"dancing with the stars," season 31, the energy is already so high here in times square, and they're taking it over. we have the big cast reveal coming up in our next hour. first that breaking news from buckle haing ham palace. maggie rulli is there. >> reporter: for buckingham palace to reveal this much detail about the queen's health is unusual. it's leaving many deeply concerned about her majesty this morning. two days after this photo emerged of the queen meeting the new british prime minister, doctors have troubling news. this morning buckingham palace putting out a statement saying, following further evaluation, the queen's doctors are concerned for her majesty's health and recommend she remain under medical supervision.

>> we're in unprecedented territory with this announcement. they never update us on the queen's health. the fact we're seeing whispers from politicians being informed about this. >> reporter: she's reported to be resting comfortably with prince charles by her side. william is on the way. >> we've seen all family members travel immediately to balmoral, including the sussexes. they're making their way to scotland. >> reporter: the 96-year-old queen has been suffering from deteriorating health, including mobility issues. the queen canceled wednesday's virtual meeting of the privy council after being advised to rest. >> it feels like there's a grave atmosphere. the whole of the united kingdom are waiting, wanting to hear the next update. very concerned about the queen. >> reporter: prime minister liz

truss announcing that the whole country would be deeply concerned. all of the queen's children are on their way to balmoral. a spokesperson for the sussexes confirmed prince harry and meghan are on their way as well. robin? >> maggie, thank you very much. a very emotional morning. we turn to the breaking news overnight out of memphis. mola lenghi is there on the scene in memphis tracking the latest developments. good morning, mola. >> reporter: well, good morning, robin. this hours' long shooting spree leading to hours of panic in memphis. a shelter in place order, seven people shot and ultimately more than half a dozen crime scenes throughout the city. overnight in memphis, police capturing a man they say went on a deadly shooting spree. killing at least four people and injuring three others. the man streaming live video of himself allegedly firing a gun. >> first we thought it was like -- he was trying to rob them or something but then we

found out this guy was just shooting randomly. >> reporter: authorities identifying the suspect as 19-year-old ezekiel kelly. the rampage spanning across eight different crime scenes. >> ordinary citizens doing ordinary things, getting off from work, picking up children from day care, just going about their ordinary lives when it was all of a sudden shattered. >> reporter: the first deadly shooting just before 1:00 a.m. on wednesday. officers responding to the initial homicide but unable to identify a suspect. then wednesday afternoon, police respond to another report of gunshot victims at 4:38 p.m. and 4:40 p.m. just over an hour later the shooting apparently going live on facebook showing himself allegedly firing a gun with two more shootings at 7:24 p.m. and 8:55 p.m. police capturing him at 9:28 p.m. after a standoff in a memphis residential area. as the shooter terrorized the city, authorities issued a shelter in place order.

the scare shutting down the memphis area transit authority, the university of memphis going on lockdown, residents fearing for their lives. >> go and tell the people and i told them to close the stores down because there's a mad man shooting people. >> reporter: well, it has been a violent week here in memphis. this shooting spree coming just a few days after the kidnapping and murder of a 34-year-old schoolteacher and mother abducted while jogging last friday. the suspect in this shooting spree, ezekiel kelly, is being held at the detention center in memphis awaiting murder charges. robin? >> thinking of everybody there in memphis. george? >> they've had a tough week. the latest on steve bannon. the trump ally and former adviser set to turn himself in to authorities in new york today facing fraud charges tied to fund-raising for the southern border wall. erielle reshef is at the courthouse here in manhattan. good morning, erielle. >> reporter: good morning to you, george. bannon walking through the doors of this courthouse surrendering to new york authorities. he's being accused of stealing

from donors. though he pledged to fight those charges, his legal battle is far from over. this morning, longtime trump adviser steve bannon facing a new criminal indictment as he turns himself in to authorities here in new york, accused of siphoning money from the group called we build the wall, an online campaign to build a section of president trump's border wall that raised $25 million. >> they see that this is a way that they can take action to actually, you know, make happen a physical barrier on the southern border and support president trump in what president trump is trying to do. >> reporter: the founders claiming that every penny would go to construction. >> 100% of your money goes towards the wall. >> reporter: promising those who donated a brick in the wall with their name on it. >> you're not going to last forever but your brick will. >> reporter: prosecutors said instead bannon and his associates lined their pockets with large sums of that money and in 2020 the justice department charging them in the alleged scheme.

