robin. the 22,000 students here at the university of virginia still asked to shelter in place after that horrific overnight shooting near the campus grounds. as you can see behind me, still a very active investigative scene here in charlottesville. this morning, a massive manhunt at the university of virginia. authorities searching for christopher darnell jones jr., a student at the university who police allege shot at least five people on this campus bus, killing three. >> i have two people shot. one person at uva. oe shot in his chest. another one was shot in her leg. >> reporter: the shots first reported at 10:30 p.m. at a garage near the center of campus. >> i heard the gunshots when they originally happened. i'm terrified. i have no words. i never thought i'd be in that kind of situation. i'm calling my family, my friends.

>> reporter: the university cancelling all classes for the day as frightened students shelter in place. >> i've just been up here because i don't want to go downstairs with an active shooting and a suspect still not found. >> reporter: the suspect last seen wearing a burgundy jacket, blue jeans and red shoes, and may be driving a black suv with a virginia license plate. >> it's sad that we have to go through this as college students. it's always been a fear of mine growing up. >> reporter: the uva athletics website lists the suspect as a one-time member of the football team back in 2018, but he did not play any games. his player bio also says he was a member of the national honor society. robin? >> appreciate your reporting, alex. t.j.? we turn now to our chief justice correspondent pierre thomas. pierre, we are on the air with you far too often having these conversations about gun violence in this country. here we are once again talking about a campus shooting.

>> reporter: t.j., good morning. the tragic shooting at uva the latest example of the nation's chronic epidemic of gun violence and the second significant shooting on a virginia college campus in less than a year. last february, two college police officers were killed at bridgewater, with three people shot last night it qualifies as a mass shooting. there have been 598 mass shootings in this country this year. that's a slightly lower number than last year, but there's no reason to celebrate. the number in this country is still so much higher than it was in just 2019. as someone who grew up an hour from uva, this is shocking and will truly shake that close-knit community. george? >> no question about that. pirre, thanks very much. now to the latest on the midterm elections. democrats have kept control of the is that the with the win in nevada over the weekend. congressional correspondent rachel scott tracking it all from capitol hill. good morning, rachel. >> reporter: george, good morning. the party in power typically suffers big losses in midterm election year. you add to that sky-high

inflation and low approval ratings but president biden is on track to do something few first-term presidents have done in a first midterm election. this morning, democrats celebrating a narrow victory after beating the odds and defying history to secure the majority in the senate. >> i'm not surprised by the turnout. i'm incredibly pleased. >> reporter: nevada handing republicans the crushing blow. democratic senator catherine cortez masto winning re-election beating adam laxalt. it was one of the tightest races in the country. >> whether you voted for me or not, i will always fight for you. always. >> reporter: with senator mark kelly's win in arizona democrats have now 50 seats with the chance to pick up one more with georgia's runoff election next month. >> our message is the same. this election is about who's ready and who's fit to serve the people of georgia. >> reporter: six days after the midterms, democratic senator raphael warnock and republican herschel walker back out on the campaign trail.

>> if you voted last time, vote for me again, but tell the people that didn't vote for me they need to vote for me. >> reporter: it's all a far from the red wave republicans were hoping for. at least 30 of president trump's hand-picked candidates lost including several high-profile election deniers, now republicans are grappling with what went wrong. >> i think what people said is look, we can work on these policies later but as americans we got to fix extremism right now. >> reporter: others blaming turnout. >> election day, our voters didn't show up. we didn't get the voters. it's a complete disappointment. >> reporter: republicans were focused on the number one issue for voters -- record-high inflation. in exit polls, abortion ranked a strong second. control of the house is still up for grabs. 18 races still not called, republicans only need to win seven, but democrats say, they're still in the fight. president biden acknowledged that it will be a stretch for democrats to hang on to the house. if republicans do win, it will be a narrow majority and some of these races still just so tight across the country where votes

are still being counted. in colorado lauren boebert is ahead by just over 1,000 votes. >> rachel scott, thanks very much. who is going to be leading the house anyone's guess. robin? okay, now, to our abc news exclusive. former vice president mike pence sat down with "world news tonight" anchor david muir for his first network television interview since the january 6th insurrection. he has a new book coming out called "so help me god." pence directly criticized donald trump calling his actions on january 6th reckless. saying his words endangered him, his family and everyone at the capital. >> members were barricaded inside the house chamber. and in the middle of it all, you can see that the president has tweeted. 2:24 p.m., the president tweets, mike pence didn't have the courage do what should have been done.

