the app has 150 million users in the u.s. raising serious questions about enforcement and potential legal challenges. this morning montana moving to become the first state in the u.s. to ban tik tok. the governor signing the bill into law, prohibiting the popular social media app from operating within state lines starting in january of 2024. governor tweeting the law is meant to protect montanans personal and private data from the chinese communist party. >> we just never seen something like this in the way of a ban on a social media app that so many millions of americans use. >> reporter: the ban is a major blow to content creators like adam, a former football player and recent university of montana graduate who has 170,000 followers on the platform. >> it hurts just 'cause one of the three main platforms that i have built a community on. it's the biggest one i have built a community on. as a content creator you always have to adapt.

>> reporter: more than half the states in the u.s. and the federal government already ban tik tok on government devices. this follows growing concerns that personal data could be shared with the chinese government through tik tok's beijing's parent company, a claim tik tok denies. the company responding to montana's new law saying it infringes on the first amendment rights of the people of montana by unlawfully banning tik tok. now, the law states it could fine tik tok or entity likes app stores $10,000 per day for each time it allows someone to access the app. those penalties would not apply to users so enforcement gets very complicated, especially when it comes to people visiting from another state. overseas to japan where president biden is meeting with america's allies. the president has cut the trip short as the debt ceiling showdown intensifies at home. senior national correspondent terry moran is with the president in hiroshima. good morning, terry. >> reporter: hey, george. this was supposed

to be a major foreign trip for president biden but the disfin dysfunction back in washington, that game of chicken over the national debt, has underminded him overseas. the negotiations continue the clock keeps ticking. overnight president biden arriving in japan for the annual g-7 summit, meeting first with japan's prime minister. >> our countries stand together, we stand stronger. >> reporter: the agenda here in hiroshima is stacked. ukraine, china, climate change and more. but the debt ceiling drama back in washington followed the president here and hangs over these meetings. before he left, biden tried to reassure the country and the world. >> i'm confident that we'll get agreement on the budget and america will not default. >> reporter: for months biden insisted he would not negotiate over the debt ceiling, accusing republicans of holding the economy hostage to get their way on spending cuts. but with the clock ticking,

biden changed his tune and the outlines of a deal are emerging. republicans would agree to raise the debt limit for one year in exchange for spending cuts, or caps on spending, clawing back some unspent covid funds and tougher work requirements for some federal aid programs for poor americans. those proposed work requirements for people receiving food aid, assistance to families with young children and medicade have ignited fierce opposition from many democrats. biden has said he's open to these ideas while trying to downplay the whole issue. >> i'm not gonna accept any work requirements that will impact medical health needs of people. but it's possible there could be a few others, but not anything of any consequence. >> reporter: asked about that comment, house speaker and republicans citing biden's support years ago for similar measured laughed at him. [ laughter ] >> anything that has consequences? this is a senator who voted for work requirements. >> reporter: senior white house

officials will continue their negotiations. that june first deadline getting closer every day. >> of course this is the president's top priority. he couldn't cancel the entire trip, terry. >> reporter: it has to be his top priority, george. given the stakes here. economic research from moody's estimates that if the debt limit is breached even for a few days it could cost up to 1.5 million americans. if that breach lasts for months, which would be the nightmare scenario, up to 7.8 million jobs could be wiped out across the country. george? >> terry moran, thank. robin? to the 21-year-old accused pentagon leaker and new court documents that state that he was caught taking notes on classified documents more than once. our chief global affairs correspondent martha raddatz has that story for us. good morning, martha. >> reporter: good morning, robin. according to prosecutors, red flags were waving again and again, a warning to the air force that jack teixeira should

not have had access to highly classified material that they say he eventually leaked. this morning the young national guardsman remains in jail as alarming new court documents are revealed. prosecutors saying that 21-year-old air man jack teixeira's willful disregard to was apparent months ago, resulting in multiple reprimands. the new document saying last september teixeira was caught taking notes on classified intelligence and then putting that note into his pocket. teixeira, they say, was told by his superiors to stop taking notes in any form, but his access continued. in october, the documents say teixeira attended a morning meeting and started asking very specific questions. he was instructed again to cease and desist on any deep dives into classified intelligence

