been allowing very closely as it works its way through the legal system. ama: 33-year-old alonzo log one pleaded no contest in a murder for hire plot. dan: this plea deal comes up to prosecution dropped two other murder charges, citing problems with a key witness. reporter dan noyes was in court and has the story. reporter: one key witness linked him to the killing of 22-year-old eric ford at this gas station july 1, 2008 area the man listed in court's documents as d.l. testified he overheard logwood agreed to kill him exchange for a bounty. but today in court, the prosecutor told the judge d.l. refuses to testify, and several other witnesses contradict his story. homer wrote, d.l. was lying in whole or in part when he testified at the per luminary hearing. the prosecutor now says he does not know who pulled the trigger. >> the prosecutor has abandoned

that theory that he pulled the trigger. he didn't do it. reporter: defense attorney david briggs told me that logw ood pleaded no contest to avoid a potentially greater sentence if you went to trial. >> we know that people get wrongfully convicted and they can get wrongfully convicted in a case like this that has a lot of publicity. we just felt like we had to give mr. logwood some assurance that he would have a life after this case is over. reporter: the district attorney already dismissed two other murder charges against logwood based on problems with d.l.'s testimony. >> it is our obligation to follow the evidence and not prosecute someone who we do not believe a jury will find guilty beyond a reasonable doubt. reporter: but this afternoon, the original prosecutor on the case texted me. d.l., through his lawyer, made

cornell: extremely vital, fo sure. it has been a long, hot day of training for these firefighter recruits, who say they are more than ready for summer fire season. smoke and flames in marin county, and a lot of new firefighters learning how to tame a wildfire. >> let me get back to the engine. cornell: more than 100 new and returning seasonal firefighters are using this 30 acre swath of open space between san rafael and novato as their classroom. the seasonal wildland academy is wild and intends. >> the goal and main focus is public safety. but to train our seasonal firefighters to be ready to fight fires this summer. >> making sure we are staying hydrated, fueling up before we start the day. cornell: setting backfires and learning how to put flames out is part of the training. this controlled burn is happening less than a week before summer, in under area where the grass is already high

after record-setting enter rains. >> when we get a lot of rain, the grass is typically bigger. so, our grass is going to be tolerant and readily available to burn. cornell: new funding from the state is allowing california fire departments to hire more seasonal firefighters. >> it is unfortunate that events that happen, the camp fire, the kincade fire, the napa county fires, to kickstart that funding. but we are behind the curve, but catching up to it. >> hopefully, we get some practice income i get training. and if a fire happens, we will be there to help put it out. cornell: chris patella is a seasonal firefighter who is here to be challenged. >> i have been very excited. i changed careers later in life. wanted to do something i am more passionate about. this is it. first burn day and loving every minute of it. cornell: department officials say hiring new firefighters has been challenging in years past. but this year, there are 120 new

and seasonal firefighters on duty. and that is a record for marin county. .the training continues here tomorrow live in san rafael, cornell bernard, abc 7 news. dan: what kind of fire danger do we faced now? ama: let's check in with sandhya patel on the conditions. sandhya: right now, because we don't have the extreme heat, or fire danger is not that high. but let me show you what the concerns are looking ahead into the summer months. decreasing fuel and moisture. all the storms that brought the rain outed fuel to the storms. but now we see things turning brown. typically it is hotter inland in the summer, and the climate prediction center is expecting above average temperatures out west, which includes the bay area, july through september, with increased fire danger as it heats up. temperatures in the comfort zone, although it. was . it is an offshore transporting higher humidity

from the cool ocean waters. let's look at the fire danger index toward tomorrow. it will be in the moderate to high category inland for the afternoon hours, and we are going to see that repeat again saturday afternoon. i will be back again with a look at the weekend forecast, which includes the all important father's day, coming up. ama: arson investigators are on the scene of a massive fire at a san jose storage facility. the fire broke out around 6:30 p.m. yesterday on blossom hill road. more than 12 hours after the three alarm fire was brought under control, crews were still dousing hotspots. the fire destroyed 40 to 50 storage units. renters stopped by the facility today, hoping to learn about the status of their belongings. >> i have a 130-year-old piano there. that is not too far from the door. >> we were trying to move up to the sacramento area, and we put everything in there for the meantime.i have seen the drone footage. i talked to the chief.

it is very unlikely anything made it through. ama: police say a person of interest has been detained. dan: police have arrested a man they think was responsible for at least two. mass shootings in the bay area cam it happened last friday. he is also wanted for reportedly shooting at a video crew in oakland. it happened at a gas station and left one man dead and six others injured. ama: an antioch police officer has been fired for violating the department's use of force policy. he is also charged with assault. our reporter spoke with one community organizer, who has had run-ins with this officer. >> stop resisting. >> i'm not resisting. i'm going to get in the car. alright i'm going to get the car.

