observatory atop mount hamilton in santa clara county. it rained for most of the day but as temperatures dropped yesterday afternoon, the rain turned to snow and stuck around overnight. now's the time to head to the sierra if you want to enjoy the snow. four cameras show us the conditions. truckers have to put on chains on 80 but highway 50 has no requirements or restrictions for drivers. what kind of cold weather is in the days ahead? dan: that's the key question. lisa argent is here with the answer. lisa: we are getting into our next system as soon as the overnight hours. freeze warning in effect for the interior north bay valleys. around the east foothills, the clouds are going to increase. that will allow for temperatures not quite as cold. today and tomorrow, a level 1.

rainy weather coming. how are you keeping warm? >> i stay underneath my blankets and bundle up. >> it's an all hands on deck effort. reporter: the rain and cold prompting marin county to activate this emergency shelter at the marin and health -- health and wellness campus. officials say there's room for 60 people and everyone gets a hot meal. >> it allows us the opportunity to open up emergency space, especially for those who might be medically vulnerable, most impacted by the cold temperatures and wet weather. reporter: santa rosa opening this downtown warming center. >> people can come in and warm up, charge devices, have a drink and a snack. a place to be overnight. reporter: the need for shelter has never been greater. officials estimate there's about 2800 on house people in sonoma county alone.

that number continues to increase. >> countywide, we saw an increase in homelessness comparing our last count in 2022 the recent homeless count. 5% increase countywide. in santa rosa, 13% increase. reporter: outreach efforts continue for the on housed with food and coats available. >> everybody in the bay area is happy for rain. we know we need rain. at the same time, to be living on the streets, this is the weather where people can't stay warm. it can affect your physical -- physical and mental health. we want to have compassion for people living on the streets right now. reporter: teams are providing free transportation here for those who want it. this shelter and the warming center at santa rosa will be open through saturday morning. abc7news. ama: you can check the forecast anytime and access live doppler 7 on through our abc 7 bay area streaming tv app. dan: for people hurt today in a

dramatic crash involving a bus in daly city. it happened shortly before noon. the bus crashed into 16 vehicles and a number of shopping carts. one driver says the bus hit her car as she was waiting to leave the lot and dragged it several feet. the bus crashed into more vehicles near the target store. >> i was in shock. i was just over there. >> i was shopping in target and came out and found my car totaled. maybe like four or five rows over where i left it parked. ama: the supervisor says the bus driver told police the brakes failed. two victims are still hospitalized. ama: no murder charges filed in a robbery that killed a gas station clerk in antioch. how the district attorney's office determination. reporter: the suspect who

allegedly shot a store clerk after an armed robbery at the chevron gas station will not be charged with murder. >> when the imminent threat of harm to one's life has dissipated, the victim of up -- a property crime cannot then use deadly force to attempt to reclaim that property. reporter: antioch police got a 911 call after 2:00 about the robbery. when they arrived on scene, they found a 36-year-old who was fatally shot. it's what williams did before he was shot that may determine the charges filed by the contra costa county district attorney's office. >> the specific facts of that robbery and subsequent gunfire exemplify an important legal distinction. >> surveillance footage shows williams was robbed at gunpoint. the suspects took off on foot.

williams then gets the gun and chases after them. they get about 100 feet away when williams fires first. he hit 19-year-old ronald jackson in the leg. jackson allegedly returned fire which ultimately killed williams. >> technically when you commit a robbery, it's not over until you reach a place of safety. the robbers hadn't at this time. but the analysis is, now they are under a deadly attack. when such attack was not legally justified. the deputy da says they considered all possible scenarios. because williams chased after the suspects with a firearm, at that point in the eyes of the law, it's no longer self-defense. >> there is no reasonable interpretation of these events that would suggest that mr. jackson had been in the store, was under any sort of a threat from these individuals who were clearly running away and gained

quite a distance. reporter: he says it's illegal to possess a gun within a business. it was not legal for williams to have a gun. jackson could face up to 15 years behind bars. the second suspect is still at large. abc7news. dan: san francisco is reporting the city's first flu death of the season. the department of public health says the person was an adult under the age of six to five who was not vaccinated and had pre-existing medical conditions. this comes as the cdc reports for -- flu-related hospitalizations have doubled this week. ama: the oakland mayor elect joined gma three today to talk about her historic victory. karina nova joins us live in the newsroom with what this means in oakland and american history. reporter: she will be sworn in as oakland's mayor in january, becoming the first mong mayor of a major u.s. city. the mother of two and youngest mayor of oakland in 75 years

