the weather is on the move, wreaking havoc overnight with at least one tornado ripping through texas, of course. >> storm system heading east. putting millions on alert. ginger is tracking it all. >> at least 128 reports, so in the last 24 hour, each dot represents hail, wind or that red one, that's a tornado. they'll do the survey today but we know it was because we see the people in the foreground there, that wedge almost at that point. as it was forming over the apartment buildings and the homes here, you can see that upward motion and that rotation. so evident of tornados. now, we will see more isolated tornados but damaging winds with one of the other huge threats. the flipped planes there yesterday morning, kansas city, missouri. that was their downtown airport. several flipped over. they had 84 mile an hour winds in illinois close to chicago's o'hare. that cold front is capable of doing the same thing from nashville up to louisville. cincinnati might get into the action, mississippi, parts of louisiana. watch as it marches east. it is saturday afternoon and

through the evening that the i 95 corridor erupts into damaging wind and tornado threats. washington, d.c. is in it, virginia beach, richmond, savannah. it will be heavy rain that comes through here with thunderstorms saturday night through philadelphia into new york. george? >> what a weekend. now to the shake-up in the rust case. prosecutors have dropped all charges for now against alec baldwin in the death of halyna hutchins. matt gutman has more. good morning, matt. >> good morning, george. this was a shocking turn. prosecutors saying they have new facts that compelled them to drop the charges against baldwin for now. the move coming on the very day shooting of the film "rust" resumed. this morning a major victory for alec baldwin, accused of involuntary manslaughter in the death of halyna hutchins on the set of the movie "rust." less than two weeks before an important hearing in new mexico, prosecutors dropped all charges against him for now.

the special prosecutors who were assigned to the case last month dismissed the involuntary manslaughter charges without prejudice, but stated new facts were revealed that demand further investigation and forensic analysis in the case. this decision does not absolve mr. baldwin of criminal culpability and charges may be refiled. the new york times reports evidence showing the gun baldwin rehearsed with had been modified before arriving on set. that would affect the prosecution's original argument that baldwin had to have pulled the trigger in order for the gun to fire. baldwin's attorney saying in a statement, we are pleased with the decision to dismiss charges against alec baldwin and we encourage a proper investigation into the facts and circumstances of this tragic accident. baldwin insisted he was told the gun did not contain live ammunition and that he never pulled the trigger in hutchins shooting death in a 2021 interview with george stephanopoulos.

>> so you never pulled the trigger? >> no, no, no. i would never point a gun and pull a trigger. that was the training i had. you don't point a gun at somebody and pull trigger. >> reporter: the head armorer is still facing charges. her attorneys praising the special prosecutor's decision saying they have taken a very diligent and thorough approach to the entire investigation and they fully expect at the end of this process that hannah will also be exonerated. and after that long hiatus, production on the western is now moving full steam ahead. daily mail.com posting these photos of baldwin arriving in montana to resume filming this week. for his part, baldwin reacting to the legal victory on instagram thanking his wife and lawyer writing, i owe everything i have to this woman and to you, luke. also posting after the new showing her in an embrace with her husband. the prosecution in this case suffered a string of set backs. two prosecutors had to step

aside for procedural reasons. primary piece of evidence that revolver was destroyed during testing. prosecutor had to downgrade the murder charge due to a mistake they made. now the biggest question, after all of that, are they going to refile charges against him. george? >> thanks, matt. dan, this was also a stretch. >> it was always a difficult case. it's still pretty stunning that we're at this point. couple weeks from the preliminary hearing and a new set of special prosecutors come in, examine the evidence and say, we're gonna drop the charges against alec baldwin. you got to take a step back there and say, that's a really big deal by special prosecutor, who simply did not believe that they had the case. >> some of it goes back to that claim alec baldwin made to me that he didn't pull the trigger. the fbi said, that's not likely but now new evidence came in? >> no one believed that. how could you have a gun that fires without you pulling the

trigger? now it seems maybe there was an explanation. maybe he was exactly right. and even the maybe could lead prosecutors to say we don't have a case. >> it may have been altered. is that why the armorer is still facing charges? at least one of the reasons? >> the armorer is about the rounds. it's not about the gun. what were the live rounds doing on the set? that was her responsibility in the end here. it looks like they're moving forward with a case against her. >> can charges really be refiled here? >> they could, but they won't be. there's no way they're going to refile charges at a later date against alec baldwin based on new evidence. it's possible they find new evidence. considering how many months they've been investigating this case, that's very hard to believe. >> dan abrams, thank you. >> we're going to turn overseas to the crisis in sudan, where at least one american is more than 600 confirmed dead. the u.s. military is now preparing for the possible evacuation of american citizens.