place. >> and why wasn't he making these calls? >> that would be a good question for him. >> we'll bring in our chief washington correspondent jonathan karl. jon, what is the significance of what pence is saying now? >> reporter: robin, it's so striking to hear pence, who was the most loyal member of that administration, stood with trump with all those controversies, came out and called him reckless and say he put his family and all those people in the capital in danger. but when you consider what happened and the fact that trump told me just weeks after he left the white house, justifying the actions of those who were saying, hang mike pence, i think the obvious question pence is going to face now is what took so long? >> a lot of people online after seeing him sit down with david were saying the very same thing. why did it take so long?

it's been more than three years since president xi has met an american president in person. this is a big deal what happened here today. some video, biden and xi smiling, shaking hands. then they sat down with their teams for this face to face meeting. it comes at a time of heightened tension between these two world super powers, especially over the issue of taiwan and nancy pelosi's visit there this summer and china's refusal to condemn russia's invasion of ukraine. president biden telling xi today that the u.s. stands ready to work with china, if that is indeed what china wants and before this meeting even started, it's important to say the white house downplayed expectations saying they don't expect any substantive policy changes. they say the goal is to have a frank talk and reduce any misunderstandings. george, i want to tell you something about what just happened, our producer was inside for this summit, she shouted a question as american journalists always do. she asked president biden if he would raids human rights in this meeting with president xi.

as she was asking that question, a chinese delegation actually pulled her backpack and almost pulled her down. just describing how tense this meeting today was. george? >> cecelia, thanks. robin? george, now to deadly mid-air crash during an air show in dallas, six people onboard the two planes were killed. the incident is under investigation this morning, and mireya villarreal has the latest. >> reporter: this morning, an urgent investigation by the faa and national transportation safety board into what caused two historic planes to collide at a dallas air show. >> we're analyzing radar and video footage to pinpoint the exact location of where the mid-air occurred. one of the things that we would probably most likely determine is why those airplanes were in the same air space at the same time. >> reporter: the mayor posting these photos in tribute for terry barker, one of the six

people killed in the midair collision. the mayor writing, even after retiring from serving on the city council and flying for american airlines his love for community was unmistakable. >> we had an air collision, it's down on the airport. >> reporter: billows of smoke seen here in this video, captured the crash from several angles. >> i've never seen a crowd that size be so quiet and so still. >> reporter: organizers estimate there were between four and 6,000 people on the ground in the area when the collision occurred, but say no bystanders were injured. the planes are not required to carry flight data recorders or cockpit voice recorders, commonly known as black boxes, which could complicate the investigation. overnight the largest part of the wreckage was removed by crews. they say because there were no cockpit recordings the video shot by bystanders will be crucial. it could take weeks, if not months, for investigators to get a better understanding of what

happened here in dallas. george? >> okay, mireya, thanks. the latest now on the war in ukraine where president zelensky celebrated the victory of taking back kherson after months of russian occupation. james longman is on the scene. good morning, james. >> reporter: good morning, george, from the liberated city of kherson. take a look at this, these kids playing underneath the newly reinstated ukrainian flag. it was a hard-fought battle, but eventually the russians retreated. a happy day for ukraine. this morning, after nine months of russian occupation the people of kherson celebrate their liberation. ukraine retaking full control of the city, saying they've recaptured 1,700 square miles in the past week alone. this is a major blow to putin. kherson was the only major city that russia had been able to take since the war began. it now leaves access to occupied crimea impossible.

the relief here is palpable. president zelenskyy's visit a defining moment. >> a good day, a nice day. >> reporter: these two boys can't hide their joy. they're so excited to see their president. it's been nine months with no hope, and now hope has come to visit them. service members treated as heros. groups dancing in the street and singing the ukrainian national anthem banned here under russia. right now to overwhelmed hospitals as the flu and other seasonal viruses appear earlier this year. california one of the hardest hit states. matt gutman is live in california with more. good morning, matt. >> reporter: good morning, robin. california is 1 of 22 states with high or very high levels of influenza and the combination of influenza, covid and rsv has prompted l.a. county's medical director to say we could see the return of mask mandates. now the metrics so concerning to public health officials right now as the near doubling over the past week of illnesses, hospitalizations, and deaths from the flu, and those numbers have nearly doubled from the previous week, and rsv continues to be a threat. 78% of the beds at children's hospitals nationwide are filled. at mott's children hospital in michigan they're filled at 100%

