amount. not a surprise. you are looking about a one hour five minute drive from tracy into dublin. kumasi: new this morning, dozens of part passengers were forced to evacuate overnight when the train they were on got hit -- well, it hit a truck. all that happened in oakland between the fruitville and lake merritt stations. your morning commute should not be impacted if you are traveling through this area. abc seven amanda dukas to leo joining us more -- joining us with more the investigation. amanda: you mentioned that commute. part confirmed earlier this morning that crews were able to repair the damage in the area of that crash. they plan to resume that normal service for those traveling on bart early this morning. we have some very shocking video of the crash that happened late last night. the agency says a pickup truck crashed into the truck weight

near east 8th street and was hit by a daly city bound train. this all happened between the fruitvale and lake merritt stations but between -- at 11:35 last night, within text being built into early morning today. bartended service between coliseum and lake merritt, putting a bus bridge in place instead. the driver was tended to on scene. police investigated and conducted a sobriety test. no word yet on the findings. we have video from the train. at to have been injured. however, to what extent is still unknown. the bart driver had to be transported to the hospital. their injuries are also unknown at this hour. >> we were just on our way to the city. all of a sudden, the train started acting erratically, like it was bouncing around the tracks or something like that.

then, i saw a bunch of sparks along the car window we were in. i felt a big collision and the train came to a stop. people were talking about something was on fire. we were all asked to move to the front of the train. amanda: bart says oakland pd lead agencies started in their jurisdiction. the early morning commute mess could have come from this crash, but bart plans to run its normal train service this morning. now, reporting live, amanda del castillo leo. reggie: this morning, we're learning about the da decision not to charge the secured guard with the shooting of benko brown and the reaction to it. kumasi: hours after that decision in the video was released, people protested in san francisco. melanie woodrow takes a closer look at the da's decision not to file charges. reporter: in an unusual move,

the district attorney's office publicly released evidence in the shooting death of benko brown inside a walgreens last month. in his interview with sfpd, the security guard said he felt his life was in danger. >> the whole time we were wrestling, she was saying that she was going to stab me. that's what really put the fear in my heart. she walked toward the door, but then she turned around and advanced back toward me. that's when i already had my weapon drawn. when she moved toward me, that's when i fired one shot. >> ok. >> i didn't want to do that. i didn't. >> why did you do that? >> i felt like i was in danger. i felt like i was goin stabbed.

i didn't know what to expect after the hostility. reporter: today, district attorney brooke jenkins announced he will not face charges. >> at this time, there is nothing to rebut his statements that he acted in self-defense. reporter: one witness rigorously told abc 7 news several people were shoplifting and the security guard confronted brown. they were told to consider all the evidence. >> while i understand that as a resident, you would want to say to just let the jury decide, that is not the standard for charging. we have to believe at the time that we charge a case that a jury of 12 would convict. not, let's just charge the case and see what happens. reporter: she says the release of information was in part among growing concerns of san franciscans and beyond. the supervisor says he was quite troubled by the video. >> there's distance between them. benko brown is reporter:

kumasi: welcome back. the a's say they have a deal to build a stadium along the las vegas strip. it would be at the set of the current tropicana hotel, which would be torn down for the 30,000 seat stadium. the team is asking for about $400 million in public money from the nevada legislature, which could vote on a proposal this week. the stadium will cost about $1.5 billion. the team previously signed a stadium agreement on the others of the strip from this site, but was asking for money from public funding and a bigger stadium. the a's lease with the coliseum runs through next season. a new stadium will not be done until 2027. a man in virginia is under arrest, accused of hitting two staff members of a democratic congressman with a baseball bat. the man is charged with two counts of assault. both victims are recovering this morning in the hospital.

police say the suspect asked to see congressman jerry connolly at his office. when he got there, he hit two staffers with a metal bat. one of the victims was an intern and it was their first day of work. the congressman was not hurt. reggie: at least two people recovering from injuries suffered from when a large beast warm was uncovered in l.a. it was big enough to be seen from a helicopter. a professional be contractor had to be called out to remove a hive holding thousands of bees under the roof of a home in encino. the neighbors were told to stay inside, close windows and doors, after bees were found. kumasi: happening today, city officials are unveiling a new irrigation system along bar street. the new drip system brings water directly to the base of all plants. it is estimated to save more than 500,000 allers -- gallons of water per year.

that is one of the busiest sections of the roadways in the entire bay area. there is what you are funneling into if you are heading into the bay bridge. ouch. 5:37 was the magic time for the metering lights to come on. a 25 minute delay from the back of the line through the metering lights to get onto the span. the rest moving pretty well from highway 84 to the toll plaza. when you get to the toll that is where the big delay remains. we have been talking about the crash with the train into a truck near the emeryville station, merit station. however, 51 trains all on time for bart this morning. reggie: that's good news. let me show you why it was a mess on bart overnight. dozens of passengers had to be evacuated when the train smashed into a truck on the tracks. this happened before midnight between lake merritt and fruitville stations. fortunately, the tracks were

