we also have a lot of news this morning including all the fallout from the final hearing of the january 6th committee which featured stunning new video and demand that donald trump testify. >> but we are going to begin with that breaking news that has become an all too common headline. another mass shooting. this one overnight in north carolina. five people killed including an off-duty police officer. two others injured when a gunman opened fire at a nature trail. a suspect is now in custody and elwyn lopez is on the scene right there in raleigh. good morning, elwyn. >> reporter: yes, good morning. still a very active scene here. police collecting evidence throughout the night and into the morning. the mayor prayed that something like this would never happen here and this morning they are waking up to that deadly act that rocked this community. this morning, a law enforcement official telling us that that suspect who is now in police custody is just 15 years old. now, that mass shooting here in raleigh, north carolina, left five people dead, including an off-duty police officer.

officials say gunfire erupted around 5:00 p.m. near a popular walking trail. two victims were taken to the hospital, a second officer who has since been released and another victim who remains in critical condition. law enforcement sources telling our wtvd that authorities cornered that gunman in what they described as a barn before arresting him. police say the ages of those shot and killed range from 16 to 52. the off-duty officer was on his way to work when he was killed. george. >> elwyn lopez, thanks. we turn to the dramatic hearing of the january 6th committee where they voted to subpoena former president trump and showed new video of speaker nancy pelosi fleeing to safety hunkered down with other leaders making urgent calls for help as the riot escalated. chief washington correspondent jon karl has the story. good morning, jon. >> reporter: good morning, george. the january 6th committee concluded what is expected to be their final hearing with a subpoena and a challenge for the former president. >> those in favor will say aye.

>> reporter: in a direct challenge to donald trump, the january 6th committee voted to subpoena him to answer questions under oath about his actions on and before the day his supporters attacked the u.s. capitol. >> we are obligated to seek answers directly from the man who set this all in motion. >> reporter: the move came just after the committee presented riveting new video from january 6th. speaker of the house nancy pelosi shown fleeing the mob that was already inside the capitol building, whisked to a secure location with the other congressional leaders. >> we have got to get to finish the proceedings. >> did we go back into session? >> we did go back into session but now apparently everybody on the floor is putting on tear gas masks to prepare for a breach. i'm trying to get more information. >> they're putting on their -- >> tear gas masks.

>> reporter: raw footage was shot by pelosi's daughter, filmmaker alexandra pelosi, an incredible window into this moment of history as lawmakers called trump administration officials to plead for help. >> why don't you get the president to tell them to leave the capitol, mr. attorney general, in your law enforcement responsibility. a public statement they should all leave. >> reporter: republican congressional leaders including mitch mcconnell and steve scalise are there too as pelosi calls vice president mike pence who had been evacuated to an underground loading dock beneath the capitol. >> we're trying to figure out how we can get this job done today. the overriding wish is to do it at the capitol. what we're being told very directly, it's going to take days for the capitol to be okay again. >> reporter: later pence is heard on speakerphone giving pelosi an update, congress could soon reconvene to certify the presidential election. >> i'm at the capitol building

and i'm literally standing with the chief of police of the u.s. capitol police. he just informed me what you will hear through official channels, the sergeant-at-arms will inform you their best information is they believe that the house and the senate will be able to reconvene in roughly an hour. >> reporter: vice chair liz cheney made the committee's closing argument that donald trump above all was responsible for what happened. >> the central cause of january 6th was one man, donald trump, who many others followed. none of this would have happened without him. he was personally and substantially involved in all of it. >> reporter: the committee played video of longtime trump adviser roger stone before the election saying trump would declare victory regardless of whether or not he actually won. >> i suspect it'll be -- i

[ bleep ] you. >> reporter: at 2:30 in the morning on election night, that's exactly what he did. >> we were getting ready to win this election. >> reporter: when the supreme court refused to hear his final legal challenge, trump was livid. he didn't want people to know that he had lost. >> he had said something to the effect of, i don't want people to know we lost, mark. this is embarrassing. figure it out. >> reporter: after the hearing, cnn showed more video by alexandra pelosi, part of a forthcoming hbo documentary. her mother reacting to trump's speech on january 6th. >> we're going to walk down to the capitol. >> reporter: saying he would join his supporters in marching to the capitol. >> i want to punch him out. waiting for this. for trespassing on the capitol grounds. i want to punch him out and i'm going to go to jail and i'm

