we talked to experts about our safest course of action at this point to avoid contracting covid or the flu. it all looks so festive and fun time to reconnect with family and friends. but there is this hanging over our heads. if you're going to be out in public right now, you're going to be encountering these viruses. at least you have a high likelihood of getting infected with them. santa clara county is the first to slip back into a high tier for covid level where the cdc wreck commends wearing a mask in public, alameda, contra costa, solano and napa counties moved to medium tier, which triggers universal masking for jails and homeless shelters. i personally won't go into any indoor building with the public without having a maskthout having a mas.

>> the santa clara county das office filed its complaint last week. now monday, the suspect, 66-year-old mark henry waters, pleaded not guilty. waters is white and the victim is black. for now, he faces more than 20 years of what he is charged with, assault with a semiautomatic firearm. he is also charged with personal infliction of great bodily injury as well as use of a firearm. >> the da says the shooting happened when the 21-year-old victim left and airbnb rental to walk to a grocery store. they say surveillance video shows that as the victim crossed the street, he saw the suspect leave his house and approached him while holding a gun. the suspect's defense attorney did not deny claims that the suspect knew the victim tried to get away. investigators say waters shot him while his back was turned. >> he copper headed end of the victim was running away and shot him anyway. there was nothing that would cause him to fear.

the victim did not step foot at his front door, his driveway, his front yard. >> car was broken into a couple of nights before the shooting at his -- and his garage door openers were stolen. he said waters initially believed the victim could have been one of the suspects and thought the victim was carrying a gun, which later turned out to be headphones. a judge clarified there's no evidence that the victim was in any way connected to the previous crimes. several family members, friends, and neighbors showed up in support of waters. his attorney telling the judge waters had no prior terminal record and is caretaker for his grandchildren. still, the judge ruled that evidence showed waters was too dangerous to be out in public and he was taken back into custody. dan: the santa transportation authority had no

advanced warning a shooter named samuel cassidy was capable of a may 21 mass shooting. vta headquarters with new developments. amanda: despite the shooter's five document in cases of workplace misconduct and fear from another coworker that the shooter could potentially "go postal," vta said an independent investigation uncovered the agency had no advanced knowledge or early warning of that mass shooting. in a detail report -- detailed report released only two hours ago, 47 witnesses were interviewed about the course of the investigation. the report says lone gunman samuel cassidy had unpleasant interactions with coworkers but nothing to signal a workplace shooting. cassidy killed

coworkers at the vta railyard in san jose before shooting himself. addressing questions today about cassidy's history of insubordination and conflict with coworkers. >> we cannot act on what someone thinks somebody might do. there have been several cases here at vta when direct threats were made and appropriate action was taken, but the fact that somebody thinks somebody may do something is insufficient to get a restraining order or take any further actions. >> lawson says the families of the victims were notified ahead of this afternoon's press conference. when asked about the timing of the release, lawson said the vta board was concerned about transparency, wanting to get the information out as quickly as possible. moving forward, lawson says

there have mid -- there have been many changes including a study of workplace culture >> one person is in fire at a san jose apartment complex. check out these flames coming from the second floor of the complex not far from good samaritan hospital. fire officials say the flames damaged two units. the causes under investigation. no word yet on the severity of the person's injuries who was taken to the hospital. the president of the san francisco police commission is up for another turn in april, but there's a push to fast-track her reappointment, which has been drawing criticism from moderates. leanne melinda czink in the newsroom with why this appointment is so controversial -- lyanne

newsroom. lyanne: said there's a conflict of interest because her husband, a lawyer, has represented cases against the san francisco police department, but what bothers some most is that her so-called rush reappointment is a classic example of san francisco politics. cindy elias is one of the longest-serving members of the police commission, twice the san francisco board of supervisors has unanimously supported her. except that one supervisor now has pushed ahead with a vote to have her reappointed. four months before her term expires. >> doing an excellent job and deserves to continue and deserves to have this support of this board of supervisors. >> while this has been done before, the optics and timing in this case are not good.

>> this is just bar it is a simple as that. the current board, which is leaning to the progressive side, is afraid that in the coming months, there may be new members that might not share that loss if he, and they want to preempt the idea of somebody else becoming a critical vote on the police commission. >> let's take a closer look. six months ago, the board had seven progressives. the two new elected supervisors are more to the center, which means there will be six moderates and only five progressives. today, the three members on the rules committee voted on the issue to reappoint elias supervisor rafael nadal men, a moderate, in opposition. actually have somebody that knows and has been through this

process of reform to complete this reform process. >> supervisor peskin said there was no "hanky-panky" involved in his decision and said the new board will be allowed to vote after january 9 when the new term begins but made it clear they would not wait until her term expires in april. so the question now is -- by having the support of the rules committee early on, would this discourage other potential candidates from applying? >> clelia shuts down the conversation on alternatives. >> there are some big issues coming before the commission. should police be allowed to pull people over for a minor infraction? many see this as a civil rights issue. also, should police have robots? and number three, what if chief scott retires? this commission would be interviewing and selecting candidates who are then presented to the mayor.

