it is available wherever you stream. dan: oakland. a student in custody following a stabbing near a high school. investigators happe say it happn the morning and the victim had multiple stab wounds and was taken to the hospital in oakland please confirm the suspect and victim are juveniles and students at skyline high school. police are still trying to sort out what led up to the attack. ama: county prosecutors and country county contra costa county filed charges today. a 20-year-old that hayworth faces three felony charges, assault likely to produce great bodily injury, mayhem, and making threats. police say he punched an assistant manager in the face several times after she stood up for a boy with special needs being bullied. the worker, a 19-year-old, lost her right, because of the attack. the suspect was arrested on monday and will be arraigned tomorrow. if convicted, he could get 11 years in prison.

dan: a man accused in what police are calling a revenge killing had his hearing postponed today. the 52-year-old faces murder charges in the shooting death in amman last friday, 30 saying he shot the man because he blame the man's a son for the death of his 16-year-old daughter, who was hit and killed by a car following an argument between the two in october. a victim rights group advocate working with the lopez family spoke with reported tonight. >> we are sympathetic to the family, but we are interested law enforcement making sure that the case is resolved and investigated correctly. dan: again, the court appearance today was postponed and there is no word on when lopez will make his first court appearance. ama:

executive was sentenced to nearly 13 years in prison due to his role with fraud in the company. we were in court and now have the details. reporter: after elizabeth holmes was sentenced to 135 months, or just over 11 years in prison for her role in fraud at theranos, today, the former ceo learned his fate. the federal judge made his ruling and sentenced him to 12 years and nine months in prison. his attorney spoke briefly after the sentencing. >> i will not comment on his reaction. we are disappointed with the outcome and respectfully disagree with the outcome and will appeal. >> while he chose not to speak, the u.s. government and defense team argued 39 objections for multiple hours as morning before the sentence came down including enhancements for the amount of victims involved, who was the organizer for fraud at theranos whether there was risk of bodily injury or death due to the fraud, and how much financial loss investors suffered. the jolts openly added enhancements for victim accounts and total loss, claiming the

loss was one who $20 million to investors. stephen clark, legal analyst, says this is a message to silicon valley. >> they got the book thrown at them in the message was if you cross the line into fraud and when you look at the amount of loss here but that is the result today. reporter: with the adjustments, the range of sentence for him was somewhere between 135 months and 168 months in prison. the government argued for at least 180 months. the defense sought probation. they argued that he did not seek fame or fortune from the fraud, but wanted to help people with this technology that he believed could change the world. the defense believed elizabeth holmes should face a harsher sentence due to her role in the but ultimately the ceo received nearly 13 years of punishment after he was found guilty on all counts of wire fraud, conspiracy to commit wire fraud. coopersmith says he does not regret taking the case to represent him. >> he is a good person. he meant well.

i am honored and proud to represent him. reporter: he received a surrender date on march 15 to serve a sentence in 2023. ama: the sentencing lasted almost the entire day. we use the abc 7 alert to send out the news. join now so you know when news breaks. dan: alameda county supervisors considering an ordinance that would set a national standard on housing and remove criminal background checks. it was close to passing last night at the board of supervisors meeting, but the decision has been delayed for now. we are in the newsroom with more on the story and where do we go from here. reporter: after five hours at this hearing, alameda county supervisors will meet again in two weeks for they said they needed to work on the ordinance wording before moving forward.

county could become the first county in the nation to ban landlords from denying houses to form incarcerated individuals. >> once you go to prison you get released, your punishment is supposed to be over with. however, unfortunately, the punishment starts over again. reporter: he served over 30 years in prison, and when he was released, he was unable to find housing due to his criminal history. yesterday he shared his story at the alameda county supervisors meeting. >> the crime i committed 36 years ago had nothing to do with me not paying rent or destroying someone's property. i tried directly to apply for an apartment unit and on the application there was a question that stated, have you been convicted of a felony? and i marked the box yes. two in 2019, student and in nonprofits surveyed un-housed residents and found a

connection between homelessness and the criminal history. >> and found 70% have a criminal record. that supports the lived experience of people. they know that when they apply for housing that the board missed an opportunity last night to take evidence-based public policy action to address homelessness. reporter: on the other hand, the ceo of the east bay rental association says landlord should be allowed to know who is applying for housing. >> having that ability to b able to evaluate and screen tenants, it may be important for an owner or manager to know if someone has a background of child abuse. >> there is a state law going

ama: it is national influenza health week. doctors say the vaccine is standing up to the strain circulating, but many americans are not getting the flu shots. >> hospitalizations are the highest at this time of year in decades. ama: but vaccination rates for flu are lower compared to the same time last year, especially among those most vulnerable.

cdc data shows flu vaccinations are down 12% for pregnant women and rates for seniors are down 3% and flu vaccinations for children are down about 5%. if you have not gotten a flu shot, health officials say it's not too late. getting it now is better than not at all. dan: we keep hearing about this flu, covid, rsv epidemic. at 4:00, i asked our correspondent about an increase in strain on the hospital system. >> if you look at the map on the cdc website that flu-like illness in the country, the entire country is almost red to purple, very high levels and we have not seen a map like that in the past few years. it is usually green. there is a lot of virus out there. fingers crossed that it will peak in some parts of the country, but the next couple weeks could spell more trouble for hospitalizations and whites more important to stay safe and
