building a better bay area moving forward finding solutions. and unethical relationship between the san francisco 40 niners and members of the santa clara city council. and now tonight, one city council member is facing perjury charges for allegedly lying under oath about sharing confidential city documents with the niners. good evening. i'm on the dates and i'm dion lim, it all stems from a report titled unsportsmanlike conduct. santa clara city council, abc seven news reporter dustin dorsey talked with a legal analyst about what this could mean for the council member and the 40 niners. lies leaks in litigation. santa clara city council member anthony becker indicted on charges of perjury for allegedly lying under oath to a santa clare county civil grand jury.

district attorney jeff rosen shared a statement. reading council member becker violated the public's trust that an elected official would commit perjury and lie under oath before the grand jury strikes at the very heart of our justice system and requires accountability. legal analyst steven clarke suggests the d a brought on these charges because he believes they'll stick perjury happens. every day. but it's rarely prosecuted because it is difficult to prosecute and the fact that the d a has brought these charges suggests that they have a strong case in court documents. prosecutors claim becker lied under oath in november when he denied leaking a civil grand jury report to silicon valley voice into the san francisco 40 niners. the leak is charged as a misdemeanor . the alleged lie is charged as a felony. becker allegedly sent the report to the team's chief communications and public affairs officer a few days before it was to be publicly released. it detailed what's described as an unethical relationship between several santa clara city council members , including becker in the san francisco0 . neit becker, the mayor, nor the city

council, responded to our calls by news time, but the team sent us this statement today, saying the 40 niners have cooperated fully with the district attorney's office in their investigation and will continue to do so, however, because this is an ongoing legal matter, the organization is not able to make any further comment at this time . clark says conviction on the felony perjury charge could mean four years of jail time. time in the removal of a city title. perjury is a very serious allegation, and it calls into question someone's moral judgment. and when you have a case like this, where you're asked a specific question, and you lie under oath, i think that calls into question whether mr becker could continue to serve on the city council is set to appear in court on monday for his arraignment at nine a.m. in santa clara, dustin dorsey, abc seven news in san francisco, the man accused of killing tech exec bob lee was in court today. it all comes as we learn more about the events leading up to the deadly stabbing. abc seven news reporter cornell bernard poured through the charging documents

today and brings us these new details. 38 year old murder suspect, neema momeni was in court thursday where the suspect and his family sent heart symbols with their hands. the charges are very serious. he's been charged with murder. i don't think guilty of murder, according to court documents, it began about 3:30 p.m. on april 3rd when lee and an unnamed friend and a resident met up with because our momeni, the sister of defendant name a moment and an apartment in the 1500 block of mission street, where the group was drinking, the unnamed friend told investigators, lee left the apartment for his hotel room at san francisco's one hotel. that's where lee spoke to nemo, momeni by phone, who began questioning lee whether his sister was quote, doing drugs or anything inappropriate, unquote . the witness says lee assured the brother nothing inappropriate happened, court papers say lee later went to keyser's apartment in the millennium tower on mission street about 12:39 a.m. on april 4th. at about two am

surveillance footage showed neema momentum and lee in the elevator before getting into momentum's white bmw district attorney brooke jenkins says the two were at odds. there was some type of dispute between the two men, at least that mr momeni was upset with mr lee about something prior to them, leaving her residents video showed the car driving to this secluded area on main street under the bay bridge for the two got out. that's where prosecutors believe many stabbed li three times with a four inch kitchen knife and left the seeds have all viewed a video of mr lee attempting to call 911 attempting to find help and not being able to be successful with that, and so to that extent, yes, he was left to die. police say the wounded, least stumbled down main street to the portside apartment building where he collapsed. prosecutors sagas are momeni had sent bobbly a text saying just wanted to make sure you're doing okay? because i know neema came way down hard on you. and thank you for being such a classy man

and handling it with class because our momeni and her husband were in court on friday , but had nothing to say we have no comment right now. thank you very much. francisco cornell, bernard, abc seven news in the east bay. arrests have been made in the freeway shooting that killed a five year old girl. court documents reveal that the shooting is believed to have been gang related, abc seven news reporters at fuentes has been following the case and has more on the new details linking the suspects to another shooting. saturday evening will mark one week since five year old eliana was shot to death while in the car with her family as they went to dinner in milpitas family spokesperson telling us more about the young girl so excited for easter. she had a school event coming up field trips. she couldn't wait to go on those more details into what happened. that tragic night have been released. prosecutors say it links the suspects behind that shooting to one other. here's what we know from the alameda county district attorney's office and court documents obtained by abc. sevens i team shortly before

that deadly shooting at southbound etienne dixon landing wrote. another person was shot at in fremont. police say they got a call saying that three men got out of the car and shot at someone. police connected with the victim and viewed surveillance video of the shooting. documents say the victim was walking on fremont boulevard wearing red, a color associated with the nortenos gang. the d. a. says the suspects are fremont sereno gang members arrival of the north daniel gang suspects allegedly drove by the victim in a red honda commented on the color of the victims. red close shot at him returned to the car and got away. the victim in that shooting was not hit by the gunfire 15 minutes later, according to the d, a, the 8 80 shooting that killed five year old eliana happened. she was in the car with her mother, father, grandmother and half brother, the honda believed to be connected with the sun. specs pulled alongside the family's suv. the alameda county d. a says the suspects believed it was a rival gang car. the victims in the car say that two passengers in that honda pulled out guns and fired several shots into the car. eliana was hit in the chest later dying 3.5. hours later, santa cruz police noticed the license plate of the red

