stabbed and the relationship between lee and nima momeni's sister. the murder suspect, nima momeni will remain in custody without bail. a judge granted prosecutors motions to detain nima momeni even though the judge said he did not believe he is a flight risk. >> anyone who is capable of violently killing someone in society, is a public safety risk. melanie: the defense attorney. >> my defense is it's a combination of an accident and self-defense. >> it was an accident with three stab wounds? >> i will say my defense is it is an accident, with between self-defense and an accident. there was no premeditation deliberation. >> we believe this was an intentional killing. melanie: the knife used to kill lee came from nima momenis' sister. >> the attorney said abc 7 says she was friends with lee, but they did not have a

romantic relationship. in a statement, she said she was saddened by the decision to keep her brother in custody. had policed talk to nima momeni the night of the murder, he would have explained what happened, a nd the case may not have been charged. >> i don't know what i am missing, but i guarantee i'm going to figure out why basic police steps were not done in this case. >> during the nine days they had to make investigative decisions on who they interviewed. that was a police investigative decision. melanie: they tell abc7news, they cannot comment on the news while the case is being adjudicated. nima momeni did not know the severity of lee's injuries and the vehicle approached lee, it was in uber he called to pick him up. >> he walks completely fine. melanie: prosecutors say nima momeni's sister declined to be interviewed. each family member has their own attorney, including his mother,

his sister and his sister's husband. foey time -- for the i-team, melanie woodrow. kristen: a rally is getting underway a popeyes restaurant in oakland. workers are calling on the state against claims of unsafe working conditions including child labor conditions. it has closed down its location at 70th and international boulevard. two employees filed a labor and safety complaint, when a customer climbed over the customer and assaulted an employee. popeyes corporate responded today saying the company immediately shut down the restaurant to launch an investigation. larry: the bay area's biggest cities, san francisco, oakland and san jose saw declining population, with san jose dropping 1%. san jose is no longer a top 10 most populated city. new york, los angeles, chicago, houston and phoenix are in the top five.

san jose has dropped into the top 12, it is now the 17th of most popular city in the story. dustin dorsey takes a look at the numbers and what it would take to bring people back into the bay area. dustin: san jose is shrinking. the 2022 census bureau's report shows the bay area's biggest city has fallen ou we have seenr years saying residents are frustrated. they are frustrated with the high cost of living and quality-of-life, like homelessness, crime and blight dustin: the city had an estimated population of over one million residents, down to 981,000 in 2021. in 2022, a population of 971,233, which ranks 12th in the country falling behind jackson, florida and austin, texas. falling for the first time in more than a decade is a wake-up call, according to the mayor.

>> we have great companies, amazing weather, a diverse workforce, so many assets. if we will continue to grow would have a strong economy and provide high quality of life to our residents, we will have to get back to the basics. dustin: he believes staffing the city's police department, continuing to work towards ending the housing crisis and making the city feel safe and clean. san jose state economics professor, matt says the city has seen a drop in home prices due to thed, toccpl>> fallen, the property tax base goes down. cities are able to collect less tax revenue. that will affect city budgets, everything from police, schools, basic street cleaning. dustin: oakland and san francisco have joined san jose and declining population in the last few years, which makes the problem on the streets more visible, with less vibrancy. the mayor says he ran for office

to but the trend. he's confident in the city's ability to grow if they get back to basics. >> san jose is the capital of silicon valley. we are the biggest city in the region. we need to lead the region out of this funk we are in. larry: three bay area cities are in the top 10 when it comes to population decline. union city and san leandro dropped 1.9%. livermore, fell 2%. the u.s. census report looked at cities with populations over 50,000. like its m ldmk, cruz's populata roller coaster ride. census data shows the city grew by 7000 between july of 2021 and july of last year, 12.5% jump, second to georgetown, texas, which is outside of austin, due to santa cruz's rebounding from the closure of uc santa cruz during the pandemic. the population is 62,000, shy of what it was pre-pandemic. kristen: treasure island is

expected to have 8000 new units in the upcoming years. among the new buildings is one designed for veterans. leanne melendez tells us how this project on ti have dramatically improved the homeless situation among vets in san francisco. >> the day i moved into my little place, heaven. reporter: an honest statement from a marine veteran who became homeless in 2008. he moved into the newest development for veterans on treasure island, called masao may apartments. >> i see things different. it's amazing what these people have done for me, to help me come out of and become michael. i did not even know it was in me. reporter: this is the first housing project to be completed on treasure island, now home to veterans who were unhoused.

