her seat. newsom easily won reelection last night. rick jenkins is now claiming victory. >> we still don't know who will be the next leader of the bay area's biggest city. >> the latest results put matt may hanna in the lead with 51% of the vote ahead of cindy chavez. >> let's go live to zach fuentes. he is tracking this all many by minute. reporter: that is right. those latest numbers came in just about an hour ago. they are still about the same margin today as they were yesterday. still, the register's office tells me that the accounting process is far from over. we took some time with him this morning and this afternoon to take a look at that asset and more ballots coming in. the polls closed at 8:00 on tuesday, but the county process is far from over.

the ballots keep piling in. we were there as just around 2000 vote by mail ballots were brought in, going up a portion of this warehouse. >> these are going pretty fast, we have a lot of ballots to process. a lot of vote by mail ballots got dropped off at the boat centers. we are expecting a lot a vote by mail ballots, and all the people that voted at the boat center was a really high amount of people that went in and voted in person. reporter: many of those ballots adding to the final tabulation in the closed and who was a mayoral race that was too close to call on election day. we were at both candidate lodge parties as the result coming in. matt meehan was leading the race by a thin margin. he chavez responded to those early numbers. >> when he worked really hard for something, it is very easy to feel let down when things don't go exactly the way he wanted them to. the thing i know is that -- i think this may be age or

experience, every single time we move people forward, we make a change that is meaningful to someone. reporter: over at may hands watch party, a mood of celebration. >> here we are in a dead heat, you know it will take a few days to sort this out and see where we end up. either way, this campaign was a force to be reckoned with the it it will continue beyond the election. reporter: the santa clara county registrar's office is continuing to make sure everyone's boys in this election is heard. >> all the races that are close, we are still processing the ballots read we have to keep going with what we are doing and making sure that every step is -- none of the steps are missed. dave: we will continue to get results each day this week at 5:00 p.m., as these boats, many ballots, continue to be counted.

liz: very tight race there. what other races are you watching? reporter: there is a lot happening here in santa clara county. the sheriff's race has been one to watch. right now, bob johnson is leading kevin johnson. there is about 7000 votes between them. there is also the city of santa clara's mayoral race. they have about 166 votes that are separating the two candidates. right now, the incumbent, lisa gilmore, is leading in that race. it appears to be an automatic recount, the margin has to be by .025 or 25 votes that would trigger that automatic recount. liz: that is tight. just a reminder, when people say, your vote matters, it really does. dave: each and every one. there are now two front runners in the oakland mayor's race,

loren taylor has 34% of the vote, and sheng thao is about 29%. the winner will replace libby, who has endorsed taylor. >> there are still a lot more ballots to count, but taylor has a great lead, and that lead evening races after the ranked choice roll up. i am feeling very optimistic, but still waiting for those ballots to count. dave: there were 10 candidates, but do to ranked choice voting, all but taylor and her opponent have been eliminated. liz: california voters have seven statewide proposition to decide, and pass less than half of them. opposition one passed easily, that the men's the constitution to make abortion access a right. the gambling and sports betting propositions failed. prop 28 which funds public school arts and music passes. the one about dialysis clinics

failed. that has been on the ballot a few times now we had prop 30 would tax the ultrarich to fund clean air and electric vehicle initiatives, that failed. news anchor joins us with a closer look at all of these propositions. reporter: we can take a look at the vote counts behind those propositions and see just how many people voted for and against them based on counties areas let's start with prop one. that includes the choice to have an abortion. it received more yes votes in most counties. the central valley, some of those counties voting against it, and northern california, of course. it did pass by 65%. let's take a lookout prop 28. this one increases spending and arts programs in schools. you can see, it got a big, yes. 62% as we take a look at the whole state. you can see some counties there

to the north voting no. we will take a look at one last one, 131. this one past as well. you can see, some counties voting no, by some smaller numbers, even if we click here, you can see that it was a pretty close, even there. if we take a look at these state totals for this one, it did passed. this one upholds the state law, about the sale of flavored tobacco. dave: for some analysis, joining us is phil matier oh. what's your big take away from the outcome of the statewide races? reporter: california remains one of the bluest and the blue states. the democrats returned by 6040 margins across the board. the initiatives we just saw, whether it be flavored tobacco, health, choice, we are there for that. the others, no. the governor gavin newsom

