suspect made against nancy pelosi. good evening and thank you for joining us. >> a new statement from nancy pelosi that she released on her website just moments ago. she says quote since the horrific attack on paul early friday we have been lose with thousands of messages conveying concern, prayers, and warm wishes. we are most grateful. thank you to the excellent trauma care team at zuckerberg san francisco general hospital, paul is making steady progress on what will be a long recovery process. our family thanks everyone for their kindness. >> to live team coverage tonight on the attack with reporters at the pacific heights home and at a press conference held this afternoon by san francisco's district attorney. we begin with abc7news i team imported stephanie with new developments on the investigation and you learned an awful lot today? >> we sure did. district attorney brooke jenkins made it clear she will be prosecuting all six charges against david to the highest

extent of the law. and tonight, we are learning some disturbing new details from both complaints filed in federal and state courts about how this attack unfolded, the emotive and serious questions about why there was not any security at the home. 42-year-old david of richmond faces federal charges of assault and attempted kidnapping after breaking in and attacking house speaker nancy pelosi's husband, paul, with a hammer. >> he specifically targeted the pelosi home to confront speaker pelosi. it was at some point after that mr. pelosi asked to go to the bathroom. which is where he was able to call 911 from his cell phone. >> according to the criminal complaint on monday, paul poulos he was asleep when david entered his bedroom, telling him to wake up and that he was looking for nancy. minutes after the call, police arrived to see the two men struggling for control over the

hammer. officers asked what was going on. the complaint states david said everything was good. officers told them to drop the hammer before david allegedly gained control, swung it, striking policy in the head. the speakers's husband appeared unconscious on the floor. according to the affidavit when paul pelosi said nancy was not there, david responded, saying he would sit and wait poulos he indicated that his wife would not be home for several days. -- poulos he indicated that his wife would not be home. according to david come around that time he started taking out twist ties from his pocket so he could restrain paul policy. the two kept talking. when paul pelosi went to the bathroom to call 911. >> two police officers arrived at the front door two minutes after that 911 call. when that door was opened, the defendant was holding his hammer. >> they told sfpd in a follow-up interview that they were going to hold nancy hostage and talk to her, adding he would let her go only if she told the truth.

if she lied, he was going to break her kneecaps. later explaining she would have to be wheeled into congress, which would show other members of congress that there were consequences to their actions. >> it really hits very hard. there is such a disbelief to the viciousness of this. >> according to the affidavit san francisco police recovered zip ties in the bedroom. in the hallway near the front door and a roll of tape white robe, one hammer, rubber gloves, along with a journal and david's backpack. investigators found evidence that they lived on shastri street in richmond for roughly two years. among other things, investigators seized two hammers and a sword in the garage. >> >> there was no security present and he was able to break the window to a glass door to gain entry into the home. >> that is a lingering but important question that has yet to be answered, the security measures. we confirmed tonight that there is no memorandum of

at pelosi's home. elon musk did delete the tweet but itas shared widely enough that sanisco police chief il scott is weighing in. it's an example of how divisive the country has become and how social media has fueled so much of it. just 48 hours after the violent attack on paul poulos he in san francisco, yuan musk, twitter's new ceo tweeted out a conspiracy theory about the attack and suggested the report he shared might be true. he deleted the tweet six hours later, but not before it was shared widely to his 112 million followers. >> baseless, feckless theories. >> san francisco police chief refuted claims being shared. >> there is absolutely no evidence that he knew this man. as a matter of fact, the evidence indicates the opposite. >> elon musk's post comes amid concerns about how he will run twitter and how much he will crack down the spread of disinformation. how dangerous is that to have

two sides will debate whether the charges should be dismissed now that she is no longer share. for the our team in san jose, dan, abc7news. >> new details on the motive for the murder of a beloved east bay dentist. court documents revealed that this doctor had 12 to $14 million worth of property and assets. her birthday, nelson, told investigators he was the trustee and stood trustee of $1 million immediately after sue's death. john died by suicide in jail last week. the only surviving suspect is the accused gunman who police say was hired. he is set to be arraigned tomorrow. >> in the south bay, a call for police in san jose, where officers say they are stretched too thin and it is putting everyone safety at risk. police responded to three violent crimes in the span of less than two hours. from saturday night into early sunday morning. late saturday and i, two men were shot on kaufman court and one man died.

an hour later a man was shot and killed on madera avenue and less than an hour after that, two men were stabbed on 1st street in the downtown area. abc7news reporter dustin dorsey spoke with police who say nights like that put a dangerous strain on the department. >> wants known as one of the safest big cities in the country, law enforcement leaders say that is no longer the case in san jose. three major incidents tied up most of the police departments officers. the officers association says this left the rest of the city vulnerable. >> these are 911 calls coming in from various businesses and residents asking for help. pleading for help. and yet, there was not one officer of available to respond to the call for help. we are unsafe. >> it started before 11: 30 saturday night. sj pd says a family disturbance led to multiple people being shot. one dead, one injured and one suspect in custody. three miles of the road an hour

and 15 minutes later, issuing that took another life and what police say was a party at madera avenue. an hour after that a double stabbing at a nightclub two miles away. >> we do not want this violent crime in our city, however we cannot prevent it. we will do whatever we can to curb it and respond. >> they say that is getting increasingly difficult due to lack of stacking on the force. the department should have around 2000 400 officers but sj pd sits at 1021 filled spots. the sj pos as the department should've called for mutual aid for extra help but as jp deep says that is for large events. >> we were stretched to the max. however we did take care of these calls efficiently as we could with the available resources that we had. >> many nonemergency calls had longer response times during this time. the officers union told us the party received one of those nonemergency 911 calls earlier in the night due to noise complaints. it was not immediately answered.

coming through. the tail end of an atmospheric river that we're just going to get some scraps out of. we've got a three to five hour window where we will have light to moderate rain and after that, we have breezy conditions with isolated showers. here's a look at future radar toward 7:00 in the morning. scattered showers ahead of it but definitely a line of light green to moderate yellow and orange moving into the north bay. by 1:00, fast-moving storm. already starting to exit inland east bay and southbay neighborhoods. behind that you can see the sun comes out and irritates the atmosphere, adds energy to it. as we start the evening commute, scattered showers possible all the way through about midnight. then we wake up wednesday morning pretty quiet. you can see very isolated showers, especially the closer you are to the coast for wednesday. rainfall totals, a 10th of an inch to a third of an inch for most of us. in the mountains and higher elevations we could get half an inch. tried not to travel through the high country through eight wednesday evening. look at that, up to 14 inches of
