area moving forward, finding solution. this is abc7 news. there is national attention on the antioch police department and now a new cause for concern discovered by the abc seven news i-team. good evening. i'm amanda. and i'm dan ashley. thanks for joining us. for weeks we've tracked the rise of outrage surrounding text messages sent among antioch police department members, texts that are racist and misogynistic with words and images so disturbing wliterally can't show them on tv now, that issue is what abc seven news reporter ozer hasan has been tracking very closely. he'll join us live tonight with an update on that story. also joining us live is abc seven news i-team reporter dan noyes on a story that is new for you at six antioch police never charged this man. they said just wanted to talk to him. so why did they treat him like this? that cell phone video obtained by the abc seven news i-team is at the center of a federal civil rights lawsuit

just filed. dan is here with this report. you'll see only on seven dan? well, dan and ama, antioch police are already dealing with a widespread scandal. dozens of officers accused of exchanging racist texts. this man's attorney wonders if the cases are related . 29 year old rebecca rodriguez is an after school program teacher. 30 year old won the spot as a stay to home dad for their three children and a part time construction worker. they were leaving a friends apartment on a friday evening in february of last year when an antioch police officer approached was like, are you guys okay? i said , we're fine. he said, we're fine. and then we thought that would be it. you just kept, like, insisting to speak to me. and i was like, you know, like, i don't need to speak to you. i'm not on probation. i'm not on parole. i don't have to speak to you. and did he accuse you of anything? and no, he didn't. he didn't say nothing. he doesn't say why he was there. he didn't nothing. and they were just looking for their uber ride home. but the conversation with the officer escalated. and i did

make a comment like, you know, you look like you're on steroids. and i went to go walk away. and when i went to go walk away, he grabbed me because i had to walk down the stairs, go past them. he slammed me on the ground. i wait what their attorney gave me three minutes of cell phone video showing officers covering one spot on the ground, raining punches down, kicking him, punching rebecca. and at one point, after they applied handcuffs, an officer crosses juan's ankles and puts his full weight down. my legs are going to break. my legs are going to break, bro. my legs pop to that hurt bad. and i felt that it also hurt rebecca to see the father of her children that way. it was really hard. i didn't know what was going to happen after that either. when they took me, you know, i was scared for him. their federal civil rights lawsuit against the city of antioch and its police officer says they arrested juan and rebecca, but neither was charged with a crime. no charges. so all that over? nothing. over nothing. stanley goff is their

attorney. does a person have to talk to the police? know if you're not being detained based on some kind of suspicion that you have engaged in criminal activity, you don't have to speak to the police. the lawsuit accuses the officers of excessive force, unlawful detention, false arrest, illegal search and racial profiling. golf has not identified the officers yet, but has concerns they may be wrapped up in the racist text scandal rocking the antioch police department right now. there's a climate going on in the city of antioch in general in which there are a slew of officers who are engaging in a whole list of forms of misconduct. and this is just another example of that. antioch police told me they have no comment on this and i haven't heard back from the city attorney's office. i'll keep track of this case and how it moves forward. dan okay. thank you, dan, very much. as the antioch police department texting scandal investigation continues to unfold and many community members and activists continue to demand accountability, today, the east

county chapter of the naacp held a special meeting with contra costa county district attorney diana beckton. abc seven news reporter sarah hudson spoke to a member after the meeting and joins us live with the latest. unser yeah, on dan and i'm a good evening we did talk to the member they say that they met with the da for about an hour. they say they now better understand the process. they were assured of transparency throughout the investigation and for those demanding immediate justice to understand that this investigation could take a few years, members of the east county naacp say they want accountability and they're thankful that elected officials are listening. it was a big deal. we are very grateful for her to step up and try to respond to us and the community . dr. kimberly payton is vice president of the east county chapter, which includes antioch . they held a meeting with contra costa county district attorney dana beckton to discuss the texting scandal at the antioch police department. just

knowing that, you know, even a few years ago, this even if this kind of complaint had came forward, it may not have reached this level. payton says part of the discussion centered around the actual investigation. she says they were told that despite the racist text messages, racism in and of itself may not be a crime unless acted upon. payton says their concern isn't just about the possible racist attitudes, but how that could impact an officer's ability to investigate. so dana beckman's office is looking into the criminal side of things. the air side of things, which would be the hate piece that falls back on the city of antioch and their protocols of how they reprimand their officer because the hiring and firing, after all, rests with them. we come here today in support of good police before the meeting with the da members held a press conference at the antioch police department. catherine wade, describe what police texted about her son, mallard baldwin, who was mentioned in the da reports.

