suggesting he did.

she'll carry this with her for the rest of her life. >> reporter: araiza's parents released a statement saying, there has been a war waged on our son. he has been extorted, discriminated against, harassed, and the subject of multiple and continuous threats of violence and death. lawyers for one of araiza's former teammates, xavier leonard, named in the suit, declined to comment. the other said his client, nolan iwaliko, denies he was involved in any sexual assault. >> how intoxicated she was may not be the dispositive issue here. if there was a forcible rape here, it doesn't really matter as to her level of intoxication. >> reporter: according to the lawsuit, the alleged attack took place in october of 2021 at a halloween house party. the alleged victim went to the party with three of her friends. >> matt came up to me, he started talking to me, flirting. he gave me a drink. and then he led me over to a

side yard. and he asked me to perform oral sex on him. and then he turned me around and he had sex with me from behind. >> the part of your story where you talk about being outside with him, was that a consensual -- or did you say no to him at any point? >> it was not consensual. however, i did what he told me to do in that moment. without argument. >> reporter: after that initial encounter, she says araiza led her into a room in the house, according to the complaint. at what point in the night did you realize this was something that wasn't what you wanted? >> when i walked into that room and i saw that there were several guys already in there. i had a feeling that something bad was going to happen. and i expected it. >> reporter: according to the

complaint, the alleged victim was "in and out of consciousness." but she says she remembered the men took turns having sex with her from behind. did you at any point say no? >> i was screaming and crying. i don't know that i verbally said the words no, though. >> do you feel like it was clear, or should have been clear, that you were in distress? >> i feel it should have been clear to the point where i'm profusely bleeding from my vagina, from the holes where my piercings have been ripped out, when i'm covered in bruises and crying. i feel it should be clear to anybody, that's not consensual sex. >> reporter: the day after the alleged attack, she says she wrote in her journal, "all i keep replaying in my mind is being faced down in a random bed, just waiting for it to be over." she provided abc news with these images of some of the injuries she said she sustained that night, including her bloody underwear. after the alleged attack, she

says her friends took her home. >> i had blood on my legs and my costume and on my face. and i was crying. they all asked me what happened, and i told them that i was just raped. >> reporter: according to the complaint, the next morning she says she went to the police to report the alleged rape. she then went to the hospital where she underwent a rape examination. she says she didn't know the identity of her alleged attackers. >> when i was asked by the officer that i reported it to, who had done it to me, i had to tell him i wasn't sure. and it wasn't until some witness interactions and the pretext calls that we were able to figure out these suspects. >> reporter: according to the complaint, detectives in the sex crimes unit arranged recorded pretext calls with men they believed were in the room when the alleged rape occurred. >> i went in under the pretext that i couldn't remember what happened that night, that i was worried about stds and pregnancy, and that i just

needed him to help walk me through what happened. he told me that we had hooked up, and he told me that i should get tested for chlamydia. i then was told by my detectives to clarify what he meant by hook up. and so i asked him if we had had actual sex. and his tone completely changed from that point. and he shifted to then tell me that, no, i had only performed oral sex on him, and then shifted again to say, no, i don't remember anything that happened that night, my name is matt araiza, i don't remember anything. then he hung up on me. >> reporter: the san diego police department finished their criminal investigation earlier this month and turned it over to the district attorney's office. the d.a.'s office told abc news, this case remains under review by our office for potential criminal charges. do you think closure is