105 new units will be rented out with supportive services. there are common spaces with views of san francisco. >> 5, 4, 3, 2, reporter: in the late 1980's, 40% of those living in homeless shelters were veterans. today, the percentage of unhoused vets is close to 15%. >> homelessness in san francisco among veterans has been reduced dramatically. reporter: to understand how they were successful, we sat down with michael of the veterans nonprofit, sores to plowshares. he told us, the federal government stepped in. >> the v.a. made rental certificates available to homeless veterans. it provided funding for groups like swords to get out onto the street and provide outreach and the services that made it possible.

reporter: providing housing is crucial. treasure island is expected to have 8000 new units in the upcoming years and 2200 of those affordable. in san francisco, leanne melendez abc7 news. larry: they investigating what sparked a five acre fire. it started around 9:45 between mcewen world. fire fighters controlled the flames and put out the fire. no structures were threatened or injuries reported. kristen: to a new warning from the cdc on mpox, known as monkeypox, a rebound outbreak, they are encouraging more vaccinations. larry: amanda del castillo has the effectiveness of the vaccine. amanda: the country's outbreak is not overcome a reminder from the cdc this morning. officials are commending public health efforts to improve

vaccination and reduce health disparities. in a teleconference call, the mpox response incidents manager and the response deputy coordinator combed through the numbers. >> the mpox outbreak occurred with no warning. in august, with 460 cases a day, cases declined to an average of one per day. at this point. the outbreak is not over. amanda: crediting vaccinations pointing to several studies which looked at vaccine effectiveness. one finding that two doses of the genie is vaccine were more than 88% effective against mpox. >> the more immunity we have is a community, the lower the chance it is that we will have any outbreak. higher vaccination rate, equal lower risk for an outbreak amanda: the cdc says in one year, more than 30,000 domestic mpox cases were reported in the u.s. more than 140,000 specimens were

tested. more than 1.2 million doses of vaccines were administered. dr. peter han weighing in >> there has not been much resistance to getting the first vaccine. i would say that it has been disappointing that a lot of people haven't gone to get the second dose. enough time has elapsed where i think the second dose will be important for many people to get. amanda: the cdc is looking to get the information ahead ttent, sa vveness and prevta pow i trsmisonn you can benefit fromv preexposure. men who have sex with men who are living with hiv, a 25% correction factor, takes us to a denominator of 1.7 billion individuals who could benefit. larry: coming

larry: abc 7 is committed to building a better bay area. we are discovering one breakthrough in the south bay. kristen: laura looks at any program, developing small business owners with a criminal record. >> across the bay area there is a business ownership disparity. 6% of businesses are hispanic owned and 1% are black owned. >> we cannot be the entrepreneurship capital of the world when almost nobody has access to entrepreneurship. >> yeah so ventures helped budding minority -- eso ventures helped budding minority companies, now it is butting in santa clara county to help formerly incarcerated individuals build the small business. >> they will get one-on-one business coaching, access to the first investment, if they are ready, if they are formalized, they can get access to $5,000 to a $20,000 investment. >> they will be incubating and

investing in 40 businesses owned by individuals with a criminal record over the next two years. >> as juveniles exposed to the system, as an adult, i worked in the system. >> marshall williams says people entering the community after getting out of the system, start off with barriers. >> what are my forms of identification? where am i staying? what is my environment? >> p started his own company in 2021 called project pet, with the help and support services from eso ventures. >> what was able to create for me was an environment where there were like-minded entrepreneurs that were forward moving. it is a network of people who were been there, that you don't really need to know personally to be able to receive benefits from. >> the reentry program create positive change that will benefit the entire community. >> we work with them every day. we see that these are people who have transformed their lives.

they just need a chance. for some of them they have that. kristen: the chp has notched campaign warning of the dangers of street racing. the chp unveiled thrills that kill, a lifesaving education and zero-tolerance enforcement campaign. displays featured crashed vehicles and billboards of people who have died in slideshow accidents. the chp announced task forces will be saturating cities around the state to stop slideshow incidents. >> they will be canvassing the streets, conducting focused enforcement to prevent street racing while looking for illegal modifications to vehicles. i'd like to ensure the public we hear your concerns. we will continue our focused enforcement efforts. kristen: officials announced governor newsom approved $5.5 million in funding to support local agencies in stopping illegal racing. larry: new reporting out of las

vegas says nevada politicians are balking at the stadium deal they are seeing from the a's. lawmakers have yet to introduce legislation because they are unwilling to contribute the 400 million dollars the team wants for a new ballpark. that report, as lawmakers discussed between $195 million in transferable tax credits. the a's announced a second agreement to buy land, they ditched their first site, this time nine acres located off the strip. oakland city officials are keeping watch on everything that is happening with the a's in vegas. the mayor appearing with kristen on midday live. >> the howard terminal is already entitled. i want the a's to stay here. if the owners called us back to say, let's get back to the table, we are close to a deal. if someone wants to buy the a's and that happens, we are very close to a deal. larry: the mayor says the city will expedite any deal that could be reached along the team

