trying to stop a suspected shop from leaving the store. his family is, understandably, too upset to speak with us today, but we have learned he was a man deeply invested in and involved in his community. as you just heard, he was set to get married in just four months. this is 25-year-old blake mohs. police have identified him as the man killed while working as an unarmed loss prevention specialist at the pleasanton home depot right off of interstate 580. >> blake mohs he life was cut short by this senseless act of violence that turned into a robbery and ended in his murder. lena: it started when a 32-year-old was trying to leave the store through a back loading dock with some kind of electronic device lease say she had not paid for. >> she was confronted by blake, and that is when a physical confrontation ensued, the female suspect pulled out a weapon and

fired a shot at blake. lyanne: the suspect got into a getaway car, seeing neighbors in the store's parking lot said they saw a gun thrown from the car, the car was trots to oakland by the alameda county sheriff's office. they took the suspect into custody as well as a 31-year-old man who was driving the getaway car. police on the suspect's two-year-old child who was later reunited with family. >> we lost a valuable member of our family. lena: police say sign, brother, eagle scout, and a fiance, set to get married in sonoma county, according to the couple's website. >> blake was a real good person. he was the go to friend, like hey, blake, want to go hang out? "yeah, sure." want to go grab a beer? "yeah, sure." lena: david, who lived next door

to his parents, has been following the shooting since tuesday but was shocked to find out the victim was blake. >> every time i had seen him at work, he would have a really enthusiastic mood about him at work and stuff. he was not just there to do his job, he was actually there enjoying his work. i came in, it was like he was not even working. it was like talking to a friend. facing a number of charges, including murder, child endangerment, robbery, and conspiracy, with the possibility of more charges on the way to die also spoke with an armed security guard here in the home depot parking lot today. he said he along with a couple of other guards with past police or military experience work brought in today for an added

layer of security and protection for the customers when the story reopens. live in pleasanton, lena howland, abc 7 news. dan: thanks very much. police are trying to figure out who shot and killed a man in san jose today. the shooting happened after 1:30 p.m. on blossom river drive. investigators say when they arrived at the scene, the man had life-threatening injuries and later died, unfortunately. officials say they are still searching for the suspect. >> we are urging the public, anybody who has heard something, saw something, to please contact the police department and provide that information to us to help us in this investigation. dan: avoid the area as traffic will be affected while they continue the investigation. this is san jose's ninth homicide this year. ama: san jose mayor matt may quote when he said san jose would not become san francisco here is how he elaborated today.

mayor mahan: it is a cautionary tale. san francisco has struggled to get a handle on substance abuse, street-level crime. i wish the city the best of luck. i have been a resident there before. it is certainly a challenging time, but i think we will show in san jose we will get back to basis when we adequately staff our police department, when we hold repeat offenders accountable but also give them opportunities to better their lives, including drug treatment and job training. when we ensure everyone lives indoors, we can have a city that works for everyone. ama: don't forget you can see crime numbers are both san jose and san francisco on the abc 7 news safety tracker abc7news.com /safetytracker. dan: let's go to the scandal involving racist, misogynistic, text messages.

this comes as some people questions whether the antioch police department acted as a "police gang." abc 7 news reporter anser hassan has details. >> if police officers want to be treated like professionals, they need to act like professionals. it is that professional. -- it is that simple. anser: races in houma so -- homophobic text antioch police officers over eight period of two years. a sample of some of the text messages, "i'm on my way right now. what are you guys up to?" another officer replies, "violating civil-rights." >> this is not just the antioch police department today, this is historical. anser:

the report as being a target of antioch police picked she said given the number of officers involved, it could be considered a police gang under california law. >> penal code a lot of what we have meet the definition of a law enforcement gang. >> i have had no problem with a police gang. anser: even know he would categorize antioch pd to be acting this way can it would be up to an outside agency to investigate patterns of the department to make that determination. >> that is a group, of like minds, and to the extent it is unlawful, then you can consider that to be a gang. >> however, as enticing as this notion might be, this is not a gang, this is difficult to argue that the antioch police department has engaged in criminal behavior that would be similar to that of a gang.

anser: greg woods is the professor of justice studies and says a gang is loosely defined as three or more involved in criminal behavior. he points to other police gangs, such as the gang in oakland, where police planted evidence and made false police reports. prof. woods: here we don't have that. we have text messages distributing racial animus, perhaps at least an interpretation of bias, bigotry, racism. anser: woods said antioch pd acted as a fraternity rather than a law enforcement gang and it would likely take a class-action lawsuit to determine otherwise. in antioch, anser hassan, abc 7 news. ama: it appears mayor london breed is supposed to funding a new reparations office at city hall, at least for now. the mayor told the board of supervisors yesterday she has no plans at this time to report -- support the request from supervisor walton who is

proposing an office that would be in charge of implementing any final recommendations, which are due in june. mayor breed said she will wait for that final report before making decisions this comes as the city is facing a 780 million dollar two-year budget deficit. dan: san mateo county is one step closer to becoming a sanctuary county after the board of supervisors passed an ordinance that prohibits the county from cooperating with i.c.e. without a federal warrant. ama: critics of the legislation designed to bring more equality saying it overlooks public safety. stephanie has the latest. stephanie: an ordinance that is set to bring more equality for asylum-seekers and san mateo >> i double punishment for immigrants. >> when a person who is a child rapist, murderer, is released from prison, we will have no

ability to work with i.c.e. in order to go ahead and deport that individual. stephanie: the san mateo county from using county funds from cooperating with i.c.e. without a judicial warrant. supervisor ray mueller was the only one to have voted against it. he would have supported the order with three exemptions, for murder, rape, and child molestation. why did you support this for those convicted of murder, rape, and child molestation? >> when it comes to those sort of crimes, you are exactly right, that we were not going to cooperate with i.c.e. why should there be double punishment? stephanie: but the question, supervisor, is why did you not support those three exemptions? >> the answer to that question is, we took it on its totality, stephanie. we heard from families. stephanie: louis ray is the

cofounder of bay area border release, a nonprofit supporting families seeking asylum. he said the man and san mateo county is charged with molesting a 14-year-old girl. lilli: it just feels wrong. concern of his getting outcome of anybody getting out, that they will do it again. stephanie: do you know the perspective -- recidivism rate of those s >> i don't know. stephanie: the doj has found a study that the child molesters have the highest recidivism rate. does that change your answer? >> look, stephanie, that does not change my mind. what is the difference if we have someone who commits a crime that is a non-immigrant, and we have someone who is an immigrant? how is the community safer? stephanie: the question was, how can you make that assumption,

ama: at least one person is in critical condition after a fire this afternoon in san francisco's russian hill neighborhood. when an abc 7 ne news c flames were shooting out of the top of the building. one person inside got trapped while trying to get out and had to be rescued by firefighters. no one else was hurt. it took about an hour for firefighters to get the flames under control. there is no word yet under a cause. 20 people have been displaced. dan: let's draw attention to the weather forecast midweek. ama: abc 7 news meteorologist
