major news out of alameda county superior court. >> thanks for joining us. the alameda d.a. has dropped two of three murder charges against the defendant in case she inherited from the last administration. >> this case is one of the first she faced after taking office in january. >> dan noyes was in court and he is here with the latest. the judge in this case removed after he rejected a plea deal that would reduce the prison sentence for dolonc would -- the ones along would from 75 years in prison to 15. the judge is staying on the case. alonzo longwood was charged with three murders and he was 18 years old. he graduated from high school while in jail. in march after judge mark mckennon rejected a plea deal that would have gotten him out of prison after serving 15 years is that of 75 district attorney price tried to have the judge removed from the case.

today a judge from san luis obispo county world he will remain writing the presumption of judicial integrity has been rebutted. prices prosecution team made a motion to drop two of the three murder charges. >> the prosecution acknowledged the problems with the case i have been talking about for years. >> david briggs is logwood's defense attorney. >> two got dismissed. we are looking forward to proving his innocence on the third one. today was a great victory. >> he will not face charges in the death of richard carter during an alleged carjacking robbery in 2008 with the death of zaire washington the same year. he was set to testify against logwood's half-brother. the prosecution says a key witness is unreliable. the first prosecutor on the case under former district attorney of mali reduced the 31 year sentence for attempted murder and manslaughter associated with

logwood's case to just 19 years and four months. here is the first prosecutor's mistake. she gave the witness a reduced sentence to testify in logwood's preliminary hearing but the witness got out of jail in february and will not return to testify at the trial. >> according to his attorney he was willing to be put in jail for contempt of court rather than testify. >> the prosecutor wrote in today's motion because of the structure of this cooperation agreement there is nm by which the people can penalize deal for violating his promise at this stage of the proceedings. >> you make sure they give you the testimony you need before you let them out. >> former san francisco and prosecutor penny breast tells me the prosecution could've used the testimony from the luminary hearing. i don't know who evaluated the transcript and decided this does not carry the day. that is something that is unusual too. prosecutors use preliminary

hearing transcripts all the time in trial. >> today the prosecutor said the testimony does not correspond with the evidence in key areas. as for the last charge logwood faces his attorney says he has a witness confirms the murder for hire story is not true. >> there is no way this was a murder for hire whoever did it. longwood did not do it. >> this case could go away soon you are saying. >> ask me tomorrow, dan. >> i have spoken to longwood's mother and today she finally smiled when i asked if she saw this as good news. also today the prosecutor declined to comment. i asked da price and her new spokesperson for an interview or statement and did not receive an answer. >> thank you. >> we have another eye team report coming up at 6:30. stephanie sierra digs into juvenile crime in san francisco.

here what police say they are seeing on the streets. >> will san francisco's new city budget help build a better bay area? mayor breed highlighted her priorities which will receive the biggest amount of funding. the mayor had a different tone this time after being criticized for not doing enough. >> i think you are right. lately much of the blame has fallen on mayor breed. i think she feels she now has to assume a different demeanor. she realizes she has to be perceived as a consistent politician and not indecisive when it comes to issues such as drug dealings, the homeless and getting san francisco back on track. i don't like to make comparisons but i'm going to anyway. i am sure that mayor breed does not want to be compared to rudy giuliani when he was mayor of new york city in the mid-90's when things were really bad. i know because i was there.

today she seemed to borrow a page from his book. >> everybody is happy today because it is money day. >> the reality is there is less of it coming in forcing the mayor and city departments to balance a budget cutting $780 million in expenses. as expected the funding to try to get people off the streets and into shelters and supportive housing will increase by 3%. >> of course not everyone is going to be happy about the decisions i made to take resources that are not being used and spend them on people we know need help and support now and i don't really care. >> the budget will also try to build that police staffing funding 220 police over the next two years. police chief william scott said staffing is a huge mountain to climb. >> almost 600 officers below where we should be.

>> don't talk about it. be about it. join the san francisco police department. be the change you want to see you. >> as part of the public safety package, the mayor underlined the efforts to shut down the open air fentanyl market have already started. in addition programs to bring people into care and rehabilitation will be expanded. a warning to those programs that do not deliver results. we are doing a deeper dive and if you are delivering you get funded and then some. if you are not delivering we are taking away dollars. >> part of the efforts to restore downtown be contingent on how safe people feel. another factor is to bring new businesses in by delivering tax incentives. >> i know some of these decisions are not going to be popular but i don't care. i did not become mayor to be afraid to do this job the way it needs to be done.

