waiting for the video release of eight memphis police beating that result in the death of tyre nichols. the release of police body camera footage is expected one hour from now. it is something civil rights activists demand, but something that can bring about anger, unrest. a protest is planned at 5:00 p.m. in san francisco. today, tyre nichols family calls it a savage encounter. >> i have never seen the video, but what i have heard is very horrific, very horrific, and any of you who have children, do not ever see it. i just want to ask for prayer for my family, for this whole community, and i want to say to the five police officers that murdered my son, you also

disgraced your own families when you did this, but you know what i will pray for you and your families. larry: joining us live now burris, who worked on another police brutality case. welcome to the show. you have not seen the video, but what do you know about what it will show in terms of what happened to the 29-year-old driver stopped by memphis police after just taking photos of a sunset. john: i have been told that there was beating, the officers kicking this man in his head, using a taser and a baton, so beaten off throughout his body and places that undoubtedly could not survive the type of blows he was taken.

there was tremendous trauma inflicted upon him. it knocked him unconscious and his body could not recover after three days of hospitalization. the tragedy is this did not have to happen. this was a traffic event. what i gather now is the claim he was driving recklessly was not supported, so it raises the question about this stop by the scorpion unit trying to get as many arrests, stops as they can, and as a consequence, they stop this young man, he had not done anything wrong, and the next you know, they beat him. why would you beat a person based on an alleged traffic violation? this has and will have the communities outrage once they see the video. i was a lawyer in the rodney king case, and i saw how viciously he was beaten and what it did to his body.

this is a situation where this young man was beaten to the point where he lost his life, and sing the pictures -- seeing the pictures of him, his face was swollen. i assume the rest of his body was swollen as well, so we have a situation of un-mitigated, unrestrained use of force by men , who were charged to be responsive and protective, so this is an outrage. what we look for now is not only once the video is hope it does not cause people to burn down the city, but at the same time they have to express outraged, and that will be done throughout the country. remember george floyd. i remember rodney king. it is a different situation where more mercy will be shown to this young man, because he lost his life and had not done anything wrong, whereas with rodney king there were efforts

to condemn him because he was speeding, and ex-convict, and any number of negatives exploited at the time, but this is a different situation. kristen: there is so much to unpack and explore in what you said, but i want to follow up on what we will likely see. the kicking you talked about, police kicking tyre nichols. his stepfather describes seeing him being kicked like a football. that is how he describes it. out of maybe 10 officers, nobody tried to stop the beating. it is easy to say a bad egg when you have 10 officers not recognizing something very wrong is happening -- [indiscernible] john: that is officers see conduct taking place, and did not stop others. under the law, they have a duty

to interfere and stop the misconduct and could be wrong and charged with the violation of civil rights because of their failure to interfere. when somebody is unnecessarily kicking a person, beating them with a baton, and the person is not resisting, and they are using force, and not a danger officers, and so that officers should interfere and stop the taking place. that did not occur and that is what you have officers charged with failure to intervene, which is a serious charge. some of these officers are big guys, so tyre nichols was kind of thin, so he was at a distinct disadvantage. anyway, it is five against one. receipt there is a rat pack notion about this, other officers come in and look, sometimes not participate, but look. we saw that in the rodney king

case and a number of people were present who would not come forward and testify but who saw it and would not interfere, and that was a tragedy because those officers could have stopped this beating. this is a tragic situation. kristen: no doubt. john, we just showed the pictures of the five officers charged. some people point out that because the officers are black, this was not racist. how do you view that argument? john: i don't view it that way. black officers can be racist in terms of racial profiling. that is a function of the culture. who is being stopped? who is being charged? who is being arrested for a minor offense? and in the community, it's happening at a disproportional level, giving the impression that a police responsibility and charge here is racially motivated at and they are stopping black people in searching and arresting them

minor offenses, or in a case like this for a minor traffic offense, so to me, black officers can engage in racial profiling, misconduct, as well as white officers. on the face this would not appear to be but it clearly has a racial overtone to meet and the kind of policing that takes place in the community. kristen: we have seen too many of these tragedies, rodney king, whom you represented the oakland rioters, you were involved in that case as well, george floyd, tyre nichols. how do we keep this from happening again? what specific reforms? training? hiring? what would you like to see? john: legislators to pass the george floyd civil rights act, number one, giving police agencies more responsibility and lessening the protection some officers have come up but it is

