the shopping. thousands of people are taking it all in at union square on this last shopping weekend before the holiday. the one thing many people are noticing, the extra security. >> i noticed them in the candy store, i noticed them in the macy's, in the louis vuitton store. liz: -- as much security. that is comforting for some shoppers, especially after last year when a gang of organized thieves ransacked big name stores and made off with thousands of dollars in merchandise. glenn or tego remembers that day. he and his partner had just returned to the base station. there have been changes since then. >> after what they had done that night, the city, the mayor, the police chief, they have all dedicated, within an 8, 9 block radio -- radius here, to stop on

amanda: in the east bay, a little boy is dead following a shooting in antioch. it happened on lonetree way. it appears the victim walked to the park with another person and met up with a group in a car. there were gunshots, and witnesses say they saw someone running from a park to nearby walmart. police caught up to the person who ran from the scene and arrested them. police say the person is a juvenile who had a gun. saturday's 3.6-magnitude qua in el cerrito and cold temperatures may be to blame for a water main break the sent water pouring onto property at four homes in the area. the homeowner said he woke up to end yesterday morning and found water gushing into his basement. >> the water department is telling us he could have to do with the temperature because they've had five breaks in the last 48 hours.

it could be the temperature or the earthquake overnight. amanda: the homeowner says water continued for about 45 minutes before city crews were able to turn it off. a midair emergency forced a united airways flight, bound for san francisco, back to where it started. abc 7 news producer can my gale, who was aboard the flight, shot this video. the plane returned to mexico city after saturday. the captain reported in and balance infield hit -- in fuel pressure. the plane made a safe landing back in mexico city, but the passengers had to be diverted to other flights. staffers at about 100 starbucks stores across the country are off the job this weekend. it is part of their ongoing labor fight with the company. continue their three-day strike

that began on friday. they're fighting what they call unfair labor practices and the company's refusal to bargain or contract. >> starbucks has continued with her union best -- unionbusting tactics of firing partners, closing down stores, and still not bargaining in good faith, so , you know, if they are going to shut down stores, we are going to double down and show them we can do that, too. amanda: this is the second widespread strike by starbucks workers united. they staged a one-day strike in november. the popular mountain lion that took up residence in the middle of los angeles for several years has been euthanized. the given to them by tracking officials, became the face of the campaign to build a wildlife crossing over the l.a. freeway, giving big cats and other animals a safe pass. changes in his behavior led to a medical exam, which revealed the animal suffered injuries, likely

caused by a car strike. a surge of migrants arriving at the southern u.s. border has punted a state of emergency in el paso, texas. . it comes as a truck-era migration policy is set to expire in three days. abc 7 news news reporter alexis christopherson has delayed somewhat authorities are calling a humanitarian crisis. alexis: thousands of asylum-seekers sit across the border, waiting to see if they can enter the u.s. without fear of being the audit. a judgment that a deadline for december 21 to end put title 42, a trump administration policy put in fact in march of 2020 two ease immigration. texas governor greg abbott was one of several republican governors sewing to keep it in place. on friday, a federal appearance support -- appeals court denied the request. he said letting title 42 expire would cause chaos. >> not just for texas before the united states of america. alexis: he argues letting

thousands of people into the country without knowing their health status is potentially dangerous, that immigration advocates call hypocritical. >> they have been fighting to end covid restrictions everywhere except for asylum-seekers. alexis: saturday, the el paso mayor declared an emergency, saying there are already hundreds of migrants living in unsafe conditions under -- in the streets of their city, and they are worried more will of our. mayor leas experts who believe our numbers who go to 4, 5 -- 4000, 5 thousand, 6000, and asked if you can handle it today, the answer is no. alexis: the emergency declaration also allows them to offer other options to transfer migrants to other cities. the gop state that filed the lawsuit told abc news they will appeal to the supreme court.