but before bannon's trial trump issuing him an 11th hour pardon on his last day in office. that presidential pardon does not protect bannon from state charges. bannon now calling the charges phony and a political weaponization of the criminal justice system saying, i am never going to stop fighting. they will have to kill me first. and two of bannon's associates have pleaded guilty in that federal case. they now face years behind bars. a third is now awaiting trial. bannon the third federal defendant pardoned by president trump to face charges here in new york. george? >> okay, erielle, thanks very much. let's bring in chief legal analyst dan abrams. so, dan, just start out by explaining to everybody why even though steve bannon was pardoned, he can be charged again. >> talking about state charges versus federal charges. the pardon occurs with regard to the federal government, the department of justice. but that doesn't mean that you're pardoned with regard to any potential state charges and that's what we're talking about here. now, the problem steve bannon has with regard to the

politicization defense, this is all politics, is that the victims here were all people who were so committed to building a wall on the southern border that they were willing to donate their own money. some of them with not a lot of money offering $10, for example. they raised $25 million from all people who were so committed to that. these are all conservatives who believed in that cause. that's number one. number two is it was the trump department of justice that indicted bannon, not the biden department of justice. the trump department of justice under bill barr and finally it's that you have these other defendants who pled guilty. >> that's what i was going to say. >> they told us this was a scam. >> it's a pretty clear-cut legal case. >> it sure seems that way. the only question becomes what was bannon's role? right? there's no doubt at this point that there was a scam, that bannon was the chairman. the question now becomes, okay. what was bannon's role and the typical legal questions that would be asked in that context. >> okay, dan abrams, thanks very much.

michael? >> all right, thank you, george. now we go to the blistering heat wave in the west. another day of record-breaking triple-digit temperatures is expected as the heat and dry conditions fuel wildfires across the region, forcing new evacuations. will carr is on the scene in hemet, california. good morning, will. >> reporter: this morning thousands of firefighters battling fires in the midwest pushed in the swelters heat wave. the deadly fairview fire in hemet, california exploding nearly doubling in size in a matter of hours. this morning, it's burned more than 19,000 acres claiming at least two lives. watch this fire whirl burning through the hills. crews attacking the flames for the fourth day from both the ground and the sky. this fire burned fast sweeping through this canyon burning more than 500 acres in the first hour destroying everything in its path. in the mosquito fire near lake tahoe burning buildings to the

ground destroying over 5,000 acres. residents trying to salvage anything they can. >> i'm just trying to get what i cn wet. >> reporter: the fires fueled by bone dry conditions during a time of record-breaking heat. in arizona authorities responding to calls of hikers experiencing heat exhaustion, tragically 32-year-old evan dishion did not survive leaving behind a wife and an infant daughter. >> he didn't want to leave me and chloe and i don't want other people to leave behind people they love just to go on a hike. >> reporter: another hot day. there is rain in the forecast tomorrow. the problem with that is all the homes that fire crews have saved throughout the week could be threatened by mudslides if there's too much rain too fast. michael? >> if it's not one thing it's another. thank you so much. we turn to ginger in california with more on the relentless heat and where there might be relief or when there might be relief. good morning, ginger.