spoke to gma three about winning the election. >> i will be honest. it hasn't set in. my parents are so thrilled. the community is so thrilled. i couldn't have been able to do this kind of work or fundraiser or be successful without my parents. reporter: one of her first priorities is to tackle homelessness in oakland. it's an issue close to her heart after she experienced homelessness herself when she escaped domestic violence. >> we slept in our cars, couch surf. when we talk about are on house community, we are not talking about those who are coat -- couch surfing, who are sleeping on their friends homes, going from home to home. we have to do multiple different things. that is to prevent homelessness from happening first, build more deeply affordable housing. that is something that i'm charging my leadership in. creating that deeply affordable housing and mixed used income as

well. reporter: that real-life experience is why she ran for office. >> i don't have the same kind of insight as a politician. that's what i bring. that fresh energy. a fresh new look with my life experience. not just that. for one reason or another, maybe it's because i grew up in a family with 10 kids, but i'm able to bring people together. reporter: she said that she recognizes that she won by less than 700 votes. she says she will take the next four years as an opportunity to show those who did and didn't vote for her the difference she can make in oakland. abc7news. ama: thank you. dan: years of complaints at san jose state lead to an investigation and our report about how well that investigation was handled. a look at the shortcomings. ama: five years since single use plastic bags were banned in california stores. coming up, look at the next step

are getting their refunds on debit cards. many are saying it looks like a scam. ama: others say it puts their personal information at risk. reporter: they are wary because they have to enter six digits of their social security number in order to activate the card. that sets up an account at a new york bank as well as getting the car going. the card companies in wisconsin, the customer services in georgia. so who exactly has your information and what's happening to it? >> what do i do with this card? reporter: al got his new middle-class tax refund loaded on a debit card. but he refused to activate it. >> it tells you to call this number and give away six digits of your social security number. reporter: he says a scammer could use those six digits to steal his identity. >> even a cave person could figure out how to do that. that's unsafe. reporter: it automatically opens

an account at new york community bank. that sent this notice saying it does share information. >> they are going to get our purchasing history as we use these cards. this is all big business. who made the decision? they couldn't find a decent bank in california? reporter: they are paying $25 million to money network of wisconsin to provide debit cards for up to 13 million californians. the new york bank issues the cards with customer service in georgia. >> we don't know where this information and purchasing behavior is going to end up. reporter: he vowed not to provide the six digits of his social security number. however, he was shocked when he pointed out the companies already had his social security number. they also had his name, address, and refund amount. >> how did they get all that personal information? reporter: the sta o california turned over data for millions of californians so the

companies could issue the cards and mail them out. >> my government? reporter: money network requires you to punch in six digits to verify you are the real cardholder. not a scam. >> this thing is absolutely a bonfire. who authorized this? reporter: the franchise tax board says debit cards are the fastest way to send money to millions of residents. checks could take six months longer. as for privacy concerns? the companies will not use your personal information for marketing purposes despite the standard privacy notice saying new york bank can share it. al took no chances, he called money network with canceled his card and is sending a check. >> tell them, you are not a robot and you are not a more on. you want a paper check. reporter: and that's in the fine print of the contract. all the information you need. you can call money network to cancel the card and it will send

you a check. it takes a few weeks to get it but if you have issues with your debit card, let me know about it. you can contact me. read the fine print. nobody does. who has time for that? dan: it gets finer and finer all the time. ama: berkeley city officials are celebrating an upcoming change to rules regarding plastic bag use. they are calling it the better berkeley bagman. they supported the council vote in favor of the ban. it fixes a loophole in alameda county's general plastic bag ban which stores can circumvent by using thicker bags that are reusable but not compostable. plastic produce bags will also be prohibited in berkeley. students from cowper organize support for more than 4000 berkeley residents and 40 small businesses for the passage of the ordinance. >> americans are throwing away 100 million plastic bags.

all that trash poer: the ordinance takeserair. effect on january 1. dan: let's turn our attention back to more cold and rainy weather coming. ama: lisa argent is here with the latest. lisa: winter started yesterday and we are off to a good start with more rain, beneficial rain. rain is going to add up along the central coast, around monterey. they could be looking at significant rain. this system moving in from the south is a weak atmospheric rather -- river. systems in the south are slightly warmer. we will look at fluctuating snow level, starting out pretty high. the second system to arrive sunday is a colder one from the north. we will get significant snow but starting out with a little bit of rain snow mix in the mountains tomorrow.

