recently across the state. ama: live in the newsroom with the details of what lawmakers are proposing. >> california already has 100 gun laws on the books. these recent mass shootings are asking whether they are working or not. democrat and republican lawmakers have different answers to those questions. it week after the shootings in monterey park and half moon bay, california lawmakers are trying to find ways to prevent future gun violence. democrats have proposed nearly two dozen new bills. >> there is some that tries to tackle reducing gun violence in multiple ways. >> the bills include creating an excise tax on guns and ammunition sales with revenue going toward gun safety programs, allowing people going

through mental health crisis to add their own names to a do not sell list, and an existing band for those who have had domestic violence orders against them. another bill would make the possession of a so-called ghost gun a felony. >> we have plenty of gun laws on the books. what we are missing a sufficient enforcement and deterrence. >> republican lawmakers unveiled their own plan. they say california has passed 100 gun control laws and that they aren't working. at the state capital, they proposed new legislation to create harsher sentencing for criminals who use a firearm during a violent crime. >> we don't need morgan control, we need crime control. >> really, crime is your number one issue? you're not going to deal with the leading cause of crime, which is guns? what frauds. absolute frauds.

governor newsom saying gun deaths are lower in california than other states. >> we have so many gun laws in california, yet we are still seeing mass shootings. >> how gun laws are saving lives. >> a recent study compared to citizens in other states, californians are about 25% less likely to die in mass shootings. democrats say that is a reflection of gun control laws. abc 7 news. dan: the debate is emotional and intense. what are some of the other things democrats are proposing? >> assembly member berman says he feels like he is working with one hand tied behind his back knowing that federal judges seem to be eyeing state gun laws. given the democratic majority in california, it is not hard for gun measures to pass in the state. lawmakers are looking at ways to expand awareness for gun

violence restraining orders and the awareness of the danger of gun ownership. ama: a husband and father is now charged with the attempted murder of his wife and children. the whole family w white tesla that went off highway one pacifica on january 2. today, the father was formally charged. the district attorney says father made two deliberate right turns taking the car off the highway. ryan curry was at today's court hearing. >> dharmesh a. patel in court after being charged with three counts of attempted murder. he allegedly drove his family off the cliff in early january. emergency crews arrived to find the car the bottom of the cliff with significant damage. his wife, daughter, and son were in the car when the car crashed. >> we have concluded that the evidence supports the fact that he intentionally drove his

vehicle over that cliff. >> the san mateo county district attorney says his office reviewed evidence, including eyewitness accounts from other drivers and cameras on the highway, and determined there is enough to file charges. >> we have video showing the movement of the car after it left the tunnel, went up the hill, turned off the road, and then turned to go down the cliff. >> the judge said no bail for patel. only two of the three counts had domestic violence and bodily harm enhancements. he did not suffer significant injuries in the crash. there is no evidence the car malfunctioned. >> there was no breaking, no skids, nothing like that. >> they still don't have a possible motive for the crash. they are waiting to interview patel's wife who remains in the hospital. what was the trigger? that is still under investigation. we are learning more when the wife is hopefully available for

an interview and is willing to speak with us. >> patel's next court date is set for february 9. the district attorney did ask the judge to issue a no contact order. the judge did not do that today, but said he could explore that possibility at a later court date. in san mateo county, abc 7 news. dan: an assisted living worker in custody in connection with the death of a 94-year-old man at walnut creek for assisted living facility. she was arrested on a felony count of elder neglect that resulted in death. >> she neglected her duty care to our victim and he was able to access caustic chemicals and he drank the chemicals and died as a result of chemical burns to his mouth, esophagus, and stomach.

dan: prosecutors say the victim lived in the memory care unit and suffered from dementia. the arraignment was postponed until next week. ama: a freeze warning and frost advisory prompting warming shelters to open in several counties across the bay area. the view across the bay was clear. not a cloud across the sky, but it was chilly. dan: it sure was. sandhya patel is tracking how cold temperatures will drop overnight. sandhya: down to freezing or below. inland areas, the valleys are under a freeze warning from midnight until 9:00 a.m. tomorrow. down to 32 degrees or colder, frost and freeze will impact the unsheltered, obviously damage sensitive plants, and could do damage to outdoor plumbing. we have a frost advisory for the hills and the bay shoreline. temperatures down to 33 degrees. frost is expected by morning. it is going to be a cold one. temperatures in the 40's and the

