>> building a better bay area, moving forward, finding solutions. this is abc7 news. anchor: a san francisco institution standing up to an insurance company over pandemic losses a fight that could help many other restaurants come out winners as well. i'm amia daetz. dan: and i'm dan ashley. it's the first lawsuit that refused to pay back a covid payout. >> the payout is said to be in the millions. dan: this could mean other businesses will get settlements as well. leah: john's grill, an iconic owned san francisco restaurant was ordered by the city and county to close due to the

spread of the coronavirus. 54 employees were told to go home. >> that was part -- probably one oh -- of the hardest days of my life. >> john's grill quickly filed a claim with hart ford financial services group. the insurance company waste nod time in responding. >> essentially we're not covering you under this covid virus. >> the attor attorney represente restaurant. the insurance companies have said that the losses have to be related to physical -- remember that word, physical damage to the restaurant. i.e. fire, or vandalism. but in this lawsuit, the attorneys argued that the policy also included business interruption coverage. who caused the interruption? the city and county of san

francisco by forcing all businesses to close. remember the word "physical"? because covid is a very contagious virus, it created direct, physical damage and dangerous conditions to the property and people. >> it was just not a virus flying through the air. everything, every table, every chair, everything had to be cleaned. dishes had to be redone. people had to be called in to clean the entire restaurant after someone would leave. >> hence the term "physical damage." when this was brought to an appeal's court, the judge asked for more legal argument. that's when hart ford decided it was time to settle for john's grill for an undisclosed amount. hartford did not return our call for comment. >> someone said we could end up here with a very bad decision that would affect us throughout the state of california, perhaps. so they were looking at huge, huge losses. >> john's grill said the money

conditions. we have a frost advisory for the same time frame for the coastal areas and for right around the bayshore line. temperatures will be down to about 34, 35 degrees. frost can form and kill sensitive plants under these conditions. so if you're going to go out bundle up. i'll give you a closer look at how cold it's going to be at every neighborhood in the area a little bit later. dan and ama. dan: a very happy ending in the search for a petaluma person. virginia was found wandering in san francisco made it all this way. a guard noticed she had been walking up an down the aisles. and the officer immediately recognized it was virginia. the search for her shifted from petaluma to the city after she was spotted yesterday. tried to cash a check at a wells fargo. that's the surveillance photo from that a.t.m.

ama: the mayor of san jose is sitting down to reflect on the last eight years. the foreman prosecute or took office in 2018. but now as the nation's 10th largest office awaits new leadership many are wondering what the future holds. amanda has this one-on-one with the outgoing mayor. >> san jose mayor sam lucardo serving his last month in office. what's next for the city's 65th mayor? >> i'll have a chance in january to take a breath. my wife and i are going to think hard about the next steps. we promised ourselves we wouldn't make any decisions until then. you won't get any decisions out of me for a while. >> meantime, i talked to him about his legacy as mayor one he hopes helps the city reorient the future. >> whether that's the future of preserving coyote valley or with the downtown can become with

ama: multiple journalists have been critics of new owner elon musk. the names don't show up just their handle on the twitter platform. the "new y, "washington post" an had reporters suspended. you might recognize keith olbermann. elon musk said that the accounts violated twitter's term of service accusing them of sharing private information about his whereabouts. >> a proud community in the east bay is pushing to cement their passion at a historic neighborhood park. the group known as panther skate is looking to put a complete roller rink in at defemery park in oakland. but as tim johns explains, their mission goes beyond just lacing up their skates. ♪ >> every thursday, you can find kiana kemp and tamar copes

skating the night away. what started as something small to do has slowly grown over the past year to a full-on movement in their west oakland neighborhood. >> after my mom and dad passed away, roll skating was something to put everything to pavement. >> every week they're joined by dozens of skaters around the area, a gathering where everyone is welcome and one that is completely free. but on thursday they held a skating fundraiser. their ultimate goal to raise enough money to create a permanent skating rink. >> we have made a lot of strides in this one year. we've been meeting every week. we are now an official city of oakland parks and city program. >> it would ideally look like something like this, an ambitious program that would cost hundreds of thousands of dollars. >> we would be situated between the basketball courts and the

codonthohathe on believed to have been driving one of the cars who is later murdered said before he t. a reference to ivory pivens being the trigger man in jasper's killing. the bullet that hit jasper wu is believed to have come from an assault rifle. it was found during the search of trevor green's home. there's a potential here for a plea deal but the defense will likely question all of this. >> the defense team will now get together and try to show that there's a flaw in this investigation. and that they're going to say that the identity here even though we want to solve this crime, convicting the wrong people does not bring jasper wu back. all three suspects are in jail. johnny jackson's scheduled to go in front of a judge on friday. j.r. stone, abc7 news.