even right around the bay shoreline, in the mid to upper 30's, so it's going to be a very chilly not just about everywhere. highs tomorrow will not be very high at all. it will be a bright, mainly sunny day with temperatures a little on the cool side. low 50's at the coast and only low to mid 50's anywhere else. here's the accuweather 7-day forecast. we will have chilly mornings as i mentioned tuesday, wednesday, and thursday. more cloudiness will come into the picture, but notice how high temperatures will be on wednesday. that's the range for all of the bay area wednesday and even toward the end of the week, it will not be much milder than that. i mentioned we have a dry spell coming.

>> dustin dorsey explains there are no plans in place to create homes for thousands of people. dustin: this vacant building in north san jose may not look like much now, but it represents much more. city and santa clara county leaders believe a new agreement could turn this place into a solution for our area's housing crisis. >> we hope to build tens of thousands of housing units in north san jose. this step finally makes possible. >> that step was ending a lengthy legal battle of san jose versus neighboring cities in the county that put a halt on new construction because of concerns about traffic. leaders can now getting people and homes first and transportation agreements after. >> we have to make sure that as leaders, we are working closely together to be responsive.

walgreens to address its role in the opioid epidemic. the settlement will resolve allegations that walgreens failed to appropriately oversee the dispensing of opioids at its pharmacies. once finalized, california could receive more than 500 million dollars. he says the money will be used in the state's finance deal related to the epidemic. blow today to tobacco companies that are trying to stop california from enforcing a ban on flavored tobacco products. the supreme court today refused to request a block for the van and did not provide additional comment. voters overwhelmingly approved outlawing flavored tobacco in november. someone randomly attacked a 79-year-old woman on a muni bus. while her attacker is still

together or they are facing a shut off. >> 542,000 pg&e customers received 15-day and disconnection notices. the state legislature and governor approved 1.2 billion dollars in emergency assistance to save those people from losing their gas and electricity. that money will be made available at the end of this year. so far, utilities have held off shutting off people's power. >> because they know that if they do, everyone they should off -- everyone they shut off, they will not get the money for. >> he is from one of the groups advocating for emergency money. he says the reprieve is only temporary. >> but after the money has gone into the customer accounts, that's when we are going to see massive shutoffs by pg&e.

>> building a better bay area includes helping especially during this season of giving and while many are doing what they can, local food banks say they are really struggling. we have a look at the growing need and the effort to try to keep up. >> volunteers flood the warehouse, but for is not just about volunteering. it is also personal. >> growing up, and then you have to deal with not even really knowing what you feed yourself, and you become just not nourished. >> she says there was not always enough to eat while growing up.

even now, some of her family continues to struggle with food insecurity, opening the covered two a can of beans and not anything else. >> a lot of people just don't have to deal with it, and that just blows my mind because to me, people who don't experience that struggle, that's just like, you really lucked out. >> her story is much more common than most may realize. one in five people in the two counties the food bank serves face food insecurity. >> even in the summer months, we were serving an average of 275,000 residents per month. during the holiday season, we have been seeing nearly 300,000, which is even higher than the numbers we saw during the pandemic, which is really concerning. >> she says they are serving 100,000 more people per month compared to last year. 25 percent are children. >> there are kids who rely on school lunches throughout the year to eat. there are seniors on a fixed income who are struggling to

afford food. >> though it may be the season forgiving, for most food banks, it has beeneadifficulty. she says donations are down as they continue to watch demand surge. despite the drop in donations, they are still making progress, such as recently expanding their kids school food program. she says the goal is to distribute 3 million meals through the holidays. she says the community is counting on them. >> we are here to help them up when we can and hopefully as a community we can all get through this together. >> in the north bay christmas has come a little early for families in san rafael thanks to a nonprofit right in their own backyard. the ritter center hosted its annual family to family program, handing out about $40,000 in gift cards to clients. those can be used by gifts for the holidays. cards were handed out to more than 130 families.

>> a curious raccoon was spotted admiring some christmas decor at the riverside home. the raccoon stood on the hood of the car taking a closer look at some of the flashing lights. they are kind of cool, right? he just wanted to see. the woman who posted the video says she expected the raccoon came to her home because of the food she leaves out for cats. yeah, that will do it. she says over the years, she has seen plenty of cats on her security footage but this was the first raccoon she caught on camera. >> that's fascinating, to get to watch them in action like that.