martha raddatz is checking it all from washington. >> reporter: good morning. one side in the sudanese war between generals claimed a cease fire, but it sure doesn't look like one. with this nation of 45 million people, including thousands of americans, caught in the crossfire. overnight amid ferocious fighting in sudan's capital, the militia there claiming a 72-hour cease fire has been reached, though sudan's armed forces have not confirmed the agreement. the death toll reaching more than 600, with one american among the dead. the pentagon now rushing additional u.s. forces to nearby jabudi to help in a possible evacuation of the dozens of embassy personnel sheltering in place. >> if and when there's a decision to move towards some sort of military evacuation, we'll have more to say about that in terms of size, scale,

scope. >> reporter: an administration official telling abc news the situation is far too dangerous now to try any evacuations. the airport has been pummelled by shelling, air traffic halted. the embassy personnel are not the only americans in danger. some 16,000 u.s. citizens are there in sudan, caught in the crossfire of the conflict, running out of food, and with humanitarian aid also halted. american citizen mohamed akhmad, originally for from sudan, there from his father's funeral, now is trapped. >> it's been six days. now we're stuck. hopefully, something will work out here soon and we'll be home. >> reporter: there is no telling when that could be. as we said, there is no international airport operating, no safe transportation. even if this 72 hour cease fire is real, fighting will likely only intensify after that.

rebecca? >> 45 million people caught in the middle. martha raddatz, thank you. we turn to the arrest of a north carolina man who police say opened fire on a 6-year-old neighbor and her parents after a basketball rolled into his yard. erielle reshef is here. good morning. >> good morning, rebecca. he could be extradited from florida to north carolina to face charges. a sigh of relief for the family who said they were targeted by their neighbor over a basketball. overnight the suspect accused of opening fire on his neighbors over a basketball in north carolina surrendering in florida. 24-year-old robert lewis singletary allegedly shot a family after a ball several children were playing with rolled into his drive way. >> i know we have a 6-year-old down. gun shot to the chest. >> reporter: william white struck as he tried to deflect

gun fire aimed at his 6-year-old daughter. >> why did you shoot my daddy and me? >> reporter: white, still in the hospital. it's the latest in a string of harrowing shootings across the country raising alarms. seemingly every day occurrences turning violent. in texas, a cheerleading squad reeling. 18-year-old peyton washington in the icu in stable condition after one of her teammate, heather ross, accidentally got into a car she thought was hers in an austin area grocery store parking lot. >> i just saw a black figure in the passenger seat and i shut the door as fast as i could. >> reporter: authorities say pedro rodriguez fired at the girl. one bullet grazing her, another seriously wounding washington. rodriguez now in custody, charged in the shooting, awaiting a court appearance. despite the traumatizing ordeal, the athletes preparing to compete in orlando this weekend. ross posting on instagram, it's not been easy, but we will come

out the other side, stronger than ever. one of washington's coaches who visited her in the hospital saying she is making good progress even in a short period of time. she seemed to be doing well. there's still a long way to go. george, we're wishing her the best. >> thanks very much. the supreme court, after delaying a decision on access to the abortion pill is set to issue a ruling by midnight. rachel scott reports from the court. good morning, rachel. >> reporter: good morning. access to the pill used in more than half of abortions is on the line with the supreme court expected to decide at any moment whether or not new restrictions will go into place on the abortion drug mifepristone. the justices blew past their own deadline, giving themselves more time to consider a ruling by a lower court that would only allow the pill to be prescribed up to 7 weeks instead of 10, require three in person doctor visits and no longer available by mail. the justice do have several

options. the justices can allow the restrictions to go into effect, even in states where abortion is legal. they could take up the case themselves nearly one year after roe v. wade was overturned by the supreme court, or they could send it back down to the lower court. the high court did give itself until midnight tonight to make a decision. as for that initial delay, some experts suggest on an issue this contentious, there could be multiple opinions in the works, george. >> such a consequential decision. president biden getting ready to officially announce his 2024 re-election bid. mary bruce has more on what we're learning this morning. good morning, mary. >> reporter: good morning, juju. we knew this was coming. now it appears we are finally getting close. sources tell us the president's team is ready to announce his run for reelection, possibly as soon as next week. possibly even tuesday. that is a day of sentimental importance for this president. we know he's a sentimental guy. it is the day he announced four years ago his first run for the white house. we are also learning the

democratic donors, big donors, are being invited to washington for strategy sessions for the path forward. the president long said he intends to run but his team has felt little urgency to announce. he is not expected to face any serious opposition for the democratic nomination despite polling that shows many democratic voters would prefer an alternative candidate and despite those concerns about his age. biden is the oldest serving president. he would be 86 years old by the end of his second term. his response has always been to encourage everyone to just watch him and see how he is doing. we expect him to run on his accomplishments during his first term and argue it's time to give him a chance to finish the job. guys? >> thank you. big day. >> it is. >> it is also a big day on the court. the warriors won a crucial game overnight beating the kings for their first win of the series after dropping the first two on the road. demarco morgan is in san francisco. great to see you, demarco. hometown advantage.

