residents downstream have been warned to evacuate. other videos show communities downstream already flooded. ukrainian officials have said nearly 5 billion gallons of water could be released if the dam failed. russian officials say the dam was damaged by ukrainian military strikes in the contested area. count on us for any new details on the story as we get them. turning now to the investigation into former president trump's handling of classified documents. it appears to be winding down now that his attorneys have met with the special counsel. and trump is still leading the pack on the campaign trail as another republican rival joins the race for the white house. abc's linsey watts has the latest from washington. good morning, linsey. good morning, andrea. the gop primary will continue expanding today. by the end of this week, there will be 12 republicans running for president. but this morning, mike pence is taking on his former boss, filing paperwork to declare his 2024 campaign for president. most people know me as vice president, as a loyal

lieutenant standing beside the president. and i'm proud of the record that we created in the trump-pence administration. but i was also a governor. another former governor will soon join him in the race. new jersey's chris christie, a former abc news contributor, is set to make his own announcement today in new hampshire. both men joining a crowded field that includes florida governor ron desantis, former un ambassador nikki haley, and south carolina senator tim scott. nearly every gop candidate was in iowa this weekend, though notably absent republican frontrunner and former president donald trump. trump making his third run for the white house as the investigation into his handling of classified documents appears to be winding down. trump's attorneys met with officials at the department of justice on monday. sources say special counsel jack smith attended the nearly two hour long meeting as trump's lawyers tried to make the case that he should not be charged for mishandling hundreds of classified documents. get what you wanted. did you get a

meeting with the attorney general? we don't have any comment. federal prosecutors suspect trump illegally retained classified material and may have obstructed justice when the government tried to recover documents from mar a lago. trump responding on social media clearly, he worried he could be indicted, asking how he could possibly be charged when he, quote, did nothing wrong. this morning, some believe the crowded republican field may ultimately help trump win new hampshire governor chris sununu has announced he won't be running and warns that candidates with no path to victory must have the discipline to get out. andrea lindsey, thank you. now to the latest on the sonic boom scare over washington, dc and new questions about the deadly plane crash connected to the incident. now, officials say the pilot of the doomed plane was unresponsive live for more than an hour before fighter jets were sent. this morning, investigators are working deep in the virginia wilderness, a three hour hike from the nearest road where the cessna citation jet crashed on sunday. it's already a challenging process and it makes

it that much more challenging for us. the jet took off from tennessee at around 115 sunday afternoon, headed to new york's long island, less than 15 minutes after takeoff. the veteran pilot was no longer responding to air traffic controllers, but the adviser is an aircraft. nobody talks to. and the plane reaching long island, but then turning around , flying over new york and d.c. airspace. it would take 90 minutes before the military launched f-16s, one of them breaking the sound barrier, causing a sonic boom. why did it take so long to get these other aircraft scrambled in in the air? the f-16s that's going to be one of the key questions here be answered. those fighter jets catching up to the plane, firing flares and issuing warnings by radio. it's a 70 to 75. this is armed air defense fighter onboard, 1 to 1.5. contact us immediately. the fighter pilots say they could see the pilot slumped over. the ntsb is considering whether a sudden loss of cabin pressure could have incapacitated all of those

on board. but with the force of the crash decimating the plane, figuring out exactly what happened may prove difficult. fragmentation of the wreckage is going to prevent the ntsb from getting a definitive answer on what might have gone wrong with the pressurization system. in addition to the pilot and nanny, edina azarian, a new york real estate agent, and her two year old daughter, aria, died in the crash. they were just such a wonderful, close knit little family. i mean, they were really such a bright spot in the neighborhood. and investigators will be at the crash site for a few more days before wreckage is likely airlifted to another location. now, they have not found a black box, but this type of plane was not required to have one. california is pointing the finger at florida governor ron desantis after a second group of migrants picked up on the texas border, were flown to sacramento. governor gavin newsom called desantis, quote, a small, pathetic man after officials said the flights were apparently run by the same company that was paid by florida last year to fly migrants to martha's vineyard, california is considering charges, including kidnaping. yes it's one of the

