joining us, i am deon. you are watching abc seven news at 11:00. only at 7:00 tonig lived in the took sedo neighborhood for three years. several individuals were attempting to rob gardeners working next-door. one gardener tried to escape by climbing over a fence and that's when shots were fired. paul described how the bullet penetrated the fence, the window, and went through a wall. his family was not home, but he was working at his computer less than five feet away. he is speaking out demanding change. >>'s is like a third world country. is that oakland? is that california? i think everybody can agree that regardless of the political climate or opinions, we just have to be safe. we can't have people, no matter their age or whatever, firing at innocent people. dion: he is

his family out of the neighborhood. we are waiting to hear back from oakland police. new at 11:00, the wife sonoma county sheriff is under arrest for driving under the influence. santa rosa police say she crash the tesla she was driving into a house this morning. one person was hurt, a woman had minor injuries. sheriff released a statement on facebook saying, as a husband, i am greatly concerned about my wife's well-being. as a citizen and sheriff, i am also concerned about the well-being of the person inside the home who suffered injuries. abc 7 is committed to building a better bay area mac. we are looking at a landmark ruling in contra costa county. a judge under california's new racial justice act says some practices by the district attorney's office were racist.

for police accountability, earlier that morning a superior court judge issued a landmark ruling against the contra costa county district attorney's office. >> our clients were not only subjected to racist policing, but when they were brought into the economy -- criminal justice system, the ruling was they were suggested to racist charging decisions. reporter: this attorney is representing one of the four men in the case. the judge found proof of racial bias and racism in the decisions by the das office. she says that black people were up to 40% more likely to be charged with special enhancements compared to others. >> that is significant. when you charge someone with a special circumstance, you are asking the court to impose a mandatory sentence of life

without any possibility of parole ever. reporter: the ruling the men are named in the texting scandal, but this case is not about the text. just the das filing practices. >> the disparity in those charging decisions was 92% based on race rather than any other factor. reporter: in an email, the district attorney says the ruling is one of significance for offsetting systemic racial disparities within the criminal justice system. the court's ruling provides direction and my office will review similarly charged cases to promote fair and equitable prosecution. >> this is a landmark ruling the first ruling of its kind. it is actually the second ruling under the racial justice act involving the contra costa district attorney's office. reporter: the chief public defender for contra costa

there was a roundtable discussion where they talked about issues that farmworkers currently face. access to clean water, housing and health care. all in response to the deadly mass shooting in january that killed seven farmworkers. the summit focused on policy solutions which elected leaders could adopt to help farmworkers throughout the region. the league of women voters honored several bay area leaders tonight for their advocacy on lgbtq rights. the event raise money for community groups pushing for equal rights. our reporter shows us why this event took on special meaning. ♪ reporter: the glitz and of some of san francisco's top drag performers. this event is designed to send a message. >> we see people who are being pushed down. we see they are trying to make people invisible. we want to lift them up. reporter: the league of women voters put on a for democracy.
