>> reporter: violence biden said like the january 6th attack on the u.s. capitol. >> they look at the mob that stormed the united states capitol on january 6th, brutally attacking law enforcement, not as insurrectionists who placed a dagger at the throat of our democracy, but they look at it as patriots. >> reporter: hours before his speech a judge issuing the longest sentence yet to a member of the mob, former new york city police officer and u.s. marine thomas weber. he now faces ten years in prison for his actions that day. in total nearly 250 people have been sentenced for their roles in the attack. the former president is fiercely defending them saying in a new interview that he is financially supporting some of those facing charges and that he would consider pardoning them if re-elected. >> i will look very, very favorably about full pardons, i mean full pardons with an apology to many an apology. >> reporter: now, the white house insists the speech last

night was not political, but this was biden's second of three trips to this critical state within the span of just one week. democrats, of course, are hoping to pick up a senate seat here in one of the most closely watched races in the country, but this is ground zero for both parties, and tomorrow night donald trump will be here holding a rally and campaigning for the republican candidates. cecilia. >> he certainly will, mary. thanks, and he's also had mixed results in his endorsements. this morning, the former president and the justice department still in a showdown over the search of mar-a-lago. both facing off in a florida courtroom. trump's lawyers comparing these hundreds of classified documents to overdue library books. our chief justice correspondent pierre thomas has more from west palm beach this morning. good morning, pierre. >> reporter: cecilia, good morning. it was an intense, nearly two-hour hearing with pointed legal sparring. trump's attorneys portraying him as a victim of an investigation gone too far and federal prosecutors all but saying they believe he broke the law. this morning, a judge still deciding whether or not to appoint a special master, an

independent person to review materials seized by the fbi at mar-a-lago, after a high-stakes courtroom showdown. in their first face-to-face confrontation in the case former president trump's team challenging the justice department comparing the hundreds of classified documents discovered at mar-a-lago to overdue library books. but 322 classified documents have been removed from the president's home since january. some of them in this remarkable image with clear markings, secret, top secret, some of them discovered in desks in trump's own office. doj attorneys were blunt saying, quote, because he was no longer the president, he did not have the right to take those documents. they aren't his. prosecutors insist government records were likely concealed by the trump team and efforts were likely taken to obstruct the investigation. but trump's attorney asking for a special master, citing a significant lack of trust between the parties adding, we

need respectfully to lower the temperature of both sides. we need to take a deep breath. trump's attorneys leaving without taking questions. >> are you confident the judge is going to rule in your favor? >> reporter: the judge said she will make a decision in, quote, due course which means it could come within days or sooner. gio. >> all right, pierre, we know you will follow this for us, thank you so much. now we're going to turn to the breaking news overnight, the cdc giving the green light to new covid booster shots. these new doses are specifically designed to protect against the most common variants that are circulating right now, and erielle reshef is at a vaccine site here in new york. hey, erielle, good morning. >> reporter: hey, good morning to you, gio. we are here at this walgreens where they're about to administer some of the first of those upgraded covid booster shots. you can see this is alexis, she's about to get the moderna's bivalent shot. the cdc director as you said,

signing off overnight. now they're starting to roll out ahead of the holiday weekend as you can see. they are designed to target the dominant omicron ba.5 and ba.4 subvariants and will be available to anyone 12 years and older and 18 and years and older for moderna. if you've been vaccinated, they're given at least two months after your last dose and it takes about two weeks to reach full protection and the hope here is that these -- enough of these boosters will be given by the fall so we can try to prevent a fall surge. you can sign up starting tuesday for these shots and these appointments on vaccines.gov. michael. >> thank you, erielle. we turn now to an apparent assassination attempt on argentina's vice president. a man pointed a gun at her right outside her home overnight. we're going to go to maggie rulli who is tracking the very latest for us. good morning, maggie. >> reporter: hey, good morning, michael. yeah, argentina's vice president lucky to be alive this morning after coming face-to-face with a loaded gun, with a bullet inside the chamber that then apparently jammed. just look at this harrowing video, the footage shows the

moment cristina fernandez de kirchner was confronted by a man with a gun. she is seen trying to duck as supporters rush the man. authorities later revealing there were five bullets in that chamber but it failed to fire when triggered. police believe the man is from brazil, but they're still trying to find a motive. fernandez de kirchner has a complicated history, a former first lady, she's now in court facing allegations of corruption. guys, that's something she denies. cecilia. >> really tough video to see. maggie, thank you so much. we turn to this release of police body camera footage showing a columbus, ohio, police officer opening fire and killing a black man while sleeping in bed. we do want to warn you this video is difficult to watch and alex perez joins us with more. good morning, alex. >> reporter: hey, good morning, cecilia. the shooting appears to happen in an instant. donovan lewis' family is now calling for that officer to be held accountable. >> we're going to send that dog in. >> reporter: this disturbing

