today it is it's our chapa's day travis led them movement calling for equal rights and fair treatment for farm workers in the 60s. he died in 1993 today. this is birthday oakland unified's first black superintendent would have been 100 years old today. marcus foster is remembered as someone who was on the verge of improving schools in the early 70s when he was shot and killed. yeah as abc 7 news senior education reporter lee and melendez explains the foundation that he is continuing his legacy.
6:25 pm
oakland's time is now those words spoken by the late marcus as to bring as much equity and equality to the educational experience for every student back. then virtual morale was part of the oakland black caucus who supported dr. foster's appointment as superintendent the success of the schools would be based on the students parents involvement the teachers and the leadership and the leadership of course was marcus foster and his administrative team, but before he was able to accomplish his goals marcus foster was shot and killed in november 1973 right here as he was leaving the school. district two members of the militant group the symbionese liberation army were eventually arrested dr. foster's deputy was also shot but survived and in a 2002 interview with abc 7 news robert blackburn identified the two members of the sla who would later serve time to this day.

they continue to claim their innocence the group became notorious for later kidnapping patty hearst, but why kill dr. foster there is much speculation, but it appears they did not agree with some of the policies foster wanted to implement it was the 70s and era of unrest and many social movements today the marcus foster education institute partners with the school district to try to continue supporting students and improving outcomes. every teacher should want to thrive to be better. every student should have more resources to be more successful. every institution should look at their models and say, how could we be leaner be smarter do this in a faster way that benefits our opportunity to create a better educ experience in oakland leanne melendez abc 7 news coming up next a statue and a statement by the timing makes the message especially poignant also ahead. ask if i can get menthol jewel pause. the item has showed you how california's ban on flavored.
6:27 pm
6:30 pm
moving forward finding solutions. this is abc 7 news. this week the abc 7 news i team has dug into california's ban on flavored. tobacco products to see whether it's really working tonight the third and final installment. our investigation has gone into dozens of stores in person. yeah, but what about buying these band products online i-team reporter stephanie. sierra is here with an investigation. it's the only on seven staff. yes as we've been reporting all week. the state law is is very clear. this most flavored tobacco products are banned, but we found some retailers who are not following the law and federal experts argue the lack of enforcement is opening the door to a bigger problem. has any enforcement agency come around to inform you of the rules? the healtheptom around and do checks. no, no. i haven't seen nobody.
6:31 pm
what's the point of a ban if it's not being enforced are they even looking into this? the sale of most flavored tobacco products are prohibited in california the ban applies to anyone but there's special attention to keep these highly addictive products away from teens. do you get a lot of teens coming in trying to buy? some customers. yeah. yet why is it so easy for them to get it? whenever you're ready to show you we asked an 18 year old high school student to accompany us to check out several smoke shops in sunnyvale. we watched him walk in and followed shortly after to hear the conversation. he asked to buy menthol jewelpods one of many flavored. tobacco products included in the state and local city band. he says the store clerk have them in stock asked if i could get menthol jewel pause. the woman asked me if i wanted three percent or five percent, but the sale didn't take place the young man was asked for id,
6:32 pm
and he showed the clerk his vaccine card as i was paying. she asked for some id. i asked if i could sure my vaccine courage said i needed physical idea, but did she indicate she was willing to sell the product? yeah, it's good. the young man was guarded but the store clerk still. them he could just go online to buy the products. so we tried it. so what are these so these are disposable babes. just typing in the search bar flavored e6 all these results showed up. in fact, some of their best-selling items are products included in the state's band and were not just talking about a couple flavors. these are e-cigarettes offering 19 different flavor options with 50 milligrams of nicotine. i'm just curious if it requires id verification the 18 year old would have been able to purchase these online and have them sent to his home just by clicking. yes to this. yeah, okay study bales flavored tobacco band is even stricter than the statewide ban. the question is is enforcement actually effective.
6:33 pm
we are aware of the business that you mentioned what we have found through several inspections that as they are indeed selling flavor tobacco. the item obtained records from the city's code enforcement team revealing. this store has failed the last four inspections dating back to april of last year yet nothing's changed. so what happens next for businesses like this because i'm still seeing on their website they're selling and products. yeah, they they will be cited. so how many citations until it stops? well, we're working with the property owner the business owner currently because ultimately their responsible for the businesses that they own records show this store is one of tobacco retailers in sunnyvale, the city's code enforcement says the majority of them were in compliance for at least one inspection this year, but that's not the case everywhere. we visited and checked dozens of smoke shops across the bay area. some say they're strict. no, they know we are hard with
6:34 pm
the new jerseys. we don't play with them. some say they're not their stores in the cities that sell it underground and others say they're confused on the rules. have you been given any direction from the state none? but if you ask well informed critics, they say stricter not the band simply doesn't make sense in part because of this anyone including teens can seemingly access a legal products with just a few clicks. we need to be more responsive. we spoke with a retired assistant director with the bureau of alcohol tobacco and firearms richard mariano's who's conducted enforcement operations involved in criminal. tobacco trafficking. he says the state's band lacks an adequate enforcement strategy and because of that the demand for the tobacco black market in california is one of the highest in the us black market is alive and well in california specifically black market. tobacco mariano says former atf investigators have conducted a market survey to see just how
6:35 pm
effective the ban is in different california communities. he says the teams made purchases to try and identify problem areas across northern california, and that's an issue when seven out of 10 places they can go to are just selling randomly to anybody one flavored. tobacco product. well known in the black market across the us is starting to gain popularity in california. it's called gummies and experts worry, they're attractive to kids rich from what you've seen would you say the tobacco black market is worse in california compared to other states. it's been wrong all over the united states with california is one of the places where it is gathered the most attention. now mariano says an association of police chiefs across the country has found nine out of 10. tobacco products being sold to youth are being manufactured overseas and are being trafficked through the black market and we all know how addictive these products are to put it in perspective one jewelpod has just as much nicotine as smoking an entire