50's. one thing you need to know is that you will want to protect any sensitive plants, bring in your pets. i will be back to show you how cold by tomorrow morning coming up. ama: the oakland zoo is set to reopen friday more than a month after storm related damage forced it to shut. the zoo closed new year's day after a sinkhole opened up on the main entrance road. this is time lapse video showing some of the repair work. originally, they hoped to reopen by january 17, but it has announced this friday as the opening date. dan: parents o students say they are desperate to keep their schools open. summit denali is a public charter school that has a middle and high school in sunnyvale. the school has been operating at a deficit since opening and will have to close at the end of the year. zach fuentes spoke with parents

who are hoping and trying to keep it open. >> summit public schools denali has been operating for nearly 10 years now with a diverse student body. it is home to students in santa clara county from grades six to 12. >> there is no other school like it. it supports every learner, every child, in every way that they need. >> school officials say they expect this year to be its last. chris graduated from denali last year and said the school closure will be devastating, for students who rely on its mentorship program. >> they will not keep their mentors or their mentorships. >> officials sent us a statement that said a specific series of financial issues put denali in an unfortunate situation. it is a wonderful school and while we don't want to close it, we don't see a viable path forward to stay open. they pointed to the notice that

went out to parents that said the loss of state funding is largely to blame. denali said talking openly with families is a priority, but parents say they want more communication and don't understand why they are now being informed of financial troubles. > it is becoming extremely clear to us parents who have evaluated the finances that something is off. there is a mismatch between what they are telling us and what we see in black and white and numbers. they need to get transparent. >> school closures in the bay area are not unheard of neither is a decision to reverse the shutdown. earlier this year, the oakland unified school board rescinded the closure of five schools. denali parents are still hoping for a similar turn of events, perhaps in the form of a big philanthropic handout or something. >> this is just such a gem to lose in our community. if we could write a check, we would. dan: new at

every two years, counties take a point in time count. there are homeless people in every county of course. we have the story from the county with the highest number of homeless, santa clara. >> long before the break of dawn, the count begins. santa clara county tallying up the in housed. >> this is the census track we will be surveying first today. >> laura sandoval is the regional director of path, one of the nonprofits helping with the point in time count. housing and urban development requires these counts every couple of years. >> we are going out to see if we had denny -- identify any people who are in housed. >> there used to be somebody here. it looks like they moved. >> ryan is a street outreach worker and he knows his way around these encampments. >> there are another two here. >> account is meant to be a

snapshot of the homeless population, both the sheltered and unsheltered. it helps determine federal funding and gives guidance to counties who know to put their resources. >> people who are able to off the street and not able to sleep outside. >> the last snapshot showed more than 10,000 people were in housed in santa clara county, a number on the rise since the past several tallies. while the percentage unable to find a shelter bed has gone up, the biggest barrier to finding permanent housing, 69% said they can't afford rent. 55% said they don't have a job. as don breaks, the team heads to an area hit hard by the recent record rainfall. >> is this what you expected to see today? >> the water is a little lower. you guys can probably be out here without the boots. >> for the most part people fled to higher grod someone to evacs

>> everybody has an individual story of why they are out here. >> abc 7 news. dan: these counts are conducted every few years and we have charted how the numbers have changed over a decade in each bay area county. you can check this out at abc7news.com. ama: part of our work to bui better bay area is to focus on solutions. san rafael recently closed a homeless camp and is working on a way to keep people off the streets permanently. cornell barnard has that story. >> this is a model that the city council is going to think about. cornell: the city of san rafael is thinking small when it comes to solutions for those experiencing homelessness. a community of tiny homes. >> it is difficult for the city to serve people in encampments because people must move around a lot and the situation is not as healthy or safe as what it would be within an interim housing project that we set up. cornell: the concept of interim

housing or tiny homes is gaining popularity across the bay area as communities grapple with homeless camps. san rafael is considering small, livable structures to house about two dozen people. the discussion comes after a city sanctioned camp, once located right here under highway 101, close last summer. this woman says she once lived in the camp. where are you living now? >> you are looking at it, the sidewalk. i stay with friends here and there, but mostly because i need a place to stay and then either house cleaned. i've never been homeless before, so the past three years have been a whirlwind. >> i think it is a step in the right direction. cornell: advocates from a nonprofit support new housing options, but only if the tiny structures are built to last. >> think long term about spending money on tiny homes, build permanent housing. don't build tiny homes only

intended to be short-term and then you throw them out. we don't want people to live in that substandard housing. cornell: federal and state grants would help fund the project, but it is unclear where they would be located. public input still to come. >> i think it is important to know that the success of these programs depends entirely on positive relationships with the neighbors. cornell: abc7news. ama: time to focus on the weather. quite chilly. dan: it really is. sandhya patel is here with the forecast. sandhya: the winter chill will be with us tomorrow morning just like this morning. the only thing that saved you in some areas was the wind. but it was cold. don't get me wrong. 31 in downtown santa rosa. 34 in concord. those are some of the colder spots. 38 degrees in san jose. from midnight until 9:00 a.m.