actually came out against one of the taxes. liz: what about newsom? he wasn't really even campaigning for his reelection. he won it, he knew he would win it, it seems like he was campaigning for something else? reporter: might is the big question. newsom made a big point saying, democracy was on the ballot across the country. california reaffirmed its freedom stance and right to choice. he has gone a lot of national attention from that. everyone is looking at him as a possible potential contender read the election is over, democracy won. now it is his job to govern. attention is going to drift away right now and will be on donald trump, joe biden. it won't be on gavin newsom or ron desantis in florida. he has two govern california. if he is going to make another

move, it will be hinged on homelessness and public safety, not on the democracy. liz: knowing the fact that a lot of people look at california, san francisco -- reporter: it is not an easy job. he has to get onto that. dave: since we are talking about the future of politicians, nancy pelosi with republicans controlling the house, a lot of speculation about when she might retire. reporter: there is a lot of things at play here. first off, it appears the republicans are going to be in control of the house. let's go with that. that gives a question, woodmansee police -- wouldn't nancy pelosi agree to be minority leader? in the last couple of years, we haven't seen a lot of this publicly. behind the scenes, a number of congressional people wanted her out as speaker. they said it was time for a generational change. they wanted younger people to step up. it was a close call last time.

in that time, she was at war with trump. the democrats could go, she didn't lose that much. for them, it is a victory. they could go to her and say, look, we want you to stay on as minority and fight for us to in in two years. you say listen, dan, i know you have two years left, can you commit to this? if she doesn't, it would be a race for her replacement. don't rule out the fact that they don't have somebody of her stature and her ability to keep the party going. they may need her. dave: san francisco's election results are still pending. it is clear, the and accountability helps sway voters in favor of london breed's appointees. liz: district attorney, jenkins, declared herself the winner.

we look at what this means for the mayor's plans moving forward. reporter: when the asian-american community saw a spike in hate crimes, chinatown fought back with community patrols and later, going to the polls to vote. so, it was no surprise that chinatown was mayor london breed's first stop, following yesterday's elections. accompanied by her appointed district attorney, brooke jenkins. >> we care about reforms. we know that people have challenges and deserve second chances. also, when those lines are crossed, where is the accountability? reporter: while the official results are still pending, jenkins declared herself the winner. while out learning -- outlining her plans moving forward. >> to put my foot on the gas as it has been for the last four months. we started four months ago with trying to make sure we were implementing policies to move and safety forward in the city.

reporter: supervisor matt dorsey is leading the race in his district. he previously worked with the san francisco police department and the city attorney's office. it appears the accountability message worked in the mayor's favor. unlike in 2019, when voters rejected her appointee, susan, in favor of tessa, who won on his criminal reform policies. >> they are really tired of the politics and the fighting, because our neighborhoods are suffering read retail is suffering. public safety is suffering. it is important that we get back on track. reporter: voters also have favored mayor breed's appointees for school board. two of them have been declared winners. one is hanging on to a third place while the top three are voted in. dave: keep in mind, many races are still outstanding. we will continue to update results as they come in. you can go to our website to

find all results in one place. liz: david to pop, the man accused of attacking paul pelosi has been indicted by a federal grand jury. we received a copy of this indictment. the indictment does not replace san francisco district attorney jenkins investigation. they are two different prosecutions in different systems. he is accused of breaking into nancy pelosi's home last month and attacking her husband, paul pelosi, with a hammer. he has a preliminary hearing scheduled for december 14 on those charges. a dangerous chase appears to be ending in southern california. the driver stole multiple vehicles. he took the truck from a home that he went into while the people there try to stop him, and then minutes ago, the driver smashed into multiple police cars and other vehicles. he came to a stop at a gas station. it appears police shot beanbags

