he appointed in a court known for moving quickly but a hallmark of trump's legal strategy has been delay. this morning trump is working to secure legal reputation after two attorneys that were handling this case resigned. the charges that the former president faces are punishable in theory by decades in prison. but even if he's convicted with the former president said he will not withdraw from the race for the white house telling reporters, i'll never leave. whit. >> that's what he's saying, the former president, aaron, thank you so much. let's break all this down now with abc deputy political director avery and legal contributor kate shaw. good morning to you both this morning. avery, i want to start with you because there's no polling out this morning on former president trump's favorability with voters and the poll was conducted after the indictment was announced and appears to show good news for trump. >> when you look at latest abc news ipso poll, we find the

number of americans that view trump favorably has gone up and the number of americans viewing him unfavorably has gone down and before the first indictment, trumped arminged that criminal charged could boost the popularity and very well be part of what we're seeing here and the rhetoric of the campaign is one of retribution, revenge, framing himself as a victim and the segment of the base that sticks by him no matter what and that's part of hearing elizabeth speak to that and his campaign is undoubt lily going to take advantage -- undoubtedly going to take advantage of that. >> respond together indictment trying not to alienate trump's base. how are they responding to all this? >> looking at recent polling across the board, president trump outperformed each and every one of the gop competitors and, yes, this forces them to address president trump. so far we've seen more

candidates speak out and point fingers of blame at the justice system rather than at trump himself for these alleged actions and we've seen one candidate pledge to pardon trump if he's elected and really reflective of the state's race and these candidate cans not afford to alienate the trump supporters and trying to win them over later on and try to chart a path to the nomination. >> kate shaw, the former president is out there speaking frequently about the indictment and making accusations and could prosecutors continue to use his own words against him in the case? >> jack smith is the special council and team of prosecutors watching for president trump and candidate trump on the campaign trail very, very closely and one of the thins most striking in the very striking document is the indictment was how central the former president's own words were in the charging document. you have some of former

president trump's conversations with aids in -- as recorded in text messages and actual recordings, but you had public statements including back in 2016 on the campaign trail and from the white house essentially trump acknowledging the importance of safeguarding information and talking about presidential can dates and that's -- candidates and that's central to the document and the extent that former president trump talks on the trail about these charges and talking about that and they will and saying that in a political register, could be problematic in court if he take as position that i did this and had these documents but u had the right as former president to do that. that could resinate with voters and could be problematic with the court of law. >> timing is critical ahead of the 2024 election and how quickly can the doj and court move in this case? >> typically a case like this would take probably a couple of

years between the original indictment and trial and resolution. of course that would mean no final resolution till after 2024 presidential election. so i imagine the special council and his team will be trying, you know, to the extent possible to move things along expeditiously and this is a court that this florida trial court with a reputation as a so called rocket docket court to move things along quickly and if the judge is willing to accelerate proceedings, that could mean we could see things happen on faster than ordinary track. of course the defendant, former president trump is going to do everything possible to delay the final resolution i imagine. a lot will be on how interested the judge is in moving things along swiftly and in a related case involving the documents was sympathetic to trump's argument against the fbi search in the first place. there was reason for the justice department to be concerned and they're going to try and move things quickly.

up 120 years in prison. we've spoken to his mother in california and said her son first moved to moscow in 2010 and spent most of the past decade working as a musician and producer including with relatively well known rock bands and one of the bands publicly criticized the war in ukraine and comes amid a series of de-tenses in russia that the charges stay and wall street journal and former marine paul whelan and brittney griner was held on drug charges. the american detained in moscow and declined to comment further. gio. >> many questions there, thank you, patrick. now to the war in ukraine, kyiv's long awaited counter offensive underway and acknowledged by ukraine's president. abc tom berge in ukraine. >> good morning. we're getting reports from the ukrainian military claiming they've recaptured in the

southeast of the country and a small territorial gain and one of the most significant advantages since the counter offensive began and president zelensky urging ukrainians to trust the military saying in his view russia doesn't have long left and that's on multiple fronts in the south and east and releasing video showing lethal attack drones frying with ukrainian -- new yorking ukraine indian attack missiles and they've appeared to penetrate russian defenses and the ukrainian advances are slower and a stark warning from the un after explosions breached a major dam in southern ukraine and the reservoir behind the dam draining saying 700,000 people in ukraine face a dire shortage of drinking water adding global food prices will rise because the farmland here will run dry. one tiny note of good news is

the flood water is down river from the dam receded by around 50%. guys. >> silver lining there, tom, thank you. remarkable story of survival. four young children found alive in a columbian jungle 40 days after a small plane crash. abcrena roy has more. >> in morning new video from a story that's almost hard to believe. four young children in a columbian hospital after somehow surviving on their own in the amazon jungle for a staggering 40 days. the siblings ranging in age from 1-13 que13 years old recover, wk in good condition. the columbian president and others visiting the survivors at the hospital. rescue teams finding them deep in the rain forest, air lifting them onto a helicopter weeks after a plane crash following a trail of footprints and half

eaten fruit. crews also dropping packages of food near the downed plane during the frantic search. the three adults on board were found dead including their mother and the pilot after the engine failed. but no sign of the children. luckily officials say they're from the amazon and the 13-year-old had at least some knowledge of how to survive in the difficult terrain. >> i imagine in that rain forest, they would have had torrential downpours and then issue withs getting food with clean water. there was someone in their family that gave them some traditional knowledge. that's what saved them for the most part. >> an emotional moment friday when family members got word they were still alive, the children spotted less than two miles from the crash site. now something that's even stumped experts is how the 1-year-old survived because babies that young require specific foods and have a harder time regulating body temperature and there's a lot of questions, janae. >> a lot of questions but so much amazement, thank you.