but no doubt about it, this was an incredibly dangerous situation that many will now be demanding answers for. >> the bad guy is right there. >> reporter: this morning, a shocking tsa security breach. a passenger getting through the airport at cincinnati/northern kentucky international airport with not one, but two box cutters. >> how did he get a knife on the plane? >> reporter: the tsa telling abc its employee did not use a new 3d scanner properly, missing the box cutters, but the man's bag was flagged for more screening. an agent found one box cutter and removed the blade, but gave the box cutter back to the passenger. even without the blades, that breaks every protocol. the second box cutter went entirely undetected. >> wekt hear commotion and we were like what's going on? >> reporter: on board the suspect reportedly walking down the aisle swearing and scattering clothes even allegedly threatening others with the knife. this passenger says he spoke

with the person who sat right next to the man. >> he flashed a box knife at me and said i wanted to kill, i want to stab people. >> reporter: this man jumping in to help as the flight diverted to atlanta. >> landing was the most dangerous part because now he's seated and he's next to another person and there's a toddler behind him and a baby crying. thank god nothing happened. >> reporter: another vet and a former police officer also helping subdue the suspect. after passengers de-planed, police moved in. the man getting agitated, but the former officer took action. >> the ex-police officer said, hey, don't do that, what are you doing? like some kind a warning not to do something and he just tackled him. >> reporter: box cutters a focus for the tsa after the 9/11 hijackers smuggled them through security. >> i joined the navy before 9/11 happened. when i heard that, that was the first thing i said, that's not going to happen again. i don't know what the situation is but we're going to take control of any situation we're in. >> reporter: and the tsa telling abc news that those agents are

the latest now on alec baldwin who's suing the crew members who gave him the loaded gun on the set of "rust" where baldwin's gun went off and killed cinematographer halyna hutchins. we'll speak with dan abrams after this report from mola lenghi. good morning, mola. >> reporter: good morning, george. alec baldwin trying to clear his name in this new lawsuit, alleging it was the film's crew members who were the ones who were negligent. this as questions remain exactly how live ammunition made it onto that movie set in new mexico. this morning in an effort to clear his name, alec baldwin is suing the armorer and crew he says is responsible for handling the loaded gun he used that

fatally shot cinematographer halyna hutchins and injured producer joel souza on the set of the movie "rust." the star and producer baldwin adamant he was told by crew members the gun had no live ammunition, alleging the crew was negligent and failed to maintain a safe set. his attorney saying in a statement, more than anyone else on that set, baldwin has been wrongfully viewed as the perpetrator of this tragedy. the armorer in question, hannah gutierrez-reed responding with her own statement through her lawyer writing, baldwin is solely responsible for the harm that happened. he rejected training and pointed the gun and pulled the trigger without the armorer being present. his arrogance is astounding. it's his fault, period. it was more than a year ago when hutchins was killed during rehearsal for a scene in the low-budget western. in an interview with george stephanopoulos last december, baldwin adamant that he didn't pull the trigger, which he still maintains to this day. >> it wasn't in the script for the trigger to be pulled.

>> well, the trigger wasn't pulled. i didn't pull the trigger. >> you never pulled the trigger? >> no, no, no, no. i would never point the gun at someone and pull the trigger, never. >> reporter: contrary to baldwin's claim, the fbi stating in august report the gun used in the fatal shooting functioned normally and could not have fired without pulling the trigger. baldwin's lawsuit also named dave halls who gave baldwin the gun, seth kenney who supplied guns and ammunition to the set, and sarah zachary who was in charge of props. none of those defendants have responded to the suit. despite the tragedy, production on the ill-fated western will resume in january, but not in new mexico. halyna hutchins' widower husband joining the production. santa fe prosecutors now pouring over the case. >> there's no evidence that this was intentional. this was clearly an accident,

