building a better bay area moving forward finding solutions. this is abc 7 news. for the first time, we're hearing from one of the many victims in a $39 million ponzi scheme, allegedly orchestrated by an east bay man. it's a story you'll see only on abc7 news. good evening. thank you for joining us. i'm dan ashley. and i'm alma daetz. >> and many of these cases victims say they were scammed out of not only hundreds of thousands of dollars but also their homes. >> abc seven news anchor diane lim tells us that more than 100 members of the chinese community were targeted and there may be more victims. >> you feel ashamed. you feel violated, and you feel

embarrassed. that and you feel afraid. and it has been a long trying seven years for kingsley and his 76 year old mother, ellen, who requested we only use their nicknames. >> seven years of trying to find justice after mom was allegedly defrauded out of a house by an alamo man named derek chiu indicted by the us department of justice this week. ellen was close with derek's father, felix. >> he's a family friend for close to 30 years. he just seemed like a very honest man. my mom trusted him so much that he had felix deliver a eulogy at my dad's funeral. kingsley said felix was well connected in the chinatown community, and his mom would give him and his son small amounts of money with the promise of a significant return. it starts off as several thousand and then it goes up to 100,000. >> as the returns came in, ellen's trust grew and then those investments started becoming higher and higher because he kept on asking for

more. >> eventually, ellen signed over her san francisco home when she realized that it was just all a lie and she felt truly, truly ashamed of it. it broke my heart because it looked like her soul wasn't even there. uh- at the time, the doj alleges derek zhou's ponzi scheme began in 2013. >> he allegedly solicited investments with the promise of returns from the resale of warriors tickets and luxury suites at oracle and the chase center for $500,000. check january mack and john chao have filed multiple lawsuits from more than a dozen people who believe the true father and son duo worked as a team. >> this one's 100,000. you get 18% interest. wow right. so you get $1,500 a month. they say much of the fraud started by targeting a certain demographic . we believe the first round are for chinese monolingual seniors because many of these victims are seniors. they went through really emotional abuse from

this. some of them were suicidal while mac and chao are not certain if victims will ever be made whole since in charging documents, derek chiu is accused of misappropriating $7.3 million on luxury cars, jewelry and credit card debts. >> they do believe the doj indictment is a start. >> now that there's steam, we want to continue this. >> kingsley hopes his mother's story will inspire others to come forward if you don't report it. >> what ever happened to derek chiu a couple of days ago will not happen. stop being afraid. and it's these guys turns to be afraid if there are other victims out there we encourage them to you know, speak up. >> i've reached out to the doj to inquire if charges would be coming for father felix as well. >> derek chiu faces a sentence of decades behind bars and a maximum fine in the millions. his next court appearance is may 9th in san francisco. diane lim, abc seven news. so day two of the oakland teachers strike with

little progress being made to end it. >> each side pointing the finger with much confusion about why they haven't returned to the bargaining table. abc seven news senior education reporter leanne melendez is in the newsroom. leanne. they are going to finally meet. this weekend is crucial, obviously. >> it is. and we hope so. dan now i will say this, the level of miscommunication between both sides is mind boggling. we found out today there are a few times when we may be confused about an issue, but i think we've been able to decipher what's going on and why there hasn't been an agreement. it started with this statement on thursday by school board president mike hutchinson stating that the teachers union abruptly stopped negotiating, even though they were so close to finalizing a salary agreement. >> we want to continue negotiating. we don't want a strike troc but they've left the table and they've broken off discussions. not us. >> and today a small group of

teachers showed up at his house as hutchinson was in pajamas and drinking his morning coffee. ofa member of the teachers union bargaining team was on the phone assuring hutchinson that they were at the table ready to negotiate. >> vilma has our bargaining team been holding up negotiations happened, and there's witnesses to this happening. >> and we have timestamp proposals. >> so how can both sides say they are at the table when they are clearly not meeting? hutchinson claims ousd officials were at some point negotiating directly with the interim president and vice president of the union when a salary proposal was given to both of them. and instead of consulting with their own bargaining team, they walked away and called for a strike. >> that's an accurate. we got it . they sent it to us after they left it at like, i don't know what time, midnight or something. we never got that before. the union says everyone,