47 in hayward right now. it's a chilly 44 in santa rosa. the clouds are increasing already so i think temperatures aren't going to drop as low as they did yesterday. we still have a freeze warning in effect for the northzing aga. looking at a rainy and chilly saturday. high temperatures not getting out of the 40's. anywhere from one to three feet of snow in the mountains. we were in the 20's and the north bay, even in the south and east bay. we could add on another five to 10 degrees with the cloud cover. it's definitely going to be slick out there if you want to sleep in or wait a little bit. it's a good idea for your saturday as the rain is going to come in pretty quick from the south into the south bay under saturday morning. scattered showers, less rain on sunday. two inches for your saturday sunday totals. the second system will linger into monday. there's a look at early saturday

morning. light rain from san jose moving into the east bay. as we stop this at 11:00, the rain is getting more steady from the peninsula. over into oakland and berkeley. the north bay, not yet. as we get through the afternoon hours, it pushes off to the east and south and we will be looking at a few scattered showers overnight into sunday. there's that line while you are sleeping. here comes the next system into monday. so we are looking at a few more scattered showers. the niners game so looks ok. the rain should move out beforehand and then this is what lingers into monday. we have three days of level 1 systems on the way. rainfall saturday and sunday. a third of an inch for san francisco, half an inch in napa. three quarters of an inch in the san ramon valley. east and south bay. ben moment, over an inch of rain. here's our winter storm warning early tomorrow through early monday. very treacherous travel.

rolling dice, playing a hand of poker. reporter: coin toss. >> yeah. it is surreal. reporter: election officials recounted all the votes by hand to be sure. both candidates for the richmond city council race received 1921 voids -- votes. now it goes to a tiebreaker. >> 1921 votes. reporter: what are the odds that it ended in a tie? >> it's crazy. reporter: the city clerk will conduct a tiebreaker, possibly next week. >> we put our names into a green envelope. it will be sealed and we put it into a bag. we each have an opportunity to shake the bag. the city clerk draws one envelope and opens it and that would be the winner. reporter: both candidates have a good sense of humor. >> i was saying, we should raise. running a race for this campaign. we should do a quick race. maybe a dance off or something like that. that would go down in the

dan: when elon musk took over twitter, he promised he would clean up hatred on social media. so has he? by firing key people, musk has opened up the door tomorrow hate speech on the platforms and before. ama: dustin dorsey takes a look at the statistics. reporter: old issues can often open new wounds. hate directed towards the african-american community is nothing new for this reverend. how easily it can now be spread on social media is troubling. >> what the speech does is not just attack those disenfranchised groups. it attacks america. again, it's not something that is just happening. but what it's going to do is insight even more. reporter: what began as a

platform for new report shows the most egregious hate speech targeting african-americans the jewish and lgbtq communities has risen dramatically on twitter since musk bought the company in reality what he did was open the gates to hell and allow back in all those people that spread hateful rhetoric and then put at the bat signal and say, you know what people can get away with whatever they want because my platform is gonna tolerate the intolerable the numbers the center for countering digital hate found tell that story for average daily tweets slurs against black americans are up from 1,282 tweets to 3,876 slurs against gay men before musk 2,5006 tweets and after 3,964 tweets anti-semitic tweets up 61% on an average daily basis, san jose state university associate professor of public relations. matt cabot says free speech should be protected but hate has its limits musk is a free speech