larry: we hear about restaurant week in san francisco but the peninsula has one too. the third annual peninsula week starts tomorrow, including restaurants and san mateo county and silicon valley. gloria rodríguez has the details. >> this is going to be the vegetable curry. gloria: this chef shows me the dishes he created for peninsula restaurant week. the nine event is put on by the san francisco peninsula and embarcadero media. >> tends to get overlooked. coming in between two cities, we really want to showcase that we have an amazing culinary scene. since the pandemic, i think we want to get visitors and locals out, and support the local dining scene. gloria: jaclyn of the san francisco peninsula tells me they have more than 100 restaurants participating, featuring amazing food and fresh

about her health. new calls for her to resign. she waived for order -- waved off a reporter who asked her about it. >> do you feel like you are fit to serve? >> what you think about calls free to resign? larry: senator feinstein was being wheeled to a senate judiciary committee meeting, escorted by the eldest daughter of nancy pelosi. she is caring a red purse wearing the scarf. she seemed to be at her side, but she is not technically working for her office. today's exchange comes after the 89-year-old senator interaction on tuesday with an l.a. times or order -- reporter that raised questions. >> you have been working from home? >> i've been here. i have been voting. please. it is either no or don't know. larry: senator feinstein,

appeared to not know she was away from the capital for months while recovering from shingles. she is planning to retire at the end of her term. kristen: joining us now is our political analyst. thanks for coming on the show today. >> good to be with both of you. kristen: let's start with we just heard and saw. what are your impressions of senator feinstein? does she see more affected question goes complications? >> i think she has been more affected. the complication of the encephalitis, and it paralyzing part of her face has had an impact. that coupled with the fact that she lost her husband of 40 years, earlier this year, i am sure it has taken a toll. she has already decided that she is retiring. there were calls for her to come back to washington. she has returned. she is doing her duty by voting and serving on the committee.

so, i think we need to recognize that this is the end of her career. personally, whether she feels that she can continue. but that is her decision to make. larry: when you look at the interaction on tuesday, are you concerned about senator feinstein's ability to do the job? >> i think time will give us the answer. but, let me remind everyone that we have had members of the senate who have been gone for as much as a year, after having a stroke, and there were no calls to have them resign. there were no calls that they return to the capital. those have been made and quite swiftly in the case of senator feinstein. i think that we need to just give her the opportunity to evaluate whether she can continue to do the job. she's always put california

first. i think that, whether it is the 30 years that she has served in the senate or the 10 years she has served as mayor of san francisco, she is a record that she can certainly be proud of. kristen: certainly. i think, in the last couple of years, concerns about her cognitive abilities have been spoken in public, in the past year, progressive lawmakers have been very vocal that she does need to resign. do you think that calls for stepping down, has expanded beyond the circle, since the singles -- shingles episode? >> you have to evaluate who these people are. it is a handful. two members of the house do not even live in california. one member of the house supported her opponent in the last election, in which she was up for reelection. and who has a lot of ambitions himself. i think that giving time to

to make that evaluation is the appropriate thing to do. we don't call on other members of the senate to step down and yet some people are calling for her to do so. i do think that there is a level of misogyny here. we should call it out. larry: so, this is really a touchy situation, when you talk about someone who has devoted so much of their life to public service, do you know if anyone has sat down with her and said, look your 89 years old, we are not sure about where this is going, really think about whether you want to finish out your term? has that conversation been had with anybody? >> larry, i don't know if that conversation has been had. i can remember her, after george moscone he and harvey milk were assassinated, 10 days after the jonestown massacre, and that steely resolve helped her continue to lead the city and

kristen: time now for the four at 4:00. it is a big win for twitter. the supreme court ruled twitter is not liable for hosting tweets made by the terror group isis, following the similar case of googles content moderation of google. it is a win for social media forms -- platforms that face similar lawsuits. karina: the people on the side of google and twitter, facebook, metta they state is a big win for 3 -- four free speech but this comes into question our isis posts and isis inspired people to commit crimes, should that be protected as free speech? yeah, victory for social media,

but i think still a lot of questions here, a lot of debate of course. larry: it is a slippery slope. you would like to see content that you know is untrue swiftly removed from the site, all of the sites. frequently that does not happen. another supreme court ruling today that could have big implications for artists. the court says andy warhol infringed on copyright law created work from the photo of pirnce -- prince. his silk screens are transformative enough to fall under the fair use doctrine. i find this to be really interesting. if you look at the music industry right now, current artists are sampling and basically taking music from older hits, from 10, 20, 30 years ago, and remixing them. it's clearly the exact same beats, but you are allowed to do that in music, clearly here with artwork is a different story.