including that bargaining team, now has that proposal, even though the union president admitted he hasn't had time to really digest the proposal. >> i'm confused. you're saying that you're at the table. they're saying they're at the table. >> i'm confused. we're there. we have been there. our team is there. there are 50 witnesses who are there. our team has 50 members. >> during this morning's surprise visit, union members told hutchinson that the district was not at the table because they needed an authorization from him and the board and they've been authorized to negotiate. >> that's how we've been engaging in negotiations, ins and there's no call from the school board necessary to continue negotiations as it's been authorized to clarify, hutchinson told us the school district's bargaining team is not authorized to negotiate anything outside of the scope of the contract, like common good proposals. >> why, he says it would be fiscally irresponsible to add

proposals. the district cannot afford, especially is still undr receivership from the state and with regard to the actual costs attract if accepted by the union , the district will carve out an additional $70 million from the general fund to pay for these salary increases. and that means some program teams will have to go. now, i also spoke to some teachers attending today's rally and they said there worried that if this strike continues and students don't return before the end of the school year, it could have a negative impact on them. on the teachers, even though many parents have expressed that their support. in the newsroom, leanne melendez, abc seven news. >> all right, leanne, thank you for that. the question here now is so what exactly are those common good proposals and why are they such a sticking point in the negotiations? we have team coverage now with abc seven news reporter answer hassan and the issues that go beyond

learning in the classroom. as hundreds take part in day two of the oakland teacher strike. >> oakland school board member valerie batchelor says she's getting hundreds of emails about one issue, literally hundreds of emails from families, educators and the community to give the district the authority to negotiate around common good demands. common good proposals are often items that are not related to classroom curriculum , such as green spaces on campus , shared governance or student homelessness. >> yes, we are the biggest landowners here in the state. in the city of oakland, and so we have a lot of properties that we aren't using and that we actually can't afford to rebuild or refurbish or redo. in this example, under common good, the teachers union is asking the district to prioritize oakland's homeless students if there's going to be housing there, that it's affordable housing and that it potentially goes to our unhoused students first, the district may share those values but won't negotiate them. >> there are items that are

outside of the scope of the contract of what we are required to negotiate. the school board has not authorized negotiators to go outside of that scope currently, the six member school board is split on common good. >> some are concerned about giving up too much power or being bound to projects they can't afford. bachir argues they can codify contract language and add staffing and funding contingencies to protect the district. all of those are all different ways we can handle this. >> but as a board we have not been able to give clear direction and directive to even have those conversations. wilma serrano is the chief negotiator for the union and she says another common good issue is reparations, which isn't about giving black students money, but helping schools that have been historically neglected. >> that is about directly investing in our schools, and it includes things that are mandatory subjects of bargaining, such as additional staffing. >> and you think it's going to come down to common good? yes, that is my feeling. >> that is a sentiment that i'm

hearing from folks on the line. that's the sentiment of folks that are not on the line, but calling me, emailing me. it's really going to come down to that in oakland on stars.and abc7 news, san francisco officials are urging the state legislature to pass a bill that will make it easier to treat opioid addiction. >> the bill by assembly member matt haney would allow mobile pharmacies to carry no drugs known as suboxone and other drugs that control heroin and opioid cravings and help addicts deal with withdrawal symptoms. they will be able to carry these. right now, mobile pharmacies are prohibited from carrying that drug like suboxone , buprenorphine can help people deal with those physical impacts of addiction in a way that allows them to access treatment, get into recovery and get stabilized. it's a serious, serious problem. opioid addiction. dixon is now the leading cause of death among 18 to 45 year olds. another round of showers is moving into parts of the bay area. when will it

