zach: san jose mayor sam liccardo says he has been pushing into reform onto how police officer misconduct has been investigated. mayor liccardo: we are past the point where we can think that americans can simply ascend police. zach: l city's independent police officer -- auditor to take on a larger role than they have now. mayor liccardo: they are not empowered to subpoena witnesses, lead investigations, issue findings to the police chief and city manager about what they have investigated. they simply review investigations that the police department has performed and offer their continue -- critique. zach: lic have police handling sound and internal affairs handling others. but the police officers association said what he has proposed is illegal and it is up to voters.

officers assigned know what they are doing and that there is accountability. >> if you look at the histories of the outcomes of investigations at the end of the year, it is very clear that our officers are held accountable. if they have done wrong, it is shown that they have done wrong. if they've done wrong, they will be disciplined in a number of different ways, up to and including termination. zach: san jose police chief anthony mata issued a statement saying in part we do not believe that a dramatic departure from the system that is working is needed without further discussion. this is a serious issue with many legal and policy issues to resolve. san jose city council voted to have the city look into mr. locarno -- liccardo's proposal. after that, it will be looked at by an all-new city council. zach fuentes, abc 7 news.

threatening a day of action unless the school district responds. luz pena spoke to a school spokesperson and have the latest. luz: in the middle of getting improvement thanks to a $40 million bond. as part of that project, they detected elevated levels of lead. lead is invisible to the naked eye. high levels can impact the brain and nervous system. at buena vista school, lead was found to feet below the surface of this courtyard. >>ave 600 students on campus that it is accessed by all students in multiple use, so not just students that are here, but since the contaminant was they are. luz: chandler is a coordinator. he says lead in the school's courtyard is just an example of the many examples that -- issues

at the school. for at least a decade, teachers have been documented discoloration in the water. >> they have been told it is safe to drink, it is safe to drink. it is hard to trust better after the number of times that we have felt that we have been endangered by the building. luz: you are saying after 10 years, the water has turned yellow, and they are saying it is safe to drink? >> correct, that we should flush the pipes, we can move the dirty water out and drink the clean water. luz: san francisco's public utility commission concerned. preliminary test results indicate elevated levels of lead in tested faucets. what about the water itself? >> right now we are in the process to test the water. luz: but the remainder of the school year, the district sent over 2000 water bottles for staff and students. the last time they tested the water for lead was in 2018. >> and at that time, the results came back that there was not

actionable levels of lead in the water, that it was safe to continue drinking. now because we detected the hazardous materials in the soil, we are conducting testing for water again. city's department of public health to test every student for lead exposure. >> we have asked dph to intervene and do the testing. sadly, they say that is not their responsibility, and they are not going to do it, so it is probably going to have to take some sort of legislative or other action to make that happen. luz: according to the school's community court nader, staff, parents -- coordinator, staff, students, and parents are planning a day of action for thursday, asking to facilitate lead exposure testing. if parents want to get their students tested, the school district will reimburse the cost of that. chandler says many parents do not have the means to do that. in the newsroom, luz pena, abc 7 news. dan: luz, thank you very much.

a movies on the way to fast-track wellness hub that includes safe injection spaces in san francisco. >> we have open drug use happening next to elementary schools, where kids and families pass by every day, and we want to fix that problem. we don't want our streets to be a place where people are using drugs. >> wellness hubs are an important step in the direction toward a comprehensive model for recovery. dan: today announced of this proposal that includes $5.5 million to open the hubs and earmarks money from opioid settlements to find them. supervisors still need to vote on the proposal. earlier this year, the governor vetoed a safe injection site bill for california. city efforts, backed by the mayor, came to a halt as a result. opponents say the focus should be instead beyond residential treatment programs and rehabilitation. kristen: happening tonight, we are in store for a cold one.

let's take a live look outside. it may be dry and actually rather pretty, but the temperatures will take a serious dip. let's get to abc 7 news meteorologist sandhya patel. sandhya: it will be freezing and subfreezing for parts of the bay area. 1:00 to 9:00 a.m. for all inland areas shaded in purple, temperatures in the mid to upper 20's in our coldest spots, and that means frost and freeze will kill crops, so you want to protect any tender vegetation, obviously outdoor pipes and your pets, bring them inside. frost advisory for the coastal areas and the bay shoreline, same time period tomorrow morning, 32 degrees to 42 degrees. frost will form. tonight at 6:00, still in the 40's and 50's. by the time we head into 8:00 p.m., some 30's showing up in our inland valleys. at 4:00 a.m., you are falling below freezing in some cities. i will be back to let you know how cold it is going to get in

your neighborhood coming up, dan. dan: thanks a lot. a nsn driver was killed when a man driving the wrong way -- an innocent driver was killed when a man driving the wrong way crashing to their car. that person died at the scene. two other cars were hit, but the occupants suffered minor injuries. it happened on the eastbound lanes near the railroad avenue exit. highway patrol officers say the suspect tried running away from the crash scene. he was eventually detained and put into an ambulance so he could be treated for his injuries before being charged. kristen: an investigation is underway in the death of a tiburon police sergeant. flags are today for sergeant sean christopher, who died of an apparent self-inflicted gunshot wound. he joined the department in february 2019, coming over from the marin county sheriff's office he was promoted to sergeant in october.

