to board the bus? that is what you're supposed to do but you will be stunned by what we saw on muni. >> building a better bay area, moving forward, finding solutions. this is abc7news. >> good evening. >> thanks for joining public transit across the bay area is still struggling to recover from the pandemic and struggle is the word. bart ridership is barely t 40% during the week. the san francisco bay ferry recently had 85% of pre-pandemic passenger levels. muni is in the middle with two thirds the number of usual writers -- riders. >> the state has made it clear it wants to see an effort by muni to prove it is on the path to being financially healthy. leeann melendez spent a morning writing muni. >> it was fun. our people really not paying?

we wanted to find out firsthand. we spent a few hours on buses to get a snapshot of the problem. if passengers are not paying, muni is losing money. how about those citations? that is supposed to bring in revenue. late this afternoon the sfmta released data confirming in the past 11 months $2.2 million in citations have been handed out but they have managed to collect only half of that. in their budget they allowed for 45 citation officers yet as of today only 23 are actively working. on this clear san francisco morning we decided to ride on the oldest publicly operated transit schist him -- transit system in america. paying using my clipper it is reassuring to see most lines are back to near pre-pandemic levels.

also encouraging is the recent statement by the executive director of the san francisco municipal transportation agency who oversees muni. >> most people are still paying just as they did pre-covid. >> because we had our doubts who decided to record who paid and who did not. here we go. these two women did not pay. neither did he. no. this couple walked right on without paying. th for some reason his clipper card never worked. too busy talking on the phone. no. no. this passenger paid with her clipper card but the person behind her did not. no. no. no. and no. one more no.

that is $12.15 muni did not collect from those five people. we estimated about three quarters of the people who got on the bus never paid. a muni driver told us a good day for her is when 40% of passengers pay. >> i am honest but if i were really pressed and did not have anything to pay with i would do the same thing. >> some are candid about the reason for not paying. > i think post-pandemic it is kind of like the norm as far as i have seen. especially when it goes up and down market. i don't know. people don't pay so i do not know. >> jef there other ways to pay then perhaps we did not capture on camera. >> we have invented new fair instruments. you can download muni mobile and pay with your phone rather than paying with your clipper card. >> have you heard of the muni mobile app? >> yeah. >> do you use it?

>> no. >> we finally found a passenger using muni mobile. an honest law-abiding taurus too had a one-day pass on his phone. so you paid using the app. >> yes. >> there are people who feel that because others are not paying, why should i? >> absolutely. >that is the reason. >> that attitude shift is what in psychology is referred to as crowd behavior. >> we still try to pay our f as much as we can but he gets to a point where it is like, what is the point? >> because bus drivers have been assaulted in the past for trying to collect a fair it is understandable they don't engage with anyone who refuses to pay. that is the responsibility of the fair inspectors who are supposed to ask passengers to show proof of payment. >> we have inspectors out every day collecting good data about who is paying and who is not

paying. >> limits the last time you saw an enforcement officer on muni? >> i would say probably a year ago on a muni train. now in bus. >> here is a problem with not paying. transit fares represent 18% of sfmta's revenue or $219 million. that is part of the reason why muni had a $134 million deficit in 2022. two many numbers for you you say? perhaps you will be interested in knowing how muni is seriously c thinki listen up because this will likely affect you. extend the hours of parking meters on weekdays to include nights. on sundays. that is 28,000 parking meters that could potentially be active on sundays. >> that would bring in an extra

$80 million a deal paired that is enough to save three muni lines. expanding neighborhood parking permits, increased taxes on offstreet parking in downtown garages. another idea that circulated in the past is downtown congestion pricing. except after the pandemic downtown has been slow to recover. so many proposals out of their. why not do something simple like enforce fares? >> we should enforce fares but fair evasion is a small piece of the problem. even if we had 100% compliance, that would not solve this problem so we need the state to help out. >> the federal stimulus money's that have kept muni afloat are expected to run out. sfmta is hoping the state will provide some short-term relief funds. if not the transit agency may have to scale back muni to pandemic levels of service when only 40% of routes were up and running. >> 70 people are riding on muni

and bart right now and we cannot have them fall apart. >> muni says 70% of its passengers make less than $50,000 a year so we can only assume because many are not able to afford a car muni is their only option and you know who is going to be affected by students, seniors, people with disabilities, people of color who rely on muni and the solution senator is ridership has to go up both on muni and bart by a lot. >> the system has to be reliable, safe and paid for which means people have to pay to ride. >> we have assumed this attitude. >> it is unbelievable. >> less than an hour ago we got word bart's board of directors has approved a budget for the next two years. it includes two 5.5% fare hikes beginning in january. an increase of about $.25 on an average fair. the discount for clipper start