recounts a conversation with joe henry about his dog. if i had to shoot him, i would that reporting comes from sunday, september 18, the day the dog died. henry's grandkids were visiting. >> they were playing in the garden, they were right by the gate, the dog accidentally got out for the gate. huff headed straight for the sergeant's yard, and on the security camera, you can hear the grandchildren trying to coax huck home. less than a minute later, anna henry arrives with his leash, but the dog is already chasing chickens that rome loose in the yard. anna henry, 71 years huck, as he kills one bird, winning another, and sergeant frei arrived -- emerges from the house with gun at the ready. anna is able to leash the dog at

the same time filled henry is pulling up with the trunk open with his suv, huck would often jump right in, but there's. not enough time. >> i was right there, i immediately apologize profusely, i'm so sorry about your chickens, and i got the dog on a leash, but i felt, and the dog went back toward the chickens. >> the dog takes off toward the wounded chicken, pulling ann to the ground, sergeant frei's wife shouts. [shouting] [gunfire] >> the henry's wish frei had not used lethal force so quickly. >> you could have used a broom, water. if i probably had five more minutes, i could've had him on a lead. >> i was like, why did you do that? >> i spoke with nick attorney. >> why didn't he just

leash? >> i think you are asking for a superhuman effort. the dog viciously and ferociously lunged at him, and a split second toward him. >> allison barry tells me he gave his neighbors time to capture as well as an opportunity to >> if the dog is now moving toward you, is charging after you, after it has broken free from its owner, and after the dog is shot, all pretty much at your feet, what is the logical inference to draw from that? >> but the henry family lawyer disputes that, pointing to the same video. anna has huck on the leash, heading back home, he turns and heads in this direction after another chicken. sergeant frey moves to the right come out of the way, takes a

shooting stance, opens fire. it appears the dog goes down here. frey takes seven steps to the right of huck. the henry's attorney says that shows the dog was a significant distance from the sergeant and did not fall at frey's feet. when shot. >> it >> is pretty comical that he is arguing he is acting in self-defense, because that is hard to do when the dog is running away from you. >> with huck frey's wife >> and he said, i'm not touching that dog. >> the dog was no longer a threat. he is not justified in shooting a dog for the sake of shooting a dog. >> barry wilkinson said he could not legally euthanize the dog, and in any event, he thought the dog died after the shooting. >> the henry's believed he was

near death. an hour later, he was still alive, so they loaded him in the suv with her daughter. >> i climb in the back with him, because i did not want him to die alone in the back of the car. >> she texted this picture to a friend and asked what was happening. breanna henry did not know she had huck's blood on her he later had to be euthanized. i tracked down the veterinarian who treated huck that day, and she said bullets hit him from behind, in her opinion. >> there was one right in the back in the shoulder, one right in the back at the top of the head. >> dr. hannah burns shared these images with me, showing the shrapnel. based at least in part and sergeant frey statement that he did in part to protect himself, sonoma county animal control closed the case, adding the state agricultural code allows a dog to be killed if he is chasing livestock or process -- or poultry but this nationally

recognized police use of force expert, who has testified in 1300 cases, have a different opinion. >> i'm speaking at the level of a trained police officer, can't shoot to protect chickens, end of story. >> roger clark is surprised that the sonoma county sheriffs's office and novato police where frey works did not do their own investigation, relying instead on their own report. he asked why he would open fire on an active roadway. a truck passes by after the second gunshot. >> i don't know how the barrel was pointed. if there was anyone in the general vicinity of that car he could ricochet and hit somebody in the car. >> finally, there is the issue of this skeleton the frey family put up one week later near the spot where huck died. the henry's tell me it added to the pain and loss they already felt. frey's attorney says it was just a halloween decoration they had used before. >> it was the same decoration they did last year.

[crying] and i'd like for him to be accountable. somehow, i would like accountability. amanda: dan spoke w neighbor who was afraid of huck because the dog would bark when he walked by. it is a difficult story, but you can understand how both families have been affected by this. north korea is continuing with its launch of ballistic missiles. on sunday, it fired two more toward the waters off its east coast. it marks the 35th day of test in a record year of launches by the kim jong-un regime. japanese and south korean authorities suggests the

use gingerbread bricks. 3300 bricks on a gender birdhouse come about 1300 pounds of royal icing, which is powdered sugar, egg whites. it keeps the house together. i have my little team of elves come through every morning and replace the candy children have eaten. they get out the royal icing, and they patch it up. just seeing the children, how excited they are, families take pictures in front of the gingerbread house. it makes it worthwhile. they can count on it being here every year, and they can create their own memories here with their families, and their children and their children's children is how it is starting to be. >> i would like to come next year. >> if you are feeling a little bah humbug, you should come to fairmont san francisco. it will get you in the spirit. amanda: kids certainly will. and it is indoors, so that is good. let's toss it to lisa argen. chilly out right now, but it is warming up. lisa: as we look at our
