security guard at a san francisco walgreens last month. we are also hearing from his mother and his attorney this morning. amanda joins us live in the newsroom with this. amanda: this morning we are hearing from benko brown's mother and attorney in response to the latest case development. john burris says the family plans to sue the security guard, his employer, and walgreens. burris says he will target the company for the policy of having guns. at 10:00 this morning there is a planned rally outside of the d.a.'s office and the group behind it is expected to continue their push for the prosecution of the security guard. burris and his mother are referring to anthony as the aggressor. >> saying my son was the one trying to protect himself. balled up on the ground to cover his body and his face. i just don't understand where the gun came from.

>> he was not the aggressor. that is why it is troubling to me to have this view that the officer claims he was the one in fear when he was the one with the gun, the one that was physically assaulting benko. it's hard to understand how subjective intent can be acknowledged and accepted. in his interview -- amanda: his intvi guard said that he claimed his life was in danger and ground said that he would stab anthony. saying that that is what the fear in his art. back to this morning's planned demonstration, the group will amplify their a quest for the doj to get involved in reviewing the case. there is much more to cover on the case this morning. for now reporting live in the newsroom, amanda dicker still yelled. , amanda del kumasi: you can see more of the

interview with benko brown's mother on "good morning america," coming up at 7 a.m. after the newscast. reggie: east bay penalties have been up to crackdown on and city council unanimously passed the legislation last night. participants could face up to six months in jail or a $1000 fine and it would not penalize people who watch sideshows. city leaders say that sideshows affect the infrastructure of the city and often end in violence. kumasi: also in the east bay, police are asking for your help to find a person who was possibly kidnapped. witnesses saw two men force a woman into the back of a pickup truck. take a look at your screen, a pickup truck with the license plate 8 this happened just before 2 p.m. yesterday near the intersection of e street and 100 1st avenue in oakland. take a look at the truck again.

attention to the fentanyl crisis. we were at brandon near 5th street where one of the billboards has gone up. part of a campaign launched by two groups seeking to put an end to the open air drug markets in the city and employ -- implore city leaders to do more about them. it's also quite the critique of what they call failed drug policies including what they said to them is that there are not enough laces to actually treat drug use rather we are focusing too much time on meeting people where they are. these can be found at the south of the market and tenderloin neighborhoods and they are highly controversial. kumasi: elizabeth holmes, founder of their news, denying -- denied her request to remain out of prison pending appeal. after the decision the judge ordered her to pay 450 $2 million in restitution to the of her crimes. a jury convicted her last year in connection with misleading and defrauding investors about her blood testing technology.

a security guard shot and killed him at a walgreens in san francisco last month. amanda joins us now with new reaction plus details on the protest planned for today. amanda: on behalf of banko brown's family the attorney says they plan to sue the walgreens security guard, his employer, and walgreens, specifically targeting the company policy of having guns. he and brown's mother spoke out this morning, maintaining the security guard was the aggressor . and on brown's alleged shoplifting, the attorney says security guards can stop the person, no doubt about that, but in this case anthony he says went way beyond what was reasonable and necessary, adding that stopping someone and talking to them is different than stopping them and ultimately killing them. in the interview with police, the security guard said that he claimed his life was in danbrow.

the city but brown supporters want to see more donend of banko brown gathered at the harvey milk club yesterday, speaking out against the district attorney's decision to not file charges against of the security guard who shot and killed brown over a confrontation of suspected shoplifting. video was released from the store where it happened where the district attorney says the guard acted in self-defense and there is insufficient evidence for criminal case. loved ones disagree and public officials are now weighing in. >> it's a real tragedy but at the end of the day i think the district attorney did everything she could to look at the evidence and make a decision based on what the evidence demonstrated. >> our folks did their jobs. >> more san francisco stores and businesses are hiring private security guards and the chief confirmed there are other armed guards in the city and said

these types of incidents are very rare. the san francisco supervisor introduced a resolution yesterday urging the california attorney general and u.s. department of justice to look at the evidence in the case income to their own conclusion. the mayor says there is nothing wrong with welcoming the attorney general or anyone else to come and review the case and make their own determination. reggie? happening today, 30 -- reggie: thank you. happening today, health care workers coming together to rally across the state as the board of regents is set to meet today on pay raises for senior management. executives average salary reaches nearly $500,000 a year. uc health health care workers rally last month for cost-of-living increases. some of the lowest paid workers in the system say low wages are making it impossible to make ends meet. the rally is scheduled for later today at the parnassus campus. reggie: london breed -- kumasi:

everyone was ok and the game just continued. resilience of children i guess, i definitely would have run home. new this morning, an investigation being launched after an unidentified man entered the home of a nationals area advisor, jake sullivan. the spokesperson said that he enter the home through an unlocked door around 3 a.m. two weeks ago. sullivan was home, confronted the intruder in the intruder left minutes later. the security breach brings into question secret service protocol because sullivan is under 24 hour per day protection and agents were at his home at the time. >> the secret service has ordered a comprehensive investigation into what went wrong but from a personnel standpoint and in the terms of technology we are told that changes have been made and depending on the results of the investigation, agents could be held accountable. reggie: this shows after