>> reporter: good morning, michael. in anaheim we broke a daily record, more than 80 cities across the united states broke daily records. i have another list like we've been showing for days, where it's not just daily records, but all-time hottest which they tied in salt lake city. smashed their all-time september heat and helena, montana, 102. that was their hottest september. now the excessive heat warnings that still remain on the map from southern nevada through most of the state of california. today is the last big day. about a day and a half left of this. denver even has a heat advisory. some of the relief will come, michael, from hurricane kay which is already spilling clouds and rain to the mexican border and arizona by tomorrow and saturday. we're going to see big impacts. flood watches are up. we are concerned about mount laguna to the san gabriel mountains. >> i know that relief can't come fast enough. thank you, ginger. robin? now to the latest on the war in ukraine and breaking news overnight. secretary of state blinken is there in ukraine. this as the country ramps up its counteroffensive taking back

some territory from russian forces. tom soufi burridge is on the scene for us there in ukraine. good morning, tom. >> reporter: yeah, good morning, robin. secretary of state blinken just arriving in kyiv touring a hospital. secretary of defense austin in germany this morning too in a major show of u.s. support. it comes as ukrainian forces for the first time in months appear to have the upper hand. this morning, secretary of state antony blinken arriving on an unannounced trip to ukraine, pledging a further $2.6 billion in security assistance for ukraine and eastern europe. and not far away in germany, secretary of defense lloyd austin at a critical summit on the agenda, sustaining the flow of weapons to ukraine. >> all these capabilities have demonstrably helped ukraine fight back against russia's aggression. and even enabled ukraine to resist russia's ongoing onslaught.

>> reporter: and overnight president zelenskyy declaring success for his forces' counteroffensive in the kharkiv region in the northeast. confirming several settlements have been liberated calling it good news. ukraine's military command this morning saying intel gathered by drones critical in the fight. we're with a ukrainian reconnaissance unit outside zaporizhzhia and these guys' main job is to work out where the russian positions are so they can call in the strikes. at that nuclear power plant nearby, renewed concern. the u.n.'s nuclear watchdog saying, renewed shelling has damaged a backup power line, further underlining significant nuclear safety risks at the facility. robin, this morning, secretary of defense austin mentioning that ukrainian counteroffensive saying the capabilities provided by the u.s. are critical as the ukrainians try and recapture their territory.

robin? >> all right, tom, thank you so much for being there. now to tennis sensation frances tiafoe, scoring another breakthrough win to become the first american man to reach the semifinals at the u.s. open in 16 years. lara is here with more on his success so far and his cinderella story in the making. good morning, lara. >> it really is, michael. the last time an american man won the open it was andy roddick in 2003. the last black american man was arthur ashe himself. now 24-year-old frances tiafoe is two games away from ending that drought. >> that's it. frances tiafoe. >> reporter: frances tiafoe on fire. >> lighting up the crowd here inside arthur ashe. >> reporter: the 24-year-old besting russia's andrey rublev in the quarterfinals at the u.s. open. >> you got to love it. >> reporter: the match lasting a little over 2 1/2 hours with tiafoe dominating the court.

defeating his opponent in straight sets. >> that one hurt for rublev. >> i feel so at home on courts like this. like this court is unbelievable and you guys get so far behind me. i want to play and give my best. >> reporter: it is an achievement 50 years in the making. frances now the first black man to make it to the semifinals since arthur ashe himself back in 1972. back in maryland, at that very same tennis academy where tiafoe got his start, current students cheering him on, hoping one day to be just like him. >> every single time we see frances i think of all the people who look up to him and know he trained here and he's one of us. >> reporter: frances' father who worked as a maintenance employee at the academy where frances first got a scholarship for tennis in disbelief. >> it's like a dream come true because frances is really, really playing well. i'm, like, stunned. >> reporter: but things did not go as smoothly for tiafoe's fellow american jessica pegula.

