♪ thanks for joining us. he's one of hollywood's biggest stars, but tonight the future for alec baldwin is much dimmer. the accomplished actor with a comedic touch is facing criminal charges in the fatal shooting on the "rust" set. now he'll have to defend himself in court. >> alec! >> reporter: alec baldwin, a hollywood heavyweight for more than three decades, making millions laugh on shows like "30 rock." >> i'm 50. that's like 32 for ladies.

>> reporter: now his illustrious career hangs in the balance. prosecutors criminally charging the actor and producer with two counts of involuntary manslaughter in the fatal shooting of cinematographer halyna hutchins on the new mexico set of the movie "rust." >> this certainly is always going to be a black mark on his reputation. >> reporter: the bombshell court documents released today revealing new allegations about the tragedy. >> alec baldwin was the actor who had the gun in his hand. but he was also one of the producers of the film. and prosecutors seem to be holding him accountable for both. >> reporter: the santa fe county district attorney's office also formally charging armorer hannah gutierrez reed with two counts of involuntary manslaughter. prosecutors compiling instance after instance of alleged recklessness by baldwin, gutierrez reed, and the movie's assistant director, dave halls. october 21st, 2121, baldwin was

rehearsing with a pistol he believed had no ammunition when the gun fired, hitting hutchins and wounding director joel so souza. no cameras were rolling on set when the gun went off, but body camera footage shows baldwin waiting to talk with deputies. >> so my understanding, you were in the room when the lady -- >> i was holding the gun, yeah. >> okay, all righty. >> what do you need? >> reporter: today's filing states in media and law enforcement interviews, baldwin "displays very inconsistent accounts of what happened." >> the d.a. clearly believes that alec baldwin was lying in his media interviews. and that seemed to have a big impact on the decision to charge. >> reporter: in an interview with george stephanopoulos less than two months after hutchins' death, baldwin insisted to abc he did not pull the trigger. >> i let go of the hammer of the gun and the gun goes off. i let go of the gummer of the gun, the gun goes off. >> at the moment --

>> that was the moment the gun went off, yeah. that that was the moment. >> it wasn't in the script for the trigger to be pulled. >> the trigger wasn't pulled, i never pulled the trigger wide receiver i would never point a gun at anybody and pull a trigger, never. >> reporter: prosecutors refute that saying the revolver did not malfunction, the trigger had to have been depressed. perhaps one of the most damning allegations made was the pistol was never even required for the rehearsal of the scene and that a plastic gun or replica gun should be used. >> it's not a single piece that they have against alec baldwin. obviously he's the one who fired the weapon, but they also think that he was incredibly negligent in more than one way in allowing this to happen. he didn't do the proper training, he didn't do the proper safety check, and he didn't take action as the producer, they say, when they had other problems on the set. >> reporter: prosecutors also claiming baldwin was not present

for required firearms training prior to the commencement of filming. and during one half-hour training session, baldwin was distracted and talking on his cell phone to his family. court documents fiercely critical of the ar morrer as well saying gutierrez reed wasn't certified for the job and six live rounds were found on the set. >> we're going to trial. >> reporter: gutierrez reed's attorney staunchly defending their client saying she'd been prevented from entering the church where they were filming when baldwin was in possession of the gun. >> had hanna been called back into that church, had she been allowed to inspect that firearm one more time, had she been allowed to instruct mr. baldwin how to point that firearm, how to use it this tragedy would not have occurred. >> reporter: hutchins' death was not the first time a gun was discharged onst" set. the d.a. ou oer tscrg revolver that discharged a blank cartridge in the hands of the prop master and a rifle loaded

with blanks allowed a stunt performer to take possession unsupervised, in direct violation of some of the most stringent safety protocols in film. baldwin's attorneys maintain their client's innocence, reiterating the 64-year-old had no reason to believe there was a live bullet in the gun or anywhere on the movie set. these assistant director, dave halls, has agreed to plead to a misdemeanor charge of negligent use of a deadly weapon and serve a suspended sentence ask six months of probation. >> three different people, if they had only done their job, we wouldn't be standing here. >> reporter: abc's linsey davis spoke with santa fe county district attorney mary carmack altweeze when they announced charges would be coming are. when did you ultimately decide you had a strong enough case to bring charges against both hanna and alec? >> because this set was really unsafe. it was not being run well. it was not -- they were not doing the things that they should have been doing in order

to have a safety-conscious and certainly with guns, a gun-conscious movie set. >> for an actor to be charged with this type of criminal charge based on their participation in a project has a very significant chilling effect. >> reporter: s.a.g. actress duncan crabtree ireland said the incident has sparked fear among hollywood elite. >> i have been told by multiple successful working actors that they would not consider working in a production that involves the use of a firearm at this point because of their fear over this type of overcharging and the attempts to hold them responsible for things that aren't an actor's skill set or expertise. >> reporter: s.a.g. after ra continued to support baldwin. do you think alec baldwin should have been charged? >> i'm speaking with respect to alec baldwin in his role as an actor on this production. any actor on a production is not a firearms expert. it's our strong view that actors

should not be held criminally responsible and the idea that the prosecutor in this case has said that it was the actor's responsibility to do a final gun safety check, that's simply not consistent with the expectations of any actor on a set. >> i know that you're only speaking with regard to alec baldwin's role as an actor. but do you think the fact that he's a producer changes the way the responsibility might be seen by a prosecutor? >> hard to say for an individual. i think as a producer, you do have potentially different responsibilities, depending on the nature of your role as a producer. the word "producer" can mean a lot of different things. >> reporter: for decades, alec baldwin filled the big screen with hits like "it's complicated." >> omg, i thought he'd never leave. >> reporter: and his countless appearances on "snl" impersonating donald trump. >> i am so excited to live in the white house. >> reporter: but his life off screen has often been turned into tabloid fodder. >> you hive some of those people who are more known for their
