leave for dereliction of duty. and this is after he refused to take action off -- on the sergeant that ripped the bumper off of a car and the sergeant later fired a gun in an elevator. and investigated alleging misconduct by opd. the oakland police department has been going on for 20 years and the oakland city council members learned of the actions taken against him during a private session at city hall. they spoke with us about it. >> i hope going forward that the community can see this as part of the city's efforts to address transparency in all city departments. >> we are talking about accountability and transparency, it is a lot -- a logical course of action to have an outside, independent investigator

failed to take action against a sergeant that ripped the bumper off of a car in a hit-and-run crash and he layered her -- she later fired a gun in an elevator. that is being investigated by this federal misconduct of oc pd. this is within investigation going on with the oakland police department which is been going on for 20 years now. to break it down is abc7news insider. >> good morning. this is a new chapter in a long, long story of oakland. one is a cliffhanger because nobody is sure what happens next. we have a police chief that has been put on administrative leave. it does not mean they are fired. he is a popular police chief that has overseen reduction in homicides and an incredible amount of guns taken off the streets. very popular with the community. on the other hand, the report by independent investigator outside shows a systematic failure to discipline an officer in question.

even for be cheap read the report. it is not a good look, it is not a good optic and it is not a good news for the oakland police department. you see about 10 acting chiefs in the past 10 years. reggie: who called for this? was it the mayor herself who made the decision to temporarily take him off? >> yes, it was the mayor and the city administrator. we have a federal oversight that is looking at how open wind is trying to get itself back on track. the police department was wracked with the scandal about 20 years ago about police officers planting evidence and using excessive force with what was called the writer's case. and since then they've been under review by the feds and one of the effect as that we've got to get better at disciplining police. what happened was there was an incident in 20 21 involving the officers we were talking about the officer we mentioned.

and he -- there were questions raised about whether or not proper discipline was taken. an outside firm was brought in to take a look at that and they determined yes, that has been, the stakes, i would not say cover up necessarily of a eyes on some of the word. which led to this. kumasi: let's talk about the mayor just born in dealing with this now what could the action be for her as a mayor? >> it is tremendous. it is tremendously say. when you walk in as mayor, you oftentimes get to pick your police chief or you work with a police chief in conjunction. but is the most important statement you may coming in is specially a city like oakland which is understaffed in the police department and regularly having homicide rates way up sideshows, deaths, armed robberies, all of the things that are going on not just in

oakland, but all around the country. it is a difficult and politically dicey thing to do to remove the police chief coming in. a popular police chief is double that. so no honeymoon for the mayor. this is one of the toughest choices she has the first one is what to do now because they put him on administrative leave which is not firing. they say there is more to be reviewed and more to come out. we are putting an assistant chief as interim but where do you go from this? who makes the call? it's going to be a political one and it will be one for the city policy wise to determine what direction to take. reggie: i'm trying to get the temperature of this i am not trying to minimize the alleged misconduct but what we have here essentially is a member of the police force who hit a car allegedly, a bumper came off, nobody was hurt. then the same police force --

person a gun goes off in an elevator allegedly noem was hurt again. do those things amount to removing a chief from his position temporarily or permanently? >> we will go back to the initial report we are talking about. yes in a garage his police car hit another car and took the bumper off. he did not report it. it was captured on video and he did not report it. the gun went off in the elevator of the police department in a equipment elevator. he took the bullet casing he did not report it and he tossed the lit casing in a bag. and the second part, as you said, that alone is not anything of a scandal not like the sex scandal we had opened with the police department last -- a few years ago. or the writers case. but once it was turned over to internal affairs, they did not

follow the proper procedure. they did not bring this up, they did not review it properly they did not discipline they chose not to discipline to the extent that they should have possibly. it is not the incident, in other words, it is how it was handled. that is poor reflection on the chief and that is why you see the hammer coming down. reggie: the last time the chief was fired as you know the chief went back and sued and got $1.5 million. >> right. that was chief ann kirkpatrick another popular police chief who was fired and took the city to court saying she was actually the victim of blowback from being a whistleblower about improper conduct by the police commission. before her, we had sean webb who was resigned in the wake of the sex scandal involving a woman who is having sex with multiple police officers. and questions about her conduct and where they tipping her off

to suites about prostitutes. this department has been just a nonstop merry-go-round of bad news in some ways. and the chief is -- chiefs are in and out and never quite getting their footing. on top of that they are losing officers and crime continues to be a problem. it is not new, we do not know what the outcome will be, some say you cannot put a chief on administrative leave that is the one you have to fire because they are the top person you cannot say you can take a seat for a while but this is oakland but anything can happen in oakland. we are not sure which direction this will take. kumasi: what are you looking for today? >> we will look to see if -- the new chief in charge temporarily we will see the -- with the temperature is on the street and we will look for community reaction on this this will be a big thing for the chief and the new mayor.
