with the latest on the suspects and the victims on the deadly shooting in half moon bay. kristen: let's begin with zach fuentes with what happens during the suspects first day in court. zach: that first appearance in court was a fast one comment coming just a couple of days after these tragic shootings. the judge did not issue well for him. it is just the start of a long process to try to get justice for the victims and their families. the last time we saw the suspected shooter was in this video of him being taken into custody the day of the shootings. the 66 year old u yellow document trying to shield his face from the camera. he only spoke when the judge asked him to verify his name.

the district attor judge to order no bail for the suspect and the judge agreed. >> any time somebody is a danger to the community, the court has the right to hold him in bail on any charge. this is the highest number of charges, seven counts of murder, we have not had in san mateo county before. country. straightforward and simple request for no bail. >> the attorneys asking for more time to meet with him and review the case. a legal analyst says the defense has their work cut out for them. >> it looks like a difficult case for him, when you combine witnesses, the fact that he went to the sheriff's office, that he

was found with the firearm and apparently made some very damaging admissions. >> defense attorneys have articulated to the court that they are concerned about the publicity up front. i am, too. i want to make sure that for these crimes that occurred in san mateo county, that a san mateo county jury gets to hear it. we don't want it transferred to another part of the state. >> what led up to it still is not entirely clear. >> we do have a feeling on the motive, based on what he has told us. i'm not going into that. >> he did say they will be giving the defense attorneys a chance to present evidence to them. he said his office will be looking into the possibility of mental illness being a factor. >> for me to say what i'm going to pursue now would be precipitous. >> the

will be february 16 at 1:30 back here at the san mateo county courthouse. kristen: yesterday we had the governor talk about it, and since then we've heard more about the poor conditions that the employees at the shooting locations were living in. >> he said he is been in touch with the county officials and he said, we believe there will be steps taken to deal with the situation. so that was a big development coming out of here. kristen: what about attorney saying something about the monterey park shooting? was this a copycat situation? >> this has been a question on many people's minds because the shootings happen so close together. he was confident, based on what the suspect told him, that the answer to that question, was

this a copycat shooting, was no. kristen: thank you so much, zach. we appreciate that. larry: melanie woodrow has read through the charging documents enjoins us live from the newsroom with more. >> eight counts, one for victim, including the one who survived. there were enhancements which could impact his sentence if he is found guilty. the san mateo county das office tells abc 7 news it has a good sense of the order in which he shot each of his victims. the charging documents are laid out in the order in which the alleged offenses occurred. 10 chilling pages, painting a picture of who he allegedly shot first, second, and third. they were able to piece together a timeline based on a statement from zhao himself and witness statements.

a third enhancement particularly significant, special circumstance, multiple murder. the san mateo county d.a. says that enhancement makes zhao eligible for life imprisonment without parole or the death penalty. the da said making a decision on seeking the death penalty take place over the course of many, many months. he said that during that time they would have to find out much more about zhao as well as his victims. larry: we are learning more details about the victims in this case. kristen: luz cousin and brother of one of the victims. >> he described the moment he called his brother's wife and kids to tell them he'd been killed. >>

>> he was shaking as he tried to understand the words that were coming out of his mouth. recently his cousin took this photo to send to his family in mexico. he leaves behind four children. >> for you, josé was not a cousin, he was like a brother. farm with his younger brother who got him the job. their coworkers described the nightmare at the farm. his coworkers saw him getting shot. pedro the hospital. have you talked to him yet?

another victim worked at the concord farms for 26 years. his brother said he was a supervisor who loved his job. they were playing to meet as a family this weekend. >> you're saying you're still trying to process this and you still don't understand why this happened. holding back tears as he questions why his brother was killed. he remembers hearing the sirens and seeing police officers on monday and having a feeling that he was gone. it felt like and not in your stomach that you couldn't get rid of. he tried calling him, hoping it

wasn't true. you tried calling and texting him and he never got back to you. of going back to mexico one day, but now, only their bodies will. he never made it back home. 7 news. larry: other victims were not injured in the shooting, but they still need help. a group called the farmworker caravan held a food and clothing drive to help farmworkers who were displaced the shooting. >> 40 farmworker families th were living on the side of the

farms displaced as their homes turned into a crime scene. >> they don't have access t food, clothing, or anything. >> this comes within a matter of weeks after flooding also devastated the same area. >> today, we need to feed them. >> now an emergency call action for donations of nonperishable food, clothing and socks for all 40 families. emotions running nunez, while dropping off a trunk full of supplies from her neighborhood in los altos. >> because i was a farmworker myself. i can relate to a lot of they do over there. it just breaks my heart. i know there is a lot of fear and i'm sure there is a lot of need, but i also feel like that may not reach out. >> organizers plan to sort out

shooting. two vigils are planned tonight in the bay area as will permit a candlelight vigil will be held at 6:15 on the mission steps at santa clara university. in oakland, one will be held out apart from 6:00 to 7:00 p.m.. a fourth vigil will be held tonight outside the monterey park dance studio in southern california where 11 people died in last weekends mass shooting. nine others were injured. vice president harris is acted to arrive in monterey park in just a few minutes. larry: coming up, political vengeance or a real threat? delivery charges, a looming deadline that could in up costing restaurants big bucks, and the road to the super bowl. bay area fans hoping for victory in philly this weekend. spencer: we had a nice warm up

concentrated in a below grade unit. steep, narrow streets and lots of wires made it tough to extinguish the flames. larry: workers at a chi hospital picketed today to let people know their concern about their staffing levels. a mental health clinician said staffing for her program has been cut in half since the hospital became affiliated with ucsf and some programs are severely understaffed. >> the waiting list is thousands of kids. the hospital keeps telling us they are investing in kids at the east bay, but we don't see that. larry: union employees include medical technicians, housekeepers, psychologist, as well as nursing assistants. they say contract talks are not going well. kristen: especially restaurants in san francisco, could see an increase in their delivery fees from sites like doordash and grubhub.