information and focus on his job, an i.t. specialist. but again, his access continued. this february, another superior observed teixeira viewing content that was not related to his primary duty and was related to the intelligence field. again, the access continued. >> certainly something should have been instigated, especially after he continued doing what he was told not to do. it may have led to even more documents being leaked. >> reporter: federal prosecutors releasing more messages from social media platform discord, where they say teixeira leaked hundreds of classified documents in the messages they say he boasted about the wide swath of classified information he had access to. writing, there's gonna be an e

expletive here. with teixeira essentially saying, i don't care what they say i can or can't share, all of the expletive i told you i'm not supposed to. this all comes ahead of a pretrial hearing tomorrow where a judge will decide whether or not teixeira will remain in jail as the case moves forward. meanwhile, two of his air force superiors remain suspended. michael? >> all right. thank you so much, martha. we're gonna go overseas to the deadly catastrophic flooding in italy forcing more than 10,000 people to flee their homes. chief foreign correspondent ian pannell is live in italy with the latest. good morning, ian. >> reporter: michael, good morning from the swamp in northern italy. you can see the floodwaters subsided but just look what it's left behind. we have to be steady on our feet. it's just gloopy mud. these people are having to dig all of their possessions, mattress, refrigerator,

absolutely everything has been ruined. if you want a sense of quite how high the flood water came, just look at that thin brown mark up on the building. we reckon that's around 10 feet high. this morning catastrophic flooding across parts of northern italy. some areas deluged by half the annual rainfall they normally get in just 36 hours. the coast guard called in to rescue a pregnant woman trapped in her home. elderly residents had to be rescued by dingies. and in faenza, the only way for one couple to escape from their flooded house was through the roof and air lifted to safety. more than 10,000 people have been forced to leave their homes, the death toll at least nine. with every single river in the entire region bursting their banks. the interior minister witnessing the devastation from the skies. over two dozen towns under water.

the flood water near bologna, strong enough to sweep away this bridge. two days of rain and flooding, a huge blow to the economy. this weekend's formula one grand prix cancelled. trains were suspended in almost the whole region, and many still suffering power outages. the country's interior minister laying the blame completely at climate change. despite what the government officials say, it's going to take time to examine exactly what happened here and exactly what the cause or what aggravated what took place here. however, what we do know from local officials is that the ground was incredibly dry because of persistent drought. what that meant was that when the rain came, when the mud started to flow, there was nowhere else for it to go. you can see what the results were. george? >> just devastating. okay, ian, thank you very much. we're going to turn now to the migrant crisis. in new york city, plans are to house migrants at school gyms.

the announcement has been met with protest. stephanie ramos is tracking the story. good morning, stephanie. >> reporter: george, good morning. so many migrants have come through new york city. 67,000 people seeking asylum have come true. about 4,200 arrived over the past week. about 41,000 are currently in the city's care, as officials figure out where to house them. this morning new york city officials say the city is at a breaking point, as it scrambles to house hundreds of asylum seekers arriving daily. buses arriving in the early morning hours from texas. a plan to potentially convert up to 20 stand alone public school gyms into short term emergency shelters facing fierce criticism. >> i want my kids to be safe. >> reporter: for days, parents and students demonstrating outside this new york city school, one of six sites in brooklyn apparently under consideration. >> this is not a viable option. >> reporter: nearly a week after the end of title 42, cities across the u.s. preparing for a

wave of migrants. in chicago, asylum seekers being housed in local churches due to the lack of room at shelters and police stations. more than 4,200 arriving in new york city last week alone. and officials say they are out of space and more than 150 emergency shelters, and nearly half of all hotel rooms are already housing migrants. officials say that using public school gyms is a last resort but they cannot have families sleeping on the streets. and we're learning this morning from customs border patrol an 8-year-old died wednesday after experiencing a, quote, medical emergency at a u.s. border patrol station in texas. no further details were given. robin. >> thank you very much. appreciate it very much. now to the rise of shoplifting. target says last year it lost hundreds of millions of dollars from thefts. our chief business correspondent rebecca jarvis has the latest. good morning, rebecca. >> reporter: good morning, robin. target says theft and organized

