ama: it's been 10 days since the election and we still don't know who will be the next mayor of oakland. in an update this evening, one of the candidates grab the lead for the first time. good evening. dan: loren taylor had held the lead since election night but zhang tao has been closing the gap. she took the lead for the first time by the slimmest of margins, under 700 rank-choice voting. guess what. it is still not over. it appears pamela price is going to win the alameda county district attorney's race. she's ahead by 27,000 votes. there are roughly 4500 votes left to be counted. tara campbell is on top of all of this for us. reporter: a somewhat surprising turn in the race for oakland zoo mayor. the city councilwoman taking over the lead from lauren taylor. what looks to be a possible

victory for tao. the county registrar releasing new numbers like this evening showing tao pulling ahead in rank-choice voting while taylor holds the lead in total first choice votes. as we know, it's the range troy system that will determine the next mayor. it's the first time tao has taken the lead in the 10 days since the election. towns team sending us the following statement reading, it's been a long week and a half and we've been humbled to watch the results shift in our favor with each passing day. we've taken the lead with very few votes left account. we are optimistic that our lead will hold and that shane cow be the next mayor of oakland. in the race for alameda county district attorney, civil rights attorney pamela price is declaring victory over terry wiley. in the past 10 minutes, he conceded the race and congratulated price.

this race putting a black person in the alameda county das office for the first time. price also releasing a statement tonight reading in part, tonight's numbers are a confirmation of our victory. we knew this election was going to be an exclamation point in history for alameda county. the registrar's office said earlier this week, they were aiming to have both races tallied by the weekend. clearly, there is still some uncertainty out there. telling abc7news, they will be looking closely at their process in hopes of improving it for upcoming elections. ama: thank you. in a san jose federal courthouse today, elizabeth holmes was sentenced to 135 months in prison for diff robbing investors in her blood testing company. it was despite more than 130 personal letters sent to the judge in support of her. here's a melding -- amanda del castillo you with more on what's

next. reporter: once the face of promise and potential, elizabeth holmes was sentenced friday to 11 years in prison. not the max but far from the minimum. homes was convicted in january on four counts of defrauding investors while running her failed blood testing startup. legal analyst stephen clark. >> the only good thing that happened for her today was that she left the courtroom not in handcuffs. reporter: witnesses report seeing her running from court, hand-in-hand with her partner. this executive director of the markkula center for applied ethics says the judge sentenced sends a clear message to silicon valley. you can craft the best pitch for your product but it better be true. >> in this case, she is going to suffer the consequences of many bad decisions. reporter: three years of

supervision following her eventual release from prison. restitution has not yet been decided but prosecutors wanted homes to pay $804 million, money that would cover most of the $1 billion raised from investors. >> investors would like to believe this is a one-off that could never happen again. yet there's a pattern. reporter: in court friday, holmes took the stand in tears after hearing testimony. courtroom sketches depict the moment she describes taking full responsibility for the company's failures. >> the court took into consideration her pregnancy. not so much in the sentencing but in the fact he allowed her to stay out to have her child and gave her time to bond with this child. reporter: she must surrender on april 27, 2023. she suspected to appeal. >> her conviction ultimately was about the investors.

there are also all the employees, many of whom weren't in a position to know that it was a fraud. where's the justice for them? reporter: abc7news. dan: some remaining twitter employees reportedly summoned back into the office today by elon musk. musk only asked for coders and employees who write software to show up at headquarters. this comes as data suggests as many as 1200 employees may have resigned. musk told employees he would be at twitter headquarters until midnight and back tomorrow morning. >> he cut the staff in half. it seems as though a lot more have walked out the door since. he has to make sure that things are running exactly the way he needs them to. dan: a group of senate democrats including san francisco's dianne feinstein sent a letter demanding the federal trade commission investigate witter security and take necessary action for any breaches of business practices that are

unfair or deceptive. ama: one of the victims of a school shooting has died. it's been six weeks since the shooting at king estates, a campus that houses several schools. david zacharia was a carpenter for oakland unified school district and had been hospitalized since the day of the shooting. he died yesterday. students and staff remember david as a valued employee who was always willing to have. -- help. david installed the school's pa system which played a role in student safety the day of the shooting. >> he was a very friendly, kind, respectful, gentle human being who lent a hand. ama: david told a cold worker -- coworker he was looking forward to retiring someday. police haven't made any arrests. the contra costa coroner's office has released the identities of the five people involved in a wrong way crash on highway four. this is the scene of the crash early thursday morning. the victims are a 27-year-old, a

nine-year-old, a five-year-old, a four-year-old, and a 44-year-old. all five died upon impact. it's unclear why tucker was driving in the wrong direction. police are still investigating. dan: health care leaders are worried tonight as the number of rsv infections among young children continues to rise. the american academy of pediatrics asked the federal government for formal emergency declaration. both organizations say they are seeing a surge in pediatric respiratory illnesses including rsv and the flu. >> the reality is we are seeing this early, high surge of rsv as well as other respiratory illnesses. i think the worry is, we don't know how high the number will climb. is this the beginning of the surge or are we about to peak? dan: a spokesperson for the u.s.

department of health and human services responded to today's plea, saying they are helping communities most in need. more than three quarters of pediatric hospital beds are now in use nationwide. ama: u.s. attorney merrick garland has officially named a special counsel to oversee the justice department's investigation into the presence of classified records at former president trump's mar-a-lago estate. here's abc news reporter and when. reporter: jack smith officially named the special counsel by attorney general merrick garland to oversee the criminal investigation surrounding former president donald trump. the doj calling him a political independent. smith began his career 28 years ago at the new york county district attorney's office. most recently serving as the chief prosecutor for the special court in the hague investigating war crimes. his announcement comes days after trump officially declared his 2024 bid for the white

dan: governor newsom is releasing $1 billion for state homelessness funding that he withheld earlier this month. the funds were paused into local governments agreed to bolster plans to reduce the number of one house people on the streets. some of the agreements include methods to help people get into housing and ways to build housing for poor households. the newsom administration is launching investigations and filing lawsuits against cities that resist. ama: new developments on high-profile schools pulling out of the u.s. news and world reports ranking. stanford announced its law school would no longer participate in the rankings. this follows the announcements by uc berkeley, harvard, and yale. the dean agreed with many of the equity concerns brought up by the other schools. two other law schools also pulled out today, georgetown university and washington, d.c. columbia has joined the list of ivy league schools boycotting