there has been a delivery fee cap of 15% which help them stay afloat. larry: the cap is going to expire at the end of the month. >> 15% delivery fee cap during the pandemic. >> definitely helpful, yes. >> the city wanted to make that cap permanent, but when doordash and grubhub sued, san francisco reached a compromise. the compromise means it's up to small business owners to decide if they want to make changes to their contract. the new contract tells apps if i don't keep the 15% the option, the fee can go up as high as 30%. so what does a small business owner lose by staying at the 15% level?

kristen: assembly member announced legislation that will make lunar new year an official state holiday at california's community colleges. >> lunar new year is a holiday for us where we are not supposed to be in school, not supposed to be really doing anything. we are supposed to be with our families and ushering in the new year, celebrating with loved ones. kristen: he says it would give students a chance to reflect on the significance of the celebration. included in the bill last year. san francisco supervisors want to make it easier for people to get to chinatown to celebrate lunar new year. yesterday the board passed a resolution urging the mta to allow free ride citywide during the festival and parade on february fourth and fifth.

>> building a better bay area, moving forward, finding solutions. this is abc7 news. kristen: congressman eric swalwell has been kicked off of the house intelligence committee. republican speaker of the house kevin mccarthy made the decision, citing national security reasons. >> democrats say it is political vengeance. you have been covering the political scene for a long time. this is not unexpected given the rhetoric we have heard. what was eric swalwell's reaction? >> he spoke out along with two other members of congress, including adam schiff, congress member ship -- stripped of their positions, they say he's plane politics. it is a big surprise, he had vowed retribution for democrats who had two republican members,

marjorie taylor greene and -- of their assignments. so some see this as payback. a day after being formally removed from the house intelligence committee, bay area congressman eric swalwell responded, calling the republican speaker of the house, kevin mccarthy's, decision to strip him of his assignment for eight years, political reference. >> abused political power to punish and demean and smear his political opponents. the new mccarthy in washington today is doing the same. >> he stood alongside democratic congress member adam schiff of california and ill hunt omar of minnesota, who was also removed from committee assignment. >> we chose to stick together because it is not about any political assignment. it is about an institution where the speaker of the house is using his power to go after the political opponents and pick them off the field. >> let me be very clear.

this is not anything political. >> mccarthy told reporters he was forging ahead with removing them from the house intelligence committee due to national security concerns. he pointed to where eric swalwell was targeted by a chinese spy as part of an influence campaign. before he served on the intelligence committee. after he was alerted to the identity, he cut ties. republicans have continued raising concerns about the association. >> i'm sorry. you all know he should not have the responsibility to serve in the committee. >> eric swalwell responded, saying he did nothing wrong. >> the fbi said three times, all i did was two things, helped them over and over, and i was never suspected of anything. it is clearly political vengeance. >> call it payback, the promise

keeping track of sea stars along our coastline has been an urgent mission or rebecca johnson of the california academy of sciences. she and her teams of volunteers watched as several species were decimated by wasting disease, possibly triggered by a heat wave roughly a decade ago, unleashing a chain effect on the echo system >> >>. the loss of this huge starfish allowed for the purple sea urchins population to explode. with an exploding population of the sea urchins came a decline in kelp. >> she says explosion of hungry purple urchins has evolved into a long-term threat to the kelp forest which provided a critical habitat for marine life. they've been particularly destructive to the kelp forest.

>> for fish, for many different invertebrates. >> many species have recovered along the coast, at the sunflower star is still largely missing and with the pressures from climate change, there is ongoing concern about what the future might hold. >> we got two of them right next to each other over here. a big guy and a little guy. >> a senior biologist with the captive breeding program, she is currently watching over the tiny specks that will grow into adult bat stars. she says the secrets they are unlocking could one day help other species like the sunflower stars. >> just learning more about their background, what their nutritional needs are, that is a great gateway to actually do some sort of release program. >> she says plans to release a new species would likely be far off in the future, but there is

an increasing interest worldwide and learning about the biodiversity of star populations. warming ocean waters and marine diseases. >> this was our catalyst to make sure we can do it here in house and use it as a jumping off point to hopefully work with other sea star species. spencer: academy researchers are doing similar work with coral. they are hoping help scientists better manage fragile ecosystems and predators like sea stars that help keep it in balance. there are calls by some experts to reintroduce sea otter populations to the north coast. the hope is that like the sea stars, the auditors will help the kelp forest by keeping the hungry urchins in check. kristen: and you thought they were just cute. today marks the unveiling of san francisco's general hospitals
