>> building a better bay area. moving forward. finding solutions. this is abc7 news. >> there's a lot of drugs in lee's system. bob lee's system is like the walgreens of recreational drugs. >> regardless of whether somebody has or has not done drugs, that does not give someone a license to kill them. >> lee as the man accused of stabbing him to death appeared in court. good evening. i'm amanda. and i'm dan ashley. thanks for joining us. the arraignment for nima momeni was once again postponed today, but we did hear from the district attorney in the case. ama: melanie woodrow was there and has the latest on what we are learning about bob lee's final moments. reporter: his attorney once

again asked a judge to post photos -- to postpone his arraignment. >> the minute you enter a plea, you have decisions to make as to when the preliminary hearing is going to be held. reporter: the san francisco district attorney says her office was ready to proceed again today. >> often times, the da's is blamed for cases that age for years in the system. this is a situation where they are exercising their right to delay this until they feel that they want to move forward. reporter: the medical examiner's office released these autopsy and toxicology reports which showed lee was stabbed two times in the upper left chest and one time above his right hip. he had alcohol, cocaine, ketamine, and allergy meds in's system. it's not clear what lee ingested and what may have been administered to him during surgery. he died in the operating room at 6:49 a.m. >> bob lee's system is like the

walgreens of recreational drugs. he didn't die of a drug overdose. that's not what that is about. but put on your thinking caps. what happens when people take drugs? generally, the act like -- they act like drug people. what do drug people act like? not themselves. >> we are accustomed to having the reputations of our victims as prosecutors to be denigrated by the defense. regardless of whether somebody has or has not done drugs, that does not give one a license to kill them. reporter: they were both stunned that news outlets received the autopsy and toxicology reports before they did. momeni is being held without bail. his arraignment has been postponed until later this month. melanie woodrow, abc7 news. dan: today we learned nordstrom plans to close its two market street locations in san francisco.

one is the anchor department store inside westfield center and the other one is the neighboring nordstrom rack location. why are these huge stores closing? there's more to the story than you might think. reporter: tuesday, nordstrom announced the closure of their downtown san francisco store and the nordstrom rack locations. both stores will be closed by the end of august. >> that's unfortunate for the whole community. reporter: the nordstrom store opened in 1988. at the rack on market street in this comes amid a slew of other closures in the area. the san francisco whole foods flagship which opened along market in march of 2022 also announced a temporary closure last month, citing worker safety. the westfield mall where nordstrom is located sent me the statement placing blame squarely on crime, sang the part the closure underscores the

deteriorating situation in downtown san francisco, and blamed retailers and businesses for leaving the area due to unsafe conditions. however, there is more to the story than just crime. national retail federation says many retailers are shifting from more high-end stores to budget friendly options. nordstrom's appears to be mirroring this consumer trend. they are opening 20 new rack stores, their discounted brand, this year. >> we have gone through a pretty inflationary period over the last year and a half. . things have cost a lot more. what tends to happen is the consumer will change their behavior. it will start trading down for example. if fedex costs too much, they will pay something different. reporter: in large cities, the cost of operation is higher and organize retail theft is an issue compared to suburban areas. >> it becomes a question of

whether or not you want to continue to lose money in these areas by keeping your stores open or whether you want to just look for other opportunities. reporter:ntket reki worse for small businesses. call hardware has a l close to the stone to be closed nordstrom -- to the soon to be closed nordstrom on market. >> it's coming back and we are optimistic that we continue to inch forward. and hopefully we will be back to 2019 numbers maybe by 2029. back across the bay area. how long is it going to last? let's get sandhya patel. meteorologist: a storm has developed in the pleasanton area. dublin boulevard. . if you are caught under this thunderstorm, you will notice downpours and hail potentially. around san francisco's chinatown, the richmond district, we are getting heavy rain. same thing with the sausalito area. you will notice heavy rain across the region as we head towards the south bay. they are not out of the wet weather either. they've been saying downpours. rainfall has ranged anywhere from a few hundredths of an inch to over an inch in the santa cruz mountains. this is a light level onehu snds the state.

