news. >> abc news confirmed president donald trump will face multiple charges over the classified documents investigation. the federal indictment happened in florida and trump has been told to appear in federal court in miami on tuesday afternoon. >> trump took to his truth social platform and in a lengthy post that included the words "i have been indicted." the investigation kicked into gear last august. agents found more than hundreds of classified documents, trump had received a subpoena in may t 2022 to return all classifie documents in his possession. dan: we will continue to keep you updated as that story continues to develop but let's start in the bay area. the two men facing murder charges in the deadly shooting of a toddler on an east bay freeway appeared in court today. >> even without the special

circumstances the charges are extremely serious and carry decades of time. ana: the move from the d8 makes the suspects eligible for parole, even though they would face many lifetimes in prison if convicted. dan: abc7 news reporter cornell barnard has reaction from people in the community. >> my heart goes out to the family of that toddler, but they have the wrong guys. cornell: a defense attorney did not explain why she believes her client, a 22-year-old, is not responsible for the shooting death of a toddler in 2021. green 2021. green and another are charged in the killing of wu. police say he was struck by a bullet in a gun battle while in his family's car. the charges include special gang enhancements for murder. >> recent amendments to the gang

statute make it clear that you can't take neighborhood groups of kids from minority neighborhoods and just call them a gang simply because they identify with a particular neighborhood. cornell: the alameda county da dropped the special circumstances filed against the two suspects, meaning they no longer faith the death penalty if california resumes executions. the wu family opposes the decision. >> number one, they want to thank the people that have been supporting them all this time but definitely they want to make sure justice is not only served for the family, justice for all. cornell: the da says both suspects face decades long sentences if convicted. price in a statement said we will continue to hold these men accountable for the charges that will likely land them behind bars for the rest of their lives. last month a judge dismissed murder charges against the third defendant, saying the

28-year-old was the victim of an ambush. jackson pleaded guilty to felony possession of a firearm. >> johnny took responsibility for what he was responsible for. he did nothing to cause the death of the child. cornell: both suspects did not enter a plea in court thursday. they will be back in court july 25. cornell barnard, abc7 news. dan: in his latest attempt to tackle the ongoing issue of gun violence, governor newsom is now proposing a new 28th amendment to the constitution. abc7 news reporter dustin dorsey has details of the proposed landmark change to the u.s. constitution. >> half moon bay, san jose, gilroy. just a few cities impacted by devastating mass shootings in the bay area the past few years. governor newsom says prayers for those affected are not enough. gov. newsom: i am the 28th amendment to the

constitution to do that. dustin: if approved the amendment would require universal background checks, ria the firearm -- raise the firearm purchase raise to 21 and bar the civilian purchase of assault weapons. >> this will guarantee states the ability to enact common sense gun safety laws while leaving the second amendment intact. dustin: this announcement was quickly met with criticism. the california assembly republican leader said "newsom's proposal is a poorly t out attention seeking stunt." "if he truly ownership, he would not push this nonsense." in santa clara county the district attorney says this could be a step in the right direction. >> it is tough to amend the constitution, however i think having a conversation about gun violence in our country will move us in a direction of more commonsense measures to reduce the incredible violence caused by guns. dustin: the county has already

taken steps to do that. today, supervisor chavez shared a report about gun violence prevention programs in the county and the financial cost of gun violence. >> if we can't rely on the federal government to create legislation that will govern the whole country, we don't have a choice but to make sure we are doing all we can to protect the people in california. dustin: governor newsom says california is aiming to become the first state to call for a constitutional convention and approve the 28th amendment. dustin dorsey, abc7 news. ana: there is an effort to get more guns off the streets with the gun buyback event this saturday. it runs from 10:00 to 2:00 p.m. in east oakland on international boulevard. people who turn in guns will be given a's tickets and up to $300 gift cards. the guns will be melted into gardening tools. last year 131 guns were surrendered at a similar event. dan: the two men who spent a decade locked up for a wrongful

