times before using his body weight to break in. no one was monitoring the cameras. they learned upgrades were not in place that would have notified u.s. capitol police. >> they are usually at the house. >> this san francisco police. >> i understand. >> i have a problem. >> ok. >> this gentleman just came into the house. he wants to wait for my wife to come home. >> there was no formal between u.s. capitol police and the san francisco police department at the time of the attack involving the speaker and her family. despite the fact that the agents

required partnerships to exist to address how cooperation will be handled, but none of that happened. the u.s. capitol police was only aware of the threat after the break-in and the 911 call. >> [indiscernible] >> [indiscernible] and when i left my [indiscernible] >> there are some chilling moments in that interview with the lead investigator where he talked about how he tried to comfort policy -- paul pelosi as they saw the police lights through the window. when asked if he regretted what he did he said "no, it needed to be done." kristen: boy, that 911 call was so bizarre. one thing that was clear is he

was trying to get the operator, between the lines. larry:asotetting it. is heuby hinted in the first press conference with the san francisco police chief, he talked about how the 911 operator was a huge in terms of how quick the response was. i want to point that out in contrast as we continue to evaluate the evidence. paul pelosi was trying to give subtle hits on the phone, the fact that the man was motioning for him to hang up the phone. that was reviewed in one of the interviews with the investigator. larry: do we have more of the forklift now? >> yes. >> [indiscernible] >> [indiscernible] >> there is a

call almost ended at that point. larry: right. kristen: she almost said goodbye. paul was quick to say no, and revisit it. you can so imagine those were tense moments. maybe she had pushed the button, playing this game, but it could have angered him. >> it could be. larry: it was a possibility. it was clear he was not trying to alarm the man, it seems, to alarm him in any way, but to let the police. what about nancy pelosi's reaction to it? >> well, we can report that paul pelosi continues to make progress. congresswoman pelosi did come out and speak about not only that come up so let's a listen. >> on behalf of my entire family we continue to thank all of the

prayed over them. this was the first in a series of vigils to be held today and next week too as this community continues to grieve the loss of lives following the shooting. after the service of the second location, we spoke with some one who visited the family members today. the archbishop remarking on how locals rallied around them. >> i must say i am happy united around this tragic time and supporting the loved ones, those whose lives were lost, giving them not only moral support but practical and financial support, but also to see the love of the ones affected, even to the point of extending forgiveness to the people who took their loved ones away from them, so to see them come together in love and in unity in the midst of this darkness is also a bit hopeful. >> the family members at the

services today did speak and are understandably in a lot of pain, but did think the community for the sport they have been receiving and continue to get help with their losses. back at half moon bay, we are here where the first vigil is set to start at 5:00 p.m. preparations are happening behind us now, then followed by more services and a procession on tuesday, so a lot going on as hi this community continues to grieve. kristen: thank you. would learning more about the man accused in the mass shooting. according to the das office, the men told investigators that he was angry over a $100 piece of equipment. he claims the incident was not his fault, but was told to pay $100 after the incident. the shooting

this is an abc news special report. now reporting, david muir. good evening again, everyone. we're coming back on the air briefly here after what has already been a very difficult day in memphis. that community and the country is now getting the first look at that disturbing police body camera video of what authorities say is the police beating of tyree nichols following a traffic stop near his home 20 days ago as we've been reporting he died of his injuries in the hospital. three days later, the nichols family and police have been pleading for peaceful protests. while recognizing the anguish and outrage among so many hoping that preparing the community with in some way help here. the video coming in now it is very

difficult and we're going to not show very much of this. but this is what our team has been able to screen so far. the first video is of nickels being pulled into the car. i need to do anything. i didn't ask rail. alright. alright alright. know? do that, okay? on the ground, okay. your time on the ground around. that's t video again. he was being pulled out of the car, and obviously we had to bleep some of t to bleepo there. but that was the moment i got pulled from the car initially after the stop, the next video is of nickels on the ground being pepper sprayed, calling out for his mother. here it is okay. give me your sprayed again. watch out.

your hands. give me we should note that there is more than an hour of video 67 minutes worth multiple police body cameras. tyree nichols family has already viewed the images earlier this week, saying that it showed the officers brutally beating their son. his mother was unable to watch. he had to leave the room . the officers fired now charged with second degree murder, among other charges, as well, and they had claimed that he was initially pulled over for alleged reckless driving before running from the car. the police chief. those saying so far we have found no proof that he should have been stopped fbi director christopher racing. he watched the video and was quote appalled by it was five former police officers now facing several charges, including murder. justin smith, desmond

mills jr. emmett martin, the third, demetrius, haley and darius being. attorneys from mills and for martin have said they will plead not guilty. the white house as president. biden has not yet seen the video, but he did speak to the family. he offered his condolences, commending their quote, courage and strength. i want to bring in stephanie ramos. she's live in memphis tonight, stephanie they had been urging calm. we're getting reports of some protests already, which, of course was expected. absolutely david. the people here in memphis are set. they're upset over this video. this 29 year old man, unarmed, stopped by police. and then as we can see, in that video being on the ground until he's unconscious, as you said, dying three days later, and we heard from tyree nichols family earlier today, his mother, understandably emotional, wiping away tears and urging for peace, saying that if there are protests here in memphis or across the country, she asked she was is asking for them to be peaceful again. we are seeing

them here tonight, so far, not violent. but as you mentioned tyree nichols's mother, saying that she hasn't been able to watch that video says she hasn't been able to grieve the loss of her son. and it's just devastating for her to know that he was calling out for her just a few yards away from their home, david stephanie ramos from memphis at this hour, stephanie thank you. we should point out that ben crump, the attorney for the family earlier today, as you look at the peaceful protests that have memphis at this hour earlier today, ben crump said it doesn't matter if the officer is a black officer, hispanic officer or white officer. it is the culture that allows them to think they can do this to tyree. those words from ben crump. i want to bring in our chief justice correspondent pierre thomas, for his thoughts on what you've seen pierre play out here in memphis tonight. david i've had the opportunity to be out with police on numerous law enforcement actions. it's clear that this is not police work.

