time a us president has been arrested for federal felony charges. over three dozen counts . supporters and protesters descending around the miami federal courthouse as donald trump, once the most powerful man in the world, arrived under ground 45, where he was taken into fbi custody, thrown all just one day before his 77th birthday. these are serious charges. if he is convicted on all of them, he faces nearly 30 years in prison as a maximum sentence. so this is a far more significant case than the first trump indictment by the manhattan da. trump, accompanied by an ever evolving legal team after two of his attorneys resigned just hours before the indictment was unsealed last week, special counsel jack smith, who's leading the prosecution, was seated. one row behind trump. former president donald trump was stoic, stern at times. he was restless. he had to wait about 15 minutes for the

judge to begin on the arraignment. and he was fidgeting with his thumb at times for most of the hearing. he sat with his arms crossed, folded at times, one thing was clear. trump did not utter a single word, but he didn't have to. his body language really said everything, and he was ready to move on and get back to his 2024 campaign. trump's lawyers entered a plea of not guilty on his behalf to all 37 charges related to the alleged mishandling of classified documents. the former president accused of keeping hundreds of pages containing some of the world's most sensitive secrets, including military activities and nuclear capabilities of foreign countries. plans for possible retaliation in response to a foreign attack, military operations against us forces and us military planning and nuclear weaponry. and details of an attack in a foreign country. prosecutors also accused the former president of obstruction by suggesting that his attorney, his aide or destroy documents and saying trump told his attorney, quote, i don't want anybody looking through my boxes

and wouldn't it be better if we just told them we don't have anything here, even after he took these sensitive secrets to mar a lago, even after he failed to turn them over to the national archives, he could have avoided all of this if when he was subpoenaed. the first time. he had simply turned it all over and instead he did. he acted in a way, allegedly to obstruct justice. the 49 page indictment included photos showing numerous locations throughout mar a lago, where the boxes were allegedly stored, a ballroom stage in storage next to a toilet and behind a shower curtain. the private social club hosts tens of thousands of visitors every year, and trump hosts his biggest events from fundraisers to christmas parties there. this map shows the various places the documents were held around the site, allegedly unsecure, aired this behavior directly contradicting trump's own past comments about classified documents during the 2016 campaign, something the special counsel included in the

indictment in my administra tation, i'm going to enforce all laws concerning the protection of classified side information. no one will be above the law. trump joined today in court by his alleged coconspirator, walt nauta, a former naval valet to the president who's continuing to serve as trump's personal aide even after they were warned by the judge not to discuss the case. nada has yet to secure local counsel and did not enter a plea. he's scheduled to appear in two weeks. the veteran has been accused of making false or misleading statements to investigators about the documents found at mar a lago. trump's popularity has only grown. the latest abc news ipsos poll shows his favorability has increased from 25 to 31% since his first indictment in new york two months ago. donald trump has been helped by things that would

kill off almost any other politician in terms of their career, almost in the history of the world. and some top republicans continuing to defend him. i think donald trump is stronger today politically than he was before. i think the espionage charges are ridiculous . and there's a real feeling right or wrong inside the republican party that that there's two tiers of justice. so that's why you're seeing some voices in the party say let's let's stand behind trump. let's call this for what we believe it to be. but other notable gop names are publicly condemning him on cable tv, including former allies like his own attorney general, bill barr. if even half of it is true, then he's toast. i mean, it's a it's a pretty it's a very detailed indictment and it's very, very. and chris christie now one of trump's 2024 opponents, this is vanity run amuck. everyone's blaming the prosecutors. he did it. it's his conduct. but trump's legal woes have grown immensely since he left the white house in 2021. last month,

a jury ordered that he pay $5 million in damages for battery and defamation to e! jean carroll, who says he raped her in the 90s. today, a judge ruling carroll can amend her lawsuit to include allegedly disparaging comments trump made after he was found guilty. he's also set to go on trial next march from his first indictment by the manhattan da relating to hush money payments to adult film star stormy daniels and georgia investigators are still looking into whether he acted illegally in the frantic days after the 2020 election. meanwhile special counsel jack smith continues to probe whether trump broke any laws before or during the january 6th attack on the us capitol. and jack smith's not done yet. think about the people he has subpoenaed and he has had to testify before the grand jury. some of trump's top aides in the white house, even the vice president of the united states, mike pence, subpoenaed and lost a court battle and is forced to testify before that grand jury. regardless of the

outcome of these legal cases, trump seems determined to stay in the 2024 race. there is nothing in federal law or the constitution that prevents someone who is indicted or even convicted of a federal crime from becoming president. he could even hypothetically serve from behind bars. so far as the constitution is concerned, i truly. trump appeared unfazed, hosting a fundraiser tonight at his bedminster, new jersey, golf club, maintaining his innocence once again. they will fail and we will win bigger and better than ever before. and we're joined now by abc's executive editorial producer john santucci . you have covered this former president extensively. we saw that rousing speech in bedminster, a lot of bravado, but we know you've been tracking his mood throughout the day and it has changed, evolved. what we ended the night at bravado there with his supporters who were there to greet him as he gave that speech, firing back at special counsel jack smith. but that is not where we began on