murder conviction are suing the oakland police department. their attorneys filed the lawsuit today. they accuse an oakland police detective of paying a woman to lie about witnessing a murder in 2011. that woman implicated douglas and hunter in the fatal shooting. both had their convictions overturned by the alameda county district attorney's office last year. >> two men who were robbed of close to a decade of their life, in the prime of their life. due to the unlawful despicable, and criminal conduct of an oakland police officer. dan: tran was charged in april with multiple felony charges including perjury and bribery. the lawsuit accuses oakland police of failing to turn over key details about the murder. ana: the city of oakland is making budget adjustments to keep fire services as they are.

it is thanks to a federal grant of $27 million which enabled the mayor to keep a promise she made. >> she said, chief, you don't want to hear this but we have to cut $20 million from the fire department and do a brownout. but if you find the money elsewhere, chief, you have my word we will not do the brownout. i just want to thank you, madam mayor, for keeping your word and taking care of not only the oakland residents of the oakland fire department. -- but the oakland fired apartment. ana: the chief's last day leading the department is tomorrow. the interim chief has been with the department for more than 20 years. dan: a specialized team from the sheriff's office is joining an effort to tackle the open air drug use epidemic. the announced his department will start sending deputies into areas where open-air drug dealing is rampant. more than 130 deputies will take

part in this effort. the san francisco police chief was also on hand for today's announcement, saying he welcomes this added support. the influx of deputies is expected to last for six months. officials will decide then whether or not to continue it. ana: the fallout from the racist texting scandal at a police department continues. now for the first time serious felony charges are being dismissed because the district attorney's office says the investigating officers are linked to that texting scandal. an abc7 news reporter spoke to the victim's family. reporter: last october police found a body burned and mutilated along the trail in antioch. two men were arrested in connection to the case. but the charges they face are now being dropped. >> what justice looks like to me is a fair trial. now the case is dismissed and they walk free, with no

rehabilitation, no punishment. >> nicole says she is frustrated that the evidence alone was not enough to move the case forward. >> there was some concrete evidence that should have landed a conviction. so we are very heartbroken at the judicial system. reporter: these are the first serious felony charges being dismissed because these officers are linked to the antioch police texting scandal. >> it was a difficult decision to make. >> depending on how the officers are involved, it's incidental or are they material witnesses? if they are material witnesses and are not available, how are we supposed to proceed to prove the case? reporter: that suggest it is not that the officers are no local critical -- no longer credible but they may not want to testify since they are under investigation.

>> their availability, i'm not sure because of the reasons. >> for some people it is disappointing to see this but i think in light of all that has happened right now the question about this organization is, are we credible? do we have any legitimacy? reporter: the antioch police chief says there will likely be more felony dismissals with potentially thousands of cases under review, but he insists his department can still do its job. >> what is happening now is not abnormal. it is not earthshaking to me. your appointments to have officers coming to this organization every day doing the right thing. i want to emphasize that. reporter: meanwhile mayor says this is more reason that the officers and the texting scandal need to be fired. >> the racist text victims and their families will potentially no longer have justice as a result of all this. so these officers need to be

the a's proposed to put up a new baseball stadium on the las vegas strip where the tropicana hotel stands. the 30,000 steet stadium -- stadium would require hundreds of millions of dollars of public funding. lawmakers did not take up a funding bill in the regular session so the nevada governor called a special session to discuss and possibly vote on a $380 million public financing package. lawmakers met late into the night without voting. they are scheduled for thursday with further discussion, but there is talk lawmakers are considering possible an immense. a's representatives say a new stadium would add to a growing sports scene in las vegas, but critics worry about the project's cost, and some say there would be minimal public benefit. one major opponent of the bill said "if this team wants to build a stadium, their billionaire owner can build it with his own money."