he leaves behind a wife and five children. the website loop -- bluehelp.org found a total of law enforcement officers have died by suicide since 2017. more first responders died by suicide every year than in the line of duty. they also have life inspecting seeds of 15 years shorter than civilians. dan: u.s. indicted former ceo of ftx sam bankman-fried on eight counts of fraud today pure the crypto owner was arrested in the bahamas. bankman-fried is waiting for an extradition to the u.s., where he faces a number of criminal and civil charges. this comes one month after bankman-fried filed for a $32 billion bankruptcy. he is accused of defrauding customers and investors of ftx of $1 billion.

at the white house. president biden signing the respect for marriage act, which protects the rights of same-sex and interracial couples under federal law. pres. biden: marriage is a simple proposition -- who do you love? and will you be loyal to that person you love? it is not more complicated than that. liz: the new law requires states to honor all marriages, regardless of sex, race, ethnicity, or national origin. it has protections for religious institutions and does not require estates issue same-sex marriage licenses. the law a reaction to the supreme court was the overturning of roe v. wade. justice thomas also calling for marriage presidents to be reconsidered -- precedents to be reconsidered. tammy baldwin eased that. >> we can put to rest the fears of loving couples. liz: the bill passed with

clean, limitless high-profile investors from bill gates to jeff bezos have poured billions of dollars into fusion startups. >> the last time we counted, there's 10 or 12 small fusion companies that are trying. dan: dan cabin is the professor of energy at university of california and a participant in a fusion startup himself. he think that will be something like elon musk's spacex. prof. that public-private partnership. dan: some experts believe nuclear technologies have a significant head start, unlike older dinner action -- generation reactors, they say the newer ones are much safer and environmentally friendly. physics professor lee bernstein also expected to be much sooner. prof. bernstein: yes, i say

that, and it is a good thing, and i say that as someone who lives on planet earth with two kids. dan: wind power and particularly solar, in fact, kammen expects our own sun to be the most potent fusion of all. prof. kammen: i think in 2070, the world is going to be 70% powered by fusion, 93 million miles away. dan: that year 2070. the u.s. is partnering with a european project to create fusion, different from the livermore laser strategy, so expect a lot of advancements ahead. it is a breakthrough and very exciting news. kristen: we are placing a few bets, right? it is time now to check on your weather forecast. i am getting chilly thinking about it. dan: we need some of that fusion heat here. chilling cold. layer up, plants, bring the tender ones inside, bring in your pets, and don't forget to cover your outdoor pipes. very important here, obviously as frost advisories go up tomorrow morning for the coast and bay shoreline, and freeze warnings go up for our inland areas. very cold night as ahead, and frost and freeze will damage outdoor pipes and obviously tender plants. on live doppler 7, we have passing high clouds. temperatures in the 40's and 50's, already feeling chilly out there. let's take a look at the rainy season, from october 1 until tonight, the weekend just dumped several inches of rain in the bay area, santa cruz has gotten over half a foot, 112% of average, sfo, oakland, 138, santa rosa and san francisco still behind, but when you compare the rainy season this year so far to last year, we are actually in most cities behind compared to last year with the exception of san jose.

we really got a good dumping in the mountains, now at 213% of average, building that snowpack through the upcoming months. we are seeing mainly clear skies. temperatures plunging tonight. morning frosting patchy fog. partly cloudy and cool in the afternoon. our dry pattern continues through the weekend. tomorrow morning, we are talking subfreezing and freezing conditions. north and east bay bally's in the upper 20's to low 30's -- valleys in the upper 20's to low 30's. watch out, you may have to scrape that windshield if you park outside. afternoon highs may range from the low to mid 50's, a mix of sun and high clouds, so keep that extra layer handy. you will need it. we will fast-forward to next week, tuesday, a slight chance we may see some showers. that is just one computer model. the other model is not as wet, so stay tuned. here is a look at the accuweather 7-day forecast, a cold and frosty start tomorrow morning, another chilly one
