t to the xfinity black friday sale. click, call or visit a store today. >> building a better bay area. moving forward. finding solutions. this is abc7 news. >> the armed assailant who has been struck gunfire turns and fires back in mr. williams' direction, striking him, with what ultimately will be a fatal gunshot. dan: that armed assailant is not being charged with murder and today contra costa county prosecutors cited state law, saying their hands are tied. thank you for joining us. ana: deadly armed robbery happened last saturday. dan: today we were there as prosecutors explained why murder charges are not being filed. reporter: the suspect who allegedly fatally shot a store clerk after an armed robbery at this chevron gas station in

antioch will not be charged with murder. >> when the imminent threat of harm to one's life has dissipated, the victim of a time under the law cannot then use deadly force to attempt to reclaim that property. reporter: last saturday, antioch police got a 911 call after 2 a.m. about the robbery. when they arrived on scene, they found the 36-year-old, james williams, fatally shot. it's what williams did before he was shot that may determine the charges filed by the contra costa county district attorney's office. >> the specific facts of that robbery and subsequent gunfire exemplify an important legal distinction. reporter: the das office as surveillance footage shows williams was robbed at gunpoint. the suspects took off on foot. williams then gets a gun and chases after them. they got about 100 feet away, when williams fires first.

he hit 19-year-old ronald jackson in the leg. jackson allegedly returned fire, which ultimately killed williams. >> technically when you commit a robbery, the robbery is not over until you reach a place of safety. and the robbers hadn't at this time. but the analysis is, now they are under a deadly attack. one such attack was not legally justified. reporter: the deputy says they considered all possible scenarios. but because williams chased after the suspects with a firearm, at that point in the eyes of the law, it is no longer self-defense. >> there's really no reasonable interpretation of these events that would suggest that mr. jackson had been in the store under any sort of a threat from these individuals were clearly running away and gained quite a distance. reporter: without elaborating, it is illegal to possess a gun within a business, but it was

not legal for williams to have a gun. jackson could face up to 15 years behind bars. the second suspect is still at large. >> more than a dozen cars this afternoon were smashed and several people were injured when a bus driver lost control on the south side of the target parking lot at sarah monty center. our reporter is on the scene and joins us with details about the possible cause of the crash. what's the latest? reporter: it is a shocking scene here, after a bus crashed into multiple vehicles at the sarah monty shopping center here in daly city. we know at least one person is in critical condition. a dramatic scene at the sarah monte shopping center in daly city. es paula was making a left turn, when the bus unexpectedly crashed into her. >> i was waiting for the light.

i was in shock. i was just over there, and it was scary. reporter: paula said her car was dragged several feet before the bus driver kept driving and crashing through the bushes and into the parking lot. did you see the driver? >> it was a woman. a woman driver. reporter: did she seem ok? >> yes, she seemed ok. the bus -- she was driving faster. reporter: lisa was shopping inside target. when she came out, she noticed her car was one of the first ones hit. >> i was shopping at target and came out and saw my car totaled, and four or five rows over from where i left it parked. then all of a sudden i noticed other cars were totaled. reporter: four people were taken

to s.f. general, one in critical condition. they are working with authorities to investigate the cause of the collision. san trans confirmed there were multiple passengers inside the bus. marilyn saw the aftermath. >> without it was just a regular accident, you know -- we thought it was just a regular accident, you know? then we saw. it was so shocking. reporter: authorities are investigating the cause of this crash. one possibility is brake failure. in daly city, luz pena, abc7 news. >> thanks very much. let's turn now to storm watch as we get ready for the next round of rain to return here to the bay area. our meteorologist is here with round 2. meteorologist: that's right. it was frosty this morning. we had 26 in livermore and san jose. with increasing clouds out ahead of the snack system, but still a

killing of rapper take off, i suspect has been arrested and charged with murder, the 20-year-old rpper -- rapper was killed during a shootout after an event at a boating alley -- at a bowling alley. take off was the youngest member of the popular rap group migos. dan: when elon musk took over twitter, he promised to clean up hate speech on social media, but with the firing of key moderation specialists, there's actually more hate speech on the platform than before. dustin dorsey has the story. reporter: old issues can often open new wounds. hate directed toward the african-american community is nothing new for the reverent, but how easily it cannot be spread on social media is troubling. >> what this speech does is not just attack those

disenfranchised groups. it attacks america. and again, it is not something that is just happening. but what it is going to do is incite even more. reporter: what began as a platform for information and entertainment, social media has devolved into a place where meanness and hate can't drive. in your report shows the most egregious hate speech targeting african-americans, the jewish and lgbtq communities has risen dramatically on twitter since musk bought the company. >> what he did was open the gates to hell and the low back and all those people that spread hateful rhetoric. then said, people can get away with whatever they want because my platform is going to tolerate the intolerable. reporter: the numbers found tell that story. slurs against black americans are up from 1000 to 82 tweets 3876. slurs against gay men before musk --

and after -- 3964. antisemitic tweets -- up 61% on an average daily basis. san jose state university associate professor of public relations matt cabot says free speech should be protected but hate has its limits. >> musk is a free speech absolutist. he's being tested at this point on that principle. reporter: he stands from that hateful impressions on twitter are down and the professor says he's shown signs of walking back his free-speech ideals, like suspending ye for antisemitic messages. >> he has decimated the teams that were doing this before. i think what he realizes now is that he needs those people back in order to moderate that content. reporter: if not, there could be greater consequences. the district attorney's office told us it will take action to stop hate speech online next week. dustin dorsey, abc7 news.