>> reporter: the couple also accused of conspireing to kill chad's former wife tammy, who was still married to chad when he met lori. thursday a friend testifying about their relationship before tammy died. >> they had no complaints. she was a good wife. said her time was coming up. >> reporter: tammy mysteriously dying in october 2019. weeks later lori and chad marrying in hawaii. the prosecution saying tammy died from asphixation. lori and chad pleading not guilty to all charges. if convicted lori faces up to life in prison without parole. >> all right eva, thank you. we turn to the future of the starship project after the starship exploded minutes into launch. spacex chief elon musk is calling it a success. not all that surprising. a number of other experts are, too. our transportation correspondent gio benitez is here with more.

one step closer to mars. >> elon musk had been lowering expectations earlier this week, now congratulating his team saying they learned a lot for the next test launch. >> space is hard. space requires failure to get to success. starship will succeed. when it does, it will open up the cosmos in ways we have only been able to dream. >> musk said the next test launch will happen in a few month. this is where we see the difference between government and private industry. these mishaps would be very bad if using taxpayer dollars. but spacex can afford it. it's important to see everything that can go wrong before you get humans on board. >> gio, it's a commercial enterprise. the goal is interplanetary travel. going to mars. >> that's the whole point. they want to get there eventually. >> are you going? anyone? anyone interested in a vacation to mars? >> i have been trying to swipe that corporate card and nobody is letting me. >> stray got halfway there.

it's the classic addage, you have to fail in order to succeed. we're going to turn to oscar winner jamie foxx health battle. he has been hospitalized after what his daughter called a medical complication. stephanie ramos is here with the latest. >> jamie foxx reps haven't said what his medical issues are, but the support from hollywood and around the country have been pouring in for the super star. this morning growing questions surrounding the health of actor jamie foxx as fans and friends praying for the star, who's remained hospitalized for more than a week. ♪ georgia georgia ♪ >> reporter: the 55-year-old's portrayal of ray charles earned him an oscar, suffering a medical complication. his daughter posting to instagram that, due to quick action and great care, he is already on his way to recovery. >> what we do know is jamie foxx is reportedly on the mend.

>> >> we are back with a rise in car thefts. one incident caught on camera. you see a man jump into action to fight off thieves. trevor ault has the story. >> reporter: good morning, george. for decades car thefts have been steadily trending downward, but the past years they have skyrocketed particularly surrounding major cities. notably a lot of step, the man fighting off those four thieves. these thefts are happening right outside people's homes. caught on camera, a homeowner sprinting out to his drive way to stop a would be thief trying to steal his car in broad daylight. it happened just last week in a quiet connecticut neighborhood. police releasing this ring video as part of their investigation where the car's owner physically tried to remove the suspect, three more arrived, beating the owner until someone alerts them they're calling the police.

the case last month dismissed the involuntary manslaughter charges without prejudice, but stated new facts were revealed that meant further investigation and forensic analysis in the case. this decision does not absolve mr. baldwin of culpability and new charges may be filed. the new york times showing the gun baldwin rehearsed with had been modified before arriving on set. baldwin's attorney saying in statement, we are pleased with the decision to dismiss the case against alec baldwin and we encourage a proper investigation into the facts and circumstances of this tragic accident. baldwin insisted he was told the gun did not contain live ammunition and that he never pulled the trigger in hutchins shooting death in a 2021 interview with george stephanopoulos. >> so you never pulled the trigger? >> no, no, no. i would never point a gun at someone and pull the trigger. that was the training i had.

there's always pressure to make people laugh and make them comfortable. >> it's an interesting subject. you're getting praise for the sobriety journey for a very young woman. you feel strongly you want to get it right. >> i think it's a story we don't see very often. there was a feeling of, okay, one of the only ones doing it, we wanted it to feel specific and authentic and for people to relate to it. >> ally sheedy plays your mom on set. what's it like to hang out with someone who is '80s royalty? >> she's a legend. i love her so much. she's one of the kindest people i have ever worked with. we love pushing each other's buttons and driving each other crazy. it is fun to go to work with someone like that. >> your creator's story is the story this is focused on. you felt strongly that the sobriety journey was an important one. >> yeah. i think more specific with any story telling you can be the better. we very specifically wanted to

tell simone's story. this is her journey and her recovery story. hopefully, within that, people find a lot to relate to. we didn't want it to be this link. everyone's recovery is different. >> everybody knows a character like yours in their life that they can respond to. >> i think so, yeah. >> and speaking of ally sheedy, she is reuniting with molly ringwold. what was that like? >> if you told me i would be walking on set to do a scene with ally and molly, i would freak out. i did freak out actually. to see them together was so great for me. molly is so funny and just fit right into the gang. >> how do you get the humor right? it's being called next level flea bag in your face comedy. yet, it's a very gritty real portrayal as well. >> i think i'm glad that some people feel like we do get it right. i go home sometimes and i'm not sure.

all we can do is try to tell the truthful story of her journey. hopefully, within that we get some laughs. we also have a really funny cast. they bring joy and levity to the story, which helps. >> how does season 2 differ from season 1? >> in the first season, it's about physical sobriety. don't drink, don't drink, don't drink. season 2 is more about emotional sobriety. so what happens when something is trying to fill that hole outside of alcohol that are still not totally right. she has to find her higher power. doesn't sound like a funny pitch, but it is. it's a comedy, i promise. >> a dark comedy. but all brilliant. your co-star said she wants to do a musical episode. she revealed that you actually have some singing chops. >> sasha is really, really nice. she's also a liar. i don't sing. i can't sing. we will not be doing a musical