going to be happy. >> reporter: trump said he would respond to the subpoena this morning. he issued a lengthy statement that complains about the dimorphos's hearing. calls it a witch-hunt, it even complains that not not attention has been paid to the size of the crowd that turned out on january 6th but does not say whether or not he will comply with the subpoena. >> okay, jon, thanks very much. let's bring in our chief legal analyst dan abrams for on this. we'll get some answers from donald trump later. in the past he suggested he would want to testify live. i don't buy it. >> there is no way he can answer the questions that they want to ask, right? let's start with that. there is simply no way. >> truthfully. >> well, look, he can't even go there, because, think about it, when you're under investigation in this many different investigations, any lawyer will say, there's no way you can begin to answer questions. right, right, and under oath. no way, but the question is, what sort of twist is going to happen now? is he going to throw an offer back at them? is he going to say, i'll show up

for this, but i won't for that. i mean, look, when it comes to the fifth amendment right against self-incrimination, you have to be very careful because you can't pick and choose which questions you answer. he can't show up and say, i'll answer questions about this, but i won't answer questions about that, because you've then effectively waived your fifth amendment right against self-incrimination. so there are issues that make me think, gosh, i'm so curious to see exactly what he's going to do. >> and, of course, the clock is working for him because if the republicans take control of the house the whole committee -- >> except, let's point out one thing, if there were a criminal contempt charge, that would survive a congress, right? so you're right with congress' role. but if the department of justice gets involved, it doesn't matter who is in congress. >> we had a major development, "the washington post" reporting that donald trump according to this aide directed this aide to move documents. we see surveillance footage of the documents being moved. very significant development. does it up your analysis of the chances of him getting indicted?

>> absolutely. i think this is the single most significant development we've seen in connection with the document case. why? because it relates to a post-subpoena action, right, so there's now been a subpoena. it relates to donald trump specifically, and there's video of it. >> it's all about obstruction. >> and that's the heart of the document case. so it's not about the retention, per se, although that could be an issue. the greatest legal threat to donald trump is about the possible destruction. you now have a witness, a reluctant witness, by the way, who comes forward and is saying, donald trump instructed me to move those documents after the subpoena. it's getting tougher and tougher for the department of justice not to move forward with an indictment. >> dan abrams, thanks very much. we're going to have more analysis of all this sunday on "this week." t.j. we turn to the reaction after a jury did not unanimously agree on the death penalty for the gunman who killed 17 people in that horrific school massacre in parkland, florida, in 2018. some of the victims' families

actually walked out of the courtroom. our gio benitez is in florida with the very latest. gio, good morning to you. >> reporter: hey, t.j. good morning to you. it's been a long 4 1/2 years for these families, and now many of them are furious that the killer will live another day. this morning, anger and disappointment after the jury recommended life in prison for parkland gunman nikolas cruz rather than the death penalty. >> my first born daughter, my shining star, daddy's girl was taken from me. >> reporter: cruz showing little emotion. the families of the 17 victims also inside the courtroom listening in disbelief as the judge read the verdict, some of them walking out. >> if this was not the most perfect death penalty case, then why do we have the death penalty at all? >> reporter: all 12 jurors would have had to agree to the death penalty, but the jury foreman saying, three of them voted for life in prison. >> i didn't vote that way, so i'm not happy with how it worked

out, but everybody has the right to decide for themselves. >> reporter: prosecutors had argued cruz was a sociopath and that the massacre was premeditated. >> it was calculated. it was purposeful. >> reporter: but the defense said he was mentally ill suffering from fetal alcohol syndrome after his mother abused alcohol and drugs during her pregnancy. >> he was doomed from the womb and in a civilized, humane society, do we kill brain damaged, mentally ill, broken people? i hope not. >> did joaquin get justice today? >> no, he did not. he did not. >> reporter: in the midst of it all, joaquin oliver's father on the road working to bring awareness to gun violence. >> the day that i lost joaquin, joaquin did not lose me, so i got to keep on doing my parenting role. >> reporter: and the families