ana: the house is expected to pass the respect for marriage act. today san francisco's historic role in paving the way was recognized. but the threat of overturning the law still remains. reporter: officiating a union between two women was a symbolic act for senator alex padilla. nearly 19 years ago, the first marriages between same-sex couples at san francisco city hall set off a crusade that this week led the u.s. senate to pass the respect for marriage act. >> it's not lost on me where we gather today. it is very intentional, in fact. in a city known for not just tolerance, but love. reporter: in 2015, the u.s. supreme court ruled that same-sex couples have a fundamental right to marriage in all states. the most recent respect for marriage act would protect couples on a federal level.

but if the more conservative supreme court were to overturn the right of same-sex couples to marry, anyone could bring forward a new challenge, citing the 2008 california voter approved proposition 8 that bann -- california voter approved proposition 8 that banned same-sex marriages, which by the way, is still in the state's constitution, despite the courts ruling it unconstitutional. >> we would have more litigation about whether prop 8 could be enforced, as sort of a zombie amendment come back to life. reporter: there is a way to remove it from the state constitution. >> once the voters put prop 8 into the california constitution, it stays there on the books until the people take it out. reporter: karen strauss and ruth b. were the plaintiff's that challenged prop 8 before the california supreme court and won. >> i leave it to the political pundits and the people who really know these issues inside and out as to what is the right

complains about his conduct has been made -- had been made for years. the report was commissioned by the university in april of 2021. an independent investigator looked into investigations done 2009 and 2010. the key findings of the report were released this week. the investigator listed four main bullet points. including the 2009-2010 investigation report was inadequate and they failed to properly respond to complaints subsequent reports between 2010 and 2018 that that investigation was not adequate. they also from the university failed to adequately respond to other evidence of misconduct allegations against him and to police reports filed were not adequately investigated. the school sent a statement saying in part we are committed to further improvements that create a safer, healthier campus environment for students and staff. we remain grateful to the

student athletes and others who shared their painful stories and the work by various parties to bring information forward. >> those are all pretty words, and it's nice that those are being said. but we want to see action. reporter: carly is with the san jose campus group students again sexual assault, calling for the university to better staff and rhonda's title ix office. they are frustrated with the findings of the investigation but not surprised. >> suggesting we are in a place of, how do we move forward now that we have this official information? >> their hope is the report's findings will bring change in how victims of sexual assault are supported. >> we are hopeful this will bring more attention and will be more ground for us to stand on to keep advocating for title ix improvements and safer campus communities for all our students and faculty. reporter: abc7 news. dan: the roman catholic diocese of santa rosa plans to declare bankruptcy ahead of the first clergy sex abuse trials. the diocese says it made the

more. we are going to get some more beneficial rain. we shouldn't see any ponding or flooding issues. it was cold this morning. how about 26 livermore, gilroy, it was 25 in santa rosa, and in the 30's on the peninsula. we have a chilly air mass overhead. a system streaming in from the south. a system to the north and west. both of these systems will visit us over the weekend. here's the first one increasing the clouds. we still have our freeze warning for interior valleys in the north bay. also around the south bay here. with some cloud cover, temperatures are going to drop -- are not going to drop as much as they did this morning. we are jumping into the 40's in santa rosa, 44 danville. beautiful view here from the peak with the setting sun. freezing again tonight in the valleys. a rainy and chilly saturday. this is the rainiest day. sunday will be better. the niners game looks to be dry.

snow, coming to the sierra again. if you're heading out of town, sfo, 40's, 50's in the afternoon. that is cold, conditions also in new zealand. heading up to new york city, rainy and in the 50's. chicago, 47. dry in los angeles tomorrow. rain moves into socal sunday. overnight lows, 30's and 40's. certainly the possibility of some black ice here. you can see we are getting into the rain, some spotty showers after midnight. late tonight, you can see the cloud cover. stopping this 11:00 a.m. tomorrow. we've got the ring first -- rain first on the peninsula. the north bay will have to wait a minute before they get into the rain. it pushes through by late in the evening. then we are looking at the next system coming in from the north. early sunday, some rain, some cold rain. you can see about noontime, some very light returns.

by monday, this is the system that lingers into monday. the sunday system is weaker, but does linger into monday. these are the two day rainfall totals. saturday and sunday, a third of an inch. the city, half-inch, on the peninsula, upwards of over an inch santa rosa, the winter storm warning taking us through early saturday into monday. the snow levels are going to start off high then lower until sunday. a foot to two feet, possibly three feet. very gusty winds. only low 50's tomorrow. we dry out into next week, but we wanted rain. here it is. ana: we like it. keep it coming. tahoe is forever changed. but there is an era of excitement and a buzz as they prepare to reopen for the first time since the caldor fire roared through here in august of 2021. we were here as the fire grew in the distance. smoke filled the air and cell service was wiped out. crew worked hard to protect the result. things -- the resort buildings and infrastructure. most of them survived. but many of the old pine groves that made sierra tahoe so iconic were destroyed. it's taken months of hard work to reach this moment, since the communications manager. >> the caldor fire was really devastating, when it came in last year. sierra is a locals' choice here in tahoe. a place people call home for many generations. learning how to ski, progressing their skills. it was really hard, when
