contracted shingles nearly two months ago in early march. dan: while she recently announced she doesn't plan to seek reelection in 2024, some are calling for her to step aside sooner than that. we are in the newsroom with the story. reporter: up until of the calls for senator feinstein to step down were coming from democratic pundits and strategists. but now even congress members including one here in the bay area are calling for her resignation. they say her absence is hurting democrats'ability to confirm president biden's judicial nominees. tonight a growing number of democrats are calling on california senator dianne feinstein to step down from public office. a bay area congresswoman, the most high-profile yet to join that chorus, tweeting wednesday it is time for senator to find sent to resign and we need to put the country ahead of personal loyalty. while she's had a lifetime of public service, it is obvious you can no longer fulfill her duties. >> her defenders would say she's

a reliable democratic vote, but she's not even about anymore. when you are missing 60 of 82 boats, that is not a reliable voter. reporter: feinstein who is 89 and announced she will not seek reelection in 2024 has been out of work since mid-march recovering from shingles. she has missed dozens of votes in the narrowly held democratic senate including 25 judicial appointments. the spokesperson for the senator has given no timeline for when she will return. a the san francisco chronicle. >> particularly painful to them and the judiciary committee, where feinstein is a member, because to advance judges and judicial appointments out of that committee, you need to have a majority vote. without feinstein there, they don't have a majority. reporter: the calls for her to resign hinge on this issue like a congressman saying her absence is stalling biden's judicial

picks at a critical time. just last week a ruling by a federal judge in texas but the future of a widely used abortion pill in limbo. should senator feinstein step down? >> no. reporter: high-profile allies are coming to her defense. >> senator feinstein has been elected and she's entitled the job. and believe me when you are elected to something, you are expected to serve. reporter: speaker eme nancy pelosi said said 60 may be a factor. >> i've never seen them go after a man who was sick in the senate and that we. -- in that way. reporter: the senate has a long history of accommodating members who are sick or elderly, ted kennedy john mccain were both gone for long stretches of time as they dealt with terminal illnesses. supporters of feinstein say she deserves that same respect. dan: this is really interesting and tricky waters. let's say feinstein does step down for the sake of argument, what happens then?

reporter: if that does happen, governor newsom would then be tasked with appointing someone to fill out feinstein's term just as he did when vice president harris vacated her senate seat. what complicates things this time is we are in the middle of a robust grace already to replace feinstein. one democratic spoke to today said because of that, newsom could choose to appoint a so-called caretaker candidate, someone who would fill out the term but not seek election in 2024. we will see. ama: the judge has scheduled another court date to set a trial date for the man accused of attacking paul pelosi. david depap is due back in court on june 14, when the judge will determine when the trial will start. the charges against him include attempted murder, elder abuse, and assault with a deadly weapon. he's already facing another trial in october on federal charges. he's pleaded not guilty to all charges in both cases. dan: in the east bay, the police chief of antioch is assuring people the city is

safe after an emotionally charged city council meeting last night. all of this is coming as 25% of the police force is being investigated by the fbi over alleged racist texts. we spoke with the antioch mayor about some of these messages, and let me warn you, the messages do contain graphic language. >> we kill mexicans so that blacks can feel safe, blame the blacks, and someone else responds, no responsibility on their part. buy someone a prime rib for that pig. reporter: that is the antioch mayor describing for the first time some of the recently released racist text messages allegedly sent by antioch police. police chief steven ford was called to speak on the fbi's investigation into the department's texting scandal at tuesday night's city council meeting. >> i have three goals on the screen. 15 strategies and 20 measures of

compliance that the doj will hold us to. reporter: for the past year, the antioch police the permit has been under a f criminal investigation for a wide range of offenses. the mercury news reports the text messages were tracked from september of 2019 to january of 2022. it now involves 24 officers. or about 25% of the entire police force. 17 of those officers are now out on leave. >> i can say to the city that we have adequate coverage, thankfully. we have restructured staffing so that there are no gaps in service. the city is safe. reporter: they are putting officers on 12 hour shifts. they hope adding new recruits by the end of summer. still, mayor thorpe says change is coming. he is calling for a special meeting next tuesday to begin the process of looking into the culture of the police department. >> we are going to start with the culture and specifically looking at internal affairs, the hiring and promoting practices. reporter: emotions ran high at

tuesday's meeting. at one point, the mayor challenged a public speaker after the speaker suggested the mayor be investigated. >> [indiscernible] [beep] >> apologize! [indiscernible] reporter: the mayor was criticized for his outburst. but he says, he stands by his actions. >> i was not going to allow him to hijack the experiences of so many residents who expressed concerns about this police department and racism and biased policing. i was going to stand up to that, and i don't care what it looked like. ama: the firing of former oakland police chief lauren armstrong was not discussed during the first federal oversight hearing since the removal. judge william listen comments on the progress but says the department still has significant cultural problems. the federal monitor's latest report says opd was still not in compliance with two out of its

45 tasks. city officials said the goal was to get out of federal oversight by this summer. police remain on the scene of a double shooting in east oakland. this is video from sky7 a short time ago over brookdale avenue near coolidge. police tell abc7 news to people were found shot before -- two people were found shot before 4:00 p.m. there is no word on the conditions of the people who were shot. dan: happening now, breezy conditions across parts of the bay area. here's a live look outside. let's go straight to abc7 meteorologist sandhya patel. meteorologist: the winds are up again. the camera is bouncing around as we look back toward sutro tower right now, dust into 32 mph -- gusting to 32 mph at sfo. winds remain gusty through this evening. along the coastline we have a wind advisory until 9 p.m.

excelsior district's first affordable housing project in more than 50 years, with 137 units. construction is almost done but has one problem -- no electricity. >> people can't move into the buildings until these buildings have power. reporter: the san francisco's mayor's office of housing and community development says the same thing is happening at a total of 11 affordable housing projects across the city, with expenses and delays adding up to $41 million. now, this office is going back to the board of supervisorss, asking for $9 million in additional funds for the mission street project alone. >> that is taking from building more affordable housing just to do a transform or upgrade for the building. reporter: pg&e blames recent storms, saying we are working hard to recover from those systemwide impacts to complete customer connection projects. the city's director of housing development says the issue stems from a 2016

utilities commission their permanent provider instead of pg&e. >> the need for new buildings and infrastructure to attach to the puc, pg&e's grid rather, and those improvements are generally paid by pg&e as a retail customer. we are also customer and those costs are borne out by the housing project. reporter: the supervisor says it is red tape that could be avoided. >> a lot of people feel like it is kind of nonstop additional requirements that are asked by pg&e. it is unfortunate. reporter: that's why senator scott weiner introduced a new bill to hold pg&e accountable by setting an eight week deadline to turn on power or compensate for resulting damages. >> if they don't meet those timelines, there will be fees and penalties. that has really gotten pg&e's attention, they don't want that piece of legislation to pass.

dan: in chinatown, and effort is underway to make sure that people know their health options. today the state treasurer joined volunteers to canvass the chinatown community, the goal is to keep people healthy. they say two to 3 million people are in california that are at risk of losing their health coverage on may 11th. that is when the national public health emergency issued during the pandemic expires. >> this is coming. we know it is going to be a problem later on and if people lose coverage, we are going to be overwhelmed and we are all going to be back in that space. why didn't they know? we are doing to try to do as much outreach as we can later on -- early on. dan: people can reapply for medi-cal or health through covered california. ama: in japan town, community leaders gathered to celebrate new funding to improve one of the city's iconic landmarks. a $3 million check was presented to renovate the historic japan