into the driver's window. dozens of officers have surrounded the truck, a very dramatic situation. a lot of people have been following live. the driver has not yet emerged. dave: happening now, we will take a look at our current weather conditions. yesterday's storm has finished. drivers in the sierra are taking advantage of clear conditions today. there are no chain controls at this moment. there is an awful lot of snow. liz: it is good to see it. >> it is a great start to the snow season. let me show you those totals. dodge ridge, 44 inches. kingvale, 33. you will notice three feet at bear valley, two feet, palisades tahoe. now the chill is going to come in. temperatures are still comfortable in the 40's and 50's. we do have a frost advisory for virtually all areas excluding

dan: on wall street, stocks finish the day in the red. investors are now shifting their way away from the midterm elections. the dow was down more than 640 points. the nasdaq lost about -- s&p 500 dropped to nearly 80 today. facebook's parent company, ceo mark zuckerberg sent a letter to employees today letting them know that about 11,000 workers are being laid off. the cuts amount to 13% of

metta's workforce read that is the largest job purge in the country's history. this move follows layoffs by salesforce and twitter, as well as snap and redfin. a business professor says, as much as the cuts will hurt, there is a benefit. >> much-needed rebalancing, both in terms of these businesses, and the cost of living. dan: he says it tech companies deserve blame by thinking the huge demand for digital services we saw during the pandemic would be permanent. he also blames russia's invasion of ukraine, supply chain issues, and inflation. liz: today we are hearing from one of the laid off employees, she said she knew this was coming. reporter: for months, rumors of potential layoffs were circulating. this morning, those rumors solicit -- solidified. >> i woke up about 8 a.m., i

checked my personal email, i found the email saying i am laid off. reporter: this software engineer who did not want to be identified by name, said many of her colleagues were up until 3:00 a.m. checking their personal email, hoping it wouldn't be them. >> everyone was anxious, we knew it would happen, but we don't know when. reporter: how many people do you know were also laid off today >> >> a lot. probably 10 or more. reporter: news of the layoffs is already impacting businesses in the area. business was already down with metta employees working from home. now, that concern intensifies. rheem -- >> i don't know what happened. reporter: some business owners were afraid to speak on camera. metta owns this shopping center and is influential in this

community. housing, retail, and open space development. today, the mayor of menlo park said, the project is on the council's agenda next week. i won't comment further. according to the severance package, employees will get 16 weeks of base pay, plus two weeks for each year of service. what is your plan now? >> i think i might take a break and rest for a while, looking for the new job. liz: never good to hear about those, especially right before the holidays. speaking of that, it is feeling chilly. dan: it is cooler today, and i guess it will get cooler still. >> temperatures are going to take a nosedive. let me show you a live picture right now of san francisco. frost advisory will be in effect from midnight to 9:00 a.m..

building a better bay area, moving forward, finding solutions, this is abc 7 news. dan: a former vallejo police officer involved in two fatal shootings and fired for unsafe conduct now has a new job. he has been hired by another

local police department. dan: melanie woodrow has this story that you will see only here on seven read some of the footage could be difficult to watch. reporter: fired vallejo police department -- officer is now working for the broadmoor police department near daly city. >> it is a direct slap in the face. reporter: officer mcmahon was one of six vallejo police officers that shot mcmahon more than 50 times in february 2019, killing him. in 2020, former police chief fired him for unsafe conduct and neglect for basic firearm safety that endangered fellow officers in connection with the shooting. >> for someone to make a decision and find that it was ok to put this man back in the same position of power, i think is disgraceful and irresponsible. reporter: an independent special prosecutor determined the officers felt their lives were threatened and acted in self-defense.

in 2018, officer mcmahon shot and killed ronell foster. he stopped foster for not having a light on his bicycle. the city of vallejo paid foster's family $5.7 million. they did not file criminal charges against mcmahon, noted that foster assaulted mcmahon with his flashlight while resisting arrest. >> it is disgusting and heartbreaking. reporter: broadmoor police department rights, a thorough investigation of officer mcmahon's background was completed by a background investigator with more than 20 years of experience. no applicant to the broadmoor police department would be hired if any disqualifying information is received or uncovered. >> it doesn't surprise me. that is what they do, they send them from one town to the other, to do more mayhem and killing.