but perhaps a criminal accident. just because something is accident doesn't mean that a criminal act didn't occur. >> reporter: after a year-long investigation the sheriff's office turning over its report to the district attorney's office last month who is considering whether filing any criminal charges against those involved in the shooting. guys? >> mola, thanks very much. let's bring in our chief legal analyst dan abrams. what do you make of this suit? >> look the best defense is a good offense and i think you're seeing a little bit of that here from alec baldwin. this is cross-complaint, meaning he has been sued by someone who was on the set. that person has sued him and other people, and he's basically saying, okay, now i'm going to respond and say, yes, those other people you sued, they're responsible, but i'm not. i should be entitled to some of the damages because i'm a victim. so even if he did nothing wrong, absolutely nothing wrong, it's still a tough lawsuit to say

that he was the victim, that he should be entitled to damages here. but i think that he's being honest when he says he's doing this to clear his name. >> we need a scorecard to keep up with all the lawsuits being filed here. where do they all stand? >> the most important lawsuit is from the family of halyna htchins. that one is settled. that is off the table. now you have a number of people some of whom are saying i was on the set and i was psychologically injured, that when the bullet was fired my glasses came off and i haven't been able to get over what happened since then. you know, some of these are not particularly strong lawsuits in my view by the people who are filing them. but they are continuing because i think there's this huge battle over who's at fault and the answer will probably be a number of people a little bit, right? it's probably not the case that one singular person is entirely responsible for this. it's a series of events where a number of people are all

partially responsible. and then you have to figure out, how does that play out in the courts? >> robin referred to the civil cases, right? score card on civil cases. what about a criminal case here? >> that's the big one, right? that's the big, outstanding question. the prosecutor sure hinted there are going to be criminal charges in connection with the case. she now has everything she needs to make the decision. she's got the fbi report the sheriff's report. she's already got funding to extend her investigation and potentially prosecution. so you would think we should be hearing at any moment about a possible prosecution. >> you don't do all that unless you plan to file criminal charges, right? >> i think it's unlikely at this point that there won't be a prosecution because the d.a. has asked for this additional funding. if the d.a. hadn't asked for that additional funding, i might not be saying that. >> all right, always appreciate your insight. >> thank you. >> it's helpful. coming up later, one of the topics that resonated with many viewers after my interview with

near the center of uva's grounds at around 10:00. after those gunshots were reported last night at 10:30 the university is now on a lockdown, actually on a shelter in place because of the manhunt that's under way for jones. he may be driving a black suv with a virginia license place. we also know that jones the alleged suspect is a former university of virginia football player that's based on a roster from 2018, a player bio also mentioned that jones, the alleged suspect is a member of the national honor society, again he's described as a black male wearing a burgundy jacket with blue jeans, red shoes and so right now, there's an increased police presence from authorities here on the grounds of uva as that manhunt continues. george. >> scary situation. okay, alex, thanks very much now the latest on the midterm elections. democrats have kept control of the senate after that win over the weekend in nevada, but control of the house still very much up in the air. so let's go back to our

congressional correspondent rachel scott there on capitol hill for us. good morning, again, rachel. >> reporter: robin, good morning to you, nevada was the final blow for republicans' chances for taking the senate, democratic incumbent senator catherine cortez masto winning re-election defeating republican adam laxalt. this was one of the tightest races in the country, and her victory securing the democratic majority in the senate. here's where things stand as of this morning. democrats have 50 seats in the senate with te opportunity to pick up one more in georgia's runoff elections in just a few weeks. the house still up for grabs. there are 18 races that have not been called yet. republicans need to pick up seven of those in order to clinch the majority. it would still be a narrow victory, and far from the red wave that they were hoping for, but even president biden has acknowledged at this point it would be a stretch for democrats to hold onto the house. t.j.? >> rachel, thank you as always. we want to mention this overnight "the lion king" celebrated 25 years on the bright lights of broadway, the show opened back in 1997. it won six tony awards,

that's not to say we didn't hope it would be successful. it's certainly surpassed any of our expectations. >> a great crew and a great stuff. what's the magic sauce in there that has this show resonating with viewers all these years? >> i feel like my character has always been a hopeful character and i feel as times in the last six seasons, six years have been somewhat divisive i feel sean is a character who can bring people together and celebrating the diversity on the show we hopefully been able to, you know, figure out that we're all more the same than different and bring people together. >> you talk about that neurodiversity, your character you play there has autism, people who come up on the streets, what do they say to you about that particular element of your character? >> reactions from people who have had autism or who are in the community, family members of