convenience store moments before the pursuit. he pulls up his shirt showing a pallet gun before they make off with vape ca card they originally said it was a semiautomatic handgun and then clarified it was a pellet gun. >> pellet guns can cause serious injury, bodily injury or death. it is a tragedy. >> now protests erupting in awe roar ragaini with the richardson family at the forefront calling on acevado's resignation. >> the aurora police department says the officer involved in the shooting was placed on paid administrative leave. a criminal investigation is now underway running in concert with an internal affairs bureau investigation. gio. >> elmore, thank you for that.

the 33-year-old poisoned her husband eric last year by sneaking fentanyl inside a moscow mule. cory bought it from a drug dealer but according to court documents filed on friday, they argue the key witness to the alleged drug deal gave conflicting information about the fentanyl purchase. they also argue that friends said weeks before passing they'd never seen cory happier and her attorney said not a single text message or other document was turned over to support the allegation that eric ever believed cory attempted to poison him. >> this motion allows the public and the media to read an alternative version of what took place. they dispute a lot of allegations that the prosecutors put forth thus far. >> the utah mom of three wrote a children's book about grief after her husband died. >> i wrote this book on the different emotions and grieving processes that we've experienced

abc's morgan norwood is at a beach on long island here in new york. good morning, morgan. >> reporter: good morning, gio. rip currents trigger more water rescues than any other type of water emergencies. it's something we have seen on long beach. last week five teens were rescued by life guards. one thing i want you to keep in mind. life guards may not always be available to you. in fact, nationwide there is a national life guard shortage which is why experts want you to know the keys to survival. this morning, warnings on rip currents, coming after a deadly start to the summer beach season. a father drowning as he desperately saves his daughter after she was pulled away by a rip current along the jersey shore. as the weather warms up and millions from coast to coast flocking to beaches to beat the summer heat, warnings on the dangers of rip currents. >> the intensity of rip currents varies with whatever the surf is at a given time of year. what happens in the summertime,

you just have more people exposed to the hazard. >> reporter: the u.s. life saving association say rip currents are the number one beach hazard. with more than 100 drowning fatalities each year here in the u.s. the smith family with a harrowing story of survival. brandon smith, an avid surfer, said he rushed in to save their three children and other family members when a rip current carried them from the shore. >> everybody was in over their head. the waves were deaf separately six foot plus waves. they were beating down. >> reporter: what should you do if you find yourself stuck in a rip current? abc's matt gutman shows us. experts say one of the most common mistakes is trying to swim back to shore against the current. >> the thing with the rip current. it's moving not as fast as an olympic swimmer. so unless you're michael phelps, you probably aren't going to beat it. you start to exhaust yourself. that's when it's harder to stay above water. >> reporter: the next move, swim

parallel to the shore. if you happen to see someone in distress, call 911 or alert a life guard. thankfully these five teens in long beach new york caught the eye of a group of life guards who rescued them from a rip tide. before you go into the water, you should check out the water conditions. lot of times there are signs posted on the beach. as for choosing a beach, you should also choose a beach where there are life guards on duty and be sure to swim near them. >> that's right, morgan. thank you. it is an important story. we saw matt doing it. a few years ago i went against the rip current to see if i could do it. i like to think i'm a pretty strong guy. it was impossible to get out of it. it's the exhaustion that gets you. it's so important that you swim parallel to shore so you can get out of the rip current. then you can swim to shore. >> out of the rip current then parallel. the good news is we got to see you in that wet suit. building a better bay area. moving forward, finding solutions. this is abc7 news. good morning. i'm liz creutz. >> former president donald trump made his first public appearance yesterday since a 37 count federal indictment against him was unsealed. the indictment accuses him of putting the nation's security at risk by leaving highly classified documents at mar a lago. despite the legal battle ahead, trump is continuing his campaign, telling reporters he will excuse me, continue to run for president, even if he is convicted. the california horse racing board is investigating the death of a horse. the four year old thoroughbred named rio king died friday at the alameda county fairgrounds. he was the first horse death reported this year at the racetrack in pleasanton, but it marks the state's 31st racehorse fatality of the season. eight horses have died at golden gate fields in berkeley. santa anita park in arcadia has recorded the most

deaths this season, with 13 rio kings. last race was at golden gate fields on may 29th. the annual escape from alcatraz triathlon is underway this morning. athletes kicked off the grueling race at 715 with a one and a half mile swim from alcatraz island to the shores of san francisco. then an 18 mile ride eventually they'll finish with an eight mile run through the city's hills. the race attracts world champions olympic medalists and amateur athletes from the us and around the world. today, people in the south bay are getting encouraged to get out and get active. the city of san francisco, san jose parks, recreation and neighborhood services department will host its second viva cal 2023. three hubs will shut down to all cars and motorized vehicles for people to walk, bike, skate and explore local businesses and activities. that starts at ten this morning. all right. thanks, everyone. thanks for joining us. we'll see you at