police body camera video capturing the moment a columbus, ohio, officer killed 20-year-old donovan lewis. his grieving family this morning calling on that officer to be charged. >> donovan was unarmed, and he was abiding by police commands to come out of his room when he was shot in cold blood. >> reporter: about 2:30 a.m. tuesday, a team serving a felony arrest warrant for lewis on domestic violence, assault and improper handling of a firearm. >> department h. come to the door. columbus police. we're not leaving. >> reporter: the officers in uniform identifying themselves for some eight minutes, standing at the apartment front door calling on those inside to exit. >> walk backwards to me. >> reporter: two eventually did. >> we're looking for donovan. where is he at? >> reporter: officers then entering with a k9 to find lewis. authorities say officer ricky anderson fired one shot at lewis after the bedroom dooris opened.

kremlin. >> reporter: maganov is the second lukoil executive to die in the last few months. the company has been critical of ssnemato die oth wh nks to the oil and gas sector. >> it seems that even a lot of russian oligarchs are not happy about the war. they are too scared to speak up because they fear for their very lives. >> reporter: now, maganov was admitted to the hospital according to russian state media with a heart complaint and he started acting suspiciously they say and then he threw himself from the window, but eight russian executives dead in the last year. i think you'll agree that's also suspicious, michael. >> definitely raising eyebrows there, thank you so much, james. now to the august jobs report. it's one of the last major economic reports before the federal reserve meets this month to decide whether to raise interest rates again. our chief business correspondent rebecca jarvis is here with that. good morning, rebecca.

>> reporter: good morning, michael. the economy added 315,000 jobs in august, what analysts were expected. the unemployment rate ticked slightly higher to 3.7%. average hourly earnings rose by 5.2% over the last year. the reason we care about this, the biggest issue facing the u.s. economy right now is inflation, prices on groceries are up more than 13% from a year ago, the cost of shelter is up almost 6% from a year ago and families are paying nearly $500 a month just to keep up. the fed is hiking interest rates, they can't make inflation go away without causing some pain for the u.s. economy and we'll eventually see that pain in jobs but so far we haven't. there are 11.2 million job openings, 2 jobs for every job seeker seeker, cecilia.

>> thanks, i know you'll stay on this one. i know what we'll be doing tonight because it is going to be all eyes on serena williams as the tennis legend is back on center court in what could be her final tournament. lara, you have been there at the national tennis center with more all along. we watched both williams sisters in that amazing match last night, but ias electric when the sisters took center court to play their first doubles match in four years, but the mood quickly changed as it became more apparent that serena's doubles career is now likely over. venus and serena last played together in 2018 at the french open and trying to jump back on the court at the u.s. open proved tennis at this level not exactly like riding a bike. it was the open's first nighttime doubles match in nine years, bumping the men's singles with rafa nadal to the later slot to capitalize on the ratings juggernaut that has been serena's farewell performance, but the sisters who have won 14 grand slam doubles championships

together, well, they struggled to find their rhythm losing 7-6, 6-4 to first-time partners linda noskova and lucie hradecka from the czech republic. noskova, just 17 years old, a quarter century younger than venus, and a self-professed serena superfan. the rising star admitting that she has a poster of williams over her bed. look at this. a post she made to instagram at 13 years old, professing her love for the g.o.a.t. after the match she admitted it was sometimes overwhelming playing her hero, clearly not that overwhelming. while it probably was not a very festive night in the williams camp with venus now out of the tournament, many fans do see a silver lining. if we can't watch more of the sisters play doubles at least it gives serena more energy and focus for her singles. a huge night here for serena as you said, cecilia, and the world of tennis as well as she plays what could be her final match of her career against 46th ranked ajla tomljanovic.

take a look at this near-miss video filmed from inside a single-engine cessna looking down at a delta 757 taking off nearby. the cessna's pilot, malik clarke took evasive action avoiding a disaster. >> i knew that this didn't look right. so immediately i turned right and i climbed as steep as i could because the boeing 757 has a much higher climb rate than the aircraft that i was flying. >> reporter: it happened above orlando international airport last month. >> runway 36 left. clear for takeoff. >> reporter: clarke had just taken off nearby and says he was instructed to overfly the runway where the delta flight was taking off. both pilots saw each other. >> orlando, approach, roger. what heading did they give you? >> we saw the guy coming and

so we just flew 150. >> if i hadn't done that evasive maneuver, it's quite likely there would have been a midair collision. >> reporter: now the faa is investigating, but initial reports show the planes were closer than they should have been. >> tower, we got that traffic that just passed directly above us. >> the two aircraft got as close as 500 feet vertically and 1,500 feet horizontally which means way too close and it was someone's error to put them in the same part of the sky. >> reporter: delta is also investigating saying nothing is more important than safety. this scare coming as airlines struggle with staffing and scheduling. pilots picketing at 14 major airports around the country heading into a busy holiday weekend. airlines stressing the pilots are off-duty and protests will not lead to delays or cancellations, but it will be a busy weekend. according to hopper, some 13 million americans are set to travel this labor day weekend.