cleared before our morning commute. amanda del castillo leo joins us now from oakland. amanda: certainly a frightening experience for the more than 40 passengers when that collision happened. at least one passenger is said to be injured, though it is unclear to what extent. the agency also says the bark driver was injured and taken to the hospital. we want to get you a closer look to the crash. around 11:35 last night, art says the pickup truck crashed into the track way on east 8th street. it was hit by a daly city bound train. mark -- bart immed bus bridge in place. the truck driver was tended to on scene. oakland police responded and conducted a field sobriety trust -- sobriety test. no word yet on the findings. an interview with a witness

shows the person detained. we are told had to be evacuated from the train. >> honestly, i thought it was an electrical fire or something. i thought it was going to be real or something. but after that, the fire department picked up the crash. i couldn't believe a truck crashed into it. amanda: another passenger describes the train acting erratically as if it were bouncing around the tracks at the time. they saw sparks and felt the big collision. crews were out assessing damage and impacts to service. the good news is that bart confirms its crews were able to repair the damage from last night's crash, saying normal service has been restored and was restored early as bart trains started running this morning. that was good news for travelers early this morning.

kumasi: thank you. today, things should feel more normal for students and teachers in oakland after a seven day strike ended yesterday. the oakland education association reached a deal with oakland unified. gloria rodríguez joining us out of the newsroom with details on this. gloria: good morning. oakland teachers returning to the classroom today. there is only about a week left in the school year. schools were open yesterday, but it was an optional planning day for teachers after a seven day strike. the oakland education association reaching a deal with oakland unified early yesterday morning. the union says the 2.5 year tentative agreement with the district includes a 15.5% salary increase for most teachers. strict leaders say it comes with a one-time $5,000 bonus and investments for students, like librarians, counselors, nurses, and visual arts and performing arts teachers.

there is a common good proposal, which includes assistance for on house students, and resources for black driving community schools. davidson says he hopes this will help with future retention. >> that was making teachers leave oakland because they wanted to go to another district where they could get to that top salary faster. we shortened that an added extra amounts on the salary schedule to incentivize teachers to stay in oakland, which is what we want them to do. gloria: the district says there historic compensation package for employees over the next three years will cost around $70 million. some parents say the strike could have been avoided. they worry about even more learning loss after the pandemic and now the strike. members still have to vote on the tentative agreement. reggie: thank you. -- kumasi: thank you police. antioch police and contra costa fire is investigating this deadly crash that happened last

night in front of an arco gas station. a car crashed right into a tree. it is not clear how any people died or are hurt. reggie: jose firefighters had a busy night putting out multiple brush fires. the first broke out 11: 15 last night. then, two hours later, two fires started burning and the coyote creek area. it is unclear what started these fires or if anyone was hurt. kumasi: san francisco is in the national spotlight again after a scene and special aired taking a close look at the special issues our city is grappling with. phil matier spoke with us on 3:00 p.m. show yesterday. he says he believes san francisco is having a moment of reckoning. >> i have covered in my time in san francisco drug problems, police problems, financial problems, environmental problems, the mentally ill, the homeless. but i have never had them all at once.

that is the concoction we are seeing now. that's what leads to the question of a failed city. the question is whether we would choose to ignore it or tolerate it, saying, well that is the way things are, we will come up with a perfect solution or no solution, but in the meantime, that's what we are going to live with. kumasi: phil matier went on to say the task for leaders is to come up with a solution and it is a two-part challenge. first, there is no perfect solution. second, there is often pressure in san francisco to come up with a "politically correct" answer. reggie: president biden is said to be congressional leaders for the second time to broker a deal to raise the debt limit and avoid a historic default. president biden says he is optimistic a deal will be made. but speaker kevin mccarthy said no progress has happened on negotiations. republicans want serious cuts in spending before agreeing to raise the debt limit. emma kratz say cuts are a nonstarter. >> we made it plain to our

republican colleagues that default is not an option. reggie: treasury secretary janet yellen has warned that the u.s. is less than three weeks away from defaulting on payments if the debt limit is not raise. a default could be catastrophic for the economy. social security payments and pay checks for the military would be cut off. she also warns that up to 8 million people lose their jobs. kumasi: san francisco is about to launch its biggest change to the city's parking meters in nearly 11 years. it is planning to extend metered parking hours until 10 p.m. monday through saturday. it is also adding sunday metering hours from noon until 6 p.m. it is normally free to park on sundays at this point. the changes will be made in six phases starting this summer, going through the end of next year. they say this will make parking meter hours more consistent citywide and will generate

revenue to help sustain unique service. reggie: and health news now, can diet play a role in your risk of developing dementia? research shows yes. you may risk cognitive decline if more than 20% of your daily calories come from altar processed foods. a neurologist at cleveland clinic who did not take part in the study says the most common cause of dementia is alzheimer's disease. while age and genetics are the biggest factors for alzheimer's, the doctor stresses diet is something you do have control over. >> you can think of things like beverages, chips, fast food, frozen foods. it seems that people whose diet is very heavily weighted to these types of foods seem to have a higher risk of dementia. reggie: the doctor says people who follow the mediterranean diet generally have a lower risk of developing dementia and alzheimer's disease, along with