up to the leadership of the communities, that town. there are 18,000 police agencies, a mayor, city manager, and a police chief had the responsibility of holding officers accountable and if those people don't do it, it will not get done. the police union, powerful entities, pose a stumbling block to various reforms. reforms can be done. in california, a number of actions have been taken by the state legislature. they can do it. is it going to be followed as a principal set forth? we have a lot of rules in place, but most recently, one or two officers tried to circumvent the process, which created an entirely new scenario, so best intention is you have to keep working at it. we are a long ways away from where we were with rodney king, but since then, change has taken

place. more change has to take place, but it is still about accountability for commend people holding younger officers accountable and having plans in place so that everyone is familiar with the rules and regulations and if you step out of line, you are held accountable regardless of race or position. larry: we thank you for your insight. john: thank you. take care. kriste expert from the better business bureau for tips avoiding scams aimed at those who try to help after tr

increased calls for donations to help victims, but scammers are more aggressive than ever before. how do you make sure your donations do not end up in the wrong hands? joining us now is our guest from the better business bureau about how to avoid scams. thank you for joining us. >> thank you for having me. kristen: absolutely. do you often see a jump in scams after high-profile disasters? >> absolutely. normally when a natural disaster strikes or situations like the one in half moon bay, we do see a huge rise in scams being reported on hibi.o we want to help as much as possible, but imports, there are those people who do take advantage of not only the victims and the families but also the consumers as well that

are willing and wanting to denominate. kristen: it is -- to donate. offer tips to make sure people are donating to valid organizations. here we are. first, verify the nonprofit before donating. how do we do that? >> you can go to give.org and put in the business name or organization name to see if they meet the 20 standards of accreditation for the better business bureau. the other is go to your local state attorney general's office. you can do a search for charities and nonprofits registered with the state of california, as well as the federal government, and the next one you see on there is verify donation pages on social media. you don't want to click on anything you see on facebook. the same thing with crowdfunding. these are the gofundme pages we see. take sure you verify the stories. it is common when we see

disasters like these when fake funding websites are created, you are really not donating. kristen: pardon me. i did not mean to interrupt. i wanted to pull up what you're talking about. the most popular crowdfunding site is gofundme. let's say you type in "half moon bay" in your search and you pull up a lot of different ones, right? so when you see this, let us just click on one, how do you, what are the signs to look for that this is legit or this looks fishy? what are you looking for here? >> the n make sure that they are the victims who have been released as far as one of the unfortunate tragic endings to some of these. this is in spanish. if it is english or spanish, verify that there are no grammatical errors, misspellings , and make sure the images are not pixilated or they come from a free website. the best way to do that is if

you right-hand click, you can save the image, put it in a google search and you can see if it is coming from free for example get a images or a stock image. you can see -- getty image stock image. when we do see fake ones, these images are stock images, and not the victims or families, and a lot of times md area is not correct as of those you want to report to gofundme. kristen: thank you. i want to go back to the fullscreen because we have more tips to show people. you want to remind donors to respect the privacy of the victims and survivors. what do you mean by that? >> in situations like this, we want to jump up and help as much as possible and we have seen consumers reach out to victims families on facebook or pretty much figuring out ways to try to

help them with donations. first and foremost, make sure you respect the privacy of the families and make sure you also do have permission to be using some of these images on whether you find lull on social media -- them on social media or through a google search comes a make sure you have permission from family members before you post anything. one of the easiest ways you can see legitimate crowdfunding websites is to stay on top of the event, and the best way to do that is to watch the local news and make sure you have the correct information. we hate to see consumers donating and they are donating to the wrong cause or do not know where their money is going and it is a complete become a completely different person. kristen: those are terrific tips. a few more, do you want to check transaction fees, even if it is a legit organization? >> exactly.

we are not saying these crowdfunding websites are horrible businesses and you should not be donating, but we want consumers to understand where you are donating and what are the policies of these sites. for example, is there a transaction fee? if you are donating $100, how much is going to the cause itself? is there a fee charged on top of your $100 donation? it is super important to know what they are doing with your information. you are putting in banking information, so you want to use websites that are secure, and the best way to do that in the easiest way is in the top left-hand corner. you see ht it is secure, so whether you're putting in information, name, address, banking information, it is encrypted.

also make sure your website connection is secure and not public. those are tips to help us on the tech side. kristen: good one. ok. 30 seconds. not all donations are tax-deductible, right? >> exactly. we have to understand between a private transaction and that of a nonprofit, so therefore if you are donating directly through a crowdfunding website or you see someone posting on facebook and they have a v you have to have an ein for it to be tax deductible. so that is the way to find out most of these are not tax-deductible, so they have to have a ein number through the irs. kristen: thank you for some important information at a relevant time. >> thank. kristen: but those who want to
