trump and so-called maga republicans, and he said trump and his forces were determined to take the country backwards. in a rare primetime address, president biden attacked fme president trump by name, calling trump and some of his supporters threats to democracy. >> donald trump and the maga republicans represent an extremism. not every republican, not even the majority of republicans are maga republicans. maga republicans do not respect the constitution. they do not believe in the rule of law. >> reporter: president biden condemned the january 6th attack on the capitol while urging americans to vote in midterm elections less than ten weeks away. >> we can't pro-insurrectionist and pro-american. they're incompatible. we can't allow violence to be normalized in this country. it's wrong. >> reporter: biden's remarks come days after he accused republicans by embracing semi-fascism by following trump. kevin mccarthy said he should have apologized for that

comment. >> they're in charge of every federal agency responsible for our law enforcement, for drug enforcement, for our homeland security, for our border security. are you better off? >> reporter: meanwhile, abc news has learned newt gingrich received a letter from the january 6th committee requesting the former speaker of the house testify about his contacts with the white house, specifically tv ads he helped trump's team produce after the 2020 election. the committee writing, these advertising efforts were not designed to encourage voting for a particular candidate. instead, these efforts attempted to cast doubt on the outcome of the election after voting had already taken place. and in a separate investigation into january 6th, former trump white house counsel pat cipollone and former deputy whit house counel pat philbin are expected to appear before a federal grand jury today. it all comes as a judge issues the longest sentence yet, thomas

a so-called special master to go through hundreds of documents seized from his florida estate. the expected ruling comes after weeks of back and forth. this morning, a federal judge could hand down a crucial decision in the fight over documents related to the fbi search of former president trump's mar-a-lago residence. the judge is contemplating whether to appoint a special master, an independent legal expert to review the classified materials agents found during the search. >> are you confident the judge is going to rule in your favor? >> reporter: lawyers for trump and the justice department faced off in the florida courtroom yesterday laying out arguments for how the documents should be handled. trump's lawyers downplayed the criminal investigation comparing the documents to an overdue library book. the justice department said, trump lost access to the hundreds of classified documents when he left office adding, government records were likely concealed by the trump team, and efforts were likely taken to

obstruct the investigation. the judge indicating she is in favor of appointing a special master. >> she had tough questions for each side and asked the trump attorneys why it took two weeks to make the request and she asked doj attorneys, wasn't there a way to put a special master in place without stopping the ongoing assessment. >> reporter: trump repeated claims he was not to blame for any top secret documents leaving the white house. >> you accumulate a lot of stuff over a term, and then all of a sudden you're leaving, and stuff gets packed up and sent. all sorts of stuff. you know, mostly the boxes, pictures and newspapers and shirts and gear and, you know, golf balls and just it's a lot of stuff. >> reporter: but the discovery of classified material at mar-a-lago is drawing criticism from some republicans. >> they should never be taken from the white house in the first place, but we just don't know the details yet. >> reporter: now, if the judge rules in favor for trump, lawyers for both sides will

offer suggestions for who will review those materials, but that decision will ultimately be made by the judge. rhiannon. >> justin finch in washington, thank you. the cdc has approved updated covid boosters. that means shots could be available as soon as this weekend. the newly designed vaccines take aim at the most common omicron strains, which now cause nearly all covid infections. the government has bought 170 million doses, which will be available for free to anyone 12 and older. now to the williams sisters overpowered in their doubles match at the u.s. open in what's expected to be the last time venus and serena ever play together professionally. and later today it could be the final time we see serena in action. abc's andrea fujii explains. >> reporter: this morning, a heartbreaking loss in the u.s. open's doubles first round for sisters venus and serena williams in what could be the last time they play together in a pro tournament. after about a two-hour match in

stopped on the tracks near amarillo. the truck's trailer had gotten stuck. the driver got out before the train arrived. the conductor was not p hurt. a fugitive marine veteran accused of killing his girlfriend is due in a san diego courtroom today. raymond mcleod was captured in el salvador after authorities got a tip that he was teaching there at a school. they say he fled the u.s. in 2016 after his girlfriend krystal mitchell was found dead. we are now hearing from mitchell's mother, who came out of retirement as a detective after her daughter's murder. >> when he took krystal from our lives, he tore a hole in our hearts, and i just skdecided to get involved. i wanted justice for her. i wanted her kids to see justice. and i wanted to see justice before, you know, i left this earth. >> mcleod had been on the u.s. marshals most wanted list. two planes that came within a few hundred feet of each other in mid-air could have ended in disaster. instead, one pilot moved to

avert a mid-air collision, and it was all caught on video. abc's gio benitez has the details. >> reporter: close call captured on camera over orlando international airport. >> no. no. no. >> reporter: watch a single-engine cessna flies over the airport just as a delta 757 takes off within just hundreds of feet from the cessna. according to its pilot, malik clark. >> the aircraft is climbing at something like 40, 30 something feet per second. that's pretty close. >> reporter: the video just obtained exclusively by abc news but shot two weeks ago captures clarke making a last-minute maneuver to avoid the jet. >> i knew that this didn't look right. immediately i turned right and i climbed as steep as i could. and they were headed straight for us. >> reporter: clarke had taken off from a nearby runway. air traffic control directing him to overfly where the delta flight was taking off. delta telling abc news that it is aware of these reports and is
