immediately dismiss all pending public defender cases involving any police department, agreed to release our incarcerated clients, and sees filing any apd related cases. this comes after a published report reveal a chain of racist and homophobic text messages alleging that they were sent by any police officers. >> this is a huge moment, unprecedented. reporter: a deputy public defender says the text messages to show exactly what police officers are doing in their own words. an example of one exchange, many black people. officer says, bro, they all look the same. >> i feel like i'm at the zoo. reporter: cases based on the word of officers must be dismissed. >> a traffic stop where an officer believes to identify someone, those cases should all

be dismissed. these officers should not have any credibility. reporter: the public defender's office says this can impact thousands of cases including those involving violent crimes. those may require more litigation. >> it may be up to judges to determine how big of a remedy to give. reporter: this attorney represents this man who was arrested for an attempted shooting. he was mentioned in several text change. detective robert gerber is named in the report. she says he testified as a gang expert as it relates to special enhancements. those charges could lead to life in prison without the possibility of parole. >> that enhancement is, in large part, founded on gerber's testimony. the impact is tremendous. it infects every aspect of the charges against my client. dion:

supervisor. in it, she says chief assistant district attorney criticize the victim of her case who was a api. the complaint was sent to her direct supervisor and a union representative, alleges bruce said, samoan's fight. they like to get drunk and high and fight in a minute. ford commented on this at monday's rally. >> it was his way of attacking a victim of a violent crime and justifying what would most certainly be a very low sentencing. our young a api sister was so shocked that she left and went to her office and broke down. dion: i reached out to bruce and the das office asking for comment on tuesday and followed up, but we have yet to get a response. ford told me the purpose of the rally and sharing what happened was not about race. >> it is all about doing what's right and protecting victims. dion: when i asked the representative for the union about any response, he said, no.

dion: some frustrated oakland residents show their support today for fireplace armstrong. he joined a group of people that included african-american pastors and survivors of time in oakland. they held a press conference to address what they call noncommunication with mayor sheng thao. they want more attention paid to the crime problems and say that starts with reinstating armstrong. >> he is the one that has been trying to reach out to us. so don't take away someone who understands us. what is have someone who understands us and maybe we can

violence amongst known gang members. melanie brings us the story. >> we are here implanting justice. melanie: this is worlds away from prison. marcato morning began working here in 2020. >> what i wanted to do was to come home and have a different life. melanie: when she was 19, she went to prison for shooting and killing another known gang member. she served 16 years and said she had this job lined up before she even got out. >> it is helping me to take care of my daughter because i am a single mother. melanie: she receives a $1000 monthly guaranteed income through oakland's community work restorative reentry fund which is funded privately. >> it has been helping me to be able to have a productive life

out here and not how to go back and, i need to commit a crime in order to be able to sustain myself. that would leave me right back to prison. that is one thing i never want to do. melanie: the program is in its third year. what is the goal? >> you the first thing that comes to mind. let folks know that [indiscernible]. this money is meant to aid folks on whatever journey there on. melanie: participants receive $1000 for 12 months. >> it shows community support, that we welcome you, we see the greatness in you, we want to help you strive. melanie: this man served 36 munson prison. he shot and killed a man which he says resulted in the retaliatory deaths of his mother and little brother. >> i am 100% positive that i

would never commit another crime. i am aware of the hurt and harm that i caused in a never want to cause that again. melanie: restorative justice reduces recidivism, the likelihood that someone will commit another crime. there are no strings attached. meaning you are not mandated to do anything. even if you fall out of you will still receive the money. melanie: some people would say that makes them uncomfortable. how do you know if someone falls out of contact whether or not they are back in a life of crime? >> you don't. melanie: since 2020, has anybody who receive this money committed a crime? >> yes. nonie: he says maybe two three people out of 60 and describes them as minor offenses. >> people will do or going to

do. melanie: a nearby restorative justice program is in its 13th year. it is for active firearm offenders who haven't been prosecuted. advanced ceo says participants can earn an allowance of up to $1000 per month for meeting certain milestones. it is funded by philanthropy and taxpayer dollars. in 2022, it had fellows enrolled in eight cities. >> within 24 months, we are seeing 20% reductions in every one of the cities. melanie: he is referring to reductions in gun violence. in 2016, fellow was shooting and killing two people within three days of one another. in 2019, he was sentenced to 40 years to life. i spoke with one of the victims families. >> you didn't take their guns. you are giving the money to buy more guns.

>> there is no program in this world that can pay a criminal any money to tell me that they are changing the streets. do you see where we are standing? melanie: of 231 fellows enrolled, according to field outreach worker reports analyzed by uc berkeley researchers, 31, 13 point 4% were arrested on new gun crimes since becoming a fellow. their cases are pending. >> it is success in the fact that we have been able to significantly slow things down. this is something that people of color and communities of color deserve. for anybody that doesn't get that, too bad. melanie: would you say the victim's mother? >> i get it. i would not say that. i get it personally. that i tell you what, i wish the

killer of my brother had access to what we do. these guys don't have to buy guns. they have guns. melanie: back in oakland, ross understands the pain victims family members feel. the grandson of the man he shot and killed contacted him. >> it left my mom emotionally damaged. she hadn't had her father since she was 11 months because of a mistake you made. the grandchildren were never meeting him. i responded. i feel horrible about that. i wish i could go back and change that. but i can't. all i can do is honor my grandfather. by being a better person and being in service to make a difference in the lives of others. melanie: the apology continued. he says he didn't receive a response. >> i believe everybody deserves

a second chance. people are capable of growing and never looking back. melanie: it is for that reason marcato believes in restorative justice. >> there should be more programs that help us get on her feet and more offered to have jobs and housing. >> wouldn't you want us to give folks who are trying their best, who are actually examples of what our people are capable of when given an opportunity? when you want to see them thrive? when you want to boost them up? help change the narrative? of how we are seen sometimes in this country? melanie: otto says she is still writing her story. dion: three currently missing in mexico.