i know everyone in our community is just really scared. reporter: two people have been killed, starting with 50-year-old david bro, found that with stab wounds in central park. another student, fatally parked in a park saturday night. where a memorial of flowers and notes sits in his honor. and monday night, a third victim, a woman in her 60's, brutally stabbed through the tent she was living in your second and l street which prompted shelter-in-place alert. -- prompted a shelter-in-place alert. >> lock your doors. stands out of your house. reporter: the description -- >> the description provided for the stabbing last night is substantially similar to the description that was provided by the witness and the second homicide. -- in the second homicide. at this point, we are still determining whether the two are related. reporter: the police chief says they can't definitively say

all three stabbings are connected. >> the attacks with knives were particularly brutal and violent. reporter: a local said that is why she is taking new safety precautions. >> i order amazon, and alarm system -- an alarm system. reporter: police are fielding hundreds of tips and police officers moving into 12 hour shifts. uc davis has expanded their safe ride program to 16 hours a day so that no student has to walk home alone. ama: coming up -- we are going one-on-one with the antioch police chief. what he says about his department's racist texting scandal, staffing challenges, an

dan: the investigation continues into the antioch police department's alleged misconduct and a texting scandal. the u.s. apartment of justice has given . ama: today he s the challenges he's up against. >> i guess the question is, do you think the antioch police department has a problem with racism? >> i'm going to say that it's clear now that we know certain officers participated in certain behavior. . i have to believe in my heart of hearts that does not reflect the entire organization. reporter: just one year into the job, the police chief is in a tough spot. dealing with the fallout of an fbi investigation into his department and a racist texting scandal, both which began before he joined the force. >> it is very hurtful.

without question, that is hate speech. must just be clear. there is no need to sugarcoat what that is. reporter: the district attorney released two reports that revealed a chain of racist, misogynistic, and homophobic text messages sent by antioch police officers over two years. the chief says this goes beyond the culture of the department. >> right now i'm doing a deep dive into the psychology and organization. two things are apparent, a lack of accountability, and i think there's an undercurrent of neglect that's taken place. reporter: the public defender's office estimates 40% of the department may have been involved in the texting scandal. currently, 38 of the police department's nine officers on leave -- -- 99 officers on leave. can you do job right now? >> yes.

we have the personnel? we do. the necessary processes are in place. the officers have been implicated. reporter: they've always been in place. the laws have always been in place. >> that is true. let me back up a little, this is not germane to the antioch police department. and the antioch pd police the city in a fair, consistent and transparent way? we have no choice. reporter: according to ford, change is already underway with new policies and procedures being implement it around the use of force, the use of the police dog, and the department's cell phone policies. he adds he is open to federal oversight of that is required, but says he will move the department forward. reporter: at some point, the organization has to move forward. we have to start to pull ourselves up by the bootstraps and be intentional about giving back to the community and proving that we are not the organization that we appear to be.

dan: ama: let's get to meteorologist sandhya patel for the latest. meteorologist: there is some rain out there, that's for sure. you will notice on live doppler 7 an isolated thunderstorm right over pleasanton heading towards the north and northwest. dublin, san ramon, you are getting moderate rain. san ramon at 5:35 p.m. 5:43 p.m. into danville. heavy rain around monterey road, highway 101 between gilroy & martin. -- and saint sausalito is seeing some rain as well. if you are going to the game, take the raincoat with you. there are scattered showers out there. it's been on the chilly side. at tip-off, 53 degrees.

the temperature, dropping to 51. you will notice gray skies and raindrops on the lens. and certainly snow falling in tahoe right now. there have been a few coming down here. they do have the snow coming down over the higher elevations. strong thunderstorms have fired up with this area of low pressure. you can see the circulation here. we've seen our share of thunderstorms. mount hamilton had a little bit of rain-snow mix earlier today. in winter advisory -- a winter advisory remains up until 11 p.m. tonight. higher amounts above 7000 feet so certainly slippery roadways out there. we have anywhere from the 40's to the 60's, below where we should be this time of year. we have a light level 1 storm for tonight and tomorrow. scattered downpours, isolated thunder and hail, the best opportunity through tonight.

slick roadways for the commute this evening and tomorrow morning as well. 6 p.m. tonight, if you showers around. towards 11:00 p.m., more showers rotating around the area of low pressure. 5:00 a.m., it is going to be a wet one. towards 7:00 a.m., still some slippery roadways. into the afternoon, the heating from the sun will destabilize the atmosphere once again, so some downpours will continue into the afternoon and evening hours. lingering showers through early thursday before the system is done. tomorrow night, you will notice additional rain around santa rosa, half an inch in san francisco. temperatures in the morning, 40's and 50's. highs anywhere from the upper 50's to the lower 60's. most of you will fall in the upper 50's to mid 60's range. a level one for your wednesday with scattered showers. a few drops lingering on thursday. is not going to be a widespread

dan: more people are leaving california. here are the findings for the bay area from that department of finance report. 33,000 residents left the in 2022. 5300 left san francisco. more than any other local county. san jose lost more than 4400 people, dropping the total population to under one million. oakland's population is also down, losing more than 2200 residents. ama: a data analysis shows the top destination for californians is texas. but as the grass really greener? that's the question we are answering in "california dreaming: moving to texas." >> this is california. to sum, it is no longer their