routine traffic stop on july 1 of last year. the driver pulled over for no plates. but the situation quickly escalated with police officer taking down the passenger. >> i'm having panic attacks. >> you need to relax. >> stand up and get in the car or i'm going to bring you down again. >> ok. >> the way i took you down now, i will take you down again and harder. stand up and get in the car. passenger was arrested for an outstanding felony warrant, and the video shows the man refusing to sit in the car. but an internal investigation found the officer's use of force included punches, kicks, and knee and elbow strikes, all violations of apartment policy. he was fired. >> i think any person, not necessarily a police officer who observed that video, there's some things that could be interpreted as concerning. certainly, i was concerned with what i saw. reporter: the antioch police

chief says the use of force automatically trave triggers an investigation. communa community organizer says she is not surprised. >> it was not surprising. i have had countless interactions with officer nutt. he is known to be a bit aggressive toward community members. reporter: for the past few years, she has been trying to draw attention to allegations of use of force by antioch police. she saw the video, and she says she is also concerned that others did not step into stop it. >> that is what happened in this video. there were no sources of de-escalation. he was literally attacking this person. reporter: records don't show officer nutt being inlved in the officer texting scandal, but they do mention sergeant josh evans. he was also on scene at traffic stop. though it is tough to see where the sergeant was during the confrontation, chief ford says he is still being investigated. >> sergeant evans's level of

responsibility, i think we are referring to, or accountability to manage the scene properly within the confines of the law and policies, all of that will be determined very shortly. reporter: the officer will be arraigned in july of one misdemeanor count of assault by a public officer. dan: coming up possible unintended consequence of san francisco's crackdown on open drug use. is it making the situation better or worse? plus -- >> i feel fortunate and blessed to be in a position where i can give back and give life to someone who gave me life. ama: that is so sweet. a father and son share an extra special bond.

dan: we are working building a better bay area, which means a healthier, safer bay area. as san francisco ramps down on the open-air drug market, a warning from the front lines. could arresting drug users actually set off more drug overdose deaths? tara campbell is following the drug overdose crisis extensively for us. she is in the newsroom with the latest on this aspect of the story. tara: i have been on the streets the past few weeks, speaking with everyone from drug dealers to drug users, and those helping get people into recovery. today, i spoke with a mother whose son is addicted to fentanyl. all of them expressing concerns over this latest approach to the overdose crisis. tensions are running high on the streets of the tenderloin. police now arresting drug users. >> with the police presence, it

makes everybody pissed off. tara: the california highway patrol and national guard are teaming up with the sfpd to get drug dealers and users off the streets. >> whether he or not you want to call this a war on drugs, when you are prioritizing a punitive approach to people who use drugs, it does not work. tara: gary mccoy is with healthright 360, one of the nonprofits the city relies on to get people off the streets and into recovery. >> what happens when they leave after withdrawing for four hours is they will immediately go back out, find more drugs, except now they are going to be for fear of being caught using more drugs. they are going to be using more at once, so they are not having to use as frequently in the open. >> that brings a lot of fear and anxiety. tara: jackie berlin knows this all too well. her son is on the streets, addicted to fentanyl. >> in some respects, it can be more dangerous for these addicts

because they might take the first thing they run into, where normally they might take a little more precaution. tara: while drug users are being offered treatment services in jail, so far, the city says nobody has accepted it. here is the mayor talking with abc7news last week. >> out of the 25 people arrested, and even the ones who were released, the ones who did not have warrants, none of them accepted the services we were offering. tara: still, the city plans to continue making arrests. >> so there comes a time where people are not accepting the services, and we cannot allow what we see in the streets to continue. tara: and jacqui berlinn says she would like to see more action making services more accessible. >> having resources available 24 hours a day, seven days a week, because a lot of times the times that someone is willing to go get help is when they are cold at night. not in the middle of the day. >> a balanced approach would be

enforcing existing laws with the opportunity for people to go into a center open 24 hours a day where they can get help. tara: mccoy is talking what the city calls wellness hubs, which could house safe consumption sites. >> where they can use off the streets come out of because public visibility -- out of public visibility, under supervision. tara: the mayor has been pumping the brakes for months, citing legal concerns. safe consumption sites are still illegal under federal law, but the mayor does support the new york model. they use private donations, not taxpayer dollars, in theory making the city less liable. and nonprofits here are raising those private funds, gearing up to open safe consumption sites once the city is ready to move forward. >> we've got the national guard looped in and chp looped in, and we have still not opened a wellness hub. tara: it is important to note

weekend. sandhya: we are going to hang onto the warmth for the first part of your weekend. let's take a look at the high temperatures for today. we got up into the low 80's, still a few degrees below average, but it was a warmer one without a doubt. along the coastline, in the 60's. a pretty pleasant day. as we check out why we got the warmth, high-pressure in control of our weather. as it brought more of a northerly wind, it allowed the temperatures to rise. as we check out the sierra nevada, numerous thunderstorms around the sierra as we head towards tomorrow. wthings will quiet down. the snow lab just put out a statement on social media saying no snow depth for the first time since november 2 of last year. no snow depth at that site. it has all melted. it was a historical snowpack there.