retail crime is becoming a major problem at its 2,000 stores nationwide. the company reporting it lost $763 million last year due to lost or stolen merchandise, majority coming from shoplifting. as a result, target is locking up more and more of its inventory on store shelves requiring employees to get help for those shoppers. they're not alone. according to the national retail federation, organized crime in stores is growing in scope and complexity at retailers across the country. downtown san francisco, stores like office depot, the container store and nordstrom's and whole foods have all closed in recent months citing safety concerns for their workers as well as their customers. there are several other factors hurting retail. changing shopping habits, more price sensitive customers because americans are faced with those higher inflation prices and they've begun cutting back. earlier this week home depot announced they missed revenue expectations because customers are buying fewer big ticket items and taking on smaller

projects. guys, remember. when these things happen, when that shoplifting happens, it ultimately costs every customer more because the stores account for it in their prices and they pass it off to the consumer. guys? >> there is a ripple effect. >> we all pay for it. thank you, rebecca. now we're going to the nba playoffs. miami heat staying hot stealing game 1 of the eastern conference finals in boston. will reeve has the high lights in the big game in the west tonight. good morning, will. >> good morning, michael. these playoffs are so good. last night it was a tale of two halves. celtics and their home crowd on the heat and their star jimmy butler, kind of off. boston went into the half up nine points. but then the heat turned on. butler became jimmy buckets scoring 20 points in the second half. he had the most points in the game, 35. he played the most minutes with 43. and is, by far, the most valuable player on the miami heat, who opened up a huge lead

on the celtics in the second half until boston came roaring back, made it really close late, but in the end, miami stealing game 1 in boston. that is statistically significant because the team that wins game 1 of an nba playoff series goes on to win that series about 75% of the time. that's something to keep an eye on. much like the l.a. laker, the miami heat barely made it into these playoff. they had to play in the play in round. they lost the first game of that. they had to win the second. they just won't quit. they are rolling. they are just three wins away the nba finals, like the denver nuggets who, tonight, play lebron james and the lakers in game 2 of their western conference series. that, of course, is at 8:30 p.m. eastern on espn. we're really getting into the good stuff, guys. >> yes, you are. you got to appreciate miami. barely made it in and now beating up on everybody. all right. thank you very much, will. coming up, harry and meghan accusing the paparazzi of a near

interest, but they say it should never come at the cost of anyone's safety. while there were no crashes or injury, they claim the actions of the paparazzi could have easily gotten someone killed. this morning the duke and duchess of sussex and their treatment by the media once again back in the spotlight after what they call a near catastrophic car chase. >> meghan, this way! >> reporter: paparazzi were already swarming as harry and meghan, along with meghan's mother, arrived at a manhattan charity event tuesday night. according to the couple's spokes person, when they left they were immediately targeted by a ring of highly aggressive paparazzi and a relentless pursuit lasting over two hours resulted in multiple near collisions involving other drivers on the road, pedestrians and two nypd officers. they were driving to a police precinct, they tried to evade the cameras in a taxi driven by sonny singh. >> it was a strobe show. there were lights everywhere,

flashing. we srm again.y >> they lde ck they were just about to give me going but the paparazzi came. they told me to circle back to the police. >> reporter: so very quickly? >> yeah. maybe 10, 15 minutes. >> reporter: did it seem tense inside? >> they were nervous. you could see they were nervous. >> reporter: one sussex security member said the chase could have led to fatalities, though there are still questions about its level of intensity. the nypd said there were numerous photographers that made their transport challenging, but there were no injuries or arrests. sources tell abc news police interactions with the couple ended within 20 minutes. the mayor called the photographers who chased the couple a bit reckless and irresponsible. >> it's clear that the paparazzi, they want to get the right shot. they want to get the right story. but public safety must always be at the forefront.