this is brutal, and law enforcement officials today in charging these men with second degree murder and also kidnapping. think about that kidnapping, essentially saying they took this man against his own will and to see him punched and beaten. and taste repeatedly again. this does not resemble anything that is legitimate law enforcement work, and i can tell you tonight law enforcement across this country in cities, major cities across this country are hoping that the pain that the people in memphis are feeling and in cities across this country that they can use it constructively to peacefully protest for change in many cities. police unfortunately, are viewed as the occupying force. this will only reinforce that david i spoke with a very senior law enforcement official tonight who is aware of this video, and he said this could set law enforcement back for many years that the notion that they're there to protect and served it's destroyed by images like this. david here. you and i

were talking earlier today on this notion before we go here on this notion of what ben crump said that it does not matter the color of your skin. whether you're black officer, hispanic officer white officer that this, in their words is brutality. this awful police beating that now is being seen by by so many people. but he also said, given the speed with which authorities acted in this case that he and the family hopes that this now will be the blueprint moving forward and other cases like this where there exists extreme and graphic police body cam right? he the point he's making is that in so many of the other cases there have been weeks and months to go by before any action was taken by the part of prosecutors or the police in some cases, and he's saying when you have a video that is this clear cut you have to, for the sake of the community. take quick action and that we will see if that will be the standard going forward. it just remains to be seen. david here. thomas

there is one hour of video. kristen: that is many police officers from the collective body camera footage. that was the thing, there were so many there. larry: and why? that is the question, i don't know we will have an answer for, but it feels like the george floyd case very similar. kristen: it was anti release of the video would make people understandably more angry and that there could potentially, police preparing for unrest. in the bay area, police are preparing for the possibility. we want to mention it is a possibility and not an inevitability. oakland police have shut down the streets outside the department headquarters, the department has increased staffing through the weekend to help provide safety for demonstration should they occur.

larry: today marks six months since this violent reaction to a gardener enjoying a beer with friends at a long day at work. kristen: we were first with the disturbing video. we have word the gardener has filed a claim against the city of san rafael in the first step towards a lawsuit. larry: we have the details. >> the gardener still does not want us to use his real name.

it turns out his injuries were worse than we first thought. >> stop. >> the lawyers for him tell us the treatment he suffered at the hands of two police officers was so egregious that the city of san rafael should pay. >> there is no weight that is necessary. >> july 27 last year, he told officers that he and his friends like to have a beer along this remote stretch after a long day at work. they asked for his id, but he claimed he had to retrieve it. >> i know. i have to take it out. i have to take it out. >> just sit down. sit down. >> ok. >> hey. hey. >> stop. >> you that the officer forces him to the ground over beer bottles, punches him in the nose and

pushes his face into the pavement. he suffered a broken nose and concussion come about his attorney says it is, a shoulder injury for which he had surgery last week and ptsd. >> there have been personality changes. it has affected his marriage. hiwi public a living a different life in a very different way than before. >> his claim accuses the officers of assault, battery, false imprisonment, infliction of emotional distress, and failure to properly screen and hire him a failure to properly train, supervise, and discipline. a spokesperson said he would have no comment on the claim, but an internal investigation into the conduct is still underway, and the remains on paid administrative leave six months later. >> the fact they have not been able to come to a conclusion is obvious to anybody who has seen

those videos. it is very concerning. >> he still can't quite believe the prosecutors filed felony resisting charges against him, before even looking at the video. once that happened, the case was dismissed. now the district attorney tells me that the case is still under investigation and review for possible criminal charges against the officers. >> as we said right now, we do not know if these officers are going to be held accountable professionally or criminally, so a civil lawsuit is sometimes a last chance somebody has for justice. >> also no comment from the mayor and city attorney. they have 45 days to respond before lawyers move ahead with their lawsuit. larry: they have had this video for six months? >> absolutely. larry: and still no action? interesting. thank you. kristen: in the south bay, two people dead and another injured following a car crash in san jose that happened between two

roads was the car at a light pole and caught on fire. two people were pronounced dead at the scene. the driver was injured and later taken to jail for driving a stolen vehicle. this is the first of a traffic accident of the year for san jose. one worker has been charged in the death of a resident, a 54-year-old who faces one count of elder abuse resulting in the death of the person. the 94-year-old resident died after drinking cleaning solution in august. the complaint says sh he was placed and which his health was in danger. larry: we are going to lighten the mood a little bit after some rough video. chickens making a return in a big way. kristen: (vo) at wells fargo, direct deposits come up to two days early with early pay day. what if everything came two days early?