this is one part of the text message about my son. when you talk about holding his legs open and beating him in his private part, this is from a police these are from this these are police is discussing this. according to the city, close to 20% of the police department is now on paid leave, but up to 40% of the entire police force may have been involved. but according to data from the contra costa county public defender's office, payton says they understand the investigation will take time. but in the end, they don't want officers who are convicted to be allowed to remain in law enforcement. this has been a long time coming. the communities of pittsburgh and antioch have been plagued with just the disease of just dysfunctional police behaving really badly. and so we are really glad that this is finally coming to light. patton says that under the current timeline, there could be some new developments come july . now, the antioch city council is meeting tonight at seven. the texting scandal is not on the

early morning hours of april 4th on main street near harrison. the two knew each other and moments sister may have been the subject of an argument between the men before the deadly stabbing and arrest has been made in connection with a deadly shooting sunday night in san francisco's north beach neighborhood. one person died, four others wounded, and the dead man has been identified as 23 year old isaiah thomas from suisun city. police say he was among three suspected robbers who tried holding up two other people at gunpoint. both robbery targets, as well as another robbery suspect were shot along with a woman who was with the suspects. the injured suspect faces charges including murder. now you can look up crime where you live. use the abc seven neighborhood safe tracker. you'll find it on the home page of our website. abc seven news. com crime and safety especially the perception of safety, is a big issue for san francisco. they're among the reasons why people say downtown is struggling to recover from the

providing stability for our schools by demanding usd pay our entire bargaining unit a living wage. educators need enough money to be able to stay in oakland. last week, the school district went to a state board to try to block the strike, since it would coincide with ap testing. the district believes monday, may 1st would be the earliest day for a potential strike may 25th is the last day of school. an update from the i-team. late this afternoon, the san mateo county board of supervisors passed a controversial sanctuary ordinance restricting the county from cooperating with ice without a federal judicial warrant. now, this comes after the i-team uncovered newly released data revealing a pattern of recidivism among immigrants convicted of serious felonies. abc7 news i-team reporter stephanie sierra joins us live with the latest. stephanie yes, alma and dan, it got tends today the ordinance passed with a 4 to 1 vote. but before that hours of public comment got very heated as

dozens of people on both sides expressed their concern. now supporters of the legislation argue it will bring more equality to people seeking asylum in san mateo county and prevent collusion from ice. but opponents argue part of it overlooks public safety. supervisor ray mueller, the only one to vote against the policy, supports the intent of the legislation, but introduced three amendments to exempt immigrant who commit violent crimes such as murder, rape or child molestation. he says he's concerned those released from prison and deported will come back into the community to retaliate and county law enforcement won't be able to intervene. supervisor david canepa, who authored the legislation, says immigration officials will still cooperate with any federal criminal investigation. but to be clear, the county will not under this ordinance. the debate on whether or not to include the amendments became the sole focus of the meeting as lengthy public comment was raised from immigrant rights advocates. community members and victims of crimes. while both sides were

live with kelly and mark each year at 909 abc seven building a better bay area moving forward, finding solutions. this is abc seven news. a 15 month old toddler was shot while buckled into her car seat as her family drove home in oakland. police say she was hit by a stray bullet. the family rushed to the nearest fire station and banged on the door for help. e shooting happened about 24 hours ago on 12th avenuen east 15th street in the little s neighborhood. abc7 news anchor dion lim has the new details released today. if it doesn't hit you in your soul a certain way, then and that's a problem at a press conference discussing recent violence in the city, oakland police shared new details of the unthinkable. a 15 month old girl caught in crossfire and shot through the stomach around 615 monday evening in little saigon. it just totally unacceptable. this