>> reporter: brad grid said they had no intention of causing any distress or harm as their only tool was their cameras. the mayor is one of many drawing comparisons to the deadly car crash that killed harry's mother, princess diana, in 1997. >> i don't think there's many of us who don't recall how his mom died. >> reporter: harry has openly blamed the paparazzi for her death telling michael strahan in january -- >> i'm trying to put a stop this. i can't ever imagine, i don't want to imagine what that would be like for me or for my kids. especially when you talk about history repeating itself, right? >> there will be meetings between harry and meghan an their team and security detail, and also the nypd, to talk about how this can be prevented. this will really make them think about coming back to new york for events and it will make them think differently about how they carry out their work moving forward. >> reporter: that taxi driver said he's driven several celebrities but has never seen a paparazzi response like this.

we're told clearly harry and meghan were shaken up by this. neither buckingham palace or kensington palace has commented. guys? >> okay, trevor, thanks. now to the south carolina wedding night tragedy and new legal action the groom is taking. >> reporter: good morning. a wedding night turned into tragedy. the bride killed by an alleged drunk driver. the groom now going to court filing awrulgfon against the suspect and restaurants and bars that served her. this morning the husband of the bride killed on her wedding night in an alleged drunk driving crash has filed a wrongful death case against the driver and the local bars who allegedly served her. >> this case is about keeping the public and all of us safe from drunk drive. >> reporter: eric and samantha were leaving their wedding reception last month when police say 25-year-old jamie lee komaroski hit the golf cart carrying the couple. samantha was killed. the groom and two other members

were injured. police say komaroski was driving 65 in a 25 mile per hour zone with a blood alcohol level more than three times the legal limit. the lawsuit claims komaroski worked at a local restaurant, was bar hopping with co-workers and that the bars continued to serve her despite her being visibly intoxicated. the suit also accuses her boss of organizing the bar hop knowing alcoholic beverages would be purchased. >> there is a responsibility in that role as supervisor. we felt that was not done here. >> reporter: eric hutchison is out of the hospital but faces a sad new reality. >> i can't imagine. you go from the happiest moment of your life to an unfathomable tragedy. >> as for the bars named in the suit one denies any gathering involving komaroski. eric, the groom, is out of the hospital recovering from his injuries. george? >> o andrew. thank you very much.y,ka tomorrow on gma, we are going to be talking exclusively with his family.

prosecutors will forego a planned preliminary hearing that was set to take place next month. >> before someone goes to trial in idaho, you either need to have a judge or a grand jury say, there's enough evidence to take this case to trial. this is definitely the easier route for prosecutors to go. there's no cross examination of witnesses. they don't have to call in reluctant witnesses. no judge. no defense attorneys there. >> reporter: kaylee's family telling abc news they believe this was the best option for the circumstances. it means the two surviving roommates who were in the home when their friends were murdered will not need to endure a minitrial before the actual one begins. kohberger was arrested in december and shortly there after, authorities searching his washington apartment. prosecutors say in his sparcely furnished apartment, they recovered multiple pieces of evidence, including a pillow and mattress cover that came back as presumptive positive for blood.

now to the new report on the rsv vaccine for pregnant women. the fda plans to meet today to discuss pfizer's application for a maternal vaccine after approving one for older adults. dr. jen ashton is here to break down this new report. >> george, first of all, 35,000 here. remember in the covid vaccine we desperately needed data conducted on pregnant women? this is why this headline is so important. the results of this study published in the new england journal of medicine. they looked at pregnant women in over 18 countries. a dose of the rsv vaccine given to the pregnant woman between 24 and 36 weeks. this stage three clinical trial looked at efficacy and found good results in tests from the fetus to placenta. it prevented severe lower respiratory tract infections due to rsv and reducing hospitalizations in the infant. there were no serious safety signals, which had already been tested in the past. this is encouraging data. >> that means likely to be