will return to the courtroom on november 1st to deliver their victim impact statements, but no matter what, the judge is expected to formally sentence cruz to life in prison. cecilia. >> we're thinking of those families, okay, gio, thank you so much. we're going to turn now to the latest on historic inflation numbers. prices rising more than expected and our team covering all the angles from food to gas to social security checks starting with our chief economics correspondent rebecca jarvis right there at a supermarket in new york city. good morning, rebecca. >> reporter: good morning, cecilia. and you can't walk through a supermarket without seeing these price increases. overall prices up 8.2% in september from a year ago. that's not keeping up with wages, which are up 5%, meaning those paychecks aren't covering seeing these big jumps in prices in areas like rents, like medical care, day care and, of course, food, so take a look at

the grocery store in every aisle. you see it in dairy products and coffee, up almost 16%, a carton of eggs runs about $2.90, almost 30% higher than where it was a year ago. rents are also a big factor here. you look at a one-bedroom apartment, the average right now, $1200 a year ago. that is now up about $500 to more than $1700 a month, and that's at the same time that mortgage rates are near 20-year highs. that means buying a house is hard to do, out of reach for a lot of americans. renting a place is also a difficult one, and the federal reserve, in order to try and tamp down these prices, t.j., will be hiking interest rates next month. that means more expensive mortgages ahead. t.j. >> all right. well, rebecca, we go from food, rent and mortgages to gas. gas prices were falling for almost three straight months during the summer but now they are back on the rise in october. our matt gutman at a gas station in los angeles. hey there, matt. >> reporter: they're not falling

anymore. good morning, atlantic. this is one of several gas stations within half a mile of here with $7 gas. california as usual with the most expensive gas in the nation. averaging 6.15 statewide. nationwide it's 3.90, up 20 cents from last month. that as opec announcing that 2 million barrel per day cutback that will further squeeze supply and now ahead of the winter, the u.s. government announcing home heating costs could rise by up to 28% per family. now, this is just for an average winter. if it's just 10% colder, that means that families could pay up to 50% more this winter and just a little bit more bad news, sorry, in the energy department, there are shortfalls in stockpiles of certain fuels including diesel and home heating and that could further increase prices and further feed inflation, george.

>> okay, matt, thanks very much. at the white house president biden struck back at the gop. >> republican wins inflation will get much worse. it's that simple. >> mary bruce has the latest on the white house response. good morning, mary. >> reporter: good morning, george. yeah, the president is well aware that these numbers present democrats, especially with the - midterms now just a few weeks away. so the president has been trying to put a positive spin on this noting that the annual inflation rate has gone down since earlier this year and the president acknowledges, he says costs are simply still too high and understands that americans are feeling squeezed and he is trying to tout the steps he's taken to try to bring down costs like passing the inflation reduction act, which would lower prescription drug costs, but the president is also trying to shift the spotlight onto republicans arguing that inflation will only get worse if they win big in november. he says they don't have a plan to tackle any of this. george. >> inflation is in some ways good news for social security recipients. >> reporter: george, the roughly

>> reporter: this morning carli skaggs and debbie hetman, the widow and mother of los angeles angels pitcher tyler skaggs telling their story on camera for the first time since he died after taking fentanyl laced oxycodone while on the road with his team in 2019. >> yeah, i couldn't believe it was true. i mean that day still haunts me. >> medics 41, truck 41, respond, emergency. >> reporter: skaggs was just 27 years old when he was found unresponsive in his hotel room in texas. >> how did you guys find out what happened to tyler? >> carli called me and told me, and i was, wow -- well, i could not believe it. >> i was driving in my car, and i got a call from the general manager. i knew it was bad. i didn't want to hear what he was going to tell me. i knew my life changed forever in that moment. >> reporter: skaggs was in the prime of his life. he and carli had just gotten married in december. >> terkaggs taking the mound

for the angels. >> reporter: he was on a mission to start 30 games that season. his family said despite injuries, he was well on his way. but then he took that laced pill and an autopsy report revealing tyler died after choking on his vomit with a dangerous combination of fentanyl, oxycodone and alcohol in his system. >> at the point that you found out that there were pills involved, were you surprised? >> yeah, that was the last thought that crossed my mind. >> i agree with her. i agree. >> it didn't even cross my mind actually. >> you didn't have any idea that he was taking pain pills? >> not a clue. >> reporter: on tuesday eric kay, the former communications director for the angels, was sentenced to 22 years in federal prison for providing tyler with the drugs that led to his death. his sentence, two more years than the minimum, the judge saying it was because of these prison phone calls. >> i hope people realize what a piece of [ bleep ] he is.

