>> and east bay, a young boy is dead. it happened in ranch park. police say it appears the victim walked to the park with another person and met up with the group in the car. witnesses reported s run to a nearby walmart. police caught up to the person who ran from the scene. police say the person is juvenile with a gun. no reports of serious damage from in earthquake. it struck just before 3:3 morning. it was felt across the bay area, including san francisco and the peninsula. the quakes line.

water pouring into properties in the dime heights area. one of the homes had up to three feet of water inside. the homeowner said he woke up to a bank this morning and found water gushing into the basement. >> it could have to do with temperature. overnight. >> the homeowner says water poured for about 45 minutes. investigators are trying to determine would lead a driver to crash into a post office this afternoon. no one was injured. it happened just before 3:00. police say drugs and alcohol do not have been involved in the crash. a mid air emergency united airlines flight back to where it started.

>> when they moved into years ago, phil and anna henry hoped the luma would be a quiet place to retire. he's an architect. she's a university administrator. they wanted to place their grandchildren could visit and play with their shelter dog name hopped -- there halter to -- there shelter dog. >> he wasn't allowed at nighttime. he couldn't sleep. >> the trouble began last summer when their neighbor complained that huck barked every time he took out the trash. >> he said if your dog ever comes over here again, he's not coming up -- she's not coming back. >> >> he did not stop to speak to me return my messages by his lawyer provided a surveillance video.

superhuman effort there. the dog ferociously lunged at him. >> allison tells me he gave his neighborhood chance to control the dog. he worked with an expert who analyze the video and claims it shows the dog charging him. >> if the dog is now moving towards you, trudging after you after it is broken free from its owner, and after the dog is shot , what's the logical inference to draw from that? >> the layer disputes that pointing to the same video. anna has heck on the leash, heading back home. he turns and takes off in this direction after another chicken. sergeant fry moves to the right. takes a shooting stance and opens fire. it appears the dog goes down here.

he takes seven steps to the right of huck. the attorney says that shows the dog was a significant distance from the charge it -- from the sergeant. >> it's pretty comical that he's now deciding to argue that he was acting in self-defense. that's a little hard to do when the dog is running a way from you. >> with huck bleeding on the count -- on the ground and unable to move the asked him to put the dog out of its misery. >> he said nick, you have to help them. >> i said please come and nick. he said i'm not touching that dog. the dog was no longer a threat. >> barry wilkinson not legally euthanize the dog. he thought the dog had died shortly after the shooting. the henry's believed huck was near death. they waited with him in the rain. an hour later, he was still alive. they loaded him into the suv

with their daughter. >> i climbed in the back with him because i didn't want him to die alone in the back of the car. >> she texted this picture to a friend to ask what was happening. she didn't know she had blood on her face. they later had to euthanize. i checked on the vet who treated heck she told me the bullet to the dog behind, in her opinion. >> there was one on the back of the right shoulder. when on the back of the top of the head. >> she shared hex x-rays with me. if a dog be. he did what he felt nec protect himself. sonoma county animal control close the case adding that agricultural code allows a dog to be killed if it's to chasing livestock or poultry. police used an expert who testified more than 1300 cases'f
