work experience now faces serious questions. did he make up his resume growing questions this morning amid high levels of the flu, new restrictions are placed on the sale of certain child medications. but what's really to blame and not just for kids? why more adults are going shopping in the toy aisle these days for themselves? news in new york. this is america this morning. good tuesday morning, everyone i'm andrew denber. andrea g. in for rhiannon. we begin with former president trump's legal woes. after the january 6th committee recommended criminal charges against him. now it's up to the justice department whether to prosecute, trump responded, slamming the committee and saying, quote. what doesn't kill me makes me stronger, but his legal jeopardy extends far beyond january, 6th and today another committee is taking a vote. concerning a different legal matter involving trump. abc s faith of booby is here now with more faith. good morning.

good morning to you, andrew. the january 6th committee recommended criminal charges against trump yesterday and now another house committee could vote today to release his tax returns. today on capitol hill. lawmakers are expected to meet behind closed doors where they could vote on whether to make some of former president donald trump's tax returns public. the house ways and means committee obtained the records from the treasury department last month after a court battle with trump . prosecutors in new york have already accessed some of the records. but these are more recent. meanwhile congresswoman liz cheney, speaking at an event last night after the january 6th select committee concluded its investigation by urging the justice department to prosecute trump for his role in the capital riot. it was with solemnity and sadness. um that you know the facts lead to, um, criminal referrals for the former president, united states , cheney and the committee based their recommendation on multiple crimes, including conspiracy to

defraud the united states. obstruction of an official proceeding and inciting insurrection. the referrals are largely symbolic. the justice department is not required to act. instead it's conducting its own investigation, which is well underway. accountable capitol police officer harry dunn, who fended off riders on january, 6th agrees with the committee's recommendation. nobody's above the law, so he needs to go to court and have his day in court vice president mike pence is urging the justice department not to indict trump, saying trump's actions were reckless, not criminal. at this time of year. we're all thinking about the most important things in our lives, our faith. our family, and my hope is that justice department will think very carefully, legal experts say. looking ahead. it may not be january 6th that poses the greatest risk for trump, but rather the investigation into those classified documents found in mara lago. the charges that are referred over to the department of justice are ones

which do involve speech. those are defenses which. oh while i think the overwhelming evidence points to guilt do give the former president legs stand on, whereas the espionage act charges in the obstruction of justice charges or potential charges relating to the removal of documents have no such defenses associated with him. and andrea one final action from the january 6th committee. it's due to release its full report tomorrow. andrea thank you. supreme court has temporarily blocked the lifting of title 40 to the pandemic era policy keeping asylum seekers from entering the country. the policy was set to expire tomorrow. but chief justice john roberts placed the order on hold after several republican led states appealed. they say lifting title 42 will unleash an overwhelming flow of migrants into their states. abc s maria burial whera lot of questions right now about

whether the u. s. supreme court could take up this case that it is still too early to tell. this ruling is all administrative. it basically puts title 42 expiration date on holding. it buys everybody sometime, and that is a big deal here on the ground in el paso with ngos, city leaders and, of course, law enforcement dealing with all of this chaos right now. and chief justice roberts is giving the biden administration until five p.m. today to respond to the title 40 to appeal. meanwhile the white house is asking congress for $3 billion to help with the influx of migrants. we turn now to a rising political star accused of making up his resume. he was just elected to congress, but his first task in washington might very well be fighting an ethics investigation , a bcs lionel maui's explains this morning congressman elect jorge santos of long island, new york, who helped republicans flip a house seat, too, narrowly take control of the chamber from democrats is now in the hot seat . i hope i can earn your vote on

november 8th. on the campaign trail. santos ran on the american dream, touting his experience as a philanthropist, wall street financier and investor. but the new york times reports when it comes to his education and work experience. much of what santos told voters is made up. the times was first to report that santos never worked at goldman sachs or citi group, as he claimed, and never attended baruch college or y you we're in an era where a lot of political newcomers are coming in people who don't have traditional backgrounds. um and that definitely opens the door to people, um, kind of creating their own storyline their own narrative. following the report , santos firing back through his attorney, saying, in part, jorge santos represents the kind of progress that the left is so threatened by a gay latino immigrant and republican, adding it was no surprise that congressman elect santos has enemies at the new york times. who are attempting to smear his good name with these defamatory allegations. both baruch college and new york university tell abc news they have no record of

anyone with his name and date of birth. attending goldman sachs and citigroup also say they have no record of him working there. his opponent in last month's race now calling for a full investigation. the house ethics committee has got to investigate these allegations. the times report also brings into question santos charity group friends of pets united, which he claims saved thousands of cats and dogs . but abc news could find no iris record of a charity with that name. republican officials from long island are now asking for time to give santos an opportunity to address the questions about his resume. andrew andrea. thank you, former hollywood producer harvey weinstein is now a twice convicted rapist. los angeles jury yesterday found him guilty on three of seven counts at his sexual assault trial. the jury returns to court today to decide his punishment. he faces up to 24 years in prison, and that would be on top of the 23 years . he's serving for a similar

conviction in new york, which is under appeal. the fbi has issued a public safety alert over a spike and so called sextortion cases targeting boys online so the scammers typically poses girls manipulating the boys into sending sexually explicit pictures. and then blackmailed them. the fbi says more than a dozen suicides have been linked to the scheme. boys are online, a huge amount and they're in the gaming places there in all these places where it might have just been girls before, but now the boys are online just as much. parents are being urged to talk to kids about how to avoid risky situations online. the sale of cold and flu medicines for children are now being limited at some pharmacies amid the high level of respiratory illnesses nationwide. cvs and walgreens are now restricting the purchase of some medications. that's reaction to shortages of children's tylenol and other products in some areas, but doctors emphasize there are no widespread shortages right now. pft has been very clear that this is not a supply issue. it's

now to a record fine involving one of the most popular video games. the company behind fortnite is accused of tricking players into spending money while allegedly violating privacy. cause this morning epic games has agreed to pay $520 million to settle accusations involving it's wildly popular video game, fortnite. much of that fine stems from allegations the company collected personal information of players under age 13 without their consent or their parents' consent. the federal trade commission saying epic games made parents quote jumped through hoops to delete their children's data. claims fortnite caused substantial injury to children by matching them with adult strangers while enabling text and voice chat by default, and the result of this was that children were exposed to online bullying to blackmail into harassment, which led to significant trauma games is also being forced to refund $245

say the leading factors include family stress and falling out of good habits like healthy eating . it's not just an issue that holiday heart is a benign condition, it actually is a very potentially serious condition. that causes people to develop heart failure symptoms. increased alcohol intake can also result in what doctors call holiday heart syndrome. that's when binge drinking causes irregular heartbeats, which are associated with the higher risk for stroke. certain people might be more predisposed to it, but you can have no history of any heart related conditions and drink excessively or consume too much alcohol during the holidays, and you could create a situation where you develop. atrial fibrillation, congestive heart failure, even in the absence of any pre existing risk factors. a lack of sleep is another major concern, a new survey found. adults on average lose 39 minutes of sleep per night over the holidays, and if you're hosting a holiday party prepared to get even less shut, eye party hosts reported
