new york city is expecting my migrants to enter their already overburdened shelter system with the mayor saying they can't handle this on their own. they don't have the resources. mayor adams bussing migrants to the suburbs like orange county sparking a larger fight. orange and rockland county filing lawsuits and restraining orders in an attempt to stop migrants from staying long term at hotels. denver mayor warned of city service cuts if the federal government doesn't step in to help. in texas, governor greg abbott has continued bussi to sanctuary cities despite their protest. he just sent more to washington, d.c. saying it's the only way to provide relief toyot its border towns. the governor asking for the administration to use federal land to house migrants.

oklahoma. sending a boat flying into this house in the town of cole. tornadoes touching down in kansas. funnels racing across wide open plains as they tear through communities such as dodge county, nebraska. many b unfortunately, for many of those hard hit areas, we're looking at more severe weather today. rain already starting off in the dakotas this afternoon. by 6:00 p.m. we see the line of storms move through des moines into st. louis, just south of chicago. the severe threat brings an isolated tornado chance. we could see scattered tornadoes into parts of iowa. we head further south into texas where they have been seeing immense flooding. we are looking at heavy rain from areas like austin, houston and dallas. that's a look at the forecast. over to you. >> we'll be watching the warnings. thank you. now to the charges filed in the subway choke hold death. the victim's family speaking out about the case.

aaron katersky joins us with the story. good morning. >> reporter: daniel penny is out on bail the family of neely planning a funeral. some of the images are disturbing. >> reporter: this morning marine veteran daniel penny is out on bond. prosecutors reviewed this video that shows penny choking jordan neely after witnesses said neely was making threats and scaring passengers but there was no indication he was violent. >> we don't want it where you can kill someone because you thought there was a possibility they could do something to you. there was no attack. >> reporter: prosecutors said penny's choke hold continued for several minutes even after neely stopped moving. >> we think it should be murder because he knew what would happen. >> reporter: defense attorneys

said they are confident penny would be fully exonerated saying he risked his own life and safety for the good of his fellow passengers. the unfortunate result was the unintended and unforeseen death of mr. neely. he was a subway performer known for impercesonating michael jackson. he had been traumatized by her mother's death and suffered from pl mental illness and homelessness. >> the prosecution that the burden of proving beyond a reasonable doubt that daniel committed manslaughter in the suicide. ie, he recklessly caused the loss of life. i think daniel penny will argue my client wasn't the only one that felt they were in fear of their life. >> reporter: penny has not yet entered a plea to the manslaughter charge. he faces up to 15 years in prison if convicted. guys, this case has raised so many societal questions about

there. we start this half hour with the guilty verdict for lori vallow daybell. the jury finding the idaho mom guilty of murdering her two children and conspireing to murder her husband's first wife. ike ejiochi is following the story. >> reporter: the jury deliberated for total of six hours. a trial in which the prosecution clai claimed lori and her husband, chad, used money, power, sex and religion as the motivation in the death of the two children. this morning, guilty on all counts. >> not guilty or guilty of first-degree murder. answer, guilty. >> reporter: a jury of five women and seven men found lori vallow, guilty on six charges, including murdering her own

of a young black man in mississippi who claimed he was being targeted by the men where he worked. mona kosar has the story. >> reporter: there's been a haunting new discovery. six months after the death of rasheem carter. he was last heard of in fear for his life. they are calling for transparency from a new set of remains after a series of other body part discoveries. 25-year-old rasheem carter was last seen in laurel, mississippi back in october after complaining to his mom he was being followed by white men in trucks yelling racial epithets. he sought help a local police station. >> i'm going to keep standing, fighting, doing what i have to do as a mother to get the

justice that my son desemrves. >> reporter: his family and civil rights attorney calling for justice insisting carter was mutilated. >> we know this was not of natural causes. this was a mississippi lynching in 2022. >> reporter: this smith county sheriff telling abc news his office ruled no foul play was involved in carter's death. now the mississippi bureau of investigation who has taken over the case says it's an ongoing investigation. the slheriff adding our goal is to uncover the truth and to bring closure and truth to mr. carter's family. according to carter's autopsy report, a cause of death is undetermined at this time. his mother accuses local authorities of trying to sweep this case under the rug. >> mississippi, all of america is watching to see if you're going to do right by ra cheem rasheem carter.