>> building a better bay area, this is abc7news. dan: it has been one week since the shootings in half moon bay. eight people were shot at two different farms, only one victim survived. investigators call this an act of workplace violence. the suspected shooter faces the possibility of life in prison if convicted of the first degree murder charges filed against him. several employees went back to work at the mushroom farm where their coworkers were killed. ama: many are still traumatized by what happened. we were in half moon bay to better understand the process they faced. >> it has been a week since seven people were killed at two mushroom farm's in half moon bay. the shooter killed four of his coworkers. we confirmed that workers were back today.

>> option to go back to work. >> concord farms is still closed. three workers were killed here. remain anonymous. the wife said s gunshots and saw her neighbor's body on the ground. she is still traumatized and could not sleep for three days, but decided not to go back to work. >> there is a lot of fear about losing the job. may be getting deported, losing housing. there are fears. have lost their jobs and regarding housing, they are working on building permanent housing for their workers.

the company expects the development project to take one year to complete and received all operating state and local permits. san mateo county has been paying for farmworkers from concord farms and the other site to stay at hotels, help that will continue until they get stable housing in the upcoming week. >> there are memories of people who lost their lives. >> some believe that going back as part of their healing. >> they might find the healing that they need going back to the same location. >> in half moon bay, luz pena. ama: tomorrow, memorial service will be held at the district event center. there will be a candlelight procession from the event center to main street, about half a mile away. we have compiled a list of ways

you can help people impacted by the shooting. go to abc7news.com/takeaction. dan: a vigil in sacramento to honor tyre nichols. it is a place where friends say they spend a lot of time together growing up before he moved to memphis. two more memphis police have been relieved of duty. one officer and another unidentified are under investigation for their involvement in the traffic stop that led up to the deadly beating. while those two have not been fired or charged, these five officers in the case have. they have all lost their jobs and are being charged with second-degree murder. we learned that three members of the memphis fire department have also been fired because of their actions or lack of action one called to the scene. the initial call was received at 8:31 p.m. and he wasn't taken to the hospital until 9:08 p.m.

he died three days later. his funeral is set to take place wednesday in memphis. ama: a no kill animal rescue says it's landlord, caltrans, told them they must bid at auction to keep renting their property or sign a long-term lease they likely won't be able to afford. melanie woodrow has the story. >> there is no shortage of barking at this no kill animal rescue in san pablo. but all the noise is about something else today. caltrans, which owns the property, told them they must bid at auction to continue renting it or enter into a long-term lease up to 20 years. >> i could not sleep for three days. >> the founder and president says for more than a decade they have been at this location paying a nominal amount of rent to caltrans. >> we have been lucky enough to not have anything change for 12 years, but now they want to do something about it. >> and email sent last week,

the lunar new year. 2023 is the year of the rabbit, which means expect to see a lot of rabbit themed floats at the parade saturday evening. designers are putting the final touches on more than a dozen floats. dan: they will be great as always. more than 9 million californians have received middle-class tax refunds from the state loaded onto those debit cards, but many reports scammers stole the money. others threw them out by mistake. ama: one bay area couple had their own fiasco. it began with a routine trip to the atm. >> this is a crazy story. this is nuts. this couple was one of the first to get a debit card last november. when they slid the card into an atm, it did not come back out. the money did not come out either. what they went through to get it back is kind of funny, but definitely infuriating. >> it just sucked it up. it was gone. >> he was at a loss.

he's gone to an atm to cash in the $700 debit card he and his wife got from the state for inflation relief, but there was one little problem. >> i put the card in and nothing happened and all of a sudden i heard it swallowed the card. >> the atm would not give back his card and did not give him his money. >> it did not give me a prompt or anything, it was gone. >> so he and his wife called the debit card company to request a new card. there was just one little problem. >> please enter the number on your card followed by the pound key. >> the number on my card. i don't have that. >> he couldn't reach customer service without a card number, which he didn't have. >> now they are asking for the number on the card. >> he tried to guess the number using digits he found on the debit card insert. >> we will try another one. >> we still did not get the

requested information. please call us back when you have valid account information available. >> 7 on your side told their story to the franchise tax, the agency distributing the money. staffer said he could reach a live agent by calling a different number and pressing option one, then option nine. it worked. >> a nice lady told me i'd have a new card by december 6. which was great >>, but there was one little problem. >> today is january what? >> the card never came. he tried to call money network. >> thank you for your call. due to high call volumes, we are not able to assist you at this time. please try again later. >> still no debit card. the couple did get this. the 1099 tax form to report the $700 as income. >> i couldn't believe it.