>> and those tax delays will have an impact on what the city brings in. the mayor thinks it is the only way to attract businesses to the budget so the mayor can sign it by august 1. >> a few hours ago we spoke live with abc 7 news insider phil matier about the city's finances. >> san francisco is spending more than most states spend in terms of their budgets. we are talking about a 14, $15 billion budget. you say where is the money going, what is it doing? if this was a homeownership association it would be about $78,000 spent per citizen. are you getting anything for it or is it going around? that is what she has got to the liver on -- to deliver on. >> a tech billionaire is making an investment in san francisco's

future. >> one of the things we are trying to do with this effort is encourage other businesses, leaders, people who have resources to contribute. i think it is one the best channels because it is superefficient. they know what to do and they make the most of the resources they get. we love this channel of going right to the small business districts. >> the grants range from 5000 $50,000 and are intended to help revive business districts. > the man accused of stabbing an employee at a chinatown bakery earlier had his court appearanceescheduled for tomorrow. the court needs to find him a translator. we are learning new details about his previous connection to the bakery on stockton street. suzanne phan has the story. >> seen here in this photo he is accused of stabbing a female employee on stockton street monday morning. a witness took this photo right after the attack should police arrested him without a struggle. according to court documents he attacked the employee just 10 days after he was released from

prison. today we talked to the bakery owner by phone. >> i don't know why. >> we are learning more about the connection between the suspect and the bakery. he tells me according to police this is the same man who stabbed chance father in 2016 portsmouth square. this was a report about the attack. he said his father was plain poker with friends in the park that day. how serious was it? >> very bad. 12 days in the hospital. >> he says he has never seen the man and his father did not know him either. >> i did not know him. >> he pled guilty to attempted murder and was sentenced to nine years in prison. >> my hands are still shaking. >> new disturbing to a lot of people in san francisco's chinatown. according to the bakery owner the employee stabbed had only been on the job for three days and was still training. she was critically injured.

today we asked the da about the alleged attack just days after he was released on parole. >> i am horrified by the events that took place. we are taking this case very seriously. when we have someone who not only attempts to kill a resident in the past but now apparently has committed the same type of behavior, these are exactly the types of cases that concern us and we make sure we take a closer look at. >> the da says it was not her office's decision to release him. she says the california department of corrections released him on parole. >> my office was asked whether or not we wanted to oppose his rease into san francisco for his parole. we actually did object. unfortunately he was still released. >> jenkins says she has failed a motion to detain him without bail. he returns to court for his arraignment thursday morning. >> coming up w take you to a growing homeless

this growing encampment has come to symbolize the haves and the have-nots in the seemingly affluent marin county. >> what we are seeing here is a larger issue we see across the state which is the housing prices we have, the homeless crisis we are experiencing. >> this is the captaincy. >> elisa mackey has been homeless for three years. >> i was trying to hold my head above water. i was in sonoma county. >> a month ago she moved south to binford road. what do you want folks to know about binford road? >> we are not bad people. we just made the choices maybe. >> the county says there are roughly about 180 vehicles and about 90 people who live here. from a of the folks they tell us it was the pandemic that was the tipping point. just ask gordie. he has lived here for six years. and you moved here six years ago what was the road like? >> there were about five or six

motorhomes on the street. >> this video shows binford road for years ago. now it is packed bumper-to-bumper and with county sanctioned resources. there are weekly trash pick ups, porta potty's and handwashing stations. >> on a weekly basis folks are out here multiple days engaging with residents hearing about their needs, listening to their stories, talking about what support they meet -- they may need to get back into housing. >> gary is the county's director of homelessness. >> who are these folks? >> folks who are here are family members, brothers and sisters, aunts and uncles, these are our neighbors. >> the goal they say is to get these residents into permanent housing. it is something alicia and gordie hope for tubing. what is your goal one year from now? >> to be in my own place and to have a job. > i want to be out of here. i would like to be out of here.