abc 7 news at 6. again. our america lowball is the culmination of all that reporting on appraisal discrimination in the home appraisal process and now this documentary elevating the stories from the bay area in all across the country to affect true change. in a couple days. i got the appraisal report back. that was right. the only thing bringing down the value of my own was me. my wife went through her bathroom get rid of her hair products. all of our books in our art, i just literally like, okay do we miss something? that's not what you call regulation. that's not what you call oversight. that's not of course what you call fairness. julian you were reporting in this special really covers so much ground here and the findings are really deserve it. so making headlines. yeah, and not just about the disparities in home appraisals, but also the lack of diversity in the appraisal profession that plays a huge role really in how

we build wealth in the country. so you talk to us a little bit about that. this was so shocking to find out that the appraisal profession is perhaps one of the least diverse professions in the entire country. we're talking about 96% white 70% male obviously looks nothing like the country, so they're really so few people of color. so if you women and so if you women of color in this industry, and i also want to share another clip for you here of our america low ball that shows what some appraisers are saying. these are people in positions of power when they think no one else is watching check it out. we found out that appraisers definitely are not shy when it comes to sharing their views about the race of the folks that live in the neighborhoods that they're appraising. we're talking about comments appraisers made in private facebook groups with thousands of members each one of the members she screenshots with us. so these groups date back many years. i'm looking at a comment right here from 2016.

it says who's brilliant idea. was it to schedule six inspections in south atlanta in the ghetto on saturday morning, whoever it was they need to be fired. this one says don't make eye contact with the natives and i hope you're wearing the right colors, whatever that means another guy writes under their comment says dang man. i usually make sure i do my hood inspections before 11 am the boys still sleeping, so i don't need to put a cap in their blank and then that guy follows up with another comment because he had to beat the one he just commented before that says we're a priest guard with the collar usually works except in the isis areas. oops, they even mentioned my own reporting one appraisal rights. i'm not suggesting this but if abc7 and julian glover keep coming up with unsupported allegations, the black community in america is very likely to face some form of shadow boycotting and maybe this is the result of my reporting another appraisal right one general

to take action. it's heartbreaking. really is. people's lives and it is you point out in this document. it's cost. millions and millions of dollars in equity perhaps even billions of dollars all across the country. wait, julian you always do great work, but this is remarkable work that you've done. we appreciate good job. thank you. thank you. well, we hope that you can watch our america low bald. you can do it starting today find it on hulu and wherever you stream. all right, let's move on, but make sure you watch that documentary jury deliberations have started in the trial of disgraced hollywood producer harvey weinstein. he faces seven charges of rape and sexual assault here in california, the trial included weeks of emotional testimony from a number of women including our state's first partner, jennifer siebel newsome. weinstein was convicted on similar charges in new york, of course in 2020. he served two years of his 23 year prison sentence an investigation into san jose state university and allegations of sexual misconduct against a

former head athletic trainer has now been completed abc 7 news reporter zach fuentes explains it found the school failed to properly support. students who came forward for years dozens of san jose state students had made complaints about former head athletic trainer and director of sports medicine scott shaw. he was charged in early march with civil rights violations by the department of justice but complaints about shah's conduct had been made for years. this report was commissioned by the university in april of 2021 an independent investigator looked into investigations that were done in 2009 in 2010 investigations conducted to look into complaints made against shaw at the time the key findings of the report were released this week the investigator listed four main bullet points, including that the 2009-2010 investigation in report pertaining. the shah's alleged misconduct was inadequate and that sjsu failed to properly respond to complaints subsequent reports between 2010 and 2018 that the 2009-2010 investigation was inadequate. they also found that the

university failed to adequately respond to other evidence of misconduct allegations again, shaw and that two police reports filed. we're not adequately investigated. we reached out to san jose state who statement saying in part we are committed to further improvements that create a safer healthier campus environment for our students and staff. we remain grateful to the student athletes and others who share their painful stories and the work by various parties to bring information forward. those are all pretty words and you know, it's nice that those are being said, but we want to see action carly ecock is with the san jose campus group students against sexual assault who has been calling for the university to better staff and run. it's title nine office. she says they're extremely frustrated with the findings of the investigation but not surprised how it suggests. we're in a place of like, how do we move forward now that we have this like official information for now their hope is that the reports findings will bring change in how victims of sexual assaults are supported where hopeful that this will bring more attention and will be more grounds for us to stand on to