>> we understand that the blue wall will protect their own. reporter: in a wrongful termination route lawsuit, whitney that when mcmahon surrendered his badge during a separate internal investigation, two points on his badge were bent, signifying the shootings of foster and mccoy. an attorney for officers, told the i team the officers weren't celebrating, but having confronted a lethal force incident. district attorney previously told me her office would not investigate allegations of badge bending. >> we don't chase rumors. reporter: chief williams launched an independent investigation into badge bending. they want the findings of that investigation publicly released. the vallejo police department previously told the i team the holdup was with the city

attorney's office. in the meantime, sullivan and mccoy worrying about officer mcmahon being back on the streets. >> this is a nightmare. >> he is viewed as a serial killer a badge. reporter: the police department says they're very careful about the people they hire. they say officer mcmahon is an experience veteran officer who has served with fairness, equality, and constitutional leasing. -- policing. dan: fire crews are mopping up after a fire at a homeless encampment this afternoon. under interstate 880 where mandela parkway turns into 3rd street in west oakland. cruz got the fire under control just before 4:00, not before several vehicles burn. no word of any injuries, this is just the latest in a series of fires encampments across oakland. liz: back to the latest on the

election, results continue to come in. abortion rights where on the ballot, not just here in california, but across the country this year. in michigan, voters agreed to enshrine abortion access into their state constitution in kentucky, voters rejected the abortion ban enshrined in their constitution. both sides of the aisle are supporting abortion rights, that certainly must have played a role. reporter: when governor gavin newsom celebrated his victory, he spoke less about his own accomplishments and more about one, key issue. abortion access in prop one. >> how proud i am that we affirmed, clearly, with conviction, that we are a true freedom state. that we embrace the rights of women and girls. reporter: the focus of his remarks is another signal of how important democrats see the issue of abortion.

tuesday's election was the first national election since the supreme court overturned roe v. wade. despite republicans who predicted a red wave, that didn't happen. the question now is how much voters were driven by the abortion issue when they went to the polls. >> the democratic stance is more popular with voters. do you think the issue of abortion is part of the reason that democrats were able to put off this so-called red wave? >> it helped. it didn't hurt. it sort of was a part of the puzzle of holding back the red wave. reporter: during the streaming coverage, we asked the chairwoman of the california gop whether she thinks the issue of abortion her republicans? >> overwhelmingly, that is not an issue that comes. they are talking about the economy, our failing schools, the crime in our streets, and the homeless crisis. dan: is not really the case?

across the country, the supreme court decision fired up a lot of voters. you really think that your voters and republican voters didn't care about that issue? >> here in california, even if prop one would have failed, nothing would have changed. daliz: that is what the gop is saying. the republican party will have to rethink how they address this issue. she says democrats also have work to do, they can't just focus on this one issue. still, they picture many voters have a clear message. dan: something else to keep in mind, the election produced some historic victories for lgbtq candidates, all across the country. we spoke with local leaders who say the work must continue. reporter: from the first openly lesbian elected to governor in

massachusetts, to a second in oregon. a trans man voted into new hampshire's state legislature. and here in california, the first openly gay immigrant is on his way to congress. >> that shows that we have made progress. reporter: suzanne is the interim executive director of san francisco pride. today, she is congratulating her predecessor. >> we want to first of all, say, congratulations. >> i am used to saying, i am the board president of san francisco pride, this is a whole new world for me. reporter: wins across the country, and in her own backyard, signal a changing of the tide. >> not only am i a black woman, i am a masculine presenting woman. i think it is amazing that we are in a time that i don't have to put on a skirt to be who i am and run for office.

dan: a rare november hurricane is forecasted to make landfall in florida tonight or early tomorrow morning. thousands of airports have closed as hurricane nicole nears florida's southern atlantic coast. the state faces several threats. >> the winds are the main concern. we also expect to see some heavy rains, the potential for flash flooding, and three to five feet of storm surge in some areas. dan: a number of airports, key airports, have closed. waist deep flooding to the bahamas earlier today. last time a hurricane hit the u.s. in november was back in 1985. liz: there is a slight chance of rain in our forecast, otherwise it will be bright and sunny for days.