well, he's dead. so [ bleep ] him. >> reporter: prosecutors also accuse him of being in the room when tyler choked, but not trying to save him. >> do you wish that he would have done something? >> that haunts me all the time. to think that somebody is in the room and doesn't render help to your child, to your son, it's so heartbreaking. >> you know, i always think about if -- why didn't i go to texas. i wish i was there to save him, but he shouldn't have needed it. >> what would you say to eric kay if you had a chance to speak to him? >> through this entire three years, he's deflected. he's not taken responsibility, and the fact that he speaks what he spoke about myself, my family, my son, it's unacceptable. >> reporter: kay apologizing for those comments in court. his attorney says, he plans to

appeal. during kay's trial, five other major league players testified that he provided them with opioids. >> there's a chance that they could have gotten a laced pill and could have also lost their life, so it's pretty hurtful. >> reporter: the skaggs family has filed suit against kay and the angels claiming the team knew or should have known kay was a drug user. in a statement to abc news, the angels called tyler's death a tragedy adding, the angels strongly dispute the claims made by the family in their lawsuit and will defend the organization in court. fentanyl is up to 50 times stronger than heroin and 100 times stronger than morphine. last year more than 71,000 overdose deaths were linked with synthetic opioids like fentanyl. >> we're fortunate because we can hold somebody accountable for our son's death, and a lot of people aren't able to do that right now. but this fentanyl crisis, i miss tyler so much. he was my only son and, you know, i'm not going to be a

grandma. i'm not going to be able to hold a grandchild, and those things are painful. i think about that all the time. >> i distinctly remember four days before he passed away we talked about it, and he said, when i get back from texas. >> we're going to plan a baby. >> yeah. yeah. he would have made an amazing father. he was so great with kids, and i wonder sometimes if i'll ever be as happy as i was. i have a lot of healing to do, you know. i have faith that i'll get there. i know i'm never going to be the same. it's going to be different, but i believe that i can find hppiness again. >> reporter: carli and debbie are now determined to carry on tyler's mission with the tyler skaggs foundation starting a baseball club and giving grants to kids who can't afford to play

and these airlines, which are bringing in record revenue already, are expected to keep raising the rates higher and higher, so if you want to try to save at all this holiday season, you're probably going to have to either be flexible or get creative. >> the ticket prices were very insane. >> reporter: monica suh is trying to nail down her holiday travel, but like many americans, she's finding flight prices are sky high. >> i usually spend both thanksgiving and christmas with my family, and this year i am definitely going to have to choose one. >> reporter: hopper says the average round trip in the u.s. this thanksgiving will set you back $350, up 22% from 2019, and for christmas, $463, up 25% from 2019. with these prices even with thousands of cancellations and staffing problems over the summer, multiple airlines are seeing record revenue. delta reporting a $695 million profit just last quarter.

its highest ever, and american and united also say they're seeing no dip in demand. >> when lots of people want to fly, prices go up. >> reporter: but despite that success, not only are prices expected to keep climbing, several airlines including delta and american are raising the requirements for frequent fliers trying to earn status. now a lot of travelers are looking for better ways to score deals. some considering subscription services from low cost carriers like frontier or alaska, spirit's savers club will give you the lowest fares and discounted bags and seats for $69.95 a year. whether that's a good deal for you will depend on where you live and how often you fly. >> if you're a big family of four, five, six people, you're going to get $40 off airfare for everyone in your traveling party. it is a really good deal. >> reporter: but experts say holiday fares could climb $10 to $15 a day toward the end of october, so how do you save?

it was more like $1,300 a month and this is still excluding fees and taxes and things like that, so, t.j., it's much more expensive today than it was a year ago and that has an impact if you're a buyer clearly but an impact on sellers who are afraid to put their houses on the market because where would they move and drives up the cost of rents because people are renting more because home affordability is so low right now, t.j. >> what can a home buyer do? >> reporter: so, you got to look around. shop around for a mortgage, don't rush yourself on this decision. it is a gigantic financial decision. you have to be willing, especially if you're buying right now to stay in that house for at least five years before you're looking to move again. improve your credit. the best credit scores will get the very best mortgage rates available and be cautious about some of these newer mortgage products that do things like send your rates higher over time because we're in this
