7:10 am
in three and a half hours of testimony so far, carroll was conceding she wasn't 100% certain when the alleged rape occurred, but her account otherwise was detailed and stark. in an apartment store dressing room in the mid 1990s, carroll said trump thrust me back against the wall, banging her head. she described the weight of trump's body against her, the pain of the alleged assault, and how it left her unable to ever have a romantic life again. trump says none of this ever happened and as carroll was preparing to testify, he was attacking her on social media, angering the judge, who called the post tantamount to jury or witness tampering and, robin the defense has until the end of today to say whether trump is going to come here to testify in his own defense. >> all right, aaron. we'll see what happens. thanks for your reporting. now to disney, the parent company of abc, filing a lawsuit against florida governor ron desantis and other officials alleging unlawful retaliation

we're back with a foreclosure fight playing out in front of the supreme court. in roughly a dozen u.s. states if you owe back taxes, the government can seize your home. the money you owe, and the entire equity. our senior national correspondent steve osunsami has much more on all of this. good morning, steve. >> reporter: good morning to you, robin. there are a number of legitimate reasons why a city or county government is allowed to take a home. to collect on unpaid to collect on unpaid taxes, to clean up blighted neighborhoods. homeowners are asking, is it okay for a government to take a home, pay those unpaid taxes and then profit from what's left? tuwanda hall doesn't live here anymore. it wasn't her choice. do you wish you still lived here? >> there's a lot of good memories here. >> reporter: back in 2010
7:43 am
hall and her husband paid $67,000 in cash for what was their dream home in the suburbs of detroit, five bedrooms and good schools nearby. she said they put everything they had into making it look like it does now. you did all of this? >> yes. >> reporter: but in 2012 and then again in 2016 she said they fell behind on paying their county property tax and owed about $23,000 in tax, interest and penalties when her husband found an eviction notice on the garage door. >> they were taking the house. we started scrambling, trying to figure out what's going on. >> reporter: what answer were you getting? >> it's too late. there's nothing you can do. >> reporter: she said the painful surprise was just getting started. in a series of moves over eight months that were legal, property records show that the county foreclosed on her home because of those back taxes, sold it to the city, who then quickly sold it to a for profit company that said they made further improvements to the property. that company then sold the house to a new family for $308,000.
7:44 am
nearly five times what the halls paid in 2010 and about $285,000 more than their unpaid tax bill. and they gave nothing to the halls. do you know what happened to the profits of the sale of your home? >> no. i don't know who has the money. >> reporter: you didn't get that money? >> i didn't get any money. >> reporter: not a penny? >> not a penny. >> reporter: her husband died of pneumonia in the middle of this, and she believes the stress of it all didn't help. >> i owe you $22,000. at least give me whatever is extra so that we can try to start over. >> reporter: michigan's top court now says the county was wrong to take her home without paying her, but the issue is under appeal. none of this gets her any money. similar laws still stand in 11 other states and in washington, d.c. a homeowner can lose all the equity they have in a home when a local government takes the house to cover an unpaid tax bill.
7:45 am
>> small minority of states, the money is not returned back to the homeowner. the municipality just keeps it. >> reporter: in massachusetts alone, over a six year period the municipalities kept $6 -- $60 million. a state senator is trying to change the law. >> when i look at the law in massachusetts, it enables this. that's why i call it legalized corruption. i would not say those words lightly. >> reporter: christina martin is the halls attorney. she and her legal team found 9,000 other families across the country in the just like if you owed me $14 and i reached in your wallet and i took everything, no matter how much was in your wallet. >> reporter: this week she argued one of her cases before the u.s. supreme court. a 94-year-old grandmother from minnesota who owed $15,000. when the county sold her condo for $40,000, they kept the change. >> the government should never be allowed to take
7:46 am
more than what it's owed. yes, it can tack on interest, penalties and collection costs. when it goes beyond that, that is unconstitutional. i hope the supreme court agreed. >> reporter: hall's lawyers say in the vast majority of these cases the homeowners didn't have a mortgage. they believe there's a reason for that, arguing it's harder to foreclose on a home when there's a mortgage. because there's a bank involved they usually have programs set up where the taxes are paid automatically. the case that changed the law in michigan is an interesting one, a homeowner who owed $8. in unpaid taxes. the house was sold at auction for $25,000 and the homeowner didn't see any of the difference. the court reversed that, gave the home back to the homeowner. that case, guys, is under appeal. >> right now the homeowner is right. what the lawyer said, okay. if you want to tack on penalties and interest, okay. but to take the entire
