good evening. >> thank you for joining we talk about building a better bay area because we want to see life improve for everyone who lives here. for drug addicts living on the street, the question is how can we make things better for them and by extension for us as well. >> safe injection sites are one option. places where people can use illicit drugs under supervision. supporters say they save lives. >> a bay area mother and her son are the faces of the campaign aimed at president biden calling on him to say no to these sites. tara campbell has been following the story. >> she joins us live from the newsroom. >> san francisco mayor breed has been pumping the brakes on safe consumption sites citing legal concerns. being that these sites are still illegal under federal law. last week she introduced a possible workaround: on the board of supervisors to make way

for privately funded sites. while some say it is the right step others are not so sure. jackie berlin and her son, the faces of a mobile billboard campaign in washington, d.c. calling on president biden to enforce the federal law and say no to the safe injection sites. the president's own son having battled drug addiction. >> i am appealing to president biden as a parent. >> berlin is a cofounder of mothers against drug addiction and deaths. her son has been on the streets of san francisco's tenderloin for more than a decade. now addicted to fentanyl. >> we need to put our funds into prevention, intervention and recovery. my call to president biden and his administration is to not allow these drug sites, drug use sites in the united states at this time. >> the drug overdose crisis is killing on average 50 people in san francisco every month and

some see safe injection sites as part of the solution. these are places people can go to use their drugs under supervision in case of an overdose. lydia is the executive director of the group real project. >> what we know about overdose prevention sites is when people use pre-obtained drugs in a safe consumption site or overdose prevention site they do not die. to the first injection site in north america established nearly 20 years ago. it has overseen nearly three and a half million injections and reversed more than 6000 overdoses. no deaths have been reported. despite being a legal in the united states a nonprofit in new york city is operating two privately funded safe injection sites. a model san francisco could soon follow. >> we all know how to do this. we could put it up very quickly but we need to -- we want to do

it correctly. we want to make sure there are wraparound services. that there is access to as close as we can get the treatment on demand. >> mothers against drug addiction and deaths joining forces with nonprofits across the nation to make their message clear. >> i think in the future there may be a place for safe consumption sites but we need to build the recovery and treatment first. >> princeton says there is no time to wait. >> wouldn't it be perfect if we had everything lined up? yes, it would the fact we do not should not stop us from saving lives today. >> there is still a long way to go in san francisco before safe injection sites could be a reality. board of supervisors is expected to vote in favor of making way for the sites but the city attorney still has to give it the green light. >> what about the cost of these sites and the timing? >> that is seen as another big

barrier. under the new york model nonprofits are going to have to raise millions of dollars. speaking with the project, they say that is going to take some time so there is a lot to work out. i did also speak with supervisor hillary ronen who introduced legislation along with the mayor and she said ideally they will get three sites up and running by the end of this year. >> thank you. >> for more on the battle against the drug overdose crisis you can watch tara abc 7 originals documentary injecting hope. she traveled to vancouver, canada to see how it worked. >> one man is using c rather than criticism. caring instead of neglect for drug users who struggle to care for themselves on the streets of san francisco. >> he is posting videos of his efforts on social media. leah melendez walked through the tenderloin with jj smith. it is getting a lot of attention. >> i always stopped to read his

posts because i truly believed there are people in this world who are doing great things and he is one of them. his mission is simple. jj smith once people on social media to see what those on the streets hooked on fentanyl and other drugs are going through. you know everybody. >> yeah. >> everybody knows you. >> yeah. >> what to they think of you? >> they just like me. >> and so my journey with jj smith began through the embattled tenderloin. born and raised in san francisco and living in this neighborhood. what is it going to take for this epidemic, the fentanyl epidemic, to stop? to go away. >> treatment on demand. >> but they don't want treatment a lot of them. you say it in the video. >> you have to get yourself some help. >> i'm sorry. i'm kind of zoning out and

getting worse. >> if it is getting worse, let me do something about it. >> you think there should be forced into treatment? >> nobody should forced -- should be forced to get drug treatment but you don't get on that she don't give up on a person because they say no. you asked on the next day. >> for jj smith, the next days often turn into weeks and months . he posts many of his interactions with drug users on social media to show others that compassion can bring understanding. >> what is wrong? which one? this one? he had an abscess and infection on the side of his arm. you need to go to the hospital? >> yeah. >> let's go. >> smith keeps an eye on many of them as if they were his own kids. >> get a t-shirt and a coke. >> the success stories are few and far between. >> how has it been at the shelter? >> it has been alright. it has been a place to stay. >> i have him in the shelter