>> reporter: high school students ethan, chase and colin pulled their car over when they saw smoke coming from a garage calling 911 after they heard shouts. > i'm in the backyard right now. >> okay, we have help on the way, okay, try to get everybody out of the house if you see anybody in there but we have help on the way, okay? >> reporter: but they couldn't wait, two of them serving as first responder while the other waited for trained personnel to arrive. >> the flame is right there in the garage so they were right by the fire which is pretty scary. >> reporter: a short time later you see people emerging. the two inside making it out safely. >> when ethan like we thought we lost him in the house. like, what if he didn't get out. smoke in his lungs. when he came out it was a big relief. >> reporter: officials praising the fast action of those students. the fire and rescue chief saying, they could have just drove by, but instead they decided to take action and stopped this incident from becoming a tragedy, resulting in loss of life. >> couldn't drive away and not go in there. >> i didn't think about it. just went in. >> i wouldn't have done anything different.

can help you avoid burnout as the american psychological association reports nearly three in five employees have experienced negative impacts of work-related stress in the past month. abc news chief medical correspondent dr. jen ashton is here. >> good morning, my friend. how are you? >> good, good, okay, so let's get it started. before we move on to the study let's talk about burnout. this is a very real condition, isn't it? >> it's real. so many people who -- you cited a statistic in the last month but how about the last year, the last two years, a lot of it has really been exacerbated since the pandemic, right, but it's not a new phenomenon and the world health organization actually talks about it. it's not a medical diagnosis, per se, so there's no one test for it, if you will, but it's more and more common, really due to chronic work-related stress, and what does it feel like? exhaustion. mental and physical exhaustion, feelings of negativity, decreased performance at work, feeling like you're not valued by your employer. you might have a short fuse and snap at colleagues or co-workers or employers or employees, so these can all be signs or

symptoms of burnout, but it's not something that we can do an easy test for, if you will. >> so let's talk about the new research because what it says is that micro-breaks, even just ten minutes at a time could make a difference. >> right, and so it's not really about quantity, but it's about quality and the practice and this builds on prior past research showing that this phenomenon of micro-breaks, just taking a little time-out, not doing other work-related tasks really can help. it doesn't make you more productive in the workplace but it does tend to lower those subjective feelings of fatigue and irritability. >> so what do these micro-breaks look like? >> okay, well, i'm going to take one right now, maybe after the segment but it's really -- what do they look like? short pauses in between work tasks, again, five, ten minutes, it doesn't have to be a significant period of time. get up, stretch, take a walk outside. the key when you

is, gio, focus on those activities or behaviors like stretching. but it involves taking a complete time-out from your job or your work responsibilities for those five or ten minutes, but every minute really steams -- seems to have an impact. >> that's what i like to do, get on the foam roller for a few minutes. >> or take deep breaths, do stretches, but just focus on that and not your job for five or ten minutes. you can blame it on me when you get in trouble with your boss. >> dr. jen, so good to see you. thank you. michael. now to uvalde, texas, and a high school football team trying to help their small community heal after unthinkable tragedy. the uvalde players are getting redy to take the field for their first home game since the school shooting at robb elementary claimed the lives of 21 children and teachers and they are hoping to unite their community while honoring those they lost. ♪ in texas, love for football is as big as the state. >> football means a lot.

announcer: building a better bay area, moving forward, finding solutions. this is abc 7 news. liz: good morning. i am liz kreutz from abc seven mornings. let's go to sue hall with a look at the traffic. sue: good morning. we are looking at pretty clear sailing throughout the bay a few exceptions. we have two earlier accidents on 101 through palo alto and mountain view. they have been cleared. you can see the damages done. a couple of problems, westbound 24, slowing you through lafayette and toward the tunnel. drew: dense fog in the north bay. visibility is half a mile in santa rosa. temperatures are climbing through the 50's and 60's. as you take a live look from sutro tower, there is the fog. a fair amount of sunshine, a little cooler today compared to yesterday. everything will change with the three-day forecast. the holiday is hot.