end? abc seven news meteorologist sandhya patel is here with the weekend forecast. i know we're on a roll here, dan and irma, but i do want to show you the bright side, which is this is all delaying our fire season. >> so we've got to look at the silver lining. if you will. right now, there isn't much in the way of brightness from our east bay hills camera. it is a damp view. you can see those raindrops falling as we take a look at live doppler seven right now. i'm going to get you into street level radar first. we're going to start in the east bay from seventh street across 8-80 san leandro, oakland. you know, this could be a tough ride, especially with that wet weather. so if you do need to get somewhere on the cinco de mayo, give yourself extra time. seeing some moderate showers around south santa rosa, santa rosa and we widen the picture. it is a light level one storm on our exclusive abc7 news storm impact scale. that storm is sitting right off the northern california coast and as it continues to pass through here, we're going to see waves of showers at 10:00 tonight going into tomorrow morning. i'll let you know how the rest of your weekend is shaping up and how long this rain is going to stick

rock singer dee snider from the band twisted sister is responding after being dropped from san francisco. pride because of his support for a controversial tweet. this all started last week. sf pride was set to announce twisted sisters anthem. we're not going to take it as this year's pride anthem, but after snider shared a tweet from kiss singer paul stanley that some consider transphobes ibic essef pride dropped snider and the song from pride, a decision they revealed tuesday morning on abc seven seven. now today, snider responded in a statement that says in part,

quote, i've recently stated, i do not believe young children are ready to decide their gender allocation. i believe their choices should be supported and accepted by their parents. but i do not think kids have the mental capabilities to make rational, logical decisions on things of a magnitude that will affect them for the rest of their lives. snider goes on to say he is still an lgbtqia plus ally. >> people across the bay area have been getting ready for cinco de mayo all week. san jose sees one of the largest crowds each year for the celebration. and abc seven news reporter zach fuentes spoke with some of the people excited to celebrate mexican culture, to celebrate cinco de mayo. >> the celebration setup started early this cinco de mayo. >> the day is a huge deal, especially in san jose. tons of people gather every year right here at story and king roads before noon. the area had already seen a sea of mexican flags. >> it means a lot to the san jose. and like most of the bay

area, because it's not independence day, but it's there was a battle going on in puebla down in mexico. and like we celebrated because we won the battle, the day celebrated with plenty of food. >> you know, coronas. but it's not just food that's in demand. each cinco de mayo. everyone wants to get their hands on festive visuals like the mexican flag causing more demand for local vendors who look at each other as friendly competition. >> you didn't see that much vendors as you see now, like two years ago, we used to be like the first ones here and the only ones here. but like, time flies, like time moves on. you'll see more and more vendors every day. but i mean, we all make a living out of it, you know, and we try to get as much as a as much as we can. for me, with any big holiday. >> public safety is a concern. san jose pd says they're devoting extra officers to be out on the roads and will have traffic diversions in downtown and east san jose. our goal this year is to ensure that families, friends and visitors can all enjoy the holiday safely. >> this, in part will have function of patrol officers and additional patrols surrounding the area in san jose, working to

if you're right now in santa cruz, you're going, what, rain? so, yes, oakland is reporting rain along with santa rosa and visibility on the san mateo bridge will be a little dicey, although this section of the bridge is looking okay in terms of dryness, there is rain crossing the san mateo bridge across 92 there, heading towards the east bay from san mateo and as we take a look at the wider perspective here, the rain has been focused primarily in the north bay, but it is starting to push across parts of the east bay as well. so we go into street level radar, bodega avenue, petaluma, rohnert park, highway 101. it is a dicey evening commute as we look at the east bay. it is going to be a little bit slippery out there. so if you have plans, the cinco de mayo evening, give yourself that extra time to get to where you need to go. emeryville 980 into oakland foothill boulevard . seeing that wet weather, your temperatures right now in the 50s and the 60s, nowhere where nowhere near where you should be for this time of year. there's still well below normal for this time of year. here is your cinco