now. pretty soon he is going to be transitioning from the shelter to a program. >> he assures me most of them are not from san francisco. what brings them here? >> some of them came here the pandemic because they knew it was free access to drugs here. in -- and sample disco brings out a lot of assistance. 19-year-old noah who have been lost to fentanyl for a while. he posted the time he set noah down to clean his face while he was nodding off. you tear up. >> because noah is kind of special to me. i have been working with noah for so long. >> he is only 19. >> no kid that is 19 result should be hooked on drugs as much as he is. >> your approach is man-to-man defense here. is that practical? could i do it? could other people do it? the supervisor of this district

agreed to pay thousands of dollars to settle allegations they abuse the paycheck attention program during the paid-in. -- the pandemic. companies are la baguette in palo alto. santa clara, dynamic integrated solutions inc., and industrial equipment supplier will pay $50,000. also paying 50,000, priority acquisitions incorporated. a licensed general contractor based in castro valley. the companies are accused of getting duplicate ppp loans and having the loans forgiven. each is paying back the original loan amount. no wrongdoing was proved but the companies all agreed to settle the allegations against. the whistleblower who raised concerns it can $8,000 as part of those settlements. congress started the paycheck protection program in march of 2020 as the pandemic took hold to provide small businesses loans so they could continue to pay their employees well

business was lower stopped during shelter-in-place orders. the house oversight committee held its first public hearing on covert fraud. >> you test positive for covid in order to get prescribed antiviral drugs. the fda removed the requirement for paxlovid and lou trivino. the change will allow health care providers to write prescriptions based on symptoms and the risk of developing severe covid. it should make it faster to get a prescription so patients can take the drugs during the onset of the virus when both drugs work best paid santa clara county's mass vaccination and covid testing sites are closing at the end of the month. dustin dorsey explains while testing and vaccinations are still available, this is a step toward moving into the next phase of covid response. >> three that is what friday will mark in santa clara county. it is the day public health officer dr. sarah cody announced the first emergency order into the south bay.

county leaders announced a major shift. >> we are not here to say covid is over it as a matter of fact, the virus continues to spread. >> we are still in the middle of a pandemic but we are transitioning from a full-blown response where we have a sense of urgency every day to one where we are adapting to living with covid. is by closing all county mass vaccination and testing locations by the end of february. the site served around 30,000 residents per day during the peak and helped more than 90% of residents get at least one covert shot. >> we saved thousands of lives in this county by being on top of the pandemic right away and getting everyone vaccinated. >> this announcement after president biden set the national emergency will end in may. as some celebrate the sign of a return to normal, disability rights activist therese hill has concerns. >> when the emergency ends it is going to get even worse.

>> a washington, d.c. mass transit worker was killed and three other injured during an attack. a second veteran employees stop the shooter who is in custody. the surviving victims have non-life-threatening injuries. >> the caltrans building in oakland was evacuated and stayed closed all day. the call came from an employee who saw a man coming the building on grand avenue 7:00 a.m. after a two hour sweep officials

determined the man was no longer there. just over a week after the mass shootings in half moon bay and -- >> this is also in direct response to a ruling by the supreme court last year that loosened restrictions on who can get a concealed carry weapons permit. liz kreutz looks at what this legislation means. >> following up on his calls from work on reform following the mass shootings at half moon bay and monterey park today governor newsom stood by democratic lawmakers and gun-control advocates to lend his support for sp2. it proposed bill to strengthen state restrictions on who can carry a firearm in public. > we have more work to do. this is part of this effort. >> the measure would ban anyone younger than 21 from getting a concealed carry permit. it would also require all permit holders to have more training including how to safely store and transport guns.

it would set limits on where people can carry a firearm. lawmakers want to create so-called sensitive sites where unless a private owner chose otherwise guns would be off-limits. just as examples, playgrounds, amusement parks, bars, preschools, childcare facilities. all forms of public transportation. hospitals and care facilities. public event spaces. parks and athletic areas open to the public and more. >> the legislation is a direct response to the supreme court ruling last year that loosened lows around who can get a concealed weapons carry permit. that decision by the court has led cities like san francisco to begin processing thousands of new licenses that would never have been processed prior to the ruling. california attorney general rob bonta says he is confident sp2 is constitutional. >> this is compliant. it is designed to comply with the supreme court dictates and direction.

>> there are parts of it that may be constitutional but overall i think this is going to get challenged and defeated in the courts. director for the california rifle and pistol association. he says the bill will face legal challenges. he also believes it unfairly targets law-abiding gun owners instead of criminals. >> it is targeting a group of people who own firearms who are not the problem and claiming it is the problem. >> governor newsom also said he expects a federal judge will overturn california's assault weapons ban. this could happen in the coming weeks. the california way for and pistol association say they are expecting this. they point out if it does happen it would likely be challenged in court. litigation that could take years. ways you can help people impacted by the half moon bay shooting. good abc7news/take action. >> still cold and the rain is coming back. >> sandhya patel is here with

the latest. >> the temperatures are going to come up overnight and in the afternoon. we're going to see the numbers drop as the rain moves in. let's take a look at the reservoir levels. some of the major reservoirs could look shasta, 56% like orville, 65. san luis, 63. we need more rain even though we are standing above average for just about every major city. oakland, j santa rosa, 100 29. san francisco is at 170% to state wide, our snowpack is 205%. we are expecting more snow with two systems coming our way. here is the first wimp you thisy there is a second system coming in over the weekend. 40's and the 50's. our coldest and most valleys darted out in the upper 20's and low 30's.