754 inches of snow fell, which is close to 63 feet. so yeah, it is melting up there as the warmer weather is with us. as we look at a live picture of san jose, 63 in the city. 65 in oakland. comfortable in san jose, 71. from our mount tam cam, we have haze in the atmosphere. marine layer is sitting off the coast and it will be pushing its way across the bay. 68 in santa rosa. 70 in napa. 70's pretty much for everyone from concord to livermore. and one other live picture from our roof camera, a little breezy. fog along the bay overnight. the spring warmth holds through saturday. we will turn things around, a windy and cooler pattern for father's day. 7:00 tonight, still pretty mild inland, in the 70's. as we go to 9:00 p.m., the fog is advancing across the bay.

day that the baseball commissioner rob manfred claimed oakland never had a plan to build a ballpark for the a's. the oakland mayor quickly disputed that when she talked with abc7news on midday live. >> it is totally false. there was a very concrete proposal under discussion, and oakland had gone above and beyond to clear every single hurdle that the ownership put in front of us. ama: the vegas plan is now in the hands of major league baseball's 30 owners. three quarters of them must vote yes for the plan to move forward. dan: if you shop at safeway, no doubt you have interacted with employees with special needs. today, safeway put a lot of money behind that commitment. at the safeway on college avenue in oakland, a major check presentation to best buddies. $560,000 donated by customers and nearly 300 safeway stars in northern -- stores in northern california and hawaii. i spoke with the president of safeway and the founder of best buddies. >> i way say we are not looking for the cure, we are the cure.

transported to southern california by texas governor greg abbott. they arrived in l.a. yesterday evening. ama: our reporter from our sister station in los angeles has the latest. >> the 42 people who entered los angeles are fueling a political argument crossing state lines. texas governor greg abbott tweeted a statement shortly after the migrants arrived, saying overwhelmed border towns are on the front lines of president biden's border crisis in texas will bus migrants to sanctuary cities. karen bass is among city leaders to condemn the move. a nonprofit coordinated food, and legal services upon arrival at the catholic church on wednesday. the church says all 42 migrants were processed and sent to other locations. some were connected with family members, according to congressman berg jimmy gomez. >> the ones who often don't have family are the ones that are in

tempered situations. >> abc 7 has learned some of the migrants are toddlers and there were not provided food or drinks on the 23 hour long bus ride. gomez has called for an investigation. is there anything that governor greg abbott did a legal? >> the question is who is paying? number two, if they are doing it at the direction of the state of texas, governor abbott. and, number three, what did they tell these migrants? >> attorney general rob bonta says his office is looking into that. >> the legality question is an open one. we will go to wherever the law takes us. the moral question is clear. this is a morally bankrupt act, period. >> a morally complicated one for some of the people who live near the church where the migrants arrived. >> i feel like we need to take care of our own people that is here already because then the

government starts giving them free stuff and it comes out of our pocket. this country cannot handle that right now. >> the homeland security secretary of coos -- accused abbott of using these migrants as political pawns. we are told that one of the migrants was sent here to los angeles even though their court date is scheduled in another state. abc 7 news. ama: the u.s. health and human services secretary was in oakland today. he announced a new national health care workforce initiative aimed at expanding the pipeline of doctors, nurses and health care professionals. >> there's nothing that lift e steem in someone than to look at someone or hear from someone and feel like they care because you feel the connection. so, health care is so much about caring for this, right? feeling like you are cared for and respected.

ama: he made the announcement at oakland's samuel merritt university. he toured the school's health science simulation lab. dan: lawmakers in sacramento passed a state should today but they are still hammering out details. the spending measure passed with every democrat in the senate and assembly voting for it and every republican against. the chronicle reports they will keep negotiating on key issues like childcare and transit. today was the state constitutional deadline for lawmakers to pass the budget. if they didn't, they would not get paid. governor newsom has until june 30 to sign the budget. ama: thousands of janitors across the state including hundreds in silicon valley marched on justice for janitors day. many are protesting what they say are dangerous workloads in the tech industry. they say they're cleaning the equivalent of 42 single-family homes a shift. after a recent round of layoffs. peter ortiz says he is standing

lifesaving gift. >> literally, there is a part of me in him just like a part of him in me. >> he gave his dad a life-changing gift. >> i donated the right lobe to my father and this is what remained in me. how lucky are we is the liver is something that completely regenerates? >> abel shared his incredible story on tiktok. ♪ back in 2021, doctors discovered that manuel was ill and needed a new liver. >> he had liver disease, fatty liver disease. so, he had a condition where the live built up too much fat and he developed cirrhosis from that. that is why he needed a liver transplant. >> it was put on a transport list, but it was going to be along with wait. >> i learned about being a living donor. you get to expedite the process for someone to receive a transplant. >> for that to happen, he learned he had to lose weight.

what has been going on with howard terminal over the past few years? with complicated things in oakland, was the a's insisting on this huge ballpark village with condos and retail? they are getting none of that in las vegas. it was the size of the project that required so many code changes and approvals in the bay area. if the a's that wanted to build on nine acres at howard terminal, they have -- could have done that long ago. it is a terrible deal for all involved, including the taxpayers in nevada. now to the a's and raise on the field -- rays on the field. the guy in front thought he had it. right over his head. the kid with the glove. a's down 3-0, but they tied up. seth brown to left. tony kemp going as fast as he can. 3-3 after five. still 3-3. luke raley was the difference.