>> live breaking news. >> the nazar 117. the bill is passed. >> that breaking news in washington. a high-stakes vote in congress to raise the debt ceiling ended a short time ago with the bill passing as you heard and by a wide margin. >> if congress had not acted a default could have happened as soon as monday. negotiation's between president biden and speaker mccarthy led to a deal over the weekend. there had been pushback on both sides. >> let's take a live look at the house. which has wrapped up the vote on the debt ceiling limit. this is another matter. they're voting on something else. the big news in washington after a lead of heated back and forth and controversy over the deal that had been worked out by speaker mccarthy and president biden. the vote did passed to raise the debt ceiling and it moves on to the senate. >> it was 314-117.

one of those democrats who voted no is east bay congresswoman barbara lee saying it did not do enough for low income people as well as the environment. they needed 218 yes votes to push the boat through. 90 minutes ago mccarthy made his pitch to pass the legislation framing it as a victory. >> we are finally bending the curve on discretionary spending because of this bill. we are doing it while at the same time raising our national defense and our veterans fully funded. with social security and medicare preserved. and without raising a penny in new taxes. >> the bill moves to the senate where republicans have signaled there were support pit -- their support. >> new data analyzed by the i team shows a certain uptick in a violent crimes in san francisco. stephanie sierra is digging into the data and what police say they are seeing on the streets. >> it has been nearly a year

since this group of four juveniles attacked to the 70-year-old woman in san francisco. how often are these attacks happening? data obtained by the i team from the san francisco juvenile probation department shows so far this year there has been an increase in juveniles committing serious and violent felonies like this one. will break down the data in moment but first a perspective from police. we set down with the president of the san francisco police officers association who is regularly briefed by police captains at all 10 district stations. how often do you see cases similar to that? more than i want to see. >> how many? >> 6, 7 kids ganging up attacking one or two people. attacking elderly. it feels one every week. >> one every week? >> at least. >> newly updated data shows there have been 131 more

robberies across the city so far this year compared to this time last year bringing the total to 1003 since january. . police attribute some of that increase to juvenile crime. she says juveniles 12 to 14 years old are working in groups. coming in and out of the city? >> in and out of the city. come from the east bay. some who have run away from their group homes down south or from the valley coming up to san francisco. i think they feel like you know, who is going to check me? >> last week opd arrested nine juveniles believed to be responsive to 39 robberies in oakland. >> there was some crossover between some of the juveniles they arrested that in the city we have come in contact with those juveniles. >> how many of them>>? >> three or four are the same ones and their part of this group.

one of the youngest ones we ran into was 11 at the time they committed an assault. >> she says this year attacks involving juveniles are getting more violent. often targeting elderly victims. but there is not enough data to discern the uptick in violent robberies across the city as solely tied to juveniles. the number of juvenile robbery arrests in san francisco has actually gone down dramatically over the past two decades. >> very small numbers now. >> mike is a senior research fellow for the center on juvenile and criminal justice. according to fbi crime data in 1995 more than 500 juveniles were arrested for robberies in san francisco. in 2010 the number dropped to 188. from 2019 through 2021 those numbers dropped again into the 20's. the i team is still waiting for the exact number of juvenile arrests sfpd made so far this year. a crime wave, no what an uptick,

yes. according to the san francisco juvenile probation department there has been a steady increase of juveniles coming serious and violent felonies also known as 707 b offenses. in march there were 74 juvenile cases referred to court which is 35% higher than the average last year and 30 admissions to juvenile hall which is 58% higher than the average last year. >> there is some basis for saying there is an increase in juvenile crime but we have to remember the numbers are very small. >> sfpd data shows aside from robberies there's been a slight uptick in homicides and a moderate increase in motor vehie thefts across the city. other violent crimes like rape, assault, glory and larceny have gone down slightly in the first five months of the year compared to last year. larceny theft accounting for the most crimes committed. more than 11,000. down from nearly 13,000 last year. >> petty theft, going into a

walgreens, target. some organized retail theft. more sophisticated. always feel like we are playing catch up. >> do you see that problem getting better in san francisco? >> not until you change the law. not until there is some teeth within the law. long supported repealing prop 47 that made some nonviolent drug and property crimes into misdemeanors. supporters of the legislation argue california is one of 12 states with some of the toughest property crime laws in the country. >> in california you have to steal $900 worth of material before it becomes a felony. in texas you have to steal $2500 worth of material. the average for most states in the united states is about 11 to $1400 worth of goods before your crime becomes a felony. it is not a matter of having a weak law. other states have much weaker property crimes in california

and police are able to operate in those states. >> the reality is the department is bracing to lose up to 120 police officers by the end of june due to retirement. last year mcrae said this about crime in san francisco. >> it is going to stay the same. that is giving you the honest answer. >> do you stand by that statement? >> yeah. that has not changed. yes. it will take years to write the ship so to speak. >> how many years? >> at minimum five. minimum five years. maximum, maybe 10. could be tipping without knowing it. 7 on your side is next.