our journey. so of course we left bedminster. if we're going in reverse here, juju, we have to head back down to miami, florida. and when he exited that courtroom, he was a little calm, quiet. he made a stop in little havana. as we know from our reporting. and i'm told that bolstered his mood. it bolstered his spirits. it got him back in the campaign mode, as somebody described it to me. but if we fast forward the tape backwards a little more, you end in that courtroom defiant and angry, reserved. and who ever thought you'd use the word quiet when talking about donald trump? very different person in than how we've seen later in the day at bedminster with his supporters. and i think that talks about donald trump. donald trump is a human. the range of emotions that people go through. and i think for donald trump being in that courtroom today, it brought donald trump down a peg. and yet, you know that he has seems determined based on today, to play this out in the court of public opinion and at every campaign stop along the way. is that a good strategy? well, it's

the only strategy they have right now. and i think the problem with that is we are in june of 2023. we have 18 months of this to go. so think about it. if you're driving in a car, right, if you have the same song on repeat, you're eventually going to say who did this? who broke the cd player? if you still have one of those? but that's the problem they have right now. there are many people telling donald trump, you've got to add a few more songs to the playlist. and will this message play out? you know, that donald trump is famously known for wanting loyalty in his team. this indictment for some red light disloyalty. oh donald trump's favorite phrase is witch hunt. it was a hunt by donald trump to figure out who gave the information a special counsel, jack smith, because some of it is obvious, his attorneys are quoted in there. the photos are from that loyal aide, his now codefendant, walt nauta. but then there's information, then there's details, there's audio tapes that were provided. who did that come from? that is something that is bothering donald trump deeply, and it will continue to bother him, no doubt. john santucci, as always , thank you. thanks, juju. and

senator, heidi heitkamp. dan, let me start off with you. another unprecedented day in a string of unprecedented days. what struck you? >> look, as a legal matter, putting the politics aside, this is a really big deal. he is charged with very serious crimes here. he is convicted of all of them or most of them, this almost no chance he would not serve some serious prison time in connection with this case. so as we watch this and we watched the politics intersect with the law, those of us who got our legal hats on sort of look at it and are struck by, he is stopping, he is making a campaign stop on the way back. he is sending out fundraising notes, et cetera. but as a legal matter, this is a dangerous case. >> juju: you clearly have your legal head. the indictment is only part of the story. from what you know based on the indictment, how strong a case is it? >> i think it is quite strong. it was a sort of surreal to see a person who we talked about as being a private citizen and not above the law, having to high

was close on his way to the courthouse would look like a presidential motorcade taking a sitting president, not a former president but a sitting president to an inaugural or a state of a union. the most damning piece of evidence is the state that the prosecutors have of donald trump talking to two people who were ghost writing his former chief of staff book and making clear reference to secret documents, classified documents, that he says he could have declassified when he was president. he did not declassify it then and is unable to declassify that which makes up some of the elements of seven the crimes that are charged in the indictment and almost as importantly, debunks a lot of the defenses that don't trump's team has put forward. and made plans to put forward. >> juju: ryan's cat you were was chair of the rnc, president trump is your party's front runner. how does this affect his chances of moving forward in the primary and is there is narrow in which this helps him? >> first of all, while the indictment is real and i do agree it needs to be taken

seriously, clearly the majority by over 80% according to a reuters poll that just came out of voters within the republican party, they see this as nothing but a political hit job. and so if past is prologue and that is a great william shakespeare tevis has said, you look at the molar probe, who impeachment, stormy daniels, alvin bragg, if past is prolo prologue, this is making donald trump even stronger and so there are a few candidates that are trying to, you know, find this hybrid approach which are saying, they are saying, well, the president should have just ended this fight along time ago and given over the documents and not allow himself and many others to get themselves in this position. but at the same time, are you that this is politically motivated and that in fact the doj and justice has not aligned

in this particular case. we will see where it goes. but certainly, the polling thus far shows that in fact, it is making the president even stronger. but it is early in the polling. >> juju: heidi, republicans, their defense has been a lot of what about the -- whataboutism. how are democrats going to play this? >> there's an old saying in the law, if you have the facts, you argue the facts. if you have the law, you argue that law. if you have if you have neithercut you pound the table. and that is really what they are doing. not one person has said, that tape is false. great -- that tape did not happen. you know, that is not his voice. they are not defending on this. they are making this a political issue and i think a political case as opposed to a legal case. the legal case will play out. but, you know, reince makes the point about he is maintaining popularity. but think about this. he lost the midterm in 2022. he lost the election in 2020.

and he lost the house in 2018. nothing about all that behavior would suggest that this is good for him securing the presidency. they like nothing more than a rematch between biden and trump and i think as this thing plays out, if it is more likely that trump is going to be the nominee, that is not a bad position for joe biden to be in. >> juju: and so dan, you talked about the political theater. is it possible that trump's best legal defense is to win the election? >> look, if he wins the election and this case is not resolved at this case is going to go away. and so campaigning here for him has that intersection of politics and law. and i don't think there's a real chance that this case is going to get resolved in its entirety. before the election. so watch very carefully. the timing in this case and think about the political meets legal implications. >> juju: and could he pardon himself? >> whoa, if there is even a conviction at the apartment.

there may not even be a trial at the apartment. and there may not even be the appeals. >> juju: reince, let me bring you back into this. some of the candidates on the trail with no are being asked if they would pardon a president trump in this scenario. and yeah, some candidates like chris christie are beginning to be critical. will the party continued to back him under this scenario? >> whoa, it is an interesting question for just the candidates are even making the case and posing that question as far as whether they would pardon trump just goes to show you that it is going to be very difficult for candidates to go out there and try to condemned president trump and expect to win the nomina nomination. it is a fine line. as senator heitkamp points out, we are as divided as the red sea. we are a very divided country and very few people in the middle are deciding elections across the country. and those people are tired of hating each other. but right now, both parties are