designed for low income riders will rise from 20% to 50%. overall bart says it has a balanced budget for the next fiscal year but it forecasts a deficit for the year after that. bart like muni is asking for state funding. we have raking news right now. there is a pro chance it protest locking -- pro ten protest. deliberately blocking traffic off act avs tree in san francisco. when the light changes they are going out when people would normally across the street and holding the sign. a few minutes ago they had this model caltrain and they were in the intersection smashing it with the baseball bat that person is holding their. their goal is to draw attention to the need to fund a public transit. they have the banner saying we need trains not traffic. you can see some of the protesters.

when the light changes and it is time for people to cross they go across. bike riders with their yellow vests and they hold their sign. and then they let cars go when the traffic does change. we are keeping an eye on this. we will let you know if anything changes. >> let's move on. the man accused of killing three people in a random southbay crime spree was a no-show in court today. the attorney says she is working on getting him to leave his jail cell for his arraignment which is now scheduled for next tuesday. >> his refusal to come to court today, next week or next month is not going to delay seeking justice for these victims. >> he was initially supposed to be arraigned tuesday. he did not shock them either -- show up then either. he faces multiple murder and attempted murder charges. two charges for carjacking and one assault with a deadly weapon.

>> the fallout from the racist texting scandal at the antioch police department has resulted in serious felony charges in one case being dismissed. anser hassan spoke to the victim's family to get their reaction. >> last october police found michaela's body burned and mutilated along the trail and antioch. two men were arrested in connection to the case but the charges they face are now being dropped. >> what justice looks like to me is a fair trial. now the case is dismissed and they walk free with no rehabilitation, with no punishment. >> nicole eason is michaela's older sister. she says she is frustrated the evidence was not enough to move the case forward. >> there was concrete evidence that should have landed a conviction. we are very heartbroken at the judicial system. >> these are the first ser felony charges being dismissed because the officers are linked to the antioch police texting

scandal. >> it was a difficult decision to make. >> the assistant da made the decision to dismiss the charges. >> depending on how the officers are involved, is it incidental or they material witnesses? if they are material witnesses, and they are not available, how are we supposed to proceed to prove the case? >> that suggest it is not necessarily the officers are no longer credible but they may not want to testify since they are under investigation. >> they are not available right now. they are on paid leave. their availability -- i'm not sure. could it be compromised in other reasons? >> in some peoples eyes it is very disappointing but in light of all that has happened i think the question about this organization is are we credible? do we have any legitimacy as an organization? >> the antioch police chief says they will likely be more felony dismissals with potentially thousands of cases under review.

he insists his department can still do its job. >> what is happening is not abnormal. it is not earthshaking to me. we still have officers coming to this organization every single day doing the right thing. i want to emphasize that. >> antioch mayor lamar thorpe says this is more reason the officers involved in the texting scandal need to be fired. >> there are actual consequences as a result of the racist text messages were now victims and the families will potentially no longer have justice as a result of this. these officers need to be fired immediately. >> two men who spent nearly a decade locked up for a wrongful murder conviction are now suing the oakland police department. >> this is the proof. the evidence. the carnage. that officer tran young men. >> attorneys for the two men

filed the lawsuit today. the accused oakland police detective fung tran of paying a woman to lie about witnessing a murder in 2011. . that woman implicated douglas and hunter in the fatal shooting. they both had their convictions overturned last year. tran was charged in april with multiple felony charges including perjury and bribery. when we asked the oakland city attorney declined to comment on the case. >> coming up next from the eye team, results are in from test surrounding the martinez refinery. did gardeners throw away their produce for nothing? >> michael finney with a checkup of san francisco's recycling program. it is either a grand success or a dismal failure depending on who you ask. >> we are wrapping up a pleasant day today but tomorrow cooler weather moves in. the d

county department put an advisory against eating produce from backyard gardens. >> sunflowers are known to be able to pull some toxins out of the soil and some heavy metals out of the soil. we are planning on having kids soon. you worry about all of the potential health risks that could be involved. >> she also helped start a watchdog group for the refinery, healthy martinez. >> we are really just trying to make sure there is a community response every time to what are your health and safety standards? what are you doing to ensure the community is safe? >> after the chemical release the county hired an outside company to take soil samples and study them. the results announced today. >> we are concluding the soil within this area is safe. backyard gardens. the 24 tons of catalyst dust contained mostly sloth and