the failure to vote on funding has given oakland officials and a's fans new hope for keeping the a's in the bay area. the mayor said the city of oakland and the a's were close to reaching a deal in april and that she's willing to restart negotiations with the team. >> mlb has this great concept of wanting to diversify its families. we need a baseball team. we deserve a baseball team. we want the oakland a's to be here, whether it's with this current or new ownership. suzanne: the mayor told abc7's sports anchor that if the a's come back to the negotiating table, construction on a new ballpark at howard terminal could begin in two years. nevada lawmakers were supposed to meet today. many expected a vote. that did not happen. now they are in recess until monday. oakland's hope for keeping the team is still alive. suzanne phan, abc7 news. dan: in her sports news don't

dan: federal investigators are headed to the scene of a plane crash in rio vista that killed two people. video from sky7 shows the plane covered from a tent. investigators say the aircraft was a single engine experimental plane. it went down just before noon today. the victims have not been identified. ana: experts determined the release of toxic dust at a refinery did not contaminate the soil in the area. that incident happened in november and led to soil sampling in martinez and other surrounding amenities. the martinez -- today a toxicology report

revealed the incident did not increase the risk of exposure to hazardous metals. abc7 news i team reporter dan noyes will have more of today's findings at 6:00. dan: tonight that smoky haze from the canadian wildfires continues to causes threat -- to cause a threat to millions of americans. the winds have pushed the smoke south into virginia, maryland and d.c. seeing the worst of it. >> i can feel it in my lungs. when i'm walking around, it's pretty intense. >> the nation's capital now in the thick of the hazardous haze. >> i felt like i couldn't really breathe. >> the canadian wildfires smoke that has been choking new york this week is slowly pushing across the northeast. places like d.c., baltimore, suffering air quality ranging from unhealthy to very unhealthy. >> the fine particles can penetrate deeply into fragile lung tissue, causing symptoms including cough, shortness of

breath and wheezing. >> new york slightly improving thursday, downgraded to unhealthy from hazardous on wednesday. various airports in the region are experiencing delays due to low visibility. the faa listing the changing conditions for passengers at fly.faa.gov. the south not immune. cities like raleigh, north carolina experiencing alerts such as moderate or unhealthy for sensitive groups. >> chill out, sit on the couch, listen to music, write a book. >> forecasters expect the smoke to rule over the northeast admitting -- the northeast and midwest over the weekend. president biden hosted the british prime minister at the white house this afternoon. before they gave their press conference president biden urged americans in these affected areas to stay safe and keep tabs on air quality. the white house canceled a pride celebration scheduled for outdoors this evening, moving it

to the weekend. one of many events in the d.c. area canceled because of the conditions. ana: fortunately air quality around the bay area isn't nearly that bad. dan: for more on our local conditions let's go to abc7 meteorologist drew tuma who was on loan from the morning crew. drew: lovely in the evenings. great air quality here, but quite a different story across the mid-atlantic. we will take you to washington dc, that haze is still in the atmosphere. looking at those pm 2.5 levels, a huge swath of the mid-atlantic and northeast under that unhealthy air quality. but this is a vast improvement compared to yesterday. new york yesterday peaked with pm 2.5 levels in excess of 450, which is very hazardous. the smoke forecast tomorrow morning, new york city will get a break. saturday a lot of this smoke will thin out. yes, ti will -- it will still be

hazy in the atmosphere but not nearly as unhealthy as now. we can breathe easy at home. a live look from central tower. good air quality for the foreseeable future. sky will turn mostly cloudy overnight asa marine layer -- as a marine layer comes back. tomorrow it is a breezy day and a bit cooler to finish out the week. in the extended pattern we keep temperatures below average over the next seven days. it is pleasant right now. mid 70's inland. mid 60's to low 70's around the bay shoreline. here is live doppler 7 along with satellite. our marine layer will push inland tonight. around tahoe we have numerous thunderstorms. we expect fewer thunderstorms tomorrow. across the sierras, low pressure pushes to the east. overnight, a marine layer will thicken and expand. overnight lows dropping to the 50's. take that light layer with you out the door. the winds pickup as the