is nonsense, this group of neighbors expressed their outrage, confusion and fear after learning the incident happened just feet from where they live. around 12th avenue and east 15th street police say that's where the family of the 15 month old suddenly heard a barrage of bullets. they immediately take cover inside their vehicle as the sound of gunfire stopped. the victim, who is 15 month old, was seated in a car seat, began to cry. it wasn't until returning home nearby, her father realized his baby had been shot by a stranger. stray bullet. they immediately drove to the nearest fire station to get help. surveillance video from a convenience store across the street shows the moments the family frantically knocked at the door of station four fire chief reginald freeman described how his team sprung into action. thankfully, our crews and personnel were here in the firehouse at the time. i am so proud of their heroism. but if it were not for our paramedics and our emts, that child most likely would have lost their

life. according to oakland fire and ambulance arrived just two minutes later and transported the infant to children's hospital after extensive surgery. the girl is said to be in stable condition. oakland police ask anyone with additional information to come forward. deon lim, abc seven news. now, not far from where that infant was shot. a woman was wounded during an armed robbery. today this violence was caught on camera. the victim was sitting at oakland's fm smith rec center on park boulevard when two suspects approached her. and after a violent tussle over the purse, the victim ran after the suspects. that's when police say one of them opened fire, hit her once they got away, police say the victim was taken to the hospital. a high school student went to the hospital after being stabbed on campus at northgate high school in walnut creek. officials say the incident involved two students, both ninth graders. around 1:00 this afternoon. the student accused of the stabbing is in custody. no one else was involved. classes continued after the stabbing. counselors were brought on campus, though,

and will remain on site tomorrow. northgate is located in a residential neighborhood east of downtown walnut creek. a veteran oakland police homicide investigator has been charged with perjury and bribing a witness. now, an arrest warrant has been issued for that officer and the district attorney says 100 other cases that he was a part of are now in jeopardy. abc's seven news reporter ryan curry has more. oakland homicide investigator phong tran, seen on the left, has been charged with two felony counts of perjury for allegedly lying under oath during a murder trial. he has also been charged with one felony count of bribing a witness. detective tran lied about his connection to the witness and the payments to her under oath. alameda county district attorney pamela price released a video statement tuesday saying this stems from a 2011 murder investigation. two men were convicted and sentenced to life in prison for shooting and killing a man in north oakland. the charges against the men were vacated last year. court documents say a key witness originally claimed to

have seen the shooting but recanted her testimony, admitting she witnessed neither the shooting nor the people responsible for it. those documents also mentioned she admitted she was paid for her testimony by the oakland police department and officer tran, specifically in the form of cash and checks. i spoke with the witness earlier. she did not want to be interviewed, but says tran used her because he knew she needed to provide for her family. district attorney price called these charges serious. she says her office has to now go through more than 100 previous cases to see if there was possible misconduct. my office now has to review at least 125 other cases that detective tran investigated. others in oakland want these charges dropped against officer tran immediately. there's no grounds, no bearing here that would indicate that the charges that they've charged this officer with are ever going to come anywhere. barry donelan, president of the oakland police officers association, says tran has spent years solving homicides in oakland. he says

this move reflects negatively on the district attorney. it's clearly an effort to discredit homicide investigators in order to take people who've been convicted of homicide and get them out on the street in oakland. ryan curry, abc7 news. caltrans today paid tribute to its employees who died on the job, including a worker hit and killed in the bay area. those honored included shonda mccadden. she was a landscape maintenance worker who was hit and killed outside her vehicle last year in vacaville. caltrans executives paid tribute to all the fallen and spoke about the agency's commitment to safety. we have a goal that by 2050 that we don't lose another life on our roadways. every caltrans worker, every member of the traveling public will be able to go home safely. nearly 200 caltrans workers from across the state were remembered during this ceremony in oakland. the names of each employee was read

statue depicted former san jose mayor thomas fallon during a time that was considered brutal for native american and mexican communities. carl sotero has been fighting against the statue since the beginning. today he and others stopped by to grab a souvenir. he says just like the statue represented a terrible time in history. this simple bolt. what does it represent? victory but not everyone sees it that way. some argue today the statue removal actually represents a wrongful removal of history. former san jose mayor tom mchenry echoed a similar thought in 2021 when discussing the statue that he was instrumental in putting up in the city sins and oppression and mistakes. all of those happened under each flag and they deserve to be excoriated and they have been muhammad lonnie tribe chairwoman. charlene supports the $450,000 removal of the statue, but does not want to erase the history. she hopes the statue will be eventually moved to a museum because both sides of the story need to be