aluminum but also some battles with the potential to cause cancer. none of the chemicals were found in amounts high enough to cause concern. >> it was spread over a large area and that is one of the reasons we are not seeing a big impact on the soil content in the data we just took. >> the refinery is not off the hook. >> i just want to be crystal clear with our community. these results do not excuse the martinez refining company from the lack of notification at the onset of this incident. >> m faces several investigations over the release of those chemicals both civil and criminal. the contra costa county gays office is investigating the failure to report a release of a hazardous material and discharges to the storm water system. the bay area air management district issued 21 this is a violation. officials tell me their investigation is still ongoing. i was there two weeks ago when a

>> abc news has confirmed the federal grand jury invited former president trump on multiple charges under the classified documents investigation. on his platform the former president confirmed the indictment and said he has been over to appear any federal court in miami on tuesday afternoon. this is how the case could affect his run for president. >> be indicted. be convicted. you can still serve you can be serving your presidential term while also serving time which i know sounds preposterous but it is true. there is only one charge that potentially implicates your ability to serve in higher office and that is when related to an insurrection or giving aid to those in citing an insurrection. >> the investigation ramped up last august when the fbi searched his mar-a-lago home and found more than 100 classified documents. >> governor newsom is proposing a linen change to the u.s. constitution. a 20th amendment.

company headquarters. they paid the city around $20,000 in back property taxes to access parcel 36 a that makes up no man's land. according to the city of property taxes on a parcel of land remained unpaid for anywhere between five to seven years the city has the right to auction off the land. just paying the taxes does not give them the rights to the property. >> it does not. paying the taxes merel the city being able to take control of the lentil auction. >> rudy and alex avoided the auction by paying the taxes. lerma says it appears they read the legal standard for what is called a prescriptive easement. >> by necessity and former somebody can be on the land and use it to reach the road. >> a judge will ultimately decide if the easement will be granted to rudy and alex. as for the rogue mission greenway gardeners dashed of

the emergency services unit to help combat the city's drug epidemic. >> their objectives are very simple. to eradicate your -- to eradicate open air drug use and assist those suffering from harmful behavior. support current efforts to disrupt drug sales, increase public safety with a greater visible law enforcement presence. >> deputies from the emergency services unit go through specialized training for handling situations that require intervention and higher levels of awareness. these deputies join in effort that has already been going on for more than a month involving police, the chp and the national guard to try to tackle the drug right -- the drug app a demo. -- the drug epidemic. >> we need help from the federal government, state government, county and counties across the state. we need more inpatient treatment options and we need more tools legally to compel people to get the care they need when they are

suffering from severe behavioral health issues. that is true for what we traditionally called mental health issues but it is true for addiction which is a midsouth issue. i agree with the direction we have gone in as a state that has moved away from mass incarceration for issues that are fundamentally driven by addiction and behavioral health disorders. there has to be an alternative that protects the rest of the community and gets people to the care they need. >> the city of oakland is making budget adjustments to keep fire department services as they are without a reduction. it is next to a grant that enabled mayor sheng thao to keep a promise she made fire chief. >> she said that i don't want to hear this but we have to cut 20 million from the fire department. we have to do a brownout. if you find the money elsewhere, chief have my word we will not do the brownout. i just want to thank you madame mayor for keeping your word and taking care not only the oakland

>> remember a few years back where most of california's recycling centers closed? looking for solution the state funded pilot projects. >> san francisco's project has been up for more than a year and michael finney has checked in to see how it is doing. >> last time i checked these guys out san francisco had three recycling locations and not very many visitors. now there are 20 and people are showing up. san francisco's mobile recycling pilot project is now attracting actual recyclers and happy once. you like the program? >> i love it because we used to just drop it off in recycling bins. people would steal them from our house.

it is great to put it in the bag and drop it off while you're doing your shopping. >> the spokesperson for the san francisco environment department. >> we processed 50,000 bags could we recycle about 3.4 million bottles and cans since we start the program. we returned 180,000 dollars back to consumers that otherwise would be stuck in sacramento. five cents and 10 since they put down but in san francisco we are putting it back into people's pockets. >> sees a successful ramp-up of the program. . consumer watchdog sees nothing but failure. >> it is a complete bust. after 15 months we know the numbers. it may sound great. this cycle through lean containers until you find out they spent $4 million to do it. they are spending $.79 to return a nickel to consumers. the program does not work. >> he says costs for container is not an accurate representation of the program