crimes that we're looking at and, of course, has certain legal elements that need to be present at that we believe we can prove beyond a reasonable doubt to a jury. and so before we charge that, we need to make sure that we are able to meet that standard. meanwhile, a texas sheriff's office announced it has recommended criminal charges in connection with those same flights to massachusetts. officials in both cases say the migrants were deceived into boarding the planes and didn't know where they were headed. joran van der sloot, the prime suspect in the 2005 disappearance of natalee holloway, is now fighting extradition to the us. van der sloot is serving time in peru for the murder of a different woman. he was set to be transferred to the us this week to face trial for allegedly trying to extort holloway's family. his attorney says van der sloot changed his mind after meeting with dutch diplomats at a hearing on his appeal. could take place as early as today. now to the planned execution today for a man convicted of

killing two jail guards. advocates wanted the governor of missouri to pause the execution after it was discovered. a juror at the man's sentencing may have been illiterate. abc's lionel moise has the details. this morning, 42 year old michael theseus is scheduled to die by lethal injection for shooting and killing two randolph county prison guards in 2000. the us supreme court on monday declining a request to stay the execution. tiresias's case garnered national attention, with several groups signing petitions asking the governor to grant him clemency similar to so many people abused and neglected his life led him to be very, very, very vulnerable. theseus was 19 years old at the time of his conviction, and his attorneys have argued he had a troubled childhood and was homeless in his early teen years . his execution was delayed last week after his attorneys claimed a juror in his 2010 recess hearing could not read or write english, which is a requirement for jury duty. and several jurors and alternates from that

trial also signed an affidavit saying they would not object if the state's republican governor commuted the sentence to life in prison instead of death. state lawmakers also weighing in. wish for a state i long for a state where our leaders could have empathy both with the victims and with the people that made the terrible choices who were probably victims leading up to that in their lives as well. but missouri governor mike parson was not swayed, denying clemency for theseus, noting he previously ran a small county jail, saying in a statement it's despicable that two dedicated public servants were murdered in a failed attempt to help another criminal evade the law. theseus will be the third person in missouri to be executed this year. in 2018, the american bar association urged jurisdictions to prohibit the death penalty for anyone who was 21 or younger at the time of the offense. andrew andrea, lionel, thank you

into a plea agreement. deja taylor faces federal felony drug and weapons charges. her son shot abigail zwirner with taylor's gun in january. she survived. the child will not be charged. taylor still faces possible state prosecution. now to the lawyer under arrest in a serial rape investigation in boston, authorities say they found their suspect after more than a decade with the help of dna on a drinking glass. abc's erielle reshef explains. 35 year old manhattan corporate attorney matthew nilo facing a boston judge. how do you plead to those offenses? guilty or not guilty? not guilty. nilo accused of sexually assaulting four women in 2007 and 2008in the charlestown area of boston in a series of incidents that shocked the city. 15 years after the trail ran cold, authorities revisited the investigation using forensic investigative genealogy. they determined nilo, who went to school in boston at the time, was a person of interest. fbi agents in the new

york area placing him under surveillance. fbi agents were able to obtain various utensils and drinking glasses. they watched the defendant use at a corporate event from one of the glasses, the boston police crime lab was able to obtain a male dna profile, which was found to match the suspect profile. he was arrested last week at his home in new jersey. anything you want to say about your fiance, his fiance, who was with him when he was arrested? ignoring questions from the press outside the courtroom, authorities say nilo has lived in several states and the investigation is ongoing. authorities also say if you believe you may be a victim to contact the boston police department or the fbi, nilo was expected back in court next week . erielle reshef, abc news, new york. ariel thank you. hundreds of people were incorrectly told they might have cancer. a biotech company called grail said the notification letters were sent out to about 400 patients who used their gallery test, and it's blaming the error