honda on highway 17 pulled them over and arrested two suspects. a third suspect was arrested on thursday. those suspects are umberto and naya, crystal, ayala , valderrama and emmanuel tarango. court documents say that anya told police that they had been drinking and that he admitted that their actions were reckless. we reached out to a spokesperson for eliana is family who says that they did not know any of the suspects and are quote just happy justice will be served. now they can focus on the funeral and their baby girl in the south bay. zach fuentes, abc seven news, the city of oakland says it faces a multimillion dollar bill to fix areas in the city damaged by recent storms are now asking for money from fema, abc seven news reporter ryan curry went to some of the damaged areas and shows us why residents need repairs done soon. the sun is now shining. but you can still see the remains of storm damage in the oakland hills trees are still down on highway 13 and potholes everywhere on golf links road and mountain boulevard. some cars are dodging the divots, while others test

their luck, hoping to not pop a tire. cars dodge all day long. trying to beat the potholes both ways has owned this car wash for over 30 years, he says. the road in front of his shop has never been this bad. massive holes like this. you know somebody at nighttime on a motorcycle? some come through that they're gonna they're gonna they're gonna get really hurt yourself. this week , oakland released a report highlighting the damage to oakland roads from the storms in january. they estimate this damaged guardrail off golf links road will cost around $250,000 to fix this road. claremont avenue is projected to cost around 100,000. they say in total, fixing all the damage from january alone could cost them $7.1 million. but what residents are mostly concerned about are the potholes. oakland public works cat in nearly 400 new potholes in the month of january alone, a lot of them have these yellow painted circles to warn drivers. but if you ask oakland residents, they don't think those warnings are enough. i feel like i'm playing whack a mole trying to miss the

potholes, jenkins says she got a flat tire just three weeks ago after running over a pothole. i have put brand new tires on my car. two weeks later, i hit a pothole like what felt like the size of a swimming pool. and then i had to go spend another $300 to get another tire. oakland says they're holding meetings with female on funding to make repairs we reached out to the city for further comment, are waiting to hear back. both jenkins and tatum say if the city doesn't act soon, more cars will be damaged. been born and raised in oakland. i love oakland. and i have never seen oakland so ran down. i wonder if it's even operable in oakland. ryan curry, abc seven news one of the largest drug treatment facilities in years, is coming to san francisco. the city's health department will add 70 new transitional housing beds for residents seeking drug treatment. nonprofit treatment provider health right, 3 60 will lead the program located on treasure island. it's a two year long term program for people who need longer treatment than the 90 day stays. city officials say

it will cost $2.5 million a year to run. also in an effort to tackle the homelessness crisis, san francisco's mayor announced a new housing plan today. mayor london breed and the department of homelessness and supportive housing introduced home by the bay. it's five year strategic plan that includes outlines strategies and goals to reduce the number of gun housed individuals. a new permanent supportive housing site at the 12th street area was part of today's announcement. mayor breed and other city leaders took a tour of the new property , which breeds says is just the beginning. i am gonna work tirelessly and be unapologetic about the decisions. i make to make sure that this five year plan is implemented. under california's new legislation, san francisco is required to build 82,000 units over the next five years. still ahead, access to the abortion pill remains for now, after the supreme court took emergency action today will have the latest on what this means. and what comes

the biden administration is taking the abortion pill fight now to the supreme court. earlier today, the justice department asked the high court to take emergency action and restore full access to the drug . abc news reporter lindsey watts has the story. new action by the supreme court today means there will be no change to access to the abortion pill. mr prefer stone, at least for now. we are going to continue to fight in the courts. we believe that the law is on our side and we will prevail. stone is the primary drug used in over half of us abortions. last week, a texas judge suspended fda approval of the pill that was first cleared for use over 20 years ago. then a federal appeals court ruled it could stay on the market for now, but with restrictions that made the drug less accessible. it's not just about abortion. this case

if it's not overturned, has implications for a wide range of drugs that are critical in life saving now. justice samuel alito has issued an administrative stay of the texas court ruling that lasts until midnight on wednesday. already states have begun stockpiling mifepristone washington state spending over a million dollars dollars on 30,000 pills, an estimated three year supply since roe v. wade was overturned. 14 states have seized nearly all abortions. the bill passes florida on track to join the list once its six week ban is allowed to take effect. florida shouldn't be a destination state for abortion. the supreme court's action today is essentially a time out, it will give the court more time to hear from both sides and means nothing will change with regard to mifepristone until at least next thursday. lindsey watts. abc news washington. coming up the summer travel season has the potential to set new records.

water will be cold and running. fast live doppler seven right now showing you clear skies here in the bay area. i do want to tell you about el nino. so yesterday, the climate prediction center issued an el nino watch. basically they say that the sea surface temperatures near the equatorial pacific are running warmer than average. and what they're predicting is right now we're in it and so neutral conditions. basically we're not in a latina or an el nino. we're going to continue with that neutral through spring. there's a 62% chance of el nino, developing between may and july. and the range of possibilities could be anywhere from a foreign 10 chance of a strong el nino to a one in 10 chance of no el nino towards the end of the year. it is still too early to predict the precipitation. but keep in mind that we generally see higher than average precept if it's a strong to very strong el nino, and i know that the last big one i recall covering night and day was the 97 98 el nino.

tonight the suspect accused of leaking highly classified american secrets now charged under the espionage act. massachusetts air national guardsmen texas jack teixeira in court today. court records unsealed revealing how the fbi says they tracked him down after news of the leak went public. authorities accusing him of accessing top-secret materials, making some of them home and photographing them and sharing those documents with his invite only social media chat groups. when stories began surfacing in the news, the one keyword he allegedly searched on his office
