right now. it is picking up and causing traffic to have some slowdowns. it is a pretty good indicator that traffic will be slow through everyone's commute into the city. the rain putting a damper on some holiday activities in the north bay. the weather luckily held out. there was a difficult choice to postpone the parade of lights because of the rain. >> we are trying to get this amazing parade going and we have to wait well, we waited two years. reporter: back live, plaza, we

controversial plan to allow police robots to use lethal force in certain cases. the supervisors as last week's vote was not legal. he cites a provision that requires 30 days of notice before any hearing is held on military equipment. the proposal was added to the website just three days before it was presented. preston was one of three supervisors who voted against the proposal. kumasi: addressing high gas prices in california. calling on lawmakers to institute a penalty. gas prices in the biggest cities are down significantly. the average price is $44 again

it's how it brings us together. kumasi: new details on the murder of a chevron gas station were. his family is now getting. james williams died after an armed robbery at the chevron. >> he was trying to do so good. we were going to get married and everything. reporter: everything changed for her family after she received word that her fiance was killed following the robbery of the gas station he worked at. last saturday, he was working the overnight shift when he was robbed at gunpoint.

surveillance footage shows that after the suspects took off on foot, he chased after them. he fired first, hitting a suspect identified as ronald jackson. he allegedly returned fire, which ultimately killed williams. it's >> they went into his story and did that while he was on the clock. that is not ok. reporter: the eyes of the law, they say it was no longer self-defense and the suspect will not be charged with murder. >> the robbers had not met a place of safety at the time, but the analysis is that now they are under a deadly attack when such an attack was not legally justified.

reporter: as she sits with her newborn on her lap, she is reminded that her daughter will never know her father. they are not happy that anybody got shot, but they still believe he acted in self-defense. >> he was protecting himself. who knows if they would have come back in there the next day and brought them again? reporter: given the fact that williams was killed, they will seek greater penalties at sentencing. reggie: nearly 2000 people are displaced after a volcanic eruption. it spewed thick columns of ash and smoke over the weekend. towns and villages are blanketed with falling ash.

so far, despite all the damage, there have been no report of any debts. kumasi: former president trump is facing criticism for calling for the termination of the constitution. he says he should be reinstated as president after repeating his lies from 2020. some called his words dangerous. >> i thought it was a strange statement, but the republicans will have to decide whether they are going to break from him and return to some semblance of reasonableness or continue to lean into the extremism, not just of trump, but trumpism. suspending the constitution is an extraordinary step. kumasi: trump announced that he would run for president in 2024.

kumasi: a terrifying moment for a girl and her mother that went viral over the weekend. you have to watch it. the girl was waiting outside the home for the school bus when this aggressive raccoon attacked her. the girl is screaming because the animal latched onto her leg. the mother jumped into action. she ran outside, grab the raccoon, trying to separate her daughter and get her back in the house, and then, this raccoon was still on the mother's arm and she finally gets rid of it. not this time. this raccoon, right here. it is holding on for dear life. how scary. locale it just strolled over here. this video shook me.

the rise comes as we are seeing higher rates of covid and rsv. covid hospitalizations nearly doubling in a month. there are three pathogens that are circulating. while hops -- while hospitalizations are up, the number of patients in the icu is down. the biggest threat this holiday season is the flu with only 50% eligible vaccinated against it. >> i think it will influence what happens over the christmas season. these are n95 masks. protect us again pathogens and indoor, crowded places.

advisory in the forecast. we are expecting eight to 12 inches of snow. this is a wet morning. showers through tomorrow morning. tomorrow afternoon is dry. we will keep light rain in the forecast through the weekend. reggie: santa clara county has approved by a drill to dig a tunnel underneath downtown san jose. the board of directors awarded $460 million to secure the tunnel boring machine. that is a big step. the agency is also asking for a grant from the federal government for that project. the goal is to get the project finished by 2024.