>> building a better bay area, moving forward, finding solutions, this is abc 7 news. san francisco city hall where city and community leaders took a need to mourn tyre nichols and demand justice. among them the san francisco police chief bill scottrade the group wealth and disparities under the black community organize the event and demand an end to low-level traffic stops due to racial disparities.

footage from police body cams and a surveillance camera. family members from victims of police violence were in attendance including the mother of breanna tyler -- breonna taylor and the brother of george floyd. >> today on getting answe julian glover had a roundtable discussion about tyree nichols death at the hands of memphis police. the guests discussed the response to what happened and how to move forward. >> we have seen what we could call a relatively swift action taken by the police chief in memphis and the da by firing some but not all officers involved in filing murder charges against five involved in the beating death of tyree nichols. is that the appropriate response to this awful instance of police brutality? would love to be able to start with you as a former law enforcement officer. >> i think it is absolutely the

right response. what the community is looking for is swift and definitive action. it does not take a deliberation from a jury to realize what the officers did was wrong so the fact that chief davis took definitive action quickly was the right thing to do. in memphis or in tennessee you can do that. had she been c department or a stronger unit it would have been a harder thing to do. >> your thoughts? >> i agree it is obviously the right response. what i am reminded of during moments like this and on a day where tyre nichols funeral is being held is what the families want. what the mothers want is for their children to be alive. the appropriate response is for this to never have to begin with and that we are here again it is frustrating. it is enraging it is also an

opportunity for us to see what some folks may have missed in the uprisings of spring and summer 2020. there are some lessons to be learned but i hope can move us forward. >> the justice people call for obviously cannot reverse time and bring back tyree nichols or any of the other folks killed at the hands of police. martin, your thoughts here. >> i come at this obviously from a journalistic perspective and a coverage perspective. of the big things i and many journalists are concerned about is the relationship between crime coverage and the relationship between police departments and many journalism organizations. the way in which different people are cast in the media. i think that is a big problem. if you look at how in many cases news organizations have cast their lot with access to police departments in the coverage of crime. you think about how these stories are told and how folks

>> the fed raised a key interest rate for the eighth time in less than a year today. it is going up a quarter of a percent display of the hike stocks and of the day and of the green. the dow jones rose by six points paired the nasdaq up 231. >> more than 30 million californians received a

middle-class tax refund from the state last year. it is a one-time gift meant to offset gas prices and crippling inflation. >> millions are finding out they may have to pay income tax on that money. michael finney is here to sort it out. >> what the government giveth, they taketh away. the government has been sending out 1099 tax forms to man's of californians who received inflation relief payments of $600 or more. that means a payment will be reported as income to the irs. the feds are still deciding whether or not to tax the payments. >> it is good for the people. with the cost of food and gas prices the way they are. >> i have been using it for small purchases. i go by bread at the bakery. >> they arrived at what seemed the right time. with gas prices hitting seven dollars a gallon and grocery bills soaring, the state rushed

out inflation relief payments. >> that would buy a lot of groceries. >> my grandkids can get something for christmas. >> millions rece ranging from $200 per person to a thousand $50 for families. but now the feds may take a bite. >> it is going to be up to the internal revenue service to make a ruling. >> the irs is still deciding whether or not you must pay taxes on your relief payment. >> i would hope and imagine the irs within the next month would come out with some ruling. >> norman golden says if the irs believes the payments were meant for economic relief they would qualify for a tax break. >> it has to be for the promotion of general welfare. there is a very good argument it would qualify. it was at a time when it was going to counteract inflation, higher gas prices. >> no ruling yet. even as taxpayers are filing returns. the irs may be reluctant to let

go of potentially huge tax revenues. california spent more than $9 billion on belief payments. >> i think of all the people in california that got this. you pick an average tax rate. that is going to be a lot of money the federal government is going to lose out on. example and you were in the 25% tax bracket you would have to pay $175 of your payment to the irs. he says report the income but then ask to back it out. citing the so-called general welfare exclusion. if you are denied he says, be happy you get to keep the rest of the money. >> i hate to say it but through end of the tally and say that is how it is. >> you do not have to report this income on your state taxes. if your inflation relief payment was less than $600 you will not