the 28-year-old who was the highest ranked american woman left in the tournament losing in straight sets to poland's iga swiatek. that one was tough and just a few hours ago a wild five-set match setting the record for the latest u.s. open match of all time. carlos alcaraz defeating jannik sinner in a five hour and 15 minute marathon, guys. it ended at 2:50 a.m. he will get to rest today thankfully and his next opponent, yep, frances tiafoe. the pair will face off in the semifinals tomorrow at 3:00 p.m. >> i watched it up until 2:30. >> i'm going out to the matches tonight. i hope they don't last that long. >> congratulations to frances tiafoe. incredible win. >> it sure was. we have a lot more coming up on "gma" including the 11-year-old who survived a shark attack. he tells about the incredible rescue that saved his life. first, let's go back to ginger. >> reporter: let's get a check now a little closer to home.

painted the former first lady and president biden and the current first lady jill biden hosted the event. we're going to turn now to an arrest in the murder of a las vegas investigative reporter who was stabbed to death outside his home. this morning a local politician is in custody and alex presha is in las vegas with the latest for us. good morning, alex. >> reporter: hey, michael. this sleepy subdivision behind me was the scene of an hours' long standoff yesterday that ultimately ended with authorities arresting the county public administrator for murder. this morning, a las vegas county official waking up behind bars in connection with the murder of a local investigative reporter. police arresting clark county public administrator robert telles after a standoff on wednesday. telles taken into custody with nonlife-threatening stab wounds that were apparently self-inflicted. he was seen returning home before the arrest wearing white coveralls.

>> did you do this? >> can you tell us anything? >> reporter: the tense exchange coming after authorities searched his home for more than six hours wednesday towing away a red gmc yukon denali, the same model of the car spotted near the murder scene of las vegas review-journal investigative reporter jeff german. >> our victim comes outside and has -- encounters the suspect. there is an altercation that occurs and we believe that at that time the suspect stabbed and killed the victim. >> reporter: police say german was found fatally stabbed around 10:30 a.m. saturday after writing several articles critical of the public administrator's office. in may german reported telles' office has been mired in turmoil and internal dissension over the past two years, with allegations of emotional stress, bullying and favoritism and writing of a hostile work environment fueled by the elected administrator of the office, robert telles. the article is causing him to lash out defending management of his office claiming the reporter was a bully. >> scary to think about with the

water. i just saw him there screaming at me to get to him. >> reporter: his parents pulling him onto the boat. his leg severely wounded but somehow jameson kept his composure and his faith. >> he looks into my eyes as i'm holding him just like this in front of me, he says, daddy, jesus is going to save me. >> reporter: the race was on to save little jameson's life. >> the bone we can see. it's a pretty big bite. we've already put a tourniquet on his legs and we're wrapping towels around it. >> reporter: the reeders flagging down nearby boats for help. a stranger coming to the rescue. >> she jumped out of her boat and began to swim to our boat. she gets on our boat with a dry bag of like marine medical first aid and just begins to go to work. >> reporter: but there was only so much she could do. the family flagging down a faster boat nearby to take jameson jr. to an ambulance. >> i said, go save my son's life. i kissed him on the forehead, not knowing if i'd ever seen him again. >> reporter: jameson and his mom

made it to the mainland where he was airlifted to nicklaus children's hospital in miami taken right into the operating room. jameson undergoing four surgeries. even celebrating his birthday at the hospital. the staff at nicholas surprising him with his favorite, a "star wars" bb-8 cake. now as he begins his long recovery -- >> he's stronger than i could ever be after that. he's just the positivity and his faith. >> reporter: jameson learning how to use a walker. the pain still present. at times during our interview he squeezed his stuffed animal named hedgy when he felt a sharp sting in his leg. >> when i squeeze, some of the pain goes away. >> reporter: for this incredibly outgoing and active boy who loves playing baseball, he's willing to do whatever it takes to heal while still coming to grips with his new reality. >> i want to be a normal kid. >> you are a normal kid. it's going to take some time to heal and get back to doing some of the stuff you love to do. >> that's it, man. >> reporter: he perked right up when asked about being fitted
